Fuller, Assistant City Manager/City Engineer Initiated by: Public Works and Engineering Department SUMMARY On October 7, 2015, the City Council awarded a construction contract to Intermountain Slurry Seal, for the 2015 Citywide Annual Slurry Seal, City Project No. 15-02, (the .,Project"). The Project includes pavement maintenance and slurry seal of various City streets, including Murray Canyon Drive between S. Palm Canyon Drive and Toledo Avenue. Staff is recommending that in lieu of replacing the existing traffic striping on Murray Canyon Drive as a 4-lane roadway, that a "road diet" be implemented to convert the roadway to a 2-lane divided roadway with parking and buffered bicycle lanes. (The City Manager owns property within 500 feet of the Project, and is not participating in any actions associated with the Project). RECOMMENDATION: Approve the implementation of a "road diet" on Murray Canyon Drive between S. Palm Canyon Drive and Toledo Avenue, to convert the existing 4-lane roadway to a 2-lane divided roadway with parking and buffered bicycle lanes, as part of the 2015 Citywide Annual Slurry Seal, City Project No. 15-02. BACKGROUND: A full background on the City Council's award of the contract for the Project is included with the October 7, 2015, staff report, included as Attachment 1. The Project includes pavement maintenance and slurry seal on Murray Canyon Drive between S. Palm Canyon Drive and Toledo Avenue, an existing 4-lane "Secondary Thoroughfare" roadway as identified on the Circulation Element of the City's General Plan. An aerial view of a typical section of Murray Canyon Drive, and a street view photo, are shown in the following Figures on the next page. ITEM NO. The Project includes replacing existing traffic striping after completion of pavement repairs and slurry seal, and staff is recommending that the 02 City Council Staff Report April 6, 2016 - Page 3 Approval of Murray Canyon Drive"Road Diet" City Council approve implementing a "road diet" to reduce the number of travel lanes to create buffered bicycle lanes, which would extend to and connect with a previously completed `road diet" on Toledo Avenue. Toledo Avenue is also scheduled for pavement repairs and slurry seal as part of the Project, and implementing a "road diet" on Murray Canyon Drive would help complete a portion of a bicycle loop in this area of the City. The "road diet" concept captures excess capacity in an existing roadway by eliminating travel lanes and providing that area of the roadway for other mobility uses, including on- street parking and buffered bicycle lanes. The ability to implement 11road diets" is determined by identifying existing and future traffic volumes that are 0 3 City Council Staff Report April 6, 2016- Page 4 Approval of Murray Canyon Drive"Road Diet" carried by each roadway, and evaluating if each roadway has sufficient excess capacity such that the capacity of the roadway may be reduced by eliminating the number of travel lanes. Staff is completing a City-wide traffic analysis of its Circulation Element to identify where "road diets" may be implemented to allow for additional Class 2 bicycle lane routes, and will be presenting this analysis to the City Council in the near future. However, with the slurry seal repairs pending in the very near future on Murray Canyon Drive, staff is presenting the concept of implementing a "road diet" on this specific street ahead of a City-wide discussion, to allow for the physical traffic striping of Murray Canyon Drive to be completed consistent with a 2-lane divided roadway with parking and buffered bicycle lanes, rather than replacing the existing 4-lane roadway as it exists today. The traffic analysis specific to Murray Canyon Drive shows that the existing 4-lane roadway currently carries approximately 3,500 vehicles per day, with a total capacity of 25,900 vehicles per day, which operates at Level. of Service ("LOS") A, with a vehicle/capacity ratio ("V/C") of 0.14. The traffic analysis projected future traffic volumes by applying an inflation factor to represent growth of 1.5% in traffic volumes annually over 22 years, to identify future traffic volumes in 2035. On Murray Canyon Drive, the anticipated future traffic volume in 2035 is 4,700 vehicles per day, which maintains operation at LOS A, with a V/C = 0.18. The Circulation Element of the City's General Plan, Policy CR2.1, regulates how the City's streets should operate to ensure against traffic congestion and the associated environmental impacts related to such congestion, and states: CR2.1 Maintain Level of Service D or better for the City's circulation network, as measured using `in season"peak hour conditions. A 4-lane roadway similar to Murray Canyon Drive with a capacity of 25,900 vehicles per day may operate at LOS D with up to 23,300 vehicles per day with V/C = 0.90. In this case, Murray Canyon Drive is expected to carry a maximum of 4,700 vehicles per day, and has excess capacity by which travel lanes may be reduced to implement a "road diet". The converted 2-lane divided roadway with parking and buffered bicycle lanes has a reduced capacity of 18,000 vehicles per day, and with an anticipated future traffic volume of 4,700 vehicles per day, the converted 2-lane roadway will still maintain an operation at LOS A, with a V/C = 0.26. The "road diet" will function consistent with the requirements of the Circulation Element of the City's General Plan. On this basis, staff recommends that the City Council approve implementing this "road diet". ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions 04 City Council Staff Report April 6, 2016- Page 5 Approval of Murray Canyon Drive 'Road Diet" of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities," Class 1 projects consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public structures, facilities, mechanical equipment or topographical features involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. Therefore, in accordance with Section 15301(c), staff has determined that the 2015 Citywide Annual Slurry Seal, City Project No. 15-02, is considered categorically exempt from CEQA and a Notice of Exemption has been prepared and filed with the Riverside County Clerk. As it relates to the "road diet' to convert an existing 4-lane roadway to a 2-lane divided roadway with parking and buffered bicycle lanes, the City has determined, upon review of the proposed , that implementing the proposed "road diet" is exempt from the CEQA, insofar as the proposed traffic striping will occur entirely within existing, disturbed right of way; will only be implemented on Murray Canyon Drive which currently operates at acceptable levels of service, and will continue to operate at acceptance levels of service once the traffic striping has been completed; and the traffic striping will have no potential to impact the environment. The installation of the traffic striping to implement a "road diet" on Murray Canyon Drive is exempt from CEQA under the General Rule, Public Resources Code 21080, and CEQA Guidelines 15061(B)(3). FISCAL IMPACT: The cost to implement the "road diet" on Murray Canyon Drive between S. Palm Canyon Drive and Toledo Avenue, to convert the existing 4-lane roadway to a 2-lane divided roadway with parking and buffered bicycle lanes, is already included with and part of the contract awarded for the 2015 Citywide Annual Slurry Seal, City Project No. 15-02; no additional cost will be incurred. The low bid submitted by Intermountain Slurry Seal is less than the City's estimate, providing budget for additional streets; a list of additional streets to add to the Project is recommended for consideration by the City Council. Approval of a Purchase Order with Willdan Engineering will provide the City with construction inspection and administration support services required for the Project. RECOMMENDATION: 1. Award a construction contract (Agreement No. ) to Intermountain Slurry Seal, Inc., a Wyoming corporation, in the amount of $1,760,067 for the 2015 Citywide Annual Slurry Seal, City Project No. 15-02; 2. Adopt Resolution No. "A Resolution of the City Council of the City of Palm Springs, California amending the budget for Fiscal Year 2015-2016; and 5. Authorize the City Manager to execute all necessary documents. BACKGROUND: On March 4, 2015, staff presented a final report of the 2015 Pavement Management Program Update (the "2015 Update") to the City Council. The 2015 Update determined an overall Pavement Condition Index ("PCI") of 69 and confirmed that 75% of the entire City street network has a pavement condition rated at "Fair' or better condition. Staff provided copies of the 2015 Update and held meetings with various subcommittees of the Palm Springs Neighborhood Involvement Committee (PSNIC), now known as the Organized Neighborhoods of Palm Springs (One-PS), and the Measure J Commission to review and discuss the 2015 Update. The Public Works & Engineering Department oversees the maintenance of the City's street system. Each year, the Department assembles a capital project to continue its Slurry Seal Program on various City streets. The intention of the Slurry Seal Program is to provide a slurry seal within 5 to 7 years on every City street. The City generally budgets $500,000 for the Slurry Seal program, but with the deferral of a Slurry Seal project in 2014 and with additional funds accumulated in the local Measure A account from prior years, Public Works and Engineering was able to program a sizable amount of$2,450,000 for the Project. Staff and One-PS identified a final list of over 80 various streets throughout the City(4.8 million square feet of paved roadways) using a budget estimate of$2.45 Million from the City's Local Measure A Fund. The List of Streets and corresponding Maps originally included with the Project are provided as Attachment 1. This year's slurry seal program is scheduled to include all streets with PCI ratings from 65 through 69. Streets with PCI scores of 70 were prioritized from arterials, collectors, to local roads. On July 15, 2015, the City Council reviewed and approved the project specifications and the list of streets, and authorized staff to advertise and solicit bids for the Project. On July 5, and August 1, 2015, the project was advertised for bids, and at 3:00 p.m. on August 27, 2015, the Procurement and Contracting Division received five construction bids from the following contractors: Company Location Bid Amount Intermountain Slurry Seal Watsonville, CA $1,760,067 American Asphalt South Fontana, CA $2,094,885 Pavement Coatings Co. Juru a Valley, CA $2,130,062 08 City Council Staff Report October 7, 2015 -Page 3 Award City Project 15-02 Company Location Bid Amount All American Asphalt Corona, CA $2,407,280 Telfer Highway Technologies McClellan, CA $2,794.915 Using actual bid item costs from prior projects completed by the City, staff determined an Engineer's estimate of $2,450,000 with an expectation that given the large scale of streets to be slurry sealed with the project with a programmed budget of nearly five times that is annually programmed, an economy of scale would result in competitive bidding and lower overall cost. As expected, the low bid submitted by Intermountain Slurry Seal was significantly less than the engineer's estimate at $1,760,067. A full bid summary is included as Attachment 2. Public Works Contractor Registration Law(SB 854) Under California Labor Code Section 1771.1, as amended by Senate Bill (SB) 854 (2014), unless registered with the State of California Department of Industrial Relations (DIR), a contractor may not bid, nor be listed as a subcontractor, for any bid proposal submitted for public works projects on or after March 1, 2015. Similarly, a public entity cannot award a public works contract to a non-registered contractor, effective April 1, 2015. Staff has reviewed the DIR's contractor registration database, and has confirmed that Intermountain Slurry Seal, and the listed subcontractors, are registered with the DIR, and are appropriately licensed. Intermountain Slurry Seal, of Watsonville, California submitted the lowest responsive bid. Staff reviewed the bid, references, and contractor's license, and found the Contractor to be properly licensed and qualified. A construction contract with Intermountain Slurry Seal, for the Project is included as Attachment 3. Local Business Preference Compliance Section 7.09.030 of the Palm Springs Municipal Code, "Local Business Preference Program," requires prime contractors to use good faith efforts to sub-contract the supply of materials and equipment to local business enterprises and to sub-contract services to businesses whose work force resides within the Coachella Valley; submission of good faith efforts is required. Of the five bids received, none of the prime contractors were located within the Coachella Valley. The lowest bidder has submitted proof of good faith efforts. City Council Approval of Additional Streets with Remaining Budget As a result of the economy of scale and reduced bid unit costs obtained through the competitive bidding on the Project, the low bid submitted by Intermountain Slurry Seal was significantly less than the final estimate, at $1,760,067, and provides a remaining budget of approximately $540,000 (after accounting for updated costs and contingencies) from which additional streets may be included in the Project. One-PS and staff have identified an additional list of streets with both arterial and collector 09 City Council Staff Report October 7, 2015 - Page 4 Award City Project 15-02 streets, included as Attachment 4. One-PS has reviewed and recommended approval of the additional list of streets; a copy of the One-PS letter is included as Attachment 5. Staff recommends that the City Council approve the additional list of recommended streets, and authorize the City Manager to approve a Construction Contract Change Order in an amount not to exceed $540,000 to implement inclusion of such list as part of the Project. Construction Management and Inspection Services On April 1, 2015, the City Council approved agreements for on-call Public Works capital project construction management and inspection services with Dudek & Associates, Interest Consulting Group, Inc., and Willdan Engineering to provide first class as- needed construction management and inspection (`Owner's Rep") services associated with a variety of future Public Works capital projects. Staff is recommending the services of Willdan Engineering given their on-going construction management oversight for the 2015 Pavement Rehabilitation Project (City Project No. 15-01); staff recommends that the City Council approve the proposal submitted by Willdan Engineering, in the amount of $100,862 which should be no more than 5% of the construction costs inclusive of the additional street list. Staff was able to include the additional streets in the proposal, therefore, costs for construction management, inspection, and material testing reflects the additional scope. A copy of the proposal for construction phase services provided by Willdan Engineering is included as Attachment 6. A copy of the Notice of Exemption is included as Attachment 7. 10 City Council Staff Report October 7, 2015 -Page 5 Award City Project 15-02 FISCAL IMPACT: The Local Measure A Program (Fund 134) had approximately $2,200,000 available in unscheduled capital projects (Account No. 134-4498-50000) at the end of the 2014- 2015 Fiscal Year, and a remaining balance of approximately $900,000 from the prior year's annual slurry seal program. The City Council adopted the Measure A Local Streets and Roads 5-Year Capital Improvement Plan ("CIP"), which identified a total of $2,000,000 anticipated for expenditure for the annual slurry seal program; the actual amount will be revised in the subsequent annual approval of the Measure A 5-Year CIP. The Project's overall budget, and incurred expenditures, are identified in the following Table 1. The City and the Contractor, in consideration of the mutual covenants hereinafter set forth, agree as follows: ARTICLE 1 --THE WORK For and in consideration of the payments and agreements to be made and performed by City, Contractor agrees to furnish all materials and perform all work required to complete the Work as specified in the Contract Documents, and as generally indicated under the Bid Schedule(s)for the Project entitled: 2015 CITYWIDE ANNUAL SLURRY SEAL CITY PROJECT NO. 15-02 The Work includes application of weed killer to all pavement cracks or joints; cleaning, routing, and installation of crack-sealant and asphalt pavement in all pavement cracks or joints Y4" or wider; uniform micro-milling of existing asphalt concrete pavement; construction of Rubber Polymer Modified Slurry (RPMS); removal and replacement of existing traffic striping and markings; and all appurtenant work on various City streets. ARTICLE 2--COMMENCEMENT AND COMPLETION The Work to be performed under this Contract shall commence on the date specified in the Notice to Proceed by the City, and the Work shall be fully completed within the time specified in the Notice to Proceed. The City and the Contractor recognize that time is of the essence of this Agreement, and that the City will suffer financial loss if the Work is not completed within the time specified in Article 2, herein, plus any extensions thereof allowed in accordance with applicable provisions of the Standard Specifications, as modified herein. They also recognize the delays, expense, and difficulties involved in proving in a legal proceeding the actual loss suffered by the City if the Work is not completed on time. Accordingly, instead of requiring any such prof, the City and the Contractor agree that as liquidated damages or delay(but not as a penalty), the Contractor shall pay the City the sum specified in Section 6-9 of the Special Provisions for each calendar day that expires after the time specified in Article 2, herein. In executing the Agreement, the Contractor acknowledges it has reviewed the provisions of the Standard Specifications, as modified herein, related to liquidated damages, and has made itself aware of the actual loss incurred by the City due to the inability to complete the Work within the time specified in the Notice to Proceed. 2015 CITYWIDE ANNUAL SLURRY SEAL CITY PROJECT NO, 15-02 AGREEMENT FORM AGREEMENT-PAGE1 44 ARTICLE 3-- CONTRACT PRICE The City shall pay the Contractor for the completion of the Work, in accordance with the Contract Documents, in current funds the Contract Price(s) named in the Contractor's Bid Proposal and Bid Schedule(s), and any duly authorized Construction Contract Change Orders approved by the City. The amount of the initial contract award in accordance with the Contractor's Bid Proposal is One Million Seven Hundred Sixty Thousand Sixty Seven Dollars ($1,760,067). Contractor agrees to receive and accept the prices set forth herein, as full compensation for furnishing all materials, performing all work, and fulfilling all obligations hereunder. Said compensation shall cover all expenses, losses, damages, and consequences arising out of the nature of the Work during its progress or prior to its acceptance including those for well and faithfully completing the Work and the whole thereof in the manner and time specified in the Contract Documents; and, also including those arising from actions of the elements, unforeseen difficulties or obstructions encountered in the prosecution of the Work, suspension of discontinuance of the Work, and all other unknowns or risks of any description connected with the Work. ARTICLE 4--THE CONTRACT DOCUMENTS The Contract Documents consist of the Notice Inviting Bids, Instructions to Bidders, the prevailing rate of per diem wages as determined by the Director of the California Department of Industrial Relations, the accepted Bid and Bid Schedule(s), List of Subcontractors, Local Business Preference Program — Good Faith Efforts, Non- Discrimination Certification, Non-Collusion Declaration, Bidder's General Information, Bid Security or Bid Bond, this Agreement, Worker's Compensation Certificate, Performance Bond, Payment Bond, Standard Specifications, Special Provisions, the Drawings, Addendum number 1, and all Construction Contract Change Orders and Work Change Directives which may be delivered or issued after the Effective Date of the Agreement and are not attached hereto. ARTICLE 5— MUTUAL OBLIGATIONS For and in consideration of the payments and agreements to be made and performed by the City, the Contractor agrees to furnish all materials and perform all work required for the above stated project, and to fulfill all other obligations as set forth in the aforesaid Contract Documents. City hereby agrees to employ, and does hereby employ, Contractor to provide the materials, complete the Work, and fulfill the obligations according to the terms and conditions herein contained and referred to, for the Contract Price herein identified, and hereby contracts to pay the same at the time, in the manner, and upon the conditions set forth in the Contract Documents. 2015 CITYWIDE ANNUAL SLURRY SEAL CITY PROJECT NO. 15.02 AGREEMENT FORM AGREEMENT-PAGE2 4 ,,9 Contractor specifically acknowledges and agrees to be bound by the Wage Rates and Labor Code requirements specified in the Contract Documents, including the requirement to furnish electronic certified payroll records directly to the Labor Commissioner (via the Division of Labor Standards Enforcement), and shall pay the general prevailing rate of per diem wages as determined by the Director of the Department of Industrial Relations of the State of California. ARTICLE 6--PAYMENT PROCEDURES The Contractor shall submit Applications for Payment in accordance with the Standard Specifications as amended by the Special Provisions. Applications for Payment will be processed by the City Engineer as provided in the Contract Documents. ARTICLE 7 -- NOTICES Whenever any provision of the Contract Documents requires the giving of a written Notice between the parties, it shall be deemed to have been validly given if delivered in person to the individual or to a member of the firm or to an officer of the corporation for whom it is intended, or if delivered at or sent by registered or certified mail, postage prepaid, to the last business address known to the giver of the Notice. ARTICLE 8 — INDEMNIFICATION The Contractor agrees to indemnify and hold harmless the City, and all of its officers and agents from any claims, demands, or causes of action, including related expenses, attorney's fees, and costs, based on, arising out of, or in any way related to the Work undertaken by the Contractor hereunder. This Article 8 incorporates the provisions of Section 7-15 'Indemnification," of the Special Provisions, which are hereby referenced and made a part hereof. ARTICLE 9 — NON-DISCRIMINATION The Contractor represents and agrees that it does not and will not discriminate against any subcontractor, consultant, employee, or applicant for employment because of race, religion, color, sex, or national origin in any matter including without limitation employment upgrading, demotion, transfers, recruitment, recruitment advertising, layoff, termination, rates of pay, or other forms of compensation and selection for training, including apprenticeship. ARTICLE 10— MISCELLANEOUS Terms used in this Agreement which are defined in the Standard Specifications and the Special Provisions will have the meanings indicated in said Standard Specifications and the Special Provisions. No assignment by a party hereto of any rights under or interests in the Contract Documents will be binding on another party hereto without the written consent of the party sought to be bound; and specifically, but without limitation, monies that may become due and monies that are due may not be assigned without such 2015 CITYWIDE ANNUAL SLURRY SEAL CITY PROJECT NO. 15-02 AGREEMENT FORM AGREEMENT-PAGES 46 consent (except to the extent that the effect of this restriction may be limited by law), and unless specifically stated to the contrary in any written consent to an assignment, no assignment will release or discharge the assignor from any duty or responsibility under the Contract Documents. This list of suggested streets maintains the recent philosophy of focusing on arterial and collector streets when faced with limited budget funds available for slurry sealing (rather than prioritizing all streets with PCI ratings of 70 to 72 based on their alphabetical order and without regard to traffic loads). As you and I discussed, based on your estimate of$0.50 per square foot of street area, the estimated cost for slurry sealing the suggested additional streets total approximately $20,000 over the $540,000 budget. We hope that the final cost estimates will make it possible to cover the entire list of suggested additional streets, but if that is not the case, we would suggest that the two streets marked with an asterisk (') be eliminated first given their limited impact compared to the other streets on the list. Provide full-time and as-needed construction inspection, including night inspection, of the work to monitor materials and methods for compliance with plans, specifications, and contract documents; address and document non-conforming items as they are discovered. 7. Monitor compliance with Cal OSHA requirements and compliance with all local, state, and federal regulations. Evaluate the contractors operation and production with respect to quality and progress and report to the resident engineer. 16. Photograph continuous property frontages along the street alignment once prior to construction and once immediately following construction. Maintain a photographic record of key elements of each major operation of work each day, with increased detail in situations of potential changes or claims. 17. Closely monitor testing results and require the contractor to provide corrective measures to achieve compliance. 18. Maintain copies of all permits needed to construct the project and enforce special requirements of each. 19, Prepare and maintain detailed daily diary inspector reports on construction progress. 20. Prepare clear and concise letters and memoranda, as needed. Establish a solid paper trail. 21. In addition to his experience with Community Development Block Grant (CDBG) funded projects, Mr. Baca is also familiar with the inspection and contract administration of other federally-funded projects in accordance with Caltrans Local Program Manual. Mr. Baca's recent experience includes the City of Rialto's Pepper Avenue Extension Project. The project extended Pepper Avenue Y mile crossing the Lytle Creek drainage endangered species habitat to CA 210. Approximately 100,000 cubic yards of import soil, four 10' by 10' reinforced box culverts and a Verdura Wall were used to span the drainage area. The project included 2,814 feet of curb, gutter, sidewalk, AC paving parkway landscaping and irrigation, as well as a new water line, sewer line, SCE conduits and street lighting. This project was the result of 12 years of planning and design with an overall $15 million budget and a construction cost of$7 million. Dear City Council Members and City Managers, As a full time resident of Andreas Hills neighborhood, I rely on Murray Canyon road on a daily basis. I urge you NOT to approve the "road diet" contemplated for this major arterial. Especially with the new Eagle Rock Development nearby, Murray Canyon will become more of an arterial rather than less. It seems that it would neither serve bike riders or motorists in an optimum way. Because there are so many tourists and unfamiliar drivers on the road who drive considerably below the speed limit, it is very helpful for those of us who know where we're going and drive these roads daily to have an option to pass unreasonably slow motorists. I am also against the idea of traffic lights at Murray and Palm Canyon, and at the Smoketree driveway on S. Sunrise that I have read may happen because of measure ] funding. I would like to see my Measure ] funds going to increase services for the homeless and to build more free parking downtown. Directing bicyclists away from the existing North/South connection IS NOT SAFE! This proposal confuses bicyclists and draws them away form an existing and safe North/South route and into a high traffic North/South arterial.
