SUMMARY:
This is a request for Historic District designation for the Park Imperial South
condominiums, located at 1750 to 1844 South Araby Drive. The 30-unit complex was
designed by Barry Berkus, and was constructed in 1960. The historic resources report
was produced by a resident of the complex, Peter Dixon, in conjunction with the
homeowners association.
The historic resources report proposes that the Park Imperial South condominium
complex meets the City's definition of a historic site as outlined in Palm Springs
Municipal Code (PSMC) Section 8.05.020, on the basis of Criterion 4 (embodying
distinctive characteristics of a type, period, or method of construction) and Criterion 5
(presents the work of a master builder, designer, artist or architect). In addition, the
2004 Citywide Historic Resources Survey identifies the complex for possible nomination
as a historic site.
RECOMMENDATION:
1. Open the public hearing and receive public testimony.
2. Close the public hearing and adopt Resolution #, "A RESOLUTION OF THE
CITY COUNICL OF THE CITY OF PALM SPRINGS, CALIFORNIA,
DESIGNATING THE PARK IMPERIAL SOUTH CONDOMINIUMS, LOCATED
AT 1750 TO 1844 SOUTH ARABY DRIVE, AS HISTORIC DISTRICT HD-6 /

BACKGROUND INFORMATION:
Related Building Permits
A building permit was issued by the City of Palm Springs for the
09/19/1960 construction of the development, describing the work as "frame &
stucco dwelling apartment(s)."
Neighborhood Meeting/Neighborhood Notice
08/31/16 Notices of the public hearing were sent to all property owners within
500 feet of the subject site.

07/25/16 Site inspections by members of the HSPB and City staff.
The Park Imperial South condominiums were originally constructed in 1960, based on
the building permit records of the City of Palm Springs. The complex includes a total of
30 attached units arranged in various groupings across the 3.5 acre site, and includes
covered carports and a common pool area. The complex was designed by Barry
Berkus, and features distinctive folded -plate roofs over the primary living spaces of each
unit. The complex was developed by Richard and Jack Weiss, who developed under
the name of "Trudy Richards," and also developed semi -custom single-family homes in
the Los Angeles and northern Orange County areas.
The 2004 Citywide Historic Resources Survey identified the Park Imperial South
complex for possible nomination as a historic site, upon a recommendation of the
Historic Site Preservation Board in place at the time. The survey indicates that a DPR
(Department of Parks & Recreation) form was prepared as part of the 2004 survey.
ANALYSIS:
The historic resources report was prepared by Peter Dixon, a resident and unit owner at
the Park Imperial South condominiums. Mr. Dixon provides a list of sources used in
compiling the report, and also includes appendices which provide additional supporting
information. Of particular note are Appendices 5 and 6, which provide a detailed
description of alterations to each of the units and any restoration which is necessary.
The analysis contained in this staff report is based on the information provided in the
historic resources report.
Integrity:
The nomination report provides an analysis of the integrity of the buildings within the
complex, utilizing the standards established by the National Register of Historic Places.
The report notes that while most of the elements of historic integrity are in place, minor
alterations to the design and materials of the structures have been made. These
alterations are documented in Appendix 6 of the report, and may serve as guidance for

restoration of the units in the future. The report notes that the site hardscape and pool
area also retain a high degree of integrity; however, a new fence has been added
around the pool area to address safety requirements. The applicant has requested that
the site landscaping not be included as a defining characteristic of the application, as
conversion to drought -tolerant materials is underway.
Historic District and Boundaries
The Park Imperial South complex is being considered for designation as a Historic
District. PSMC Section 8.05.020(b) provides the definition of a historic district as
follows.
Any area of the city of Palm Springs containing a number of structures, natural
features or sites having historic, architectural, archaeological, cultural or
aesthetic significance and designated as an historic district under the provisions
of this chapter.
It has been the practice in the City of Palm Springs to designate condominium
complexes as historic districts when there are multiple buildings within the complex that
are under consideration, rather than historic sites. Other condominium complexes that
have received historic district designation include the Royal Hawaiian Estates
Condominiums, the Racquet Club Cottages West Condominiums, the Pompeii De Las
Palmas Condominiums, and the Sandcliff Garden Apartment Homes. The boundaries
of the district are proposed to be coterminous with the boundaries of the condominium
complex, and a description of the boundary is provided in the draft resolution
accompanying this report.
Defining Characteristics/Contributing Structures:
The physical character -defining features of the complex include the following:
• Folded -plate roof structures (utilizing prefabricated stressed -skin panels) with
clerestory windows;
• Flat roofs with deep, horizontal soffits (for the portion of the structure without the
folded -plate roof);
• Aluminum windows and sliding doors;
• Jalousie windows (where remaining);
• Decorative concrete block walls along the kitchen/garden dining court fagade (the
report notes that standards for conversion of the garden dining court to habitable
space have been adopted by the HOA and have minimal impact on the original
design of the structure);
• Smooth stucco and vertical grooved siding;
• Carport structures; and
• Pool area.
The non-contributing features and structures include the following:
• Patio walls (the report notes that the patio enclosures were originally constructed
of wood panels, and have since been replaced with concrete block walls);

• Patio gates (originally constructed of wood, the HOA has approved the use of a
metal and glass gate);
• Storeroom/pool supply shed (added later);
• Pool fence (added later);
• Landscaping within the complex.
FINDINGS — DEFINITION OF A HISTORIC SITE or DISTRICT
PSMC Section 8.05.020 provides the definition of a historic site; the historic resources
report provides an evaluation of the proposed district in accordance with this definition.
The following analysis identifies conformance to the criteria for consideration for
designation as follows:
(a) Historic Site.
An historic site is any real property such as: a building; a structure, including but not
limited to archways, tiled areas and similar architectural elements; an archaeological
excavation or object that is unique or significant because of its location, design,
setting, materials, workmanship or aesthetic effect and:
1. That is associated with events that have made a meaningful contribution to the
nation, state or community; or
The subject district does not meet this criterion.
2. That is associated with lives of persons who made meaningful contribution to
national, state or local history: or
The subject district does not meet this criterion.
3. That reflects or exemplifies a particular period of the national, state or local
history; or
The report states that the complex is associated with the emergence of
condominium development in post -World War II America, as well as with the
emergence of condominium development in Palm Springs.
4. That embodies the distinctive characteristics of a type, period or method of
construction:
The report notes that the development is exemplary of Mid -Century Modernism,
through its folded -plate roof system, strong horizontal massing, extensive use of
glass walls, and use of decorative concrete block. Of particular interest is the
folded -plate roof system, which is constructed of prefabricated stressed -skin
panels, rather than having been stick -built on site. The report compares the

difference between this method of construction and the method employed by
Donald Wexler for the roofs of his Steel House designs from roughly the same
period.
5. That presents the work of a master builder, designer, artist, or architect whose
individual genius influenced his age; or that possesses high artistic value;
The complex was designed by architect Barry Berkus, who apprenticed with
architect William F. Cody, FAIA, as a student. The Park Imperial South complex
was designed by Mr. Berkus early in his career; the report indicates that Mr.
Berkus' other Palm Springs designs include Park Imperial North Riviera complex
and Merito Manor. Mr. Berkus would later go on to produce over 10,000
residential designs for developments across the U.S., in addition to doing urban
design work in the U.S. and abroad. The Park Imperial South complex would be
the first local historic designation of his Palm Springs work.
6. That represents a significant and distinguishable entity whose components may
lack individual distinction;
The report notes that the complex was designed and built as a complete project;
consequently, the criterion does not apply.
That has yielded or may be likely to yield information important to national, state
or local history or prehistory.
The subject property does not meet this criterion.
FINDINGS — HISTORIC PRESERVATION PURPOSE
PSMC Section 8.05.160 states that the City Council shall find that the purposes of the
Historic Preservation ordinance are furthered by designation of the property as a historic
site or district. The purpose of the Historic Preservation chapter is outlined as follows:
This chapter is adopted pursuant to the authority of (California)
Government Code Section 37361 for the purpose of preserving areas and
specific buildings of the city which reflect elements of its cultural, social,
economic, political, architectural and archaeological history. This chapter
is intended to stabilize and improve buildings, structures or areas which
are considered to be of historical, architectural, archaeological or
ecological value, to foster civic beauty, to strengthen the local economy
and to promote the use of specific buildings for the education and welfare
of the citizens.
Designation of the Park Imperial South complex as a historic district furthers the
purpose of the historic preservation ordinance, in that it preserves a condominium
development that is exemplary of Mid -Century Modern style, represents a distinctive

method of construction through the use of stressed -skin panels for the folded -plate roof,
and preserves a notable example of the early work of architect Barry Berkus. Based on
findings, the complex qualifies for historic district designation pursuant to the criteria
listed in PSMC Chapter 8.05.
ENVIRONMENTAL ANALYSIS:
The proposed historic site designation is not subject to the California Environmental
Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a
direct or reasonably foreseeable indirect physical change in the environment) and
15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical changes to the environment, directly or indirectly.
NOTIFICATION:
Pursuant to PSMC Section 8.05.140, all property owners within 500 feet of the subject
property have been notified, and pursuant to PSZC Section 94.04, recognized
neighborhood organizations within a half mile radius have been noticed. Furhtermore,
notice was made in a newspaper of general circulation.
CONCLUSION:
As provided in the analysis, the historic resources report identifies that the complex
meets Criterion 4 and Criterion 5 of the definition of a historic site, and furthers the
purpose of the historic preservation ordinance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, DESIGNATING THE PARK
IMPERIAL SOUTH CONDOMINIUM COMPLEX, LOCATED
AT 1750 — 1844 SOUTH ARABY DRIVE, AS HISTORIC
DISTRICT #HD-6, CASE HSPB 103, (COMMON AREA APN
#510-070-031).
THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS:
A. Chapter 8.05 of the Palm Springs Municipal Code (PSMC) allows for the
designation of historic sites and districts.
B. Peter Dixon, on behalf of the Park Imperial South Homeowners Association, filed
an application with the City for historic district designation of the Park Imperial South
condominium complex pursuant to PSMC Chapter 8.05. The application included a
historic resources report, prepared by Peter Dixon, dated February 2016, which is
incorporated herein by reference.
C. In July 2016, members of the Historic Site Preservation Board (HSPB) conducted
guided site inspections of the proposed historic district accompanied by City staff.
D. A significant number of unit owners with the Park Imperial South condominium
complex have indicated support of the proposed historic district designation.
E. A notice of a public hearing of the HSPB of the City of Palm Springs to consider
designation of the Park Imperial South condominium complex was issued in accordance
with applicable law.
F. On September 13, 2016, the HSPB conducted a public hearing in accordance
with applicable law to consider designation of the Park Imperial South condominium
complex as a historic district, and at the hearing, voted to recommend that the City
Council designate the complex as Historic District #HD-6 (Case HSPB #103).
G. A notice of public hearing of the City Council of the City of Palm Springs,
California to consider designation of the Park Imperial South Condominium complex
was issued in accordance with applicable law.
H. On October 5, 2016, the City Council conducted a public hearing in accordance
with applicable law to consider designation of the Park Imperial South condominium
complex as a historic district, and at the hearing, voted to designate the Park Imperial
South condominium complex as Historic District #HD-6 (Case HSPB #103).
I. The proposed historic district designation is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)

and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no

J. Pursuant to PSMC Section 8.05.160, the City Council, in evaluating a historic
district application, must find that the designation of the site or district supports or
furthers the purpose of the Historic Preservation Ordinance. As stated in Section
8.05.010, "Purpose and Authority," the Historic Preservation Ordinance is:
...For the purpose of preserving areas and specific buildings of the city
which reflect elements of its cultural, social, economic, political,
architectural and archaeological history. This chapter is intended to
stabilize and improve buildings, structures or areas which are considered
to be of historical, architectural, archaeological or ecological value; to
foster civic beauty, to strengthen the local economy and to promote the
use of specific buildings for the education and welfare of the citizens.
Designation of the Park Imperial South condominium complex as a historic district
furthers the purpose of the historic preservation ordinance, in that it preserves a
condominium development that is exemplary of Mid -Century Modern style, represents a
distinctive method of construction through the use of stressed -skin panels for the folded -
plate roof, and preserves the early work of architect Barry Berkus. Based on findings,
the complex qualifies for historic district designation pursuant to the criteria listed in

City to be considered for possible historic district designation, it must contain a number

district and individually treated as Class 1 historic structures pursuant to
PSMC Section 8.05.125.
2. The carport structures shall also be treated as Contributing Structures.
3. The swimming pool and pool deck shall be treated as Contributing Structures.

Based upon the foregoing, the City Council hereby designates the Park Imperial South
condominium complex located at 1750 to 1844 South Araby Drive as HSPB #103,
Historic District #HD-6.

At the Historic Site Preservation Board meeting of the City of Palm Springs, held
September 13, 2016, the Historic Site Preservation Board took the following action:

DISCUSSION:
Director Fagg summarized the staff report.
Member Dixon asked if formal notices should be required in sales documents
when units go up for sale informing prospective buyers of the regulations under
8.05. (Director Fagg noted staff can review this question with the City Attorney
what can be imposed in conditions and the HOA's CC&R's, he also suggested
the Board consider outreach to educate the realtors in the community.)
Member Dixon noted how impressed she was with the minimal amount of change
that has happened to the complex.
Chair Johns opened the public hearing.
PETER DIXON, resident at Park Imperial South spoke in support of the
nomination and clarified the changes that have been approved by the HOA for
enclosing the courtyards.
Member La Voie & Mr. Dixon discussed the details at the decorative masonry
walls added to enclose the courtyards. Specifically the handling of the original
openings in the masonry screen walls ("breezeblock").
Chair Johns complimented Mr. Dixon's thoroughness in the report identifying the
non-contributing modifications previously made in the complex.
RICK FELIPE, president of HOA and resident. Spoke in support of the
nomination and noted they were writing a new design guideline for assisting
those residents considering making modifications to their units. In terms of the
"breezeblock" Mr. Felipe noted the HOA has adopted two options for infill, one
with glass block, one solid, but set back or darkened to visually be similar to the
original open condition. Mr. Felipe shared a conversation he had with the late
Mr. Burkus who admitted the scale and enclosure of the patios was somewhat a
failure.

BARRY SWEIGER, owner in Park Imperial South, spoke in support of the
nomination. He also noted the relatively low density of the complex with ample
open space is an important characteristic of the complex and of the era when
land prices were low and allowed more open space than contemporary
developments. He also noted the unique characteristic of the expansive glass
walls facing a private courtyard, not a golf course, and not small windows
typically seen in conventional buildings. He also noted the detailing of the beams
at the carports, as being unique.
Hearing no other testimony, Chair Johns closed the public hearing
Member Dixon asked about solar panels on historic structures. Member La Voie
explained the state law that requires that homeowners who wish to install solar
panels, be allowed do so. Staff member Lyon also clarified the City Attorney's
opinion on solar panels, noting that the HOA or city cannot deny a request to
install solar panels, but can specific placement and screening of the panels.
ACTION:
M/S/C (La Voie / Dixon, 6-0-1 (Hays absent) to recommend approval of the Park
Imperial South Condominiums as a historic district, recommending Class 1
regulations be incorporated into the HOA's CC&R's, incorporating by reference
the historic resources report which includes documentation of the non-
conforming existing elements, and the condition that future changes to the
exteriors be consistent with The U. S. Department of the Interior, Secretary's
Standards for the Treatment of Historic Sites & Districts.

1750 — 1844 SOUTH ARABY DRIVE

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will hold
a Public Hearing at its meeting of October 5, 2016. The City Council meeting begins at 6:00 p.m.
in the City Council Chamber at City Hall, 3200 East Tahquitz Canyon Way, Palm Springs.
The purpose of the hearing is to consider a recommendation by the Historic Site Preservation
Board for Historic District designation of the Park Imperial South Condominiums (Case HSPB 103 /
HD-6). The district boundaries are proposed to encompass the 3.5 acre site that comprises the
Park Imperial South condominium development, which is located southeast of the intersection of
East Palm Canyon Drive and South Araby Drive.
ENVIRONMENTAL DETERMINATION: This request is not subject to the California Environmental
Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or
reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity
is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical changes to
the environment directly or indirectly.
REVIEW OF PROJECT INFORMATION: The staff report and other supporting documents
regarding this project are available for public review at City Hall between the hours of 8:00 a.m.
and 6:00 p.m., Monday through Thursday. Please contact the Office of the City Clerk at
(760) 323-8204 if you would like to schedule an appointment to review these documents.
COMMENT ON THIS APPLICATION: Response to this notice may be made verbally at the Public
Hearing and/or in writing before the hearing. Written comments may be made to the City Council
