Ready, City Manager Initiated by: Department of Planning Services SUMMARY The City Council will consider an appeal requested by G&M Construction on behalf of the Tribal owners of Allotment 5A and 35A, seeking to overturn the action of the Historic Site Preservation Board (RSPB) in which it placed a 120-day stay of demolition on "The Ramon Drug Building" (referred to herein as the "440 Building") and initiated study for possible recommendation to the City Council of Class 1 historic designation for the structure. RECOMMENDATION: 1) Open the Public Hearing and take public testimony; and 2) Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DENYING AN APPEAL BY G & M CONSTRUCTION ON BEHALF OF ACBCI OWNERS OF ALLOTMENTS 5A AND 35A AND UPHOLDING THE ACTION OF THE HSPB REGARDING THE STRUCTURES THAT COMPRISE 436 THORUGH 454 SOUTH INDIAN CANYON DRIVE "THE RAMON DRUG BUILDING; AXA THE 440 BUILDING" (CASE 3.1009 MAA)." ITEM NO. �� --- City Council Staff Report November 4, 2015- Page 2 Case 3.1009 APPEAL—Appeal of HSPB Action "Ramon Drug Building' BACKGROUND: Related Relevant Actions`b Planning, Building, Fire, etc. (various dates) A file record of past building permits back to 1946. HSPB considered a request to demolish two Class 3 historic sites and voted 5-1-1 (Williamson opposed, Dixon absent) to initiate study for possible recommendation to October 13, 2015 City Council to move to Class 1 historic designation for the 440 Building and voted 5- 1-1 (Williamson opposed, Dixon absent) to place a 120-day stay of demolition on the 440 Building. The board took no action on the gas station at 490 South Indian Canyon Drive. October 14, 2015 1 The City Clerk received the notice of appeal on the HSPB's actions. Pursuant to Section 2.05.030 (Filing of appeal) of the Palm Springs Municipal Code, an appeal may be filed as follows: A person aggrieved by an action taken by an administrative officer or administrative agency of the city may appeal the action to the city council, if the action is made appealable by applicable provision of the Palm Springs Municipal Code or other city ordinance, by filing with the city clerk a written notice of appeal which sets forth the appellant's full name and mailing address, the specific action appealed from, the grounds for the appeal and the relief sought; and paying to the city clerk such fee as the city council may establish by resolution. OVERVIEW OF APPEAL AND STAFF RESPONSE: On September 15, 2015, the Department of Planning Services received an application to demolish all structures on a 1.81-acre parcel located at the northeast corner of South Indian Canyon Drive and East Ramon Road. Two structures exist on the site: a former automobile service station at 490 South Indian Canyon Drive (referred to as "the 490 Building") and the Ramon Drug Building (referred to as "the 440 Building"). The application and accompanying staff report was distributed to the HSPB members and discussed as Agenda Item #5.13 at the October 13, 2015 HSPB meeting. At the meeting, the Board voted to initiate study of the 440 Building for possible recommendation of the site to the City Council for Class 1 designation, and approved a 120-day Stay of Demolition pending the outcome of the- designation process. (The HSPB took no action on the 490 Building and a building permit for its demolition was issued and the building has been demolished.) The applicant has appealed both actions of the HSPB. Below are the grounds for the appeal as stated in the appellant's letter followed by staffs response: 02 City Council Staff Report November 4, 2015- Page 3 Case 3.1009 APPEAL—Appeal of HSPB Action "Ramon Drug Building" "The buildings that have been cobbled over the years together are not only adequated (antiquated) but have lived their useful life; along with over 100 building permits given in the last 40 years." As stated in the HSPB staff report dated October 13, 2015, the earliest building permit records on file were from 1946 with numerous permits for various additions and modifications over the past 60-plus years. The 440 building was occupied by a variety of commercial tenants until earlier this year. The Building's Indian Canyon Drive fagade was designed by architect Donald Wexler in about 1954. Wexler moved to Palm Springs in about 1952 and was 28 years old when he designed the modern-styled fagade, making it one of his earliest commissions. Wexler continued his architectural practice for many years and has been recognized as a significant "master architect" whose creative talent influenced the emergence and development of the unique style of modern architecture found in Palm Springs which has been referred to as "Desert Modern". Upholding the HSPB's stay of demolition and initiation of further study will allow more in- depth study of the building to better understand its relevance in the context of Mr. Wexler's contribution to the mid-century modern architecture for which Palm Springs has developed international recognition. Overall the building appears to be well- maintained and in very good condition, despite its age, and was occupied until recently by many commercial tenants. `9t was brought out by the Board that some of the buildings were possibly Army offices and/or barracks utilized in the second World War and subsequently relocated to the present location." As noted in the HSPB staff report, one building permit (undated) refers to a building being "relocated from the hospital grounds". It is not known what part of the current building was relocated from another part of the City where the Army had office or barracks used during World War II. Upholding the HSPB's stay of demolition would allow time for further study of the building to better understand its components and overall historic significance. "The Allottees are desirous of removing the buildings so that they can be afforded the opportunity to redevelop the property for a more compatible use for the downtown Palm Springs area." The appellant / applicant's representative, Mr. Moriano Patencio, spoke on behalf of the multiple owners of the property at the time of the HSPB hearing. He noted that the owners are not developers, but that developers had approached the ownership with proposals for residential development, which is not the type of development that the ownership is currently contemplating for the site. Given that no development proposal currently exists, the Board expressed concern that allowing demolition would leave a vacant lot where presently a viable commercial building stands. 03 City Council Staff Report November 4, 2015 - Page 4 Case 3.1009 APPEAL—Appeal of HSPB Action "Ramon Drug Building" The HSPB members discussed the concept of retaining the Wexler-designed facade and integrating it with some sort of new commercial development of the site, noting that the building behind the facade was "of questionable merit". The Board suggested a study should ensue to possibly integrate the Wexler-designed facade into a future new development and that such adaptive reuse of the facade would likely yield a greater return on the development investment because of its association with an architect of significance and its importance in the context of the mid-century prominence of Palm Springs. The building is listed in the City's 2004 Citywide Historic Resource Survey. For these reasons, the stay of demolition and initiation of study should be upheld to allow time for these opportunities to be explored. CONCLUSION: Upholding the HSPB's stay of demolition and initiation of study would provide an opportunity to review and consider the historic or cultural significance of the 440 Building as well as to consider possible alternatives for adaptive reuse of the Wexler- designed facade in a future economic redevelopment proposal of the site. Granting the appeal would allow the demolition of the 440 Building to proceed without the ability of the City Council to ultimately and completely resolve these questions in a timely manner. NOTIFICATION: Issuance of a demolition permit for the 440 Building is a ministerial process; however, given that the 440 Building was identified on the City's 2004 Citywide Historic Resource Survey as a Class 3 structure, referral to the HSPB was required. Appeal of the Board's action to stay issuance of a demolition permit requires a public hearing to afford the property owner due process, and notice has been given to the property owner of the opportunity to be heard at this public hearing. Additionally, although not required, a public hearing notice was published to provide notice to the general public of the proposed appeal. Public comment letters that were received are attached to this staff report. ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities," Class 1(I) projects consist of demolition and removal of individual small structures — limited to a store, a 64 City Council Staff Report November 4, 2015-Page 5 Case 3.1009 APPEAL —Appeal of HSPB Action"Ramon Drug Building" motel, office, restaurant, or similar small commercial structure if design for an occupant load of 30 persons or less, or for urbanized areas, demolition of up to three such commercial buildings on sites zoned for such use. To the extent that the appeal is granted, demolition of the 440 Building would be exempt from CEQA following staff's confirmation of the qualification of the exemption given the occupancy load of the building. However, given the HSPB action to consider the historic significance of the building, denying the appeal will allow the additional study to determine this significance and, if found deserving of and given a Class 1 designation, demolition of the 440 Building would no longer be considered exempt from complying with the requirements of CEQA. The Allotees are desirous of removing the buildings so that they can be afforded the opportunity to redevelop the property for a more compatible use for the downtown Palm Springs area. The homeless encampments have become a real problem and there is some fear that instead of demolishing the buildings, the Allotees will be forced to clean-up the fire damage that may occur. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS FINDS AND DETERMINES AS FOLLOWS: A. On September 15, 2015, G & M Construction on behalf of ACBCI allottee owners of allotments 5A and 35A submitted an application to the City of Palm Springs to demolish all structures on the parcel at the northeast corner of South Indian Canyon Drive and East Ramon Road (APN 508-084-016) which included the Ramon Drug Building, a multi-tenant commercial building (referred to herein as the "440 Building") and a vacant automobile service station (referred to herein as the "490 Building"); B. According to building permit records submitted with the application, the subject buildings were constructed prior to 1969 and pursuant to Palm Springs Municipal Code (PSMC) Section 8.05.125 all structures built prior to 1969 are automatically designated as Class 3 historic structures. Such structures are eligible for a six-month stay of demolition and recommendation by the Historic Site Preservation Board (HSPB) to the City Council to consider reclassifying as a Class 1 structure. C. On October 13, 2015, at a regularly scheduled meeting, the HSPB considered the demolition request for the 440 Building and the 490 Building. D. At the October 13, 2015, meeting, the HSPB took no action on the 490 Building, thereby allowing the applicant to proceed with obtaining a building permit for the demolition of that structure. E. At the October 13, 2015, meeting, the HSPB voted 5-1-1 (Williamson opposed, Dixon absent) to initiate study pursuant to PSMC Section 8.05.135 and voted 5-1-1 (Williamson opposed, Dixon absent) to initiate a 120-day stay of demolition pursuant to PSMC 8.05.170 to allow time for necessary studies, hearings and determination whether the 440 Building should be designated as an historic site. F. On October 14, 2015, the City received a letter from G & M Construction on behalf of ACBCI owners of allotments 5A and 35A appealing the action of the HSPB, in accordance with PSMC Section 8.05.230, to initiate study and place a stay of demolition on the 440 Building. G. A notice of public hearing of the City Council of the City of Palm Springs California was published in accordance with applicable law. 13 Resolution No. Page 2 H. At its meeting of November 4, 2015, the City Council considered all evidence presented in connection with the appeal request, including but not limited to the staff report and all written and oral testimony presented. I. The Council specifically finds that completion of the hearings and deliberations by the HSPB and the City Council on the question of Class 1 historic designation will provide full and adequate opportunity to review and consider the historic or cultural significance of the 440 Building. Granting the appeal would allow the demolition of the 440 Building to proceed without the ability of the City Council to ultimately and completely resolve these questions in a timely manner. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES AS FOLLOWS: SECTION 1. The above findings are all true and correct. SECTION 2. The City Council hereby denies the appeal submitted by G & M Construction on behalf of ACBCI owners of allotments 5A and 35A, and upholds the HSPB's actions related to the initiation of a study for Class 1 historic designation and a 120-day stay of demolition for the 440 Building located at 436 to 454 South Indian Canyon Drive (APN 508- 084-016; Case 3.1009 MAA). Staff member Lyon summarized the staff report noting two buildings on the site, one a multi tenant commercial building (referred to as the "440 Building") and a former automobile service station (referred to as`the "490 Building"). ' Moriano Patencio spoke on behalf of the .twenty or so owners and summarized the background and characteristics Qf the buildings proposed for demolition. He noted that the 440 Building was comprised of.several buildings built over time behind a facade designed by Donald Wexler. ' He=summarized the, history of zoning regulations on tribally-owned land and old 25-year limitations in land leases for tribal-allottee-owned parcels. Chair Johns asked Mr. Patencio if the:owners had`-any plans for the property. (Mr. Patencio noted the owners are not developers but that developers had approached them with proposals for various residential development concepts for the parcel, which the owners rejected in favor of comMercial or mixed use options.) Member Burkett asked Mr. Patencio if the owners had considered talking to developers on possible salvage of the facade to integrate it with future development on the site. (Mr. Patencio noted that no private developers had come forward with offers to salvage the facade): Member Hays opined thattearing down the building with no approved redevelopment was akin to "trading a treasure for a dirt lot". He noted the collection of buildings behind the Wexler facade were of questionable historic merit. He noted saving the Wexler facade would add value to a potential future re-development and generate a greater return on the investment. He noted the Board is interested in trying find a way to save the facade referring to it as "a gem". Mr. Patencio stated it was "very sad" that no one has come forward to the owners with a plan to save or preserve the facade. From review of building permits, the commercial building is comprised of several structures constructed from the 1940's and onward and the automobile service station was constructed in 1947. By virtue of the pre-1969 dates of construction, both buildings are automatically deemed Class 3 historic sites. Demolition of Class 3 sites must be reviewed by the HSPB prior to issuance of a demolition permit. Upon review of the application, the HSPB may take no action and allow the demolition permits to be issued, or it may impose a 120-day stay of demolition and initiate study to inform the board whether the site is eligible for possible recommendation to a higher classification of historic designation. The applicant has not submitted a proposal for new construction or redevelopment of the site. The fagade of the 440 building was designed by notable architect Donald Wexler, FAIA in 1954. Wexler was 28 years old when he and his business partner Richard Harrison completed the commission. RECOMMENDATION: Regarding the 440 Building: 1. Take no action and allow the applicant to proceed with demolition. OR, 2. BACKGROUND AND SETTING: The buildings are located on a 1.81-acre parcel at the northeast corner of South Indian Canyon Drive and Ramon Road. The site was also the location of the "Clara Bee" Lodge; a complex of salvaged military barracks that were assembled on the site after World War II by developer Zack Pitts to create affordable housing for women. The applicant has submitted copies of building permit records for the subject addresses which are attached to this staff report. In roughly 2010, the lease expired and was not renewed. As such, there is no current land lease in place and ownership is still vested in numerous ACBCI allottee members. DESCRIPTION AND ANALYSIS Building 1: The 440 Building - Mult-tenant Commercial Building. Indian Canyon Drive Page 3 of 9 among them Palm Springs Cleaners (a dry cleaning business appears to be the first occupant listed in a 1947 building permit), Love's Barbeque, Flaherty's Bar & Grill, (later O'Leary's Bar & Grill) and Finerman's Ramon Drug Store (which appears to have been the primary occupant when the current fagade was constructed in 1954; see attached excerpt from a 1954 Desert Sun article). The 440 Building appears to have had several additions over time. One building permit (undated) notes a "store building to be relocated from hospital grounds".' As seen from the aerial photos below, the various additions appear as different roof surfaces. The first photo below is a portion of a citywide aerial photo dated 1953. It shows the commercial building as an "L" shaped structure and the gas station as a "Y" shaped structure. Further to the east (right) one can see various other buildings which currently do not exist, including the parallel rows of former military barracks relocated to the site to form the Clara Bee Lodge. tir m. The building's street fagade is a dramatic "upswept" cantilevered stucco clad steel frame canopy subdivided into eight structural bays. The north and south "sides" of the building are skinned in arched panels of small rust-colored river rock veneer. Green aluminum shade canopies that follow the pointed arch profile of the stone veneer panels can be seen attached to the side wall toward the rear of the complex. It's modern expressive styling, clean lines, generous roof overhang, expansive use of glass and aluminum curtainwall, lack of ornament and uniform structural grid place it in the context of the mid-century modern era for which Palm Springs has become internationally recognized. It is an aesthetically unique commercial building that has generally been well-maintained and enjoyed full tenancy of its commercial spaces over most of the past sixty-plus years of its existence. The 490 Building — Former Gas Station. The second structure on the site, at 490 South Indian Canyon Drive, is a former automobile service station. The station was occupied by Standard Oil / Chevron, but has been vacant for many years. Most recently the building was occupied by a tour company. There is no background information that was found relative to this structure that would suggest it possesses any historic significance, nor is there any known architect associated with its design. It does not present a particularly unique design aesthetic and other than the single column supporting the canopies, does not seem to demostrate a particularly unique method of construction. The building was not recognized in any of the City's previous historic resource surveys and staff is not aware of any historic significance associated with the building. 26 Historic Site Preservation Board Staff Report October 13, 2015 Case 3.1009 MAA—Demolition Request of a Class 3 historic site—436—490 S. Indian Canyon Drive Page 9 of 9 Given that the allottee owners are seeking demolition of both structures, it is unlikely owner support of reclassification to Class 1 historic status would be likely. Furthermore, given the appeal authority granted to the Tribal Council on actions concerning land use actions on allottee-owned parcels under the 1977 City/Tribal land use agreement, Class 1 historic designation may also be unlikely. A more successful outcome for preservation or adaptive reuse of the 440 Building may be to allow time for negotiations with the building owners for possible salvage of the Wexler-designed front structural bay and facade, or to explore possible incorporation of the facade into a successful redevelopment of the site. CONCLUSION Of the two buildings associated with this demolition application, the 440 Building may be considered to possess sufficient historic significance based upon a cursory review of criteria for nomination and the 2004 Historic Resource Survey to warrant further study for possible recommendation by the Board to the City Council for Class 1 historic designation. The 490 Building, a former automobile service station, is not listed in the 2004 Historic Resources Survey and does not appear to possess sufficient historic significance to warrant further study. ENVIRONMENTAL ASSESSMENT Demolition permits are a ministerial action under the California Environmental Quality Act (CEQA) and as such are not subject to CEQA review. NOTIFICATION No notification is required for HSPB review of requests for demolition of Class 3 historic sites, however the agenda for today's meeting has been provided to the City's Office of Neighborhood Involvement and distributed to designated neighborhood organizations pursuant to PSZC 94.04.00 and the agent for the applicant has been notified via e-mail and telephone. The Ramon Drug Building was designed by noted master architects Donald Wexler and Richard Harrison. Preliminary research suggests that the property originally consisted of former barracks. Wexler & Harrison were commissioned to convert the barracks into a contemporary commercial property with entirely new fagades. The result is a superb example of Desert Modernism exemplified by the west elevation's upswept canopy with its gracefully curved supports that rise towards the mountains. It is also a highly visible commercial building located in downtown Palm Springs. The City's 2004 Historic Resources Survey found the building to be a "simple but sleek" example of the Modern architectural style "in good condition." (Attached.) The Survey also identified the date of construction for this Wexler building to be 1960. As a Class 3 Historic Site, (Palm Springs Municipal Code § 8.05.125 [all structures constructed before 1969 are classified as Class 3 Historic Sites]) the City's Historic Site Preservation Board (HSPB) has the authority to issue a "six-month stay of demolition" to allow the HSPB to make a recommendation regarding whether the site should be reclassified as a Class 1 Historic Site or to provide other recommended actions. The Palm Springs Modern Committee strongly urges the HSPB to issue such a stay for those exact reasons. 44 City of Palm Springs October 6, 2015 Page 2 In addition, the Palm Springs Modern Committee believes there is ample evidence that 440-460 South Indian Canyon Drive should be classified as a Class 1 Historic Site. As noted above, the Ramon Drug Building is an excellent and highly visible example of Desert Modernism that is the work of the local architectural firm of Wexler & Harrison. Indeed, the work of master architect Donald Wexler, who passed away this summer, exemplified the Desert Modern style. Detailed obituaries in the New York Times and Los Angeles Times idolized Donald Wexler for his pioneering work in Palm Springs. According to his New York Times obituary, Mr. Wexler's innovative steel houses and soaring glass-fronted terminal at the Palm Springs International Airport helped make Palm Springs a showcase for midcentury modernism. One of Wexler's steel residences designed for the Alexander Construction Company is listed in the National Register of Historic Places. The fagade of Palm Springs Airport was designed by Donald Wexler, which is the basis for the airport's fagade's designation as a Class 1 Historic Site. Thus, the Palm Springs Modern Committee strongly urges the HSPB to 1) issue a six month stay of demolition for the Ramon Drug Building, and 2) continue the HSPB hearing until such time that sufficient research on the property's significance has been gathered in evaluating whether the building should be reclassified as a Class 1 Historic Site.
