Ready, City Manager Initiated by: Public Works & Engineering Department SUMMARY Approval of this action will allow authorize additional design services to identify and design solutions to certain accessibility deficiencies at Demuth Park. RECOMMENDATION: 1) Authorize an increase in the amount of $14,935 to Purchase Order 15-1259 with Harris & Associates for revised total amount of $39,860 for the Demuth Park ADA Access Improvements, City Project No. 15-15; and 2) Authorize the City Manager to execute all necessary documents. BACKGROUND: On December 16, 2013, the City Council approved an On-Call Civil Engineering Agreement (A6444) with Harris & Associates to provide as-needed civil engineering services for a variety of future public works projects. Earlier this year, complaints were received regarding accessibility to the recreation fields at Demuth Park. In response to these complaints, staff requested a proposal from Harris & Associates to review Demuth Park and identify appropriate improvements to provide access throughout Demuth Park meeting ADA guidelines. On June 8, 2015, in accordance with their on-call agreement, the City Manager authorized Harris & Associates to proceed with preparation of design plans at a cost not to exceed of $24,925. Accordingly, Purchase Order 15-1259 was issued to Harris & Associates associated with this assignment. A vicinity map showing the location of Demuth Park is included as Attachment 1. ITEM NO. City Council Staff Report December 16, 2015— Page 2 Increase PO 15-1259 (Harris&Associates) The initial scope of work was limited to a review of Demuth Park to determine certain improvements that will be required to provide ADA accessible pathways to baseball and soccer fields, concessions stands, playground equipment, and on-site parking facilities. However, it will be important to ensure all accessibility deficiencies are resolved, and staff is recommending that Harris & Associates evaluate the accessibility deficiencies noted in an Accessibility Survey prepared by Disability Access Consultants; a copy of this survey is available and on file with the City Clerk. (Note, however, certain accessibility deficiencies noted within the restrooms and other buildings at Demuth Park will be the subject of a separate project to be assigned to one of the City's on-call Architects, who will review and prepare architectural drawings for the building modifications). Many of the deficiencies noted in the Accessibility Survey are related to parking facility improvements including pavement reconstruction, access ramp enhancements, new signage and striping, and various facilities enhancements such as restrooms, drinking fountains, and various items identified in the Deficiency Report included as Attachment 2. Staff requested a proposal from Harris & Associates to address the additional parking lot and related access defiencies noted in the Accessibility Survey and Deficiency Report; a copy of their proposal is included as Attachment 3. Harris & Associates will prepare construction drawings for improvements to address the accessibility deficiencies at Demuth Park, which are identified as part of a capital improvement project: Demuth Park ADA Access Project, City Project No. 15-15. ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities," Class 1 projects consist of pedestrian trails involving a minor alteration of existing public or private structures or facilities; therefore, the Demuth Park ADA Access Improvements, City Project No. 15-15, is considered categorically exempt from CEQA, and a Notice of Exemption will be prepared and filed with the Riverside County Clerk prior to construction. FISCAL IMPACT: This project was not originally budgeted as part of the 2015/2016 fiscal year budget; however, given the importance of addressing accessibility at public facilities, the City Manager has authorized the design work to proceed using General Funds budgeted and available- in the Park Maintenance Division. Harris & Associates has developed a preliminary construction estimate to address the accessibility deficiencies at Demuth Park (excluding any facility modifications to be undertaken separately). The current estimate for the on-site access improvements throughout Demuth Park is $450,000; staff will be evaluating sources of funding for this work for consideration by the City Council at the time construction drawings are presented for its approval and authorization to bid. Access Project Dear Mr. Fuller, We are providing a scope and fee to address the applicable site related comments in the City provided "Accessibility Survey" for Demuth Park. The attached table indicates whether the deficiency identified in the above report was already addressed in the draft construction plans provided to the City under the existing Harris task order for Demuth Park. The items marked "Y" have already been incorporated in our original contract. The items marked "N" was not covered in the scope of the original contract and is included under the scope of Amendment 1. Architectural related items are not included in our scope. The PS&E of the items in the amendment will be subject to the corresponding scope and assumptions in the existing contract for Demuth Park. Schedule We expect to submit 100% PS&E for the project in three weeks from a written Notice to Proceed (NTP) for this amendment. Final Construction documents will be provided after comments are received from the City. Fee The following is a summary of the not-to-exceed fees showing the hourly breakdown of all the major tasks required for this amendment. It is based on our understanding of the requirements of the project and the assumptions listed in the scope above.
