NEAL M.A., ED D DIVERSITY TRAINING, CULTURAL HUMILITY Diversity Training Agreement Cultural Humility Initiative This Agreement is entered into this L� day of ACC n 2012, between the City of Palm Springs, California ("City") and Veronica A. K. Neal ("Trainer"). Services and Compensation. Trainer will work with the City's Human Resources Director in the provision of cultural diversity training as described in the "Revised Training Proposal for the City of Palm Springs: Cultural Humility Initiative attached to this agreement as Attachment 1. City agrees to compensate the Trainer according to the cost schedule referenced in Attachment 1. Termination. This Agreement may be terminated at any time for any reason by either party to this Agreement after providing the other party at least five calendar days notice. Relationship. Trainer acknowledges that she is an independent contractor. Nothing in this Agreement shall be understood or construed to create or imply any relationship between the parties in the nature of any joint venture, employer/employee, principal/agent, or partnership. Trainer shall not become an employee of the City by acting under this Agreement and Trainer shall be solely responsible for the payment of any applicable taxes and social security contributions owing from the above compensation. Authority. Each party certifies that it has all necessary authority to execute and deliver this Agreement and to perform the obligations described in this agreement. Upon execution by both parties, this Agreement will be a valid and binding obligation of each party and enforceable in accordance with its terms. ----- Governing Law. This Agreement shall be governed by and construed exclusively in accordance with the laws of the State of California. If any term or provision of this Agreement is held illegal, unenforceable, or in conflict with any governing law, the validity of the remaining portions shall not be affected. Assignment. This Agreement may not be assigned without the written consent of the other party. This Agreement shall be binding upon and inure to the benefit of and shall be enforceable by and against the parties and their successors and assigns. Liability. Trainer shall be solely liable for any and all losses, liabilities, claims, damages, and expenses (including attorneys' fees) caused by her failure to comply with any and all federal, state, local, and municipal regulations, ordinances, statutes, rules, laws, applicable to her performance of her obligations under this Agreement and/or activities at the Animal Shelter or any other City property; any unlawful acts on the part of Trainer; the negligent acts, errors, and/or omissions or the willful misconduct of the Trainer; or the material breach or default of the Trainer of any provision of this Agreement. Modification of Agreement. It is understood and agreed that this agreement may not be changed, modified, or altered, except by mutual agreement of both parties. Certified Diversity Practitioner and Integral Coach® Phone: 510-610-0919* E-mail:vakneal@sbcglobal.net A Revised Training Proposal for the City of Palm Springs: Cultural Humility Initiative THE BACKGROUND AND GOAL The City of Palm Springs was incorporated in 1938 and is a charter city with a City Council/City Manager form of government. The city's motto is: The People Are the City. The following training plan is part of a City-wide commitment to embrace cultural diversity and equity both among city employees as well as the customers they service. Based on several planning conversations, it was established that the City is at the beginning stages of building awareness across the organization, for institutional understanding and integration of a cultural humility initiative. Thus, because there is a general sense of the need, an in-depth needs assessment was declined in an effort to move more quickly into the work of building shared understanding and language for a longer-term institutional initiative. As part of this training system, a cultural climate analysis will be conducted further illuminating the overall needs of the organization and how best an in-depth initiative can support the work of cultural humility and equity across of the organization. In summary, the goal of this training project is to establish an organizational understanding of the need and process of integrating a full-fledged institutional diversity/cultural humility initiative that will help shape the workplace culture and support the City's commitment to equity and inclusion. THE PLAN Based on previous planning conversations, we have identified a training system approach that will best meet the needs of the City as follows: Program Overview: • Foundation session in year one to include combination of core concepts list below. • Two sessions for all staff, excluding Executives (2 Hours each ) • Two sessions for Executives (3 hours each) o One prior to staff session (May) o One after staff sessions (late Oct) The Foundation Training Program will be delivered in two modules over the course of one year. A. Skills development and practice (training; processes): • Self-reflection • Perspective taking practice • Communication Practice: listening to understand, authentic communication, dialogue, and inquiry • Giving and receiving feedback • Analyzing challenging situations • Steps to having difficult conversations COST The estimated cost for providing two modules of the foundation training program over the course of one year is $15,450.00, plus air and hotel expenses not to exceed $5,000.00.
