Ready, City Manager BY: Department of Human Resources SUMMARY: The City Council delegated responsibility of determining and certifying applications and requests relating to disability retirement of local safety members to the City Manager on January 9, 1974, by Resolution No. 10959. CalPERS has requested an updated resolution signed by the Mayor of the City of Palm Springs. RECOMMENDATION: 1 . Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DELEGATING THE CITY MANAGER AUTHORITY TO MAKE CERTAIN DETERMINATIONS, CERTIFICATIONS, APPLICATIONS AND REQUESTS RELATING TO DISABILITY RETIREMENT OF LOCAL SAFETY MEMBERS. 2. Authorize the Mayor to sign the resolution. STAFF ANALYSIS: In accordance with Section 21023.6 of the Government Code, the governing body of an agency or an official delegated by the governing agency, must determine whether a safety member of the California Public Employees' Retirement System (CaIPERS) is disabled and must be retired when the conditions causing his or her disability become permanent and stationary. ( 3&6)vYk� '61lGkV- aG !-1711A NO._1L_ City Council Staff Report December 14, 2016 - Page 2 Delegating authority to the City Manager regarding industrial disability retirement Pursuant to a change in CalPERS rules, Resolution No. 10959, adopted on the January 9, 1974, delegating authority to make determinations, certifications, applications, and requests relating to disability retirement of local safety members is no longer valid and needs to be updated and executed by the Mayor of the City of Palm Springs. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DELEGATING THE CITY MANAGER AUTHORITY TO MAKE CERTAIN DETERMINATIONS, CERTIFICATIONS, APPLICATIONS, AND REQUESTS RELATING TO DISABILITY RETIREMENT OF LOCAL SAFETY MEMBERS. WHEREAS, the City of Palm Springs, hereinafter referred to the "City", is a contracting agency of the California Public Employees' Retirement System, hereinafter sometimes referred as "CaIPERS"; and WHEREAS, the City has in its employ certain police officers and firefighters who are classified as local safety members within the meaning of the California Public Employees' Retirement Law; and WHEREAS, the California Public Employees Retirement Law requires that the City determine whether any of its local safety member employees are disabled within the meaning of said Law, and, in the event such disability be found, whether the origin of such disability industrial within the meaning of the Law; and WHEREAS, such determination may lawfully be delegated to the City Manager; and WHEREAS, such determinations in relation to employees of the City other than local safety member employees, are duly delegated to the City Manager; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: Section 1. That the City Manager be delegated the authority to make determinations pursuant to Section 21023.6 of the Government Code, on behalf of the City, of disability and as to whether any such disability is industrial, and to certify such determinations and all other necessary information relating to such determinations to CaIPERS. Section 2. That the City Manager is hereby authorized to make applications to CaIPERS on behalf of the City for disability retirement of employees Resolution No. Page 2 classified as local safety members, and to initiate request for reinstatement of such employees who have been retired for disability.
