Q 9ALMSA ;O 4� ti u v R <f F O City Council Staff Report 4 RN, ■ DATE: February 1, 2017 NEW BUSINESS SUBJECT: Accept a $256,800 donation from Harold Matzner toward the purchase of a Ballistic Engineered Armored Response (B.E.A.R.) Tactical SWAT Vehicle for the Palm Springs Police Department and approve City matching funds to acquire the vehicle from Lenco Armored Vehicles, Inc. FROM: David H. Ready, City Manager BY: Police Department SUMMARY Accept a donation of $256,800 from community resident Harold Matzner, toward the purchase of a B.E.A.R tactical vehicle for the Police Department. This donation represents half of $513,600 purchase price - which along with the City's match of $256,800 will allow for procurement of this specialized piece of tactical equipment. RECOMMENDATION: 1. Accept a $256,800 donation from Harold Matzner toward the purchase of a Lenco B.E.A.R. Tactical Vehicle. 2. Authorize the matching funds of $256,800, for a total of expenditure of $513,600 - to purchase a new Lenco B.E.A.R. tactical vehicle utilizing Cooperative Contract #GS-07F-169DA from Lenco Armored Vehicles of Pittsfield, MA. 3. Approve an appropriation of$256,800 from the General Fund Unappropriated Reserves Balance 4. Authorize the City Manager to execute all necessary documents. STAFF ANALYSIS: Law enforcement agencies across the nation, including California, are preparing for possible terrorist and active-shooter attacks by strengthening, modernizing, and strategically deploying their tactical resources to better protect officers and the public. The recent terrorist/active-shooter incident in San Bernardino, California was an example of how these attacks can occur in any community. The response by law ITEM NO. 5• A City Council Staff Report February 1, 2017 Page 2 Purchase of Lenco BEAR Tactical Vehicle enforcement to that incident showed the value and benefit of having armored tactical vehicles available to protect law enforcement personnel and the public. The purchase of a Lenco B.E.A.R. for the Palm Springs Police Department (PSPD) would provide vital protection to officers and other public safety personnel (firefighters, paramedics, etc.) involved in incidents where a suspect, or suspects, is armed with a firearm, including high-powered rifles. These types of incidents, including terrorist and active-shooter attacks, sometimes require law enforcement personnel and firefighters/paramedics to respond into hot or warm zones to rescue injured officers and/or citizens. Large-scale and high-profile events have also become especially vulnerable to terrorist and active-shooter attacks, as they provide a soft target with thousands of people gathered in a concentrated area. The City of Palm Springs has several of these types of events every year including the Palm Springs International Film Festival, Greater Palm Springs Pride parade, Veterans Day parade, and Festival of Lights parade. Additionally, in nearby Indio, the Coachella, Stagecoach, and Desert Trip concert series attracts hundreds of thousands of people. Desert Regional SWAT (DRS), which PSPD is part of with the Cathedral City and Indio Police Departments, currently utilizes one armored tactical vehicle, a Lenco Bearcat, for all the above-mentioned events and any incident in one of the three cities requiring a tactical response. The Bearcat is 12 years old and has some moderate wear and tear due to its age and constant use over that time. The Bearcat was deployed to the recent incident in Palm Springs (October 2016) where two PSPD police officers were killed and one was wounded by a suspect using a high- powered rifle. At the time of the incident, the Bearcat was in use at the Desert Trip concert series in Indio and had to be immediately deployed to Palm Springs. The Bearcat provided vital cover for officers at the scene during the initial stages of the tactical response and was utilized until the eventual surrender and arrest of the suspect, who was barricaded inside his residence for over 12 hours. The purchase of the Lenco B.E.A.R. will provide the police department with an armored tactical vehicle that will be housed at PSPD and dedicated to the above-mentioned events in the city of Palm Springs. The B.E.A.R. is larger than the smaller Bearcat and can carry more personnel or, in the event of a terrorist or active-shooter incident, rescue more officers and/or citizens. Lenco Armored Vehicles, a Massachusetts-based company, manufactures the B.E.A.R. (and Bearcat) tactical vehicle. The Lenco product has been field tested in countless different tactical scenarios throughout the United States and have proven to be highly 02 City Council Staff Report February 1, 2017 Page 3 Purchase of Lenco BEAR Tactical Vehicle effective in protecting officers against some of the most violent, focused, and aggressive suspects involved in assaults on law enforcement and the public with firearms. FISCAL IMPACT: Lenco holds cooperative purchasing contract #GS-07F-169DA through the Federal General Services Administration. The Procurement and Contracting Manager has verified that this GSA contract falls within Schedule 84 (Public Safety equipment) via the 1122 Program that authorizes local municipal governments to utilize their agreement. As such, this cooperative purchase contract and pricing is in compliance with the provisions of section 7.09.010 of the Municipal Code and the Police Department and Procurement Manager request Council approve the purchase via the authorized cooperative purchasing program. The total cost of the Lenco B.E.A.R., including taxes and shipping, is $513,600 (see attached quote). The donation from Harold M a t z n e r of $256,800 will pay for 50% the cost — with a remaining amount of $256,800 to be paid from City's Motor Vehicle Replacement Fund, 510-5475-50020 — subsequent to an appropriation from the General Fund Unappropriated Reserves Fund.
