SUBJECT: ACCEPTANCE OF THE CALLE PALO FIERRO SEWER LINE
REPLACEMENT, CITY PROJECT NO.16-14

SUMMARY
Formal City Council acceptance of the Calle Palo Fierro Sewer Line Replacement, City
Project No.16-14, is required to document the completion of the public works
improvement, and to allow the City's filing of a Notice of Completion with the Riverside
County Recorder in accordance with Section 9200 of the California Civil Code.
RECOMMENDATION:
1) Accept the public works improvement identified as the Calle Palo Fierro Sewer Line
Replacement, City Project No. 16-14, as completed in accordance with the plans and
specifications; and
2) Authorize the City Engineer to execute and file for recordation with the Riverside
County Recorder a Notice of Completion for Calle Palo Fierro Sewer Line
Replacement, City Project No. 16-14.
STAFF ANALYSIS:
The City has approximately 230 miles of sewer mainline in its sewer collection system
that conveys untreated sewage to the Wastewater Treatment Plant ("WWTP") where it
is treated for reuse and reclaimed water purposes. On November 4, 2015, the City
Council approved a Wastewater Services Agreement (O&M) with Veolia Water West
Operating Services, Inc., ("Veolia"), providing for Veolia's operation and maintenance of
the City's sewer collection system and WWTP.
As part of Veolia's services, Veolia monitors the sewer collection system by routinely
video-taping, recording, and providing condition ratings for each sewer line segments
and sewer manholes. During its routine maintenance and inspection of the sewer
collection system, Veolia identified the sewer line segment between sewer manhole

E12039 and E12045 in need of replacement due to several areas along the sewer line
that are cracked, broken, and deformed. Veolia confirmed that soil has intruded into the
sewer line at two locations where the sewer line has broken and tree roots have
intruded into the sewer flow. Additionally, Veolia identified a sag in the sewer line where
its video camera could not access.
Veolia has rated this segment of sewer line at 5, in accordance with Veolia's Pipeline
Assessment Certification Program ("PACP"). The PACP ratings range from 1 to 5 with
repairs required for ratings of 3 or higher; a rating of 5 is the worst condition and
requires replacement. A location map of the proposed sewer line replacement between
manholes E12039 and E12045 is shown in Figure 1 and a Vicinity Map showing a 500
feet radius of the project location is provided as Attachment 1.

Section 5.3 of the Operations and Maintenance Agreement, allows Veolia to undertake
such a capital project. On October 5, 2016, the City Council authorized the City
Engineer to issue a Notice to Proceed (NTP) Authorizing Veolia West Operation
Services, Inc. (Veolia) in the amount of $90,568, for the Calle Palo Fierrc Sewer Line
Replacement, City Project No. 16-14, (the "Project"). Veolia has completed the
replacement of approximately 200 linear feet of 12" sewer main (manhole to manhole)
on the segment between sewer manholes E12039 and E12045 on Calle Palo Fierro
north of Sonora shown as the highlighted segment in Figure 1. The line segment was
replaced due to several areas along the sewer line that were cracked, broken, had

severe root intrusion, and the line was also unreachable by CCTV video camera to
perform maintenance.
With any capital project undertaken by Veolia, Veolia operates as the general contractor
under its own contractor's license. As the general contractor, Veolia is responsible for
ensuring all construction is performed in accordance with State and federal rules and
regulations, and is liable for all risks and damages that may occur. Accordingly, Veolia
obtains general liability insurance for each project, which is passed as a direct cost to
the City.
The Project was administered and contracted to Veolia, who subcontracted to G&M
Construction the construction of the sewer line. Veolia has determined that G&M has
satisfactorily completed the Project on November 15, 2016, has conducted a final
inspection and found the work to be in compliance with the plans, specifications and
standards of the City of Palm Springs as evidenced by letter from Veolia dated February
21, 2017, and included as Attachment 2.
Staff recommends that the City Council accept the Project, as required by Section 9200
of the California Civil Code, and authorize the City Engineer to file and record a Notice
of Completion within 15 days of the City Council's action. A copy of the Notice of
Completion to be submitted to the County is included as Attachment 3.
ENVIRONMENTAL IMPACT:
Section 21084 of the California Public Resources Code requires Guidelines for
Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines
are required to include a list of classes of projects which have been determined not to
have a significant effect on the environment and which are exempt from the provisions
of CEQA. In response to that mandate, the Secretary for Resources identified classes of
projects that do not have a significant effect on the environment, and are declared to be
categorically exempt from the requirement for the preparation of environmental
documents. In accordance with Section 15301 "Existing Facilities," Class 1 projects
consist of the operation, repair, maintenance, permitting, leasing, licensing, which
includes restoration or rehabilitation of deteriorated or damaged structures, or facilities
to meet current standards of public health and safety. Therefore, in accordance with
Section 15301(d), staff determined that repair of the sewer line on Calle Palo Fierro is
considered categorically exempt from CEQA.
FISCAL IMPACT:
The Project was funded through Wastewater Treatment Funds under account no. 420-
6800-57041. The project had no contract change orders. Five percent retention is held
for final payment until 30 days after the filing of the Notice of Completion. The total
amount for construction was $90,568.
Table 1 below is a summary of the total costs incurred for the Project.

The City is holding retention of $4,528.40 for Veolia, pending acceptance of the
improvements and filing of the Notice of Completion with the County Recorder's office.
Since this project is a maintenance effort, the Finance Department does not need to add
the cost of this project to the City's fixed asset system, as no new assets have been
created in compliance with Governmental Accounting Standard Board (GASB) 34
Standards for Financial Reporting of Infrastructure Assets.
