TO 7:00 A.M. FROM MONDAY THRU FRIDAY FOR CERTAIN WORK ACTIVITIES AT THE ANDAZ HOTEL CONSTRUCTION SITE FROM JUNE 20, 2016, THROUGH NOVEMBER 3, 2016 FROM: David H. Ready, City Manager BY: Office of the City Manager SUMMARY At the June 1, 2016, City Council meeting, the City Council considered a request from Penta Building Group, the General Contractor responsible for construction of the Andaz Hotel for Rael Development Corporation, ("Penta"), for an early construction start time of 12:00 A.M. Monday through Friday beginning June 2, 2016, and extending to November 3, 2016. At the meeting, the City Council continued consideration of the item until the June 15, 2016, meeting, and requested that Penta provide notice to property owners within 500 feet of the boundary of the project site. Accordingly, Penta has mailed notice to all property owners within 500 feet of the project site, including two hotels beyond the 500 feet boundary: Alcazar and Triada. At the recommendation of staff, Penta has revised its request for an early construction start time of 12:00 A.M., and is now requesting an early construction start time of 3:00 A.M. Chapter 8.04.220 of the Palm Springs Municipal Code limits the hours of construction from 7:00 a.m. to 7:00 p.m. Monday thru Friday, unless the construction work complies with the terms of a written early work permit issued by the Building Official upon a showing of sufficient need due to circumstances of an unusual or compelling nature. In this case, the Building Official will be approving an early start to construction in consideration of the need to proceed with high volume of continuous concrete construction for reinforced concrete floors, columns and decks that cannot occur during high ambient heat, and to address exposure of construction workers to high heat during the summer months, subject to continuous monitoring of noise complaints and impacts to adjacent properties and businesses. STAFF ANALYSIS: The Andaz Hotel has commenced construction, and as a reinforced concrete structure, will require placement of over 15,000 cubic yards of concrete and 2.1 million pounds of reinforcing steel. This type of construction is relatively unique to Palm Springs in the scope and quantity, and proceeding with reinforced concrete construction of this magnitude during the summer months is a challenge given restrictions on concrete construction methods limiting exposure to concrete at higher temperatures, and the need to protect concrete while curing from such higher temperatures. Penta has submitted a revised request for an early construction start of 3:00 A.M. to 7:00 A.M. for a period extending from June 20 to November 3, 2016, to allow for scheduling of continuous concrete pours for concrete footings, concrete columns, and elevated concrete podium decks for the multi-story structure, and for placement of reinforcing steel in advance of the subsequent concrete pour scheduled. Penta has submitted a revised request for an early construction start time, which is included as Attachment 1. A 500 feet radius location map of the construction site is provided in Figure 1. +�Y r Ax Figure 1 02 City Council Staff Report June 15, 2016-- Page 3 Report on Approval of Early Construction Start Time Andaz Hotel Permitted construction hours per the Palm Springs Municipal Code 8.04.220 are listed in the table below: Permitted Hours of Construction Sundays& Weekdays Saturday Holidays* 7 a.m. to 7 p.m. 8 a.m. to 5 Not permitted p.m. "Thanksgiving Day, Christmas Day, New Years Day,July 4", Labor Day and Memorial Day Certain exceptions to these construction hours are allowed in the Municipal Code, including exception (2): (2) Construction work complying with the terms of a written early work permit which may be issued by the building official upon a showing of sufficient need due to circumstances of an unusual or compelling nature; Penta has requested an early start for construction (at 3 AM) to accommodate the anticipated construction which includes setting and forming 2.1 million pounds of steel reinforcing bar, and placing over 15,000 cubic yards of concrete in multiple phases of continuous concrete pours. A copy of the request submitted by Penta Building Group is included as Attachment 1 . Included with the request is a tentative construction schedule that outlines an aggressive and sequential schedule with the following sequence: • Preparation of concrete foundations commencing May 16 through June 29, wherein that period of time four separate concrete pours of 2-3 days would occur; • Preparation of concrete columns commencing June 6 through July 13, wherein that period of time four separate concrete pours of 2-3 days would occur; • Preparation of concrete shear walls commencing June 6 through July 29, wherein that period of time five separate concrete pours of 2-3 days would occur; • Preparation of elevated concrete podium decks commencing July 6 through November 3, wherein that period of time ten separate concrete pours of 2-3 days would occur Construction will also require specific staging and detour of pedestrian traffic around the site; in order to maintain pedestrian traffic, the existing parking lanes adjacent to the site on N. Palm Canyon Dr. and Indian Canyon Dr. will be eliminated and a secured and barricaded pedestrian path of travel will be established. The entire frontage of the streets adjacent to the project site will be removed and reconstructed to accommodate the new Andaz Hotel. During this time, parking will be temporarily eliminated adjacent to the site; however, existing travel lanes will remain open. 03 City Council Staff Report June 15, 2016 -- Page 4 Report on Approval of Early Construction Start Time Andaz Hotel The Building Official is recommending approval of the early start time, to allow for staging of concrete trucks during the continuous multiple-hour concrete pours that will occur periodically throughout the summer. Given the volume of concrete to be placed, with one concrete truck holding 10 cubic yards, throughout the duration of the construction approximately 1,500 concrete trucks will need to be staged on either Palm Canyon Drive or Indian Canyon Drive in sequence to provide a continuous supply of concrete during this construction schedule. It is estimated that approximately 10 concrete trucks per hour would stage during the separate continuous concrete pours. Staging this work during the early morning hours will help to minimize disruption to traffic that otherwise would occur if the normal work hour start of 7:00 AM was maintained. Early morning work will also require temporary outdoor lighting, which may impact adjacent properties. To mitigate the noise associated with these trades, the Building Official is recommending that the Penta monitor the use of back-up alarms and radios, and make every effort to minimize construction traffic on adjacent streets on days when continuous concrete pours are not scheduled. The Building Official's approval is contingent on Penta cooperating with the community, and to periodically meet with the Main Street merchants and affected residents to discuss any needed changes to address light and noise impacts and construction activities affecting businesses during the early morning hours. An official notice from Penta was mailed on June 7, 2016, to all property owners located within 500 feet of the property boundary, including the Andaz Hotel and Triada Hotel. The notice identified the City Council's consideration of this request at the June 15, 2016, City Council meeting, and includes a contact list of Penta staff for registering complaints and concerns during construction. The contact list includes a City contact within the Office of the City Manager; a copy of the notice is included as Attachment 2, and a copy of the mailing list is included as Attachment 3. Parcels AMADORD Penta attended the Main Street merchants meeting on June 7, and informed various merchants and businesses regarding their request for an early construction start time during the summer. Penta has also communicated with members of the Old Las Palmas and Movie Colony neighborhoods, and has received an indication of support to their request from some of its members via email, included as Attachment 4. Penta also attended the ONE-PS meeting on June 9 to advise the neighborhood officials of their request for early construction start time. 05 City Council Staff Report June 15, 2016-- Page 6 Report on Approval of Early Construction Start Time Andaz Hotel Alternatively, if the early construction start time is not approved by the Building Official, Penta Building Group has advised that the construction will be delayed by 10 weeks until the ambient temperatures reduce, which would delay commencement of construction into the holiday season. ENVIRONMENTAL IMPACT: On April 2, 2014, the City Council adopted Resolution No. 23527, approving an amendment to Case No. 5.1091, Planned Development District 324, and related entitlements associated with the development of a 150 room hotel, and finding that the previously adopted Mitigated Negative Declaration Number 2006109031 as sufficient and appropriate environmental documentation for the proposed amendment to Planned Development District 324. PENTA appeared in front of the City Council on June 1 to discuss this variance.At the City Council's request PENTA has sent a letter to all property owners,the list of addresses was supplied by the City of Palm Springs, within a 500-foot radius of the project site. We also have attended the Main Street Merchants meeting on June 71h and ONE-PS meeting on June 9`^.At both of these meetings,we explained the procedures that we will be taking to control noise, explained the concrete truck route, supplied the members with 24 hours a day phone numbers, and answered all questions. Both groups were very supportive of our request and are happy that PENTA is trying to complete this project with as little impact as possible to the City of Palm Springs. PENTA also has scheduled to visit the nearby businesses in person to discuss the early work hours. We have attached two exhibits to this letter. First,the truck route that the concrete trucks will be following. This route has changed since the last City Council meeting because the concrete subcontractor has found a ready mix company that can better service the project allowing for short daily duration of the concrete involved activities. The second exhibit is logistics plan for the layout of the temporary light towers.All light towers will be angled down to avoid direct light into the surrounding areas. Another critical portion of the construction work is the location of the job site fence.This fence protects the public,tourists, and residents of Palm Springs from construction activities. PENTA is requesting to move the jobsite fence to the curb and gutter line. We will place temporary Jersey Barriers along Indian Canyon Drive and Palm Canyon Drive along with proper signage to provide the public,tourists, and residents a safe path of travel around the job site.This plan will not affect vehicular traffic but will consume street parking around the project site. Palm Canyon Dr. / Alejo Road, and has commenced work on this exciting project. PENTA is committed to properly and safely complete all aspects of construction on its projects, and the Andaz Hotel Palm Springs is no exception. As construction of this exciting project has started during the heat of the summer, PENTA has requested that the City Council consider approval of extended (early) construction hours to properly and safely build the Andaz Hotel Palm Springs. The City Council will consider this request at its June 15, 2016, meeting. This notification is being sent to you to advise you of our request and its implications for potential temporary impacts to you during construction of the Andaz Hotel Palm Springs. The Initial phase of construction of the Andaz Hotel Palm Springs is a reinforced concrete parking structure concrete that will consist of concrete and reinforcing steel, which Penta is dedicated to construct expeditiously and with as much noise abatement as possible. PENTA is requesting an early construction work hours start time of 3:00 AM for concrete placement activities, installation of reinforcing steel and formwork to avoid impacts those activities would have during the regular business day. First and foremost, consideration is for the safety of the City's tourists and residents, as well as the life safety of all construction crews. It is imperative technically that the pouring of concrete occur in cooler hours and by bringing materials and equipment onto the project site early when there is far less vehicular traffic and pedestrians is the safest method for all. The volume of concrete material is significant with 10-12 trucks per hour when concrete is periodically placed. Scheduling this work earlier in the morning minimizes traffic impacts while promoting the safety of the public and our construction workers. PENTA is dedicated to minimizing the noise that will be generated during these extended (early) construction hours. PENTA will make proper and safe arrangements to shut off concrete trucks backup alarms and generally do everything possible to abate noise during these early hours. PENTA is also dedicated to minimizing light and glare that will be generated by its light towers required to illuminate the work site at night. We expect to be complete with this aspect of construction within 100 days of starting which is planned to occur on or before June 25th. He is the Project Manager for the Andaz Hotel under construction at Alejo, between Palm Canyon and Indian Canyon. Andaz is in the process of pouring concrete. Heat is an issue in the pouring of concrete. Another issue is the traffic load of the concrete trucks on the adjacent streets. As such, they are requesting City Council allow construction during the late night and early evening hours. City Council discussed the request on June 1, without reaching a decision. The question will be back before City Council on June 15. Jeff has asked for an opportunity to meet with neighborhood leaders near the construction site. I agreed to provide an introduction. In addition to this outreach, Jeff is planning to provide public comment in the ONE-PS meeting on June 9th. It is my understanding that Penta Building Group at the request of City Council is notifying all businesses and residences within 500 feet of the construction site of the June 15 public hearing. For the record, I did advise Jeff there may be push back within ONE-PS and the adjacent neighborhoods to his request for late hour construction.
