Subject: APPROVAL OF LOT LINE ADJUSTMENT NO. 16-03 ACCEPTING THE
ADDITION OF A PORTION OF LAND TO BE INCLUDED AS PART OF
CITY OWNED PROPERTY IDENTIFIED AS LOT "R" OF TRACT MAP
30046, APN 512-330-023

SUMMARY
The City Engineer administratively approves lot line adjustments between two adjacent
property owners, subject to the requirements identified in the California Government
Code (Subdivision Map Act). Alta Verde Sereno, LLC, the owner of property identified
as Lot 2 in Tract Map 30046 (the "Monte Serreno" development), has submitted an
application for a lot line adjustment (identified as Lot Line Adjustment No. 16-03 "LLA
16-03") which would revise the boundary between Lot 2 and the adjacent property
identified as Lot R of Tract Map 30046 owned by the City. City Council approval of LLA
16-03 is required in this case as it affects (increases) the size of the property owned by
the City.
Alta Verde Sereno, LLC, is represented by Andrew Adler (President), and David Kivitz
(Vice President).
RECOMMENDATION:
1. Approve Lot Line Adjustment No. 16-03, adjusting the boundary between Lot 2 of
Tract Map 30046 owned by Alta Verde Sereno, LLC, a California limited liability
company, and Lot R of Tract Map 30046 owned by the City of Palm Springs,
whereby Lot R will increase in size by 235 square feet; and
2. Authorize the City Engineer to approve Lot Line Adjustment No. 16-03; and
3. Authorize the City Clerk to attach a Certificate of Acceptance of the additional real
property being transferred from Alta Verde Sereno, LLC, a California limited liability
company, to the City of Palm Springs via Lot Line Adjustment No. 16-03.

STAFF ANALYSIS:
LLA 16-03 proposed to adjust the boundary of Lot 2 and Lot R of Tract Map 30046, (the
"Monte Serreno" development) located on Bogert Trail. Lot Line Adjustments are a
ministerial application administratively approved through the City Engineer. However, in
this case, the benefitted property receiving a small portion of land from the adjoining
property is owned by the City of Palm Springs.
Alta Verde Sereno, LLC, has submitted plans to construct a home on Lot 2 within Tract
Map 30046, which is located along the east boundary of the subdivision and the Palm
Canyon Wash. As part of Tract Map 30046, the City received as open space property
identified as Lot R within the Palm Canyon Wash, which is located adjacent to the east
boundary of the residential lots in Tract Map 30046, including Lot 2. An aerial photo
showing the area in question is shown in Figure 1 (Lot 2 is highlighted in green).

It has been determined that the block wall constructed along the boundary between Lot
2 and Lot R deviates from the property line in two locations along Lot 2, as evident in a
closer aerial view of the property shown in Figure 2:

Alta Verde Sereno, LLC, requests that the City approve LLA 16-03 to adjust the
property line to coincide with the existing block wall between the properties, which will
transfer two small portions of property owned by Alta Verde Sereno, LLC, on Lot 2 to be
included as part of Lot R owned by the City of Palm Springs, as shown in Figure 3.

Staff recommends that the City Council approve LLA 16-03 facilitating the transfer of
two small portions of Lot 2 owned by Alta Verde Sereno, LLC, to Lot R owned by the
City of Palm Springs, to align the property line with the existing concrete block wall
previously constructed between the two properties. A copy of LLA 16-03 is included as
Attachment 1.
ENVIRONMENTAL IMPACT:
Section 21084 of the California Public Resources Code requires Guidelines for
Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines
are required to include a list of classes of projects which have been determined not to
have a significant effect on the environment and which are exempt from the provisions
of CEQA. In response to that mandate, the Secretary for Resources identified classes
of projects that do not have a significant effect on the environment, and are declared to
be categorically exempt from the requirement for the preparation of environmental
documents. In accordance with Section 15305 "Minor Alterations in Land Use
Limitations," Class 5 projects consist of(a) minor lot line adjustments, side yard, and set
back variances not resulting in the creation of any new parcel; therefore, approval of
LLA 16-03 is considered categorically exempt from CEQA,
