SOCIAL CYCLE OPERATIONS:
Social Cycle, a San Diego -based company, has debuted a unique, 16-passenger
touring bicycle, pedal -powered entirely by its riders and steered by a professional
driver. Launched in October 2011 with two bikes, Social Cycle hosted lively tours
through Downtown San Diego — including East Village, Gaslamp Quarter,
Marina/Seaport Village and Little Italy. Social Cycle now has four bikes in operation
in San Diego and has expanded to include tours in Pacific Beach, Hillcrest, North
Park, South Park, Normal Heights, Kensington, Ocean Beach and La Jolla. In addition
to this, Social Cycle has also expanded into Palm Springs, with one bike in operation
since November 2014 and business is growing.
Catering to both residents and visitors to Palm Springs, Social Cycle serves as a
platform for socializing and having fun with friends, family and colleagues, while
exploring local sights and enjoying fresh air and light exercise outdoors. Tours are
ideal for simply cruising the city, bar -hopping, corporate events, conventions, team -
building, bachelor and bachelorette parties, singles mixers, family reunions,
tailgating, picnics, progressive dinners, and even wine tastings — the possibilities
are virtually endless, and stopping points along each tour can be customized.
The concept for Social Cycle, owned and operated by longtime San Diegan
Laura Rovick, was first launched back in 2000 in Amsterdam, where all bikes are
manufactured, then licensed to select cities. Minneapolis was the first U.S. city to
debut this eye-catching, Dutch -style party vehicle, with San Diego as the first city on
the West Coast to launch it. All bikes are earth -friendly — powered entirely by the
manual pedaling of their passengers, thereby burning zero fossil fuels.
SB 530 INTRODUCTION:
Existing law generally regulates the operation of bicycles, including, among other
things, providing that a person operating a bicycle on the highway has all the rights
and is subject to all the provisions applicable to the driver of a vehicle, including a
prohibition against operating a bicycle while under the influence of an alcoholic
beverage or any drug. These provisions also apply to a pedicab, as defined. A
violation of the provisions regulating the operation of a bicycle or pedicab is an
offense.
This bill would expand the definition of a pedicab to include a 4-wheeled device
that is primarily or exclusively pedal -powered, has a seating capacity for 8 or
more passengers, cannot travel in excess of 15 miles per hour, and is being used
for transporting passengers for hire, as prescribed. The bill would impose
specified requirements on these pedicabs defined by the bill, relating to, among
other things, a maximum seating capacity for 15 passengers, local authorization to
operate, operator qualifications and training, safety equipment, inspections,
financial responsibility, reporting of accidents to the Department of the California
Highway Patrol, the loading and unloading of passengers, and general operation of
pedicabs. The bill would, until January 1, 2020, establish requirements for
pedicabs that allow passenger alcohol consumption. Because a violation of these
provisions would be a crime, this bill would impose a state -mandated local program.
THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1.
Section 467.5 of the Vehicle Code is amended to read:
467.5.
"pedicab" means any of the following:
(a) A bicycle that has three or more wheels, that transports, or is capable of
transporting, passengers on seats attached to the bicycle, that is operated by a
person, and that is being used for transporting passengers for hire.
(b) A bicycle that pulls a trailer, sidecar, or similar device, that transports, or is
capable of transporting, passengers on seats attached to the trailer, sidecar, or
similar device, that is operated by a person, and that is being used for transporting
passengers for hire.
(c) A four -wheeled device that is primarily or exclusively pedal -powered, has
a seating capacity for eight or more passengers, cannot travel in excess of 15
miles per hour, and is being used for transporting passengers for hire. A
pedicab defined under this subdivision is subject to the requirements of
Article 4.5 (commencing with Section 21215) of Chapter 1 of Division 11.
SEC. 2.
Article 4.5 (commencing with Section 21215) is added to Chapter 1 of Division 11 of
the Vehicle Code, to read:
Article 4.5. Operation of Pedicabs
21215.
(a) A pedicab defined in subdivision (c) of Section 467.5 shall operate subject to all
of the following requirements:
(1) The pedicab shall have a seating capacity for not more than 15 passengers.
(2) The pedicab shall be authorized by local ordinance or resolution to operate
within the applicable local jurisdiction.
(3) The operator of the pedicab shall be at least 21 years of age, with a valid
California driver's license.
(4) The pedicab shall be equipped with seatbelts for all passengers, seat backs,
brakes, reflectors, headlights, and grab rails. The pedicab shall be inspected annually
for compliance with the requirements of this paragraph by an entity designated by
the local jurisdiction that authorized the pedicab to operate. The entity may charge a
reasonable fee to cover the costs of the inspection. A pedicab that does not meet
these requirements shall meet these requirements by January 1, 2017, in order to
continue operation.
(5) The operator of the pedicab shall at all times be able to establish financial
responsibility in a minimum amount of one million dollars ($1,000,000) general
liability insurance coverage and an additional five hundred thousand dollars
($500,000) general umbrella insurance that covers the pedicab. The local
jurisdiction that authorized the pedicab to operate may require additional proof of
financial responsibility.
(6) A pedicab shall not operate on any highway under the jurisdiction of the local
authority unless authorized by resolution or ordinance. A pedicab shall not operate
on any freeway and shall not operate on any highway with a posted speed limit in
excess of 30 miles per hour, except to cross the highway at an intersection.
(7) The operator of the pedicab shall annually report to the Department of the
California Highway Patrol, commencing on January 1, 2016, any accidents
caused or experienced by the pedicabs.
(8) The pedicab shall not load or unload passengers on roadways or in the middle of
highways.
(9) Pedicabs shall be operated as close as practicable to the right-hand curb or edge
of the roadway, except when necessary to overtake another vehicle, to avoid a
stationary object, or when preparing to make a left turn.
(b) This article only applies to pedicabs defined by subdivision (c) of Section
467.5, and does not apply to pedicabs defined in subdivision (a) or (b) of
Section 467.5.
21215.2.
(a) If alcoholic beverages are consumed on board the pedicab, a pedicab
defined in subdivision (c) of Section 467.5 shall additionally operate subject to
all of the following requirements:
(1) The consumption of alcoholic beverages onboard the pedicab shall be
authorized by local ordinance or resolution.
(2) An onboard safety monitor who is 21 years of age or older shall be present
whenever alcohol is being consumed by passengers during the operation of the
pedicab. The onboard safety monitor shall not be under the influence of any
alcoholic beverage and shall be considered as driving the pedicab for purposes of
Article 2 (commencing with Section 23152) of Chapter 12 of Division 11 during the
operation of the pedicab.
(3) Both the operator and safety monitor shall have completed either the
Licensee Education on Alcohol and Drugs (LEAD) program implemented by
the Department of Alcoholic Beverage Control or a training course utilizing the
curriculum components recommended by the Responsible Beverage Service
Advisory Board established by the Director of Alcoholic Beverage Control.
(4) Alcoholic beverages shall not be provided by the operator or onboard safety
monitor or any employee or agent of the operator or onboard safety monitor of the
pedicab. Alcoholic beverages may only be supplied by the passengers of the pedicab.
All alcoholic beverages supplied by passengers of the pedicab shall be in enclosed,
sealed, and unopened containers that have been labeled pursuant to Chapter 13
(commencing with Section 25170) of Division 9 of the Business and Professions
Code prior to their consumption on board the pedicab.
(5) Alcoholic beverages may be consumed by a passenger of the pedicab only
while he or she is physically on board and within the pedicab.
(6) All passengers shall be 21 years of age or older if alcohol is consumed during the
operation of the pedicab.
(7) For purposes of this subdivision, passengers who are pedaling the device are
not operators.
(b) A license or permit from the Department of Alcoholic Beverage Control shall not
be required of the operator or onboard safety monitor, so long as neither they, nor
their employees or agents sell, serve, or furnish any alcoholic beverage to any
passenger.
(c) For purposes of this section, "alcoholic beverage" has the same meaning as
defined in Section 23004 of the Business and Professions Code.
(d) This section shall remain in effect only until January 1, 2020, and as of that date
is repealed, unless a later enacted statute, that is enacted before January 1, 2020,
deletes or extends that date.
21215.5.
This article does not preclude a local authority from imposing more stringent
operating or equipment requirements on a pedicab subject to this article.
SEC. 3.
Section 23229 of the Vehicle Code is amended to read:
23229.
(a) Except as provided in Section 23229.1, Sections 23221 and 23223 do not apply
to passengers in any bus, taxicab, or limousine for hire licensed to transport
passengers pursuant to the Public Utilities Code or proper local authority, the living
quarters of a housecar or camper, or of a pedicab operated pursuant to Article 4.5
(commencing with Section 21215) of Chapter 1.
(b) Except as provided in Section 23229.1, Section 23225 does not apply to the
driver or owner of a bus, taxicab, or limousine for hire licensed to transport
passengers pursuant to the Public Utilities Code or proper local authority, or of a
pedicab operated pursuant to Article 4.5 (commencing with Section 21215) of
Chapter 1.
SEC. 4.
No reimbursement is required by this act pursuant to Section 6 of Article XIII B of
the California Constitution because the only costs that may be incurred by a local
agency or school district will be incurred because this act creates a new crime or
infraction, eliminates a crime or infraction, or changes the penalty for a crime or
infraction, within the meaning of Section 17556 of the Government Code, or changes
the definition of a crime within the meaning of Section 6 of Article XIII B of the
California Constitution.

To date. there have been NO alcohol related accidents or insurance claims in
ANYof the above listed markets.
PROPOSAL:
Social Cycle, an operator of multi -passenger pedicabs, as defined in SB 530 under
Vehicle Code 467.5 subsection "C," would like to propose and recommend that the
City of Palm Springs update its municipal code of pedicabs, by definition, as well as
the allowance of safe alcohol consumption on board, to be consistent with that of the
state.
SB 530 was passed UNANIMOUSLYin both the Senate and the Assembly. Palm
Springs Senator: Jeff Stone as well as Palm Springs Assembly member: Chad Mayes
both voted to approve SB 530. Not only that, but Governor Brown's office identified
SB 530 as "the most fun bill of 2015!"
These 15 passenger bike tour businesses help support our local economy and small
business by providing information and access to many of our city's historic and
leisure attractions, promoting the city as a travel destination and keeping revenue in
our community. This supports jobs and the city's goal of a vibrant downtown and
surrounding neighborhoods. This is perfect for Palm Springs as it showcases our
community and provides a physical link between neighborhoods and businesses.
This new law has created specifications for operations as well as safe alcohol
consumption on board. This places Palm Springs on the forefront of business
innovation, facilitates small business growth and ensures that all public safety
concerns are addressed.
In addition to the regulations set forth in SB 530 in regards to alcohol, we would
also like to include further restrictions, as allowed by SB 530, in which the local
jurisdiction can impose more stringent operating requirements.

• No glass
• Alcoholic beverages must be covered (ie Koozie, red solo cup, etc)
• If alcohol is on board, operating hours are from 10am-10pm
• If alcohol is on board, no one under 21 is allowed on board
• The moment any passenger steps foot on the street, sidewalk, etc with an
alcoholic beverage in their hand they can be fined for "Open Container"
• All passengers must sign/agree to a "Code of Conduct," acknowledging that
the tour can be ended at any moment, with no refund, if anyone on the tour is
in violation of this code.
• We would like to have annual meetings with Council Members, PD, etc with
all of our staff to keep the lines of communication open, ensure safe
operations and address any issues that have been presented.

support of Senate Bill 530 (Pan).
Pedal -powered quadricycles currently operate in multiple municipalities in California such as
Sacramento, San Diego and here in Greater Palm Springs. This is a relatively new activity in our
state, although they have been operating in several other states across the country for the better
part of a decade.
Tourism is the number one industry in Greater Palm Springs, generating over $5.8 billion in business
sales for our economy, attracting over 12.2 million visitors each year, and supporting more than
46,800 jobs locally. It is essential to the tourism industry that we continue to provide new and
innovative forms of outdoor recreation, such as bike tours and pedal -powered quadricycles, to
keep our visitors coming back year after year.
The bike bus tours business model helps support our local economy and small business by providing
information and access to many of our cities historic and leisure attractions, promoting the city as
a travel destination and keeping revenue in our community. This supports jobs and the city's goal
of vibrant downtown neighborhoods. SB 530 is perfect for California as it showcases our
community and provides a physical link between neighborhoods and businesses.
SB 530 would create specifications for pedal powered quadricycles that would serve as minimum
requirement for operation in California. SB 530 would also place California on the forefront of

Dear Palm Springs City Council Members:
Our insurance brokerage presently insures hundreds of pedal powered bicycles
throughout the U.S., usually seating as many as 15 persons, driven by the owner or
an employee, providing 2 hour tours of city areas, often times visiting specific
taverns or bars. We require that these bikes are NOT driven by "independent 3rd
party contractors." Operators must provide through instructions to riders before
the tour, and inspect all bikes after every tour. Great care must be taken to remove
any guests who are intoxicated. We insure hundreds of these bikes in more than 23
states. I have provided this insurance for these particular bike tour operations for
over 9 years, and have not had ANY claims that have resulted in known settlements.
We also insure 3 manufacturers of these bikes, thus we are quite knowledgeable
about them.
Our insurance application requires extremely high standards for loss prevention on
this particular business. We address the alcohol issue with several questions
regarding training of employees, the "lecture" given to all guests before the ride,
agreement and waiver signed by guests, removing guests who have become
intoxicated, etc. Our insureds are vigorous as regards to alcohol, thus we have not
had any claims relative to this. Where cities and states permit guests to bring
alcohol on board, some of our operators have embraced this opportunity, though
they do not furnish or serve alcohol, and their insurance coverage remains intact

I am writing representing PedalPub, LLC (distributor of party bikes), PedalPub-Twin Cities
LLC, PedalPub-St Petersburg LLC, and PedalPub-Rochester LLC (retail operators of party
bikes) to support the recently signed California SB 530. This law has created specifications for
15 passenger pedal powered vehicles to operate legally and safely on the streets.
As retailer operators of these bikes in three markets, we know how much our bike tour
businesses increase economic activity our markets, helping small businesses thrive and providing
an interesting way to tour the town.
As distributors of these bikes across the U.S., we can attest to the value of having these bikes in
many markets, supporting increased job growth and the vitality of the areas in which they
operate.
We understand the new law has created specifications for operations as well as safe alcohol
consumption on board. We have found that, in markets that allow patrons to bring on their own
alcoholic beverages, there was a marked increase in the number of tours requested and
completed. Our experience with allowing this option has been quite positive.
We support allowing the option of businesses such as ours to allow the same option to its
customers.

Marijuana Dispensaries Remain Open Despite County
Lawsuits

THOUSAND PALMS, Calif. -
Riverside County is moving forward with its push to close down marijuana dispensaries operating illegally in
unincorporated county areas.
Wednesday was the day dispensaries were supposed to tell the county whether they planned on staying open or
closing down.
More than a half -dozen are in Thousand Palms. So far, every single one that News Channel 3 has visited is still
operational.
The lights were on at Desert Care Solutions just before News Channel 3 arrived, but once the crew pulled out the
camera, the place went black. Patients were still inside.
One of the managers, Julie Montante, pushed News Channel 3's camera two weeks ago. This time, she again
declined to speak on camera, but over the phone, she confirmed that at this point, there are no plans to shut down.
Inland Valley Therapeutic Healing Center is still open, and the same goes for Harmony Wellness next door. But
both declined to comment and both asked that News Channel 3's crew leave the property.
Gold Star Organic Cooperative on Ramon Road has been open since Aug. r, and it, too, has been served papers by
the county.
"I'm not allowed to comment on anything," said Daniel Bosch, an employee. "You'd have to talk to my manager."
Alternative Wellness Center is less than too yards away from Gold Star and its business hours have not changed
since the Riverside County Board of Supervisors gave the go-ahead two weeks ago to have county attorneys sue
dispensaries and their property owners, unless the operations voluntarily close down.
Relevance Alternative Health Care is also still serving the public.
Brothers Ricky and Jake Wright co-own Sublime Remedies, and they've received papers similar to a county
complaint against Platinum Collective in the City of Riverside dated Dec. 21, which states that the dispensary is a
public nuisance, and is operating illegally under county zoning laws.
"It's fivstrating. Ifs sad, and it's hard," said Ricky Wright. "(The county) kind of looks at one person, just the
dispensaries, where they should look at it across the board — like the doctors and how the doctors are modifying
who they're giving prescriptions to."
"(The patients) are very nervous," said Jake Wright. "They're scared. They don't want to go back to pills, fast off. A
lot of people have had problems with those in the past."

into Palm Springs Council members was launched. This investigation revealed numerous
examples of corruption, financial mismanagement, fraud and gross negligence to appointed
duties. Examples of corruption include the failure of Ginny Foat to include her trust on
Cahfomia Form 700, California Statement of Economic Interests, as well as other assets. On her
2012 Form 700, Ginny Foat states that she had received over $10,000.00 from Burke Rixs
Consultants, the same company that was selected to promote Measure I to the City of Palm
Springs. She has since voted to provide funding Burke Rix multiple times since then. She also
currently owes more than $30,000.00 in back taxes to the County of Riverside for a commercial
property she and her wife own. We are petitioning Miss Foat to resign from City Council and all
appointed positions therein, effective immediately -
