SUMMARY:
On May 25, 2016, the Planning Commission granted a Conditional Use Permit to allow
an 8,136 square foot liquor store known as Bev Mo! In Suite #4 located at 333 South
Palm Canyon Drive (J.W. Robinson's Department Store), a Class 1 Historic Site.
Because the census tract in which the Bev Mo! Is to be located is deemed by the
Alcoholic Beverage Control Board (ABC) to have an "overconcentration" of alcohol
licenses, the applicant is requesting the City Council adopt a Resolution of Public
Convenience or Necessity (PCN) allowing the sale of alcohol at this location.
RECOMMENDATION:
1) Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT PUBLIC
CONVENIENCE WOULD BE SERVED BY THE ISSUANCE OF ALCOHOLIC

SUBJECT SITE
PROJECT DESCRIPTION:
Bev Mol is a retailer specializing in wine, spirits, beer, gourmet food and other related
items such as glassware and wine accessories. The California Department of Alcohol
Beverage Control (ABC) requires three license types for Bev Mol, which are as follows:
Type 21 (General Off-Sale), Type 42 (On-Sale Beer and Wine, Public Premise), and
Type 86 (Instructional Tasting). Currently there is an overconcentration of these liquor
license types within the Census Tract that encompasses the Central Business District.
Because of the overconcentration, the City Council can adopt a Resolution of Public
Convenience or Necessity (PCN) granting approval for the issuance of these liquor
licenses.
Bev Mo! will occupy suite #4 equaling 8,136-square feet in size. The proposed hours of
operation are to be from 7:00 AM to 11:00 PM seven days a week. This suite is at the
southern end of the building and will have access from South Palm Canyon Drive and
the large parking lot to the west from Belardo Road. No exterior changes are requested
as part of the PCN and Conditional Use Permit review. The interior layout will be a
series of display racks, built-in coolers, and check-out areas.
The J.W. Robinson Building was designated a Class 1 historic property in 2013. The
building was designed by the Los Angeles-based architectural firm of Luckman &
Pereira (with Max R. Horwitz as the credited designer), and further notes that the

building's stylistic markers place it directly in the historic context of Palm Springs'
Modern Period. One of the city's better-known commercial buildings, the structure is a
prime, largely intact example of the significant modernist architecture for which Palm
Springs is widely known. The building also expresses the post-war and pre-mall retailing
era of the 1950's and '60's when major stores were located in downtown (including
Bullock's Wilshire, Saks Fifth Avenue, I. Magnin, and Joseph Magnin on Palm Canyon
Drive).
The historic building recently received a Certificate of Approval from the Historic Site
Preservation Board (HSPB) to rehabilitate the structure to include the building exterior,
new paint, site landscaping and renovation of the building interior. In addition, a sign
program was approved by the Planning Commission providing guidelines to future
tenants on permitted signage. The approved CUP application is for the placement of a
liquor store at this address and does not request any modifications to the building
exterior.

office uses at a higher concentration, density, and intensity
than in other areas of the City. The CBD serves as the main
activity center and cultural core of the community and, as
such, theatres, museums, retail, and other entertainment
venues are encouraged here. Uses such as grocery stores,
hardware stores, and convenience or pharmacy stores that
provide services to the Downtown's residential population are
also encouraged. The Central Business District is subdivided
into zones or areas that provide for diversity in development
standards and land use intensities. These subareas are
defined in Appendix A, Downtown Urban Design Plan.

Permitted Uses:
The subject property is zoned CBD (Central Business District). Pursuant to Section 92.09.01(D)(11) of the Palm
Springs Zoning Code PSZC , Liquor Stores are permitted with the approval of a Conditional Use Permit.

Off-street Parking:
The building parking lot is located on the west end of the property and contains 70 off-street parking spaces.
Pursuant to Section 92.26.00(C)(5) of the PSZC, retail requires one (1) space per 400-square feet of retail area
equaling 70 spaces. Based on this calculation the parking lot conforms to the PSZC as set forth in the Downtown
Parking Combining Zone.
ANALYSIS:
The applicant has applied for three liquor license types a "Type 21"; "Type 42"; and
"Type 86" through the State of California Department of Alcoholic Beverage Control
(ABC) for the proposed sale of alcoholic beverages. The ABC summarizes the licenses
as follows:
"Type 21" license as follows:
"OFF-SALE GENERAL - (Package Store) Authorizes the sale of beer and
wine for consumption off the premises where sold. Minors are allowed on
the premises."
"Type 42" license as follows:
"ON SALE BEER & WINE — PUBLIC PREMISES — (Bar, Tavern)
Authorizes the sale of beer and wine for consumption on or off the
premises where sold."
"Type 86" License as follows:
'INSTRUCTIONAL TASTING — Allows a licensed retailer to provide
instructional tastings of alcoholic beverages to consumers under very
specific conditions, restrictions, and limitations."
The proposed alcohol licenses are located within a Census tract that exceeds the
amount of on-sale licenses normally permitted; this is known as an "undue
concentration" and is specifically defined by Section 23958.4 of the Business and
Professions Code:
As to off-sale retail license applications, the ratio of off-sale retail licenses
to population in the census tract or census division in which the applicant
premises are located exceeds the ratio of off-sale retail licenses to
population in the county in which the applicant premises are located.
The subject property is located within Census Tract #0446.06, which is bounded by
developed area south of Tramway Road to Ramon Road and Indian Canyon Drive and

the Mountain on the west. The map below shows the partial boundaries of this large
census tract which encompasses most of the downtown area.

The ABC has issued six (6) "Type 21" licenses for liquor stores which are as follows:
1. Palm Springs Liquor - 1200 N. Palm Canyon Drive
2. Las Palmas Liquor - 1595 N. Palm Canyon Drive
3. Cork N Bottle - 342 N. Palm Canyon Drive
4. 7-Eleven - 150 W. Vista Chino
5. Larry's Liquor Store - 2781 N. Palm Canyon Drive
6. Rite Aide - 366 S. Palm Canyon Drive
The ABC can only issue the proposed alcohol license if the Council determines that the
public convenience or necessity would be served by the additional license within this
census tract.
Since the property is located within the Central Business District (CBD) in an existing
commercial shopping center, staff believes that the additional alcohol license is
consistent with the desired mix of commercial uses in this Census tract and will serve
the public convenience.

THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS:
A. Beverages and More, Inc., DBA Bev Mo! ("Applicant') has applied for Type 21
(General Off-Sale); Type 42 (On-Sale Beer and Wine, Public Premise); and Type 86
(Instructional Tasting) licenses from the State of California Department of Alcoholic
Beverage Control (ABC) for the sale of beer, wine and distilled spirits at 333 South Palm
Canyon Drive, Suite #4, Census Tract #0446.06, Zone CBD, Section 15/T4/R4.
B. ABC staff has determined that there is an "undue concentration" of alcohol-
related licenses in the Census Tract #0446.06.
C. Pursuant to Section 23958.4(b)(2) of the California Business and Professions
Code, the City Council may determine the public convenience or necessity would be
served by the issuance of the requested licenses.
D. The location of the proposed business, within Census Tract #0446.06, is within
the Central Business District and will provide a service to residents and tourists of the
City. The proposed use will not be inconsistent with the desired mix of commercial uses
in this Census tract.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES:
That the public convenience would be served by the issuance of Type 21 (General Off-
Sale); Type 42 (On-Sale Beer and Wine, Public Premise); and Type 86 (Instructional
Tasting) alcoholic beverage licenses for the sale of beer, wine and spirits at Bev Mo!,
located at 333 South Palm Canyon Drive, Suite #4, Census Tract #0446.06, Section
15/T4/R4.

To Whom It May Concern:
This Justification Letter accompanies the BevMo! Conditional Use Permit Application and
provides details of the proposed project and operator.
Proiect Description
BevMo! proposes an 8,260 square foot store in the south end of an existing building located at
333 South Palm Canyon Drive, which was most recently occupied by The Alley. There is ample
customer parking on the west side of the building. Deliveries to the store will also take place
from this parking area. Attached as Exhibit A are photos of some of our recently remodeled
stores. We intend to use the same interior designs in this new store.
Information
BevMo! anticipates hiring 10-20 employees, with the possibility of additional seasonal
employees hired during the holidays. The hours of operation will be 7:00 a.m. to 11:00 p.m.
daily. BevMo! operates over one hundred retail locations in California with the location closest
to this proposed site at 79715 Highway 111, La Quinta, CA.
BevMo! will be working closely with the California Department of Alcoholic Beverage Control f
to obtain the required alcohol retail and tasting licenses. BevMo! requires three types of licenses
to operate: Type 21 (General Off-Sale), Type 42 (On-Sale Beer and Wine, Public Premise) and a
Type 86 (Instructional Tasting). The Type 21 license is the primary license, which allows
BevMol to sell beer, wine and spirits for off-premise consumption. In addition to the Type 21
off-premises license, BevMo! requires a license Type 42 (On-Sale Beer and Wine, Public g
Premises) for educational beer and wine tastings and a Type 86 (Educational Tasting License) g
for spirits tastings. BevMo! operates the tasting program in a manner consistent with educating
the customer—it is not intended to be a bar or lounge atmosphere. Sample sizes (1oz samples of

for tastings are limited (typically tastings are conducted on Friday evening and Saturday
afternoon, with occasional special event tastings during the week).
Findings
Palm Springs Zoning Code ("PSZC") 94.02.00(B)(6) imposes a number of requirements for a
Conditional Use Permit which this project meets. This use applied for at this location is properly
one for which a conditional use permit is authorized by the PSZC in 92.09.01(D)(I 1).
The use is necessary or desirable for the development of the community, is in harmony with the
various elements or objectives of the general plan, and is not detrimental to existing uses or to
future uses specifically permitted in the zone in which the proposed use is to be located for the
following reasons. BevMo! is the largest specialty retailer of wine in California and was
awarded Retailer of the Year in 2006 by Wine Enthusiast, and in 2009 was awarded the Market
Watch Leader Award for management. BevMo! offers a convenient and unique store for local
residents to browse an extensive inventory of wine, spirits, beer, gourmet food and related items
such as glassware and other wine accessories. In fact, BevMo! was recently recognized as selling
more fresh caviar than any other California retailer. A typical BevMo! store offers over 3,000
wines (1,000 from California), 1,200 specialty spirits, 600 beers (including a large selection of
"craft" and imported beers), and over 2,000 "& More"products (cheese, party accessories,
caviar, etc.). The proposed store will provide Palm Springs customers with a convenient new
place to shop in a well-lit and maintained facility.
BevMol is a responsible, contributing member of the community. The store will have a positive
influence on the local economy by providing jobs and retail tax revenue to the City, as well as
competitive pricing to the consumer. BevMo! is committed to the responsible marketing of
alcoholic beverage products, which is demonstrated by:
1) Our hours of operation are limited. We are open from lam-I Ipro.
2) Our company policy prohibits the sale of cigarettes and products of abuse (such as
40 oz. of malt liquor, low-priced, screw-top fortified wines such as
"Thunderbird").
3) Our company policy prohibits the use of video or pinball games, sales of
pornographic material, pay telephones, lottery tickets, newspaper stands and other
products that would encourage loitering or products that would attract minors to
the store.
4) Our company posts and maintains a professional quality sign stating "No
Loitering", "No public drinking of alcoholic beverages", and "Stop you must be
21 to enter unless accompanied by an adult."

5) We do not allow minors to enter our store without a parent and it is store policy to
card anyone who appears to be under the age of 50.
6) Every cash register and our tasting areas are equipped with ID scanners which
assist our associates with identifying expired or fraudulent IDs.
7) We operate our own decoy sale-to-minor program, and implement extensive ID
check training of our employees.
Our policies have led to an excellent track record with the California Department of Alcoholic
Beverage Control.
The site for the intended use is adequate in size and shape to accommodate such use, including
yards, setbacks, walls or fences, landscaping and other features required in order to adjust such
use to those existing or permitted future uses of land in the neighborhood. Indeed the project
does not propose any exterior changes to the site. Minor tenant improvements may be required
to conform to the requirement of the Alcoholic Beverage Control licenses. Adjustments to the
project site will be internal.
The site for the proposed use relates to streets and highways properly designed and improved to
carry the type and quantity of traffic to be generated by the proposed use. The project is located
along South Palm Canyon Drive, which is designated as a Major Thoroughfare on the General
Plan Circulation Element. The existing streets will be able to accommodate the proposed use, as
the previous uses have proven.
Public Convenience or Necessity
In addition to a Conditional Use Permit, BevMo! requires a Letter of Public Convenience from
the City of Palm Springs due to the overconcentration of licenses in this census tract (446.06). A
review of the existing licenses in this census tract shows that BevMo! would be a unique new
operator in the area, bringing convenience to consumers who would otherwise have to go
elsewhere for the breadth of selection and the services BevMo! offers. For example, of the ten
(10) off-sale licensees in this census tract, only six (6) licensees offer beer, wine and spirits (the
other four(4) licensees only offer beer and wine). Of these six, none offer in-store educational
tastings for their customers and do not offer the breadth of selection that BevMo! offers. In
addition, of the ninety-four(94) on-sale licenses, only one is a Type 42 licensee (Fame
Tobacconist) which operates under an entirely different business model (i.e., more of a fine cigar
and beer and wine bar than a specialty off-sale retailer) than what BevMo! would bring to Palm
Springs.
Finally, permitting the sale of alcoholic beverages and offering tastings at this location will
provide residents with a convenient, well-maintained facility, with reasonable prices that will
have a positive impact on the local economy and community. We therefore respectfully request
