The subject property is located within a Census Tract which is identified by the ABC as an area with over concentration of liquor licenses. The applicant is requesting the City Council to make a determination of public convenience or necessity for the sale of beer, wine, and distilled spirits. BACKGROUND AND PROJECT DESCRIPTION: Palm Springs Fan Club, a new 1 ,722 square-foot cocktail lounge, will be established on the west side of Palm Canyon Drive, between the Arrive Hotel (north) and the Draughtsman restaurant (south). The subject site is 6,861 square feet in area. The applicant is requesting a determination of public convenience or necessity for on- site sales and consumption of beer, wine, and distilled spirits for the proposed cocktail lounge in accordance with Division 9. (Alcoholic Beverages) of the State of California Business and Professions Code. The subject property is located within the C-1 (Retail Business) Zone. In this zone, a cocktail lounge use is permitted with a Conditional Use Permit (CUP). The ABC identifies the Type 48 license as follows: ON SALE GENERAL — PUBLIC PREMISES (Bar, Night Club) Authorizes the sale of beer, wine and distilled spirits for consumption on the premises where sold. Authorizes the sale of beer and wine for consumption off the premises where sold. Minors are not allowed to enter and remain (see Section 25663.5 for exception, musicians). Food service is not required. Pursuant to Section 23958 of the State of California Business and Professions Code, the California Department of Alcoholic Beverage Control (ABC) is required to "...deny an application for a license if issuance of that license would tend to create a law enforcement problem, or if issuance would result in or add to an undue concentration of licenses, except as provided in Section 23958.4." Section 23958.4(a) of the Code defines undue concentration as follows: As to on-sale retail license applications, the ratio of on-sale retail licenses to population in the census tract or census division in which the applicant premises are located exceeds the ratio of on-sale retail licenses to population in the county in which the applicant premises are located. The Section further states that a license may be issued when "...the local governing body of the area in which the applicant premises are located, or its designated subordinate officer or body, determines within 90 days of notification of a completed application that public convenience or necessity would be served by the issuance..." (State of California Business and Professions Code, Section 23958.4(b)(2)). The subject property is located within Census Tract No. 446.06, which is identified as the west side of the north portion of Palm Canyon Drive that includes parts of Uptown and Downtown neighborhoods. According to the ABC, there are ninety-six (96) on-sale liquor licenses issued within this Census tract while only two (2) such licenses would be allowed. Hence, the applicant is requesting a determination of public convenience or necessity for the liquor license required for the operation of the cocktail lounge. According to the Palm Springs 2007 General Plan Land Use Element, the land use designation of the subject property is MU (Mixed-Use/Multi-Use). The General Plan further states the intended use of the MU designation area as "community-serving retail commercial, professional offices, service businesses, restaurants, daycare centers, public and quasi-public uses." Located adjacent to the Arrive Hotel to the north and the Draughtsman restaurant to the south, the proposed cocktail lounge will be a new addition to the service-oriented land uses found in the neighborhood. Therefore, the 04 City Council Staff Report Page 5 of 5 January 18, 2017 Case 5.1402 PCN— Palm Springs Fan Club at 1539 and 1541 North Palm Canyon Drive operation of a cocktail lounge will be consistent with the intent of the General Plan Land Use Element for the site and its vicinity. The cocktail lounge will cater not only to the local permanent residents but also to the visitors to the City, including the guests at the Arrive Hotel. According to the business description provided by the applicant in the submitted justification letter, the cocktail lounge will "serve a small menu of upscale alcoholic beverages." This type of land use is consistent with the Palm Springs 2007 General Plan Land Use Element, which aims to "...optimize the themed, charming, eccentric village ambience that will appropriately express the fantasy of Palm Springs as the playground of the rich and famous...at the same time, be appealing to mid-market tastes and profoundly affect the life of the ordinary citizen. It must reflect an array of sophisticated venues of both intimate and popular entertainment' (Palm Springs 2007 General Plan Land Use Element, p. 2-19). Palm Canyon Drive is the major commercial corridor in the Census Tract Map No. 446.06 area. The site is adequate in size and suitable for the proposed cocktail lounge use. Located adjacent to a hotel and a restaurant on Palm Canyon Drive, sales and serving of alcoholic beverages will be consistent with land uses observed in the neighborhood. Additionally, the issuance of the requested license will contribute to diversifying products and services the area has to offer. Considering these elements, staff finds that the issuance of the requested liquor license is suitable for the area and will serve the public convenience. FISCAL IMPACT: No fiscal impact. The following is a letter regarding Section 23958.4 B&P, Public Convenience & Necessary. Business Purpose: "Palm Springs Fan Club"will be the bar located at 1539-1541 North Palm Canyon Drive, Palm Springs, CA 92262. The bar will serve a small menu of upscale alcoholic beverages, with a capacity of 106 guests. The bar will have indoor and outdoor seating. Products and services: The bar is aimed at serving members of the general public and guests of the ARRIVE hotel next door. The bar will operate from I Iam to tam daily. The beverage program will include a wine, craft beer, liquor and mixed cocktail selection. Catering of food may be occasionally provided by third-party vendors. Revenue and Management: We expect 100% of the revenue of the space to come from beverage sales. The management of the bar have substantial experience in food and beverage operations, including the responsible service of alcoholic beverages. On average, we expect that 3 floor staff and 1 manager will be present during a majority operating hours. Management and beverage staff will have all necessary alcoholic beverage certifications. Uniqueness: The area of Palm Springs served by the bar—just north of the Uptown Design District—is traditionally underserved by upscale food and beverage establishments. In fact, this area of Palm Springs has been considered an undesirable area for upscale hospitality development for at least a decade. Palm Grove Group's investment into this area has therefore recognized by the Palm Springs City Council as a significant and important investment into the vitality of an underserved neighborhood and a key pedestrian activation of an underutilized stretch of Palm Canyon Drive. 09 The closest comparable food/beverage establishment is the Bootlegger Tiki bar located at the 1101 N Palm Canyon Dr., Palm Springs, CA 92262. However, that bar's menu is fundamentally different than what will be served at Palm Springs Fan Club, specifically catering to tiki enthusiasts with a tiki-centric menu of craft cocktails.
