SUBJECT: WLA INVESTMENTS INCORPORATED, REQUESTING A CHANGE OF
ZONE FOR AN EXISTING DEVELOPMENT KNOWN AS THE NORTH
VILLAGE CENTER, LOCATED AT 19345-19465 NORTH INDIAN
CANYON DRIVE, ZONE HC, SECTION 15 (CASE 5.1401-ZC).

SUMMARY
The City Council to consider a request by WLA Investments Incorporated to change the
existing zoning from HC (Highway Commercial) to M-2 (Manufacturing Zone). The site
is an existing retail / light industrial development located north of the 1-10 freeway.
RECOMMENDATION:
Introduce on first reading Ordinance No. _, "AN ORDINANCE OF THE CITY OF
PALM SPRINGS, CALIFORNIA, ADOPTING A NEGATIVE DECLARATION (ND) AND
APPROVING A CHANGE OF ZONE FROM HC (HIGHWAY COMMERCIAL) TO M-2
(MANUFACTURING) FOR AN EXISTING LIGHT INDUSTRIAL DEVELOPMENT (APN
666-330-051 & 666-330-053) LOCATED AT 19345-19465 NORTH INDIAN CANYON
DRIVE, SECTION 15."
ISSUES:
The location was previously zoned M-2, prior to annexation to the City of Palm
Springs.
PRIOR ACTIONS:
1. The North Village Center was constructed in 1995 when the location was under
the jurisdiction of Riverside County.
2. On January 25, 2017, the Planning Commission considered the proposal and by
a vote of 7-0, recommended the adoption of a Negative Declaration and approval
of the Change of Zone to the City Council.

PROJECT DESCRIPTION:
The proposed project is a Change of Zone application by the current ownership of the
North Village Center property. The existing zoning designation of the site is HC
(Highway Commercial); the proposed change of zone is to re-designate the property to
M-2 (Manufacturing Zone). The subject property is fully developed with three (3)
detached structures with multi-tenant units. Some of the individual units are currently
occupied by tenants with different uses such as small retail stores, restaurant, liquor
store, office spaces and auto repairs.

BACKGROUND INFORMATION:
The North Village Center development was constructed in 1995 when the location was
still under the jurisdiction of the County of Riverside. At that time, the zoning
designation was M-2; following its annexation to the City of Palm Springs, the site was
rezoned to HC. The new owners of the property requested the change of zone because
the re-designation of the zone will allow existing buildings at the site to be leased out to
for light industrial uses, similar to surrounding developments.

ANALYSIS:
The existing zoning designation of the subject property is HC, which allows for the
development of commercial, hotel, and office uses, but prohibits industrial uses.
Properties to the north and west of the subject site are zoned M-2, which allows
industrial uses. The surrounding properties in the project area are all designated by the
City's General Plan as Regional Business Center. The proposed project is a change of
zone from HC to M-2. This change of zone will allow the existing buildings to be leased
out to businesses that operate under industrial uses, similar to other surrounding
developments. According to Section 92.17.1.00 of the Zoning Code, the M-2 zone is
intended to provide for the development of industrial uses which include fabrication,
manufacturing, assembly or processing which do not in their maintenance, assembly,
manufacture or plant operation create by-products to any degree which will adversely

affect the resort-open space environment of the City of Palm Springs. The M-2 zone
also permits all uses permitted in the C-1 (Retail Business Zone), C-2 (General
Commercial Zone), C-M (Commercial Manufacturing Zone), M-I-P (Planned Research
and Development Park Zone) and M-1 (Service/Manufacturing Zone).
General Plan
The General Plan designation of the site is RBC (Regional Business Center); this
designation is intended to accommodate a wide variety of business activities in a multi-
use setting. According to the General Plan update of 2007, commercial, office and
industrial uses that can be supported by their proximity to the Interstate-10 freeway are
desired in this area. Furthermore, the General Plan designation of RBC allows business
parks and industrial uses. The proposed zoning designation of M-2 will be consistent
with the existing General Plan designation of the property.
Change of Zone
The proposed change of zone is to re-designate a developed site of 7.9 acres in size
from its current HC zoning to M-2. The proposed change of zone is necessary to allow
the type of uses and tenants for which the developed site was originally designed.
Additionally, a change to M-2 zone will also permit those uses allowed in the C-1 (Retail
Business Zone), C-2 (General Commercial Zone), C-M (Commercial Manufacturing
Zone), M-I-P (Planned Research and Development Park Zone) and M-1
(Service/Manufacturing Zone). Findings in support of the change of zone are found in
PSZC Section 94.07.00 (A) as follows:
1. The proposed change of zone is in conformity with the general plan map
and report. Any amendment of the general plan necessitated by the
proposed change of zone should be made according to the procedure
set forth in the State Planning Law either prior to the zone change, or
notice may be given and hearings held on such general plan amendment
concurrently with notice and hearings on the proposed change of zone.
The proposed change of zone is in conformity with the General Plan map and will
further support and serve the General Plan Land Uses of the adjacent and surrounding
properties. The M-2 zone allows a broader range of permitted uses than the HC zone;
the applicant desires more intensive use opportunities that are permitted in the M-2
zone, which conforms to the General Plan designation of RBC. The proposed change of
zone will not require an amendment of the General Plan because the M-2 zoning district
is consistent with the purpose of the RBC designation.
2. The subject property is suitable for the uses permitted in the proposed
zone, in terms of access, size of parcel, relationship to similar or
related uses, and other considerations deemed relevant by the
commission and council.
The existing properties on the site are suited for uses permitted in the proposed M-2
zone; moreover, supporting infrastructure such as roadways and sidewalks already
exist in the area as well. The size of the parcel and structures involved are determined

to be adequate for manufacturing-related uses. The area in which the parcel is located
is a zone in which industrial uses are permitted; existing uses that are consistent with
the uses permitted in the M-2 zone are already in the location. Therefore, staff has
concluded that existing buildings at the site and the parcel are suitable for the uses
permitted in the proposed zone.
3. The proposed change of zone is necessary and proper at this time,
and is not likely to be detrimental to the adjacent property or residents.
The proposed change of zone to M-2 is proper at this time; the change will specifically
allow the property to be leased out to potential businesses that are appropriate within
the M-2 zone. The proposed zone change will not have adverse effects on existing and
future surrounding land uses given that properties to the north and west of the site are
already zoned M-2.
ENVIRONMENTAL ASSESSMENT:
Pursuant to the California Environmental Quality Act (CEQA) Guidelines, the application
has been deemed "a project; an initial study was prepared, notices of the report were
sent to all applicable agencies. At the time of this writing, no comments have been
received. The project was found to have no significant adverse impacts. Thus a Notice
of Intent to Adopt a Negative Declaration will be filed.
NOTIFICATION:
A public hearing notice for this project was advertised; as of the writing of this report,
staff has not received any comment.

19465 NORTH INDIAN CANYON DRIVE, SECTION 15.
A. WLA Investments Inc, (the "Applicant') has filed an application with the
City pursuant to Section 94.07.00 of the Palm Springs Zoning Code for a Change
of Zone from Highway Commercial (HC) to Manufacturing (M-2) for a fully
developed 7.9-acre property known as the North Village Center located at 19345-
19645 North Indian Canyon Drive.
B. The subject property was constructed in 1995; at that time, the location
was under the jurisdiction of the County of Riverside.
C. A notice of the public hearing of the City Council of the City of Palm
Springs, California to consider the proposed change of zone application was
given in accordance with applicable law.
D. On January 25, 2017, a public hearing on the application was held by the
Planning Commission in accordance with applicable law.
E. On January 25, 2017, the Planning Commission adopted Resolution No.
6609. a recommendation to the City Council to approve Case No. 5.1401-CZ.
F. On February 15, 2017, a public hearing on the application for the project
was held by the City Council of the City of Palm Springs.
G. The proposed project is considered a "project' pursuant to the terms of
the California Environmental Quality Act ("CEQA"); an Initial Study and a
Negative Declaration (ND) has been prepared for this project and has been
distributed for public review and comment in accordance with CEQA guidelines.
The Initial Study / ND conclude that the proposed Change of Zone will not have a
significant effect on the environment.
H. The City Council has carefully reviewed and considered all of the
evidence presented in connection with the hearing on the project, including, but
not limited to, the staff report, and all written and oral testimony presents.

THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1:
Pursuant to CEQA, the City Council hereby adopts a Negative Declaration (ND)
and finds that the ND adequately discusses and addresses the known
environmental issues associated with the proposed Change of Zone, including
without limitation, topics such as land use policies, safety, aesthetics, noise
effects and traffic impacts relative to Manufacturing zoning designation.
SECTION 2:
Pursuant to Zoning Code Section 94.07.00(A)—"the council in reviewing a
proposed change of zone shall consider whether the following conditions exist in
reference to the proposed zoning of the subject property".
1. The proposed change of zone is in conformity with the general
plan map and report. Any amendment of the general plan
necessitated by the proposed change of zone should be made
according to the procedure set forth in the State Planning Law
either prior to the zone change, or notice may be given and
hearings held on such general plan amendment concurrently with
notice and hearings on the proposed change of zone.
The proposed change of zone is in conformity with the General Plan map and will

3. The proposed change of zone is necessary and proper at this

The proposed change of zone to M-2 is proper at this time; the change will
specifically allow the property to be leased out to potential businesses that are

adverse effects on existing and future surrounding land uses given that
properties to the north and west of the site are zoned M-2.
SECTION 3:
Pursuant to California Law, an ordinance was prepared for two readings before
Council for the approval of Case 5.1401-CZ Change of Zone and a thirty-day
waiting period before it is effective allowing the approval of Case 5.1401 CZ.
SECTION 4:
The City Council adopts an ordinance to approve the zone map change which
changes the zoning designation from HC (Highway Commercial) to M-2
(Manufacturing) for an existing site containing a business park located at 19345-
19465 North Indian Canyon Drive.
SECTION 5:
Effective Date: This Ordinance shall be in full force and effect thirty (30) days
after passage.
SECTION 6:
Publication: The City Clerk is hereby ordered to and directed to certify to the
passage of this Ordinance, and to cause the same or summary thereof or a
display advertisement, duly prepared according to law, to be published in
accordance with law.

CHAPTER 2: ENVIRONMENTAL ANALYSIS AND DETERMINATION
DETERMINATION: The City of Palm Springs Planning Department
On the basis of this initial evaluation:
® I find that the proposed project COULD NOT have a significant effect on the environment, and a
NEGATIVE DECLARATION will be prepared.
❑ I find that although the proposed project could have a significant effect on the environment
there will not be a significant effect in this case because revisions in the project have been
made by or agreed to by the project proponent. A MITIGATED NEGATIVE DECLARATION will be
prepared.
❑ I find that the proposed project MAY have a significant effect on the environment, and an
ENVIRONMENTAL IMPACT REPORT is required.
❑ I find that the proposed project MAY have a "potentially significant impact" or "potentially
significant unless mitigated" impact on the environment, but at least one effect 1) has been
adequately analyzed in an earlier document pursuant to applicable legal standards, and 2) has
been addressed by mitigation measures based on the earlier analysis as described on attached
sheets. An ENVIRONMENTAL IMPACT REPORT is required, but it must analyze only the effects that
remain to be addressed.
❑ 1 find that although the proposed project could have a significant effect on the environment,
because all potentially significant effects (a) have been analyzed adequately in an earlier EIR or
NEGATIVE DECLARATION pursuant to applicable standards, and (b) have been avoided or
mitigated pursuant to that earlier EIR or NEGATIVE DECLARATION, including revisions or mitigation
measures that are imposed upon the proposed project,nothing further is required.

INITIAL STUDY/MITIGATED NEGATIVE DECLARATION
PURPOSE OF THIS INITIAL STUDY
This Initial Study has been prepared consistent with CEQA Guidelines Section 15063, to determine if the
proposed project, as proposed, may have a significant effect upon the environment. Based upon the
findings contained within this report, the Initial Study will be used in support of the preparation of a
Mitigated Negative Declaration.
EVALUATION OF ENVIRONMENTAL IMPACTS
1) A brief explanation is required for all answers except "No Impact' answers that are adequately
supported by the information sources a lead agency cites in the parentheses following each
question. A "No Impact' answer is adequately supported if the referenced information sources
show that the impact simply does not apply to projects like the one involved (e.g., the project falls
outside a fault rupture zone). A "No Impact' answer should be explained where it is based on
project-specific factors as well as general standards (e.g., the project will not expose sensitive
receptors to pollutants, based on project-specific screening analysis).
2) All answers must take into account the whole action involved, including offsite as well as onsite,
cumulative as well as project-level, indirect as well as direct, and construction as well as operational
impacts.
3) Once the lead agency has determined that a particular physical impact may occur, then the
checklist answers must indicate whether the impact is potentially significant, less than significant with
mitigation, or less than significant. 'Potentially Significant Impact' is appropriate if there is substantial
evidence that an effect may be significant. If there are one or more 'Potentially Significant Impact'
entries when the determination is made, an EIR is required.
4) "Negative Declaration: Potentially Significant Unless Mitigation Incorporated" applies where the
incorporation of mitigation measures has reduced an effect from 'Potentially Significant Impact' to
a "Less Than Significant Impact:'The lead agency must describe the mitigation measures, and briefly
explain how they reduce the effect to a less than significant level mitigation measures from Section
XVII, "Earlier Analyses," may be cross-referenced).
5) Earlier analyses may be used where, pursuant to the tiering, program EIR, or other CEQA process, an
effect has been adequately analyzed in an earlier EIR or negative declaration. Section
15063(c)(3)(D). In this case, a brief discussion should identify the following:
a) Earlier Analysis Used. Identify and state where they are available for review.
b) Impacts Adequately Addressed. Identify which effects from the above checklist were
within the scope of and adequately analyzed in an earlier document pursuant to
applicable legal standards, and state whether such effects were addressed by
mitigation measures based on the earlier analysis.

Discussion of Impacts
a-c) No Impact. The proposed zone change will not physically divide an established community nor will
it conflict with an applicable habitat conservation plan since there will be no new development or
construction and the existing buildings are located in an industrial area.
The proposed zone change would result in the property zoning changing from Highway Commercial
(HC) to Manufacturing (M2) zone. The properties to the north and west are currently zoned as M2.
The City's process of Change of Zone includes three required findings. The first of these is that the
proposed Change of Zone be made according to procedure set forth in the State Planning Law. The
City will process the proposed project in conformance with the procedures in the State Law in
conjunction with the Change of Zone. A public notice will be published in the local newspaper
regarding the Initial Study and the public hearing to discuss the proposed project. A public hearing will
be held at both the Planning Commission and the City Council level for the amendment of the zoning
map. The second finding would be that subject property is suitable for the uses permitted in the
proposed zone in terms of access, size of parcel, relationship to similar or related uses and other
consideration deemed relevant by the City. The subject site and the buildings were constructed when
the project area was zoned as M2 in the past when the project buildings were constructed, thus it
complies with all the above criteria. The third finding is that the Change of Zone is necessary and proper
at this time and is not likely to be detrimental to the adjacent property or residents. Since the proposed
change will allow for a broad spectrum of businesses to occupy the buildings that are of the some type
and character as the surrounding properties the proposed change will be consistent with development
in the area.
In addition, the General Plan designation of Regional Business Center will not be changed and is
compatible with the proposed M2 zone. No impacts are expected.

Discussion of Impacts
a-g) No Impact. There will be no increase in traffic as a result of the proposed project. The current
level of service standard will be maintained since it will not induce a substantial increase to existing
traffic.
The Palm Springs International Airport is located approximately 4.5miles from the project site and will not
see a change of air traffic pattern with the implementation of the proposed change of zone. No design
features are proposed. Currently the site has adequate emergency access and parking capacity to
meet the proposed future uses. There will be no conflicts with adopted polices, plans, or programs
supporting alternative transportation. No impact will occur.

Discussion of Impacts
a-g) No Impacts. The implementation of the proposed zone change will not exceed wastewater
treatment requirements of the applicable Regional Water Quality Control Board. The provision of
domestic water and the future sanitary sewer plans have been analyzed by the MSWD as part of their
long range planning, using the City's General Plan Land Use Map, and MSWD has sufficient capacity or
can expand services to accommodate development. No impacts are expected.
The city uses Palm Springs Disposal Services. The landfills in the region currently have sufficient capacity
for solid waste disposal and currently accommodate solid waste generated by this project site. No
impacts are anticipated.

At the Planning Commission meeting of the City of Palm Springs, held January 25,
2017, the Planning Commission took the following action:
2B. WLA INVESTMENTS INCORPORATED, REQUESTING FOR A CHANGE OF
ZONE FOR AN EXISTING DEVELOPMENT KNOWN AS THE NORTH VILLAGE
CENTER LOCATED AT 19345-19465 NORTH INDIAN CANYON DRIVE, ZONE HC,

Principal Planner Robertson presented an overview of the proposed change of zone as
outlined in the staff report.
Commissioner Middleton verified if any comments were received from any property
owners along 20th Avenue and to the east of the subject property. (None were
received.)
Chair Calerdine verified the original zoning and annexation of the property.
Chair Calerdine opened the public hearing:
NOEL RAMOS, leasing property agent, summarized>the history of the property and
requested approval of the zoning,to be in conformance with the existing industrial uses.
There being no further speakers tIhe public hearing was closed.
ACTION: Recommend approvat of the Zone Change to the City Council.

NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will hold a
public hearing at its meeting of February 15, 2017. The City Council meeting begins at 6:00 p.m., in
the Council Chamber at City Hall, 3200 East Tahquitz Canyon Way, Palm Springs.
The purpose of this hearing is to consider an application by WLA Investment Incorporated for a
Change of Zone (CZ) from the existing Highway Commercial (HC) to Manufacturing (M-2) zone. The
proposed change of zone will allow the existing buildings at the site to be leased out to businesses
that operate under industrial uses, similar to the surrounding developments. The existing zoning
designation of the subject property is Highway Commercial (HC), which allows for the development of
commercial, hotel, and office uses, but prohibits industrial uses. Properties to the north and west are
zoned as Manufacturing (M2), which allow industrial uses. The surrounding properties and the project
site are all designated in the City's General Plan as Regional Business Commercial (RBC).
ENVIRONMENTAL DETERMINATION: The application has been deemed "a project," an Initial Study
was prepared under the provisions of the California Environmental Quality Act (CEQA) Guidelines
and a proposed Negative Declaration will be reviewed by the City Council at the hearing. Members of
the public may view this document at the Planning Services Department, City Hall,
3200 East Tahquitz Canyon Way, Palm Springs between the hours of 8:00 a.m. to 6:00 p.m., Monday
through Thursday and submit written comments at, or prior to, the City Council meeting.
REVIEW OF INFORMATION: The proposed application, site plan, and related documents are
available for public review at City Hall between the hours of 8:00 a.m. and 6:00 p.m., Monday through
Thursday. Please contact the Office of the City Clerk at (760) 323-8204 if you would like to schedule
an appointment to review these documents.
COMMENT ON THIS APPLICATION: Response to this notice may be made verbally at the Public
