BRLS-5282(042) FROM: David H. Ready, City Manager BY: Engineering Services Department SUMMARY Staff has completed a lengthy process to prepare a comprehensive environmental review of the South Palm Canyon Drive Bridge Replacement, City Project No. 12-02, Federal Aid Project No. BRLS-5282(042) (the `Project') pursuant to California Environmental Quality Act (CEQA). The proposed Project is located along South Palm Canyon Drive, approximately 250 feet south of East Sunny Dunes Road and north of Mesquite Avenue. In addition to the bridge replacement, the project will also improve traffic circulation on South Palm Canyon Drive by providing a consistent roadway and sidewalk section along the project area, and will also improve Tahquitz Creek Channel hydraulic capacity by providing a larger and consistent channel cross-section under the bridge. The City of Palm Springs is the CEQA Lead Agency for the Project. A draft CEQA Initial Study/Mitigated Negative Declaration (IS/MND) and associated technical studies have been prepared and a 30-day public review period has been completed. The IS/MND is ready for consideration and, if appropriate, adoption by the City Council. In accordance with Section 15202 of the CEQA Guidelines relating to review and evaluation of environmental documents, "CEQA does not require formal hearings at any stage of environmental review process, and public comments may be restricted to written communications." However, as part of the City's normal procedures, to the extent a public comment was received requesting that a formal Public Hearing be provided, consideration of this action would be scheduled as a formal Public Hearing before the City Council. During the public review process, there were no requests for a Public Hearing; therefore, none is required in the City's approval of the final IS/MND and adoption of the Mitigated Negative Declaration. ITEM NO.�_ City Council Staff Report April 5, 2017 - Page 2 South Palm Canyon Drive Bridge Replacement(CP 12-02) Environmental Document Approval Completion of this process allows the City to move forward with final design, right-of- way acquisition, utility relocation, and ultimately, construction of the Project. RECOMMENDATION Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADOPTING AND ORDERING THE FILING OF A MITIGATED NEGATIVE DECLARATION FOR THE SOUTH PALM CANYON DRIVE BRIDGE REPLACEMENT OVER TAHQUITZ CREEK CHANNEL, CITY PROJECT NO. 12-02, FEDERAL AID PROJECT NO. BRLS-5282(042)" STAFF ANALYSIS Project History The State of California Department of Transportation (Caltrans) inspects City's local bridges biennially in accordance with Title 23 of the Code of Federal Regulations (Federal Highway Act). The bridge inspection results of each bridge, ratings of all structural and functional elements, and the recommended repair or rehabilitation works are summarized in a Bridge Inspection Report that is forwarded to the City for actions. The existing South Palm Canyon Drive Bridge (State Bridge No. 56C0408) spanning the Tahquitz Creek Channel was originally constructed in 1930. The structure was further widened in 1956. The bridge is a reinforced concrete earth-filled spandrel arch structure. In 2009, the City received a Bridge Inspection Report that showed a low Sufficiency Rating (SR) of 37.1 with a status flag of "Structurally Deficient" — however, this "Structurally Deficient" classification does not imply that the bridge itself is not safe — the state has confirmed the bridge is structurally sound and can support vehicle loads. However, this classification will allow for the rehabilitation or replacement of the bridge to be eligible for federal funding. On June 26, 2012, the City prepared and submitted a funding application to Caltrans to request federal funds for the South Palm Canyon Drive Bridge Replacement project. On September 18, 2013, the City successfully received an initial programmed amount of approximately $889,000 ($787,032 in federal-aid funds, requiring $101,968 local match funds) from Caltrans to initiate the Project Approval and Environmental Document (PA/ED) phase of the Project. The City initiated the PANED phase of the Project in October of 2014 to provide 30% design of the Project, which serves as the basis for the subject CEQA review. Project Description The proposed project will result in the replacement of the existing bridge (State Bridge No. 56C0408) on South Palm Canyon Drive at the Tahquitz Creek Channel. The existing bridge deck consists of one twelve-foot wide inside lane and one fourteen-foot wide outside lane in each direction, which is narrower than the approach roadway width. North and south of the bridge, South Palm Canyon Drive has a median in order for traffic to safely make left turns, and an eight-foot wide sidewalk on both sides of the street. The north and south approaches are tapered to fit with the bridge width by eliminating the median. The existing bridge essentially creates a bottleneck traffic condition and requires roadway geometric correction. A location map with 500' radius is provided in Figure 1 for reference. x� - x- y=A "a U, Figure 1 - Location Map with 500' Radius The purpose of the project is to replace the existing bridge with a new wider bridge at the same location to ensure public safety, enhance vehicular and non-motorized traffic circulation in the area. The need for the project is to construct a new bridge that meets current design standards and accommodate local requirements. The proposed cross-section for the new replacement bridge will be sufficiently wide to support a raised median, two standard twelve-foot wide travel lanes in each direction, a shoulder that can accommodate a Class II bike lane and an ADA-compliant sidewalk on 03 City Council Staff Report April 5, 2017 - Page 4 South Palm Canyon Drive Bridge Replacement(CP 12-02) Environmental Document Approval ° both sides. The proposed roadway improvements consist of providing horizontal transitions from the proposed bridge section to the existing South Palm Canyon Drive street sections. Existing and proposed cross-sections of the bridge is shown in Figure 2 and Figure 3, respectively. The new bridge will provide sufficient vertical clearance below the soffit to accommodate multi-purpose trail underpasses associated with the proposed CV Link along the Tahquitz Creek Channel. Two construction stages are considered, with traffic being reduced to one lane in each direction during each phase, and shifted to one side of the street while the bridge is constructed one-half at a time. The upstream South Belardo Road Bridge provides a temporary optional alternative route that will reduce traffic congestion during construction. Construction equipment will be staged on a vacant lot located on S. Palm Canyon Dr. Environmental Analysis An environmental document, consisting of a CEQA Initial Study/Mitigated Negative Declaration (IS/MND) was required for this project. The purpose of this IS/MND is to evaluate the potential environmental impacts associated with implementation of the proposed South Palm Canyon Drive Bridge Replacement Project. This document has been prepared to fulfill the requirements of CEQA and the City's Rules to Implement CEQA. A copy of the IS/MND is included in Attachment 2. The IS/MND evaluated the full range of analysis categories as set forth in Appendix G of the CEQA Guidelines, including but not limited to the following areas: • Human Environment • Physical Environment • Biological Environment • Cumulative Impacts • Air Quality and Climate Change The proposed project is primarily located within the existing roadway right-of-way in an urban environment surrounded by commercial and residential land uses, as well as the Tahquitz Creek Channel. The existing South Palm Canyon Drive Bridge over the Tahquitz Creek Channel is bordered by the existing KFC restaurant and various commercial uses to the north, and future planned residential to the south. The Tahquitz Creek Channel is designated as "Watercourse". All land uses surrounding the project area are designated as mixed use/ multi-use on the City General Plan Land Use Map. The project site is located on South Palm Canyon Drive, south of its intersection with East Sunny Dunes Road. The project site is specifically located along South Palm Canyon Drive approximately 250 feet south the intersection of South Palm Canyon Drive and E. Sunny Dunes Road, and consists of approximately 500 feet of roadway encompassing the existing bridge. The project is located within an urban setting surrounded by commercial, residential, and watercourse land uses and urban land uses undergoing redevelopment. South: Southwest — vacant, future mixed-use residential; Southeast — vacant, future residential under development. East: Tahquitz Creek Channel West: Tahquitz Creek Channel Public Participation Early and continuing coordination with the general public and appropriate resource agencies was an essential part of the environmental process for this project, as a way to determine the scope of environmental documentation, the level of analysis, potential impacts and mitigation measures, and related environmental requirements. Agency consultation and public participation for this project have been accomplished through a variety of formal and informal methods, including project development team meetings, interagency coordination meetings, formal meetings with the Palm Springs Public Arts Commission, coordination with resource agencies, consultation with native American individuals and organizations. As a form of public outreach and enhancing the City's community involvement, the City's Engineering Services Department conducted an informational open house meeting on Tuesday, March 14, 2017 to inform affected residents and neighborhood communities about the proposed Bridge Replacement project. The meeting reviewed the bridge aesthetic design, engineering features, traffic control measures during construction, funding, project schedule, potential construction noise impacts, environmental clearances, and accommodation of the bridge for future bike trails along the channel. A total of twelve (12) verbal comments and two (2) written comments were received during the meeting. The public comments and associated responses, and presentation exhibits including photo simulations are provided in Attachment 3. Consultation with several agencies occurred as part of preparing the project technical reports and the IS/MND. These agencies are identified in the various technical reports and include: • United States Department of the Interior Bureau of Indian Affairs • State of California Office of Historic Preservation • Native American Heritage Commission • California Department of Fish and Wildlife Services • Caltrans • US Army Corps of Engineers • Agua Caliente Tribal Historic Preservation Office • Coachella Valley Association of Governments • California Regional Water Quality Control Board • Riverside County Flood Control & Water Conservation District 06 City Council Staff Report April 5, 2017- Page 7 South Palm Canyon Drive Bridge Replacement(CP 12-02) Environmental Document Approval The Draft IS/MND was circulated for public comment from December 5, 2016, through January 3, 2017. A public notice announcing circulation and availability of the document was published in the Desert Sun on December 4, 2016. The Draft IS/MND was also available for review at the City of Palm Springs, Department of Public Works Office located on 3200 East Tahquitz Canyon Way, and the Palm Springs Public Library located on 300 South Sunrise Way. A total of three (3) project/comment letters, listed below, were received and responded to during the availability period for the Draft IS/MND. A letter from the State Clearinghouse indicating that there were no comments on the IS/MND from state agencies was also received, but not included in the list below. • Johnson P. Findings The IS/MND prepared for this project has concluded and following public review and consideration of comments received on the draft IS/MND, it has been determined that the proposed project, with mitigation measures set forth in the IS/MND, will not have a significant effect on the environment. The project will have no adverse effect on aesthetic or visual resources, biological or cultural resources, hazards, public services or utilities, agricultural resources, area hydrology or water quality, noise, air quality or climate change, soils or geology, transportation, or area housing or population. A Mitigated Negative Declaration has been prepared that identifies various avoidance and mitigation measures related to biological resources, cultural resources, and transportation/traffic. Implementation of the avoidance and mitigation measures, as identified in the Mitigation Monitoring and Reporting Programs set forth in the IS/MND will ensure that the proposed project will have no significant effect on the environment. 07 City Council Staff Report April 5, 2017- Page 8 South Palm Canyon Drive Bridge Replacement(CP 12-02) Environmental Document Approval FISCAL IMPACT: Major project funding is from the federal Highway Bridge Program (HBP), which will fund 88.53% of the total project costs. The City will be responsible for the remaining 11.47% local match of the project costs. Local match cost not funded by HBP funds is expected to come from Coachella Valley Association of Governments (CVAG) Regional Measure "A" and City of Palm Springs Local Measure "A" funds. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: Section 1: The above recitals are all true and correct. Section 2: The City Clerk of the City of Palm Springs, is hereby designated the custodian of the documents and other materials which constitute the record of proceedings upon which the City Council has based its decision. The custodian of the documents is located at 3200 E. Tahquitz Canyon Way, Palm Springs, California. Section 3: Pursuant to Section 15063 of the CEQA Guidelines, a Mitigated Negative Declaration ("MND") of environmental impact was prepared and circulated for a 30-day public review period ending on January 3, 2017. The Mitigated Negative Declaration adequately analyzes the general environmental setting of the Project, its potentially significant environmental impacts and mitigation measures related to each potentially significant environmental impact of the Project, and has determined that there are no potentially significant impacts associated with the Project. Section 4: The Project implements the following goals and policies of the City of Palm Springs General Plan: lI Goal CR1: Establish and maintain an efficient, interconnected circulation system that accommodates vehicular travel, walking, bicycling, public transit, and other forms of transportation. Goal CR2: Establish improved levels of service for efficient traffic flow and provide a safe circulation system. As stated in the Project Description, the Project will accomplish the following: • The project will improve traffic circulation on South Palm Canyon Drive by correcting a bottleneck that occurs at both the north and south approaches, providing a consistent roadway and sidewalk section along the project area. Policy CR2.2: Make street improvements at problem intersections and bottleneck locations to improve specific traffic operations and safety, with all such improvements to be considered selectively on the basis of specific studies of the affected intersection and streets, and the impacts on the surrounding area and on pedestrian activity. As stated in the Project's Statement of Need, the Project will resolve the following: • Safety Deficiencies: The existing bridge is currently listed on the federal Eligible Bridge List due to structural deficiencies. The proposed project will replace the structurally deficient bridge, and improve traffic safety and traffic flow on the existing river crossing by widening the narrow bridge and improving its roadway approaches. • Traffic Deficiencies: The four-lane roadway and bridge currently creates a traffic bottleneck situation as South Palm Canyon Drive narrows at the north and south bridge approaches. As a result, the project area experiences undesirable traffic congestion during peak hours and intermittently throughout the day. • Channel Hydraulic Deficiencies: In addition to the bridge widening, the new replacement bridge will be lengthened from the existing structure to eliminate the channel bottleneck at the project site by providing a larger and consistent channel section under the bridge. Section 5: The City Council has carefully reviewed and considered all of the evidence presented in connection with the Project, including, but not limited to, the staff report, the Initial Study and public comments received, the proposed Mitigated Negative Declaration, the proposed Mitigation Monitoring and Reporting Program, and all written and oral testimony presented. The City Council further finds that on the basis of the entire Project record, there is no substantial evidence that the Project will have a significant effect on the environment and that the Mitigated Negative Declaration reflects the City's independent judgment and analysis. 12 NOW, THEREFORE, BE IT RESOLVED, that based upon the foregoing, and pursuant to Section 15074 of the CEQA Guidelines, Title 14, Division 6, Chapter 3, Article 6 "Negative Declaration Process", of the California Code of Regulations, the City Council adopts and orders the filing of a Mitigated Negative Declaration, and approves the Mitigation Monitoring and Reporting Program, for the South Palm Canyon Drive Bridge Replacement at the Tahquitz Creek Channel, City Project No. 12-02, Federal Aid Project No. BRLS 5282(042). INITIAL STUDY/MITIGATED NEGATIVE DECLARATION CHAPTER 1: INTRODUCTION AND PROJECT DESCRIPTION Description of the Project The City of Palm Springs (the City), in cooperation with California Department of Transportation (Caltrans), is proposing to replace the existing structurally deficient bridge (State Bridge No. 56C0408) on South Palm Canyon Drive at the Tahquitz Creek Channel with a new bridge.The project is located in the City of Palm Springs on South Palm Canyon Drive south of the intersection of East Sunny Dunes Road. Once a part of State Highway 111, South Palm Canyon Drive carries approximately 18,000 vehicles per day. The road serves as a major traffic corridor through the City; linking the commercial community of Palm Springs with its neighboring cities. South Palm Canyon Drive is classified as a 4-lane divided Major Thoroughfare in the Palm Springs General Plan. The existing bridge is approximately 60 feet long and 64 feet wide. The existing bridge deck consists of one twelve-foot wide inside lane and one fourteen-foot wide outside lane in each direction, which is narrower than the approach roadway width. North and south of the bridge, South Palm Canyon Drive has a median in order for traffic to safely make left turns, and an eight-foot wide sidewalk on both sides of the street. The north and south approaches are tapered to fit with the bridge width by eliminating the median. The bridge essentially creates a bottleneck traffic condition and requires roadway geometric correction. The proposed cross section for the new replacement bridge will be sufficiently wide to support a median, two standard twelve-foot wide lanes in each direction, a shoulder that can accommodate a Class II bike lane and an ADA compliant sidewalk on both sides. The proposed roadway improvements consist of providing horizontal transitions from the proposed bridge section to the existing South Palm Canyon Drive street sections. The new bridge will provide sufficient vertical clearance below the soffit to accommodate a multi-purpose trail underpass for the on going planning of CVAG CV-Link trail and the City's Tahquitz Trail along the north and south side of the bottom invert of the Tahquitz Creek Channel, respectively. The project will improve traffic circulation on South Palm Canyon Drive by providing a consistent roadway and sidewalk section along the project area, improve the Tahquitz Creek Channel capacity by providing a larger and consistent channel section under the bridge, and remove the bridge from the federal Eligible Bridge List. The replacement bridge will be constructed in stages over an 18-month period to minimize traffic impacts during construction. Two construction stages are considered, with traffic being reduced to one lane in each direction and shifted to one side of the street while the bridge is constructed one-half at a time. The upstream South Belardo Road Bridge provides a temporary detour route to reduce traffic congestion during construction. Construction equipment will be staged on a vacant lot located immediately south of the now demolished Rock Garden Bar and Grill. Environmental Setting and Surrounding Land Uses The South Palm Canyon Drive Bridge over the Tahquitz Creek Channel is located approximately 0.4 miles south of Ramon Road in the City of Palm Springs, within Riverside County. The site is located within the NW I/,of Section 23, T.4S., R4E., SBB&M. The proposed project area consists of approximately 500 feet of roadway. Properties surrounding the site are predominantly designated Mixed-Use/Multi-Use lands on the City of Palm Springs General Plan Land Use Map. North: Northwest and Northeast-restaurants and general retail/commercial. South: Southwest-vacant, future mixed-use residential; Southeast-vacant, future residential. Source: Project materials. Setting The City of Palm Springs is located in the valley floor in the southwest corner of the Coachella Valley where Palm Canyon enters the valley from the south. The city is framed by views of the San Jacinto Mountains to the south, west, and partially to east; by open desert and the City of Cathedral City to the east; and the Little San Bernardino Mountains to the north. The San Jacinto and Santa Rosa Mountains provide dramatic backdrop that is visible from virtually any point in the City. Discussion of Impacts a) Less Than Significant Impact. The proposed bridge replacement project is located along South Palm Canyon Drive, approximately 250 feet south of East Sunny Dunes Road. Tahquitz Creek Channel flows east through the project site, and continues until the Creek joins Palm Canyon Wash. The San Jacinto Mountains are visible to the west and south of the subject site. The height of the bridge will not be increased to a level that impacts or limits views of the San Jacinto Mountains. Persons traveling in the project area will continue to enjoy the some views through construction and operation of the proposed project. Construction and operation of the proposed bridge replacement will have a less than significant impact to the traveling public and surrounding development. b,c) Less Than Significant Impact. As proposed, the design of the bridge incorporates an aesthetically enhanced design and color scheme that complements the surrounding visual environment. Although the subject property is not located within a state scenic highway, the City's General Plan designates South Palm Canyon Drive as a scenic corridor. The replacement of the bridge does not create a significant impact on the corridor for the reason that the completed bridge will continue to provide the traveling public views of the mountains to the south and west. It does not contain scenic resources such as rock outcroppings or trees. Thus, there will be less than significant impacts to such scenic resources and the surrounding visual character. d) Less Than Significant Impact. The proposed infrastructure project will have on-bridge pedestrian lighting that will be placed within a recess of concrete barrier wall and will be facing the sidewalk and shielded as to prevent spillover, The site is located in the City's urban core, and is currently subject to vehicle light levels on surrounding streets. Setting The Coachella Valley, including the City of Palm Springs and the project site, is located within the Salton Sea Air Basin (SSAB), which is under the jurisdiction of the South Coast Air Quality Management District (SCAQMD). All development within the SSAB is subject to SCAQMD's 2012 Air Quality Management Plan (2012 AQMP) and the 2003 Coachella Valley PMio State Implementation Plan (2003 CV PM10 SIP). The SCAQMD operates and maintains regional air quality monitoring stations at numerous locations throughout its jurisdiction. The proposed site is located within Source Receptor Area (SRA) 30, which includes monitoring stations in Palm Springs and Indio. The Indio site has been operational since 1985 and the Palm Springs site since 1987. Criteria air pollutants are contaminants for which the state and federal air quality standards have been established. Currently, the Coachella Valley is classified as being in non-attainment for both ozone (03) and PMio. Ambient air quality in the SSAB, including the project site, does not exceed state and federal standards for carbon monoxide, nitrogen dioxides, sulfur dioxide, lead, sulfates, hydrogen sulfide, or Vinyl Chloride. State and federal ambient air quality standards are show in Table 1 and described in detail below. Ozone (03) is the most prevalent of a class of photochemical oxidants formed in the urban atmosphere. The creation of ozone is a result of complex chemical reactions between hydrocarbons and oxides of nitrogen in the presence of sunshine. Unlike other pollutants, ozone is not released directly into the atmosphere from any sources. The major sources of oxides of nitrogen and reactive hydrocarbons, known as ozone precursors, are combustion sources such as factories and automobiles, and evaporation of solvents and fuels. The health effects of ozone are eye irritation and damage to lung tissues. Carbon Monoxide (CO) is a colorless, odorless, toxic gas formed by incomplete combustion of fossil fuels. CO concentrations are generally higher in the winter, when meteorological conditions favor the build-up of directly emitted contaminants. CO health warning and emergency episodes occur almost entirely during the winter. The most significant source of carbon monoxide is gasoline-powered automobiles, as a result of inefficient fuel usage in internal combustion engines. Various industrial processes also emit carbon monoxide. Nitrogen Oxides(NO,) are the primary receptors of ultraviolet light initiating the photochemical reaction to produce smog. Nitric oxide combines with oxygen in the presence of reactive hydrocarbons and sunlight to form nitrogen dioxides and ozone. Oxides of nitrogen are contributors to other air pollution problems including: high levels of fine particulate matter, poor visibility and acid deposition. Sulfur Dioxide (S02) results from the combustion of high sulfur content fuels. Fuel combustion is the major source of SO2, while chemical plants, sulfur recovery plants, and metal processing are minor contributors. Sulfates result from a relation of sulfur dioxide and oxygen in the presence of sunlight. S02 levels are generally higher in the winter than in the summer (when sunlight is plentiful and sulfate is more readily formed). City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 14 28 INITIAL STUDY/MITIGATED NEGATIVE DECLARATION Particulate Matter (PMio and PM2.5) consists of particles in the atmosphere as a by-product of fuel combustion, through soil erosion by wind. Particulates can also be formed through photochemical reactions in the atmosphere. PM10 refers to finely divided solids or liquids such as soot, dust, and aerosols which are 10 microns or less in diameter and can enter the lungs. Fine particles are those less than 2.5 micrometers in diameter and are also referred to as PM2.5. Lead is found in old points and coatings, plumbing, and a variety of other materials. Once in the blood stream, lead can cause damage to the brain, nervous system, and other body systems. Children are most susceptible to the effects of lead. The South County Air Basin and Riverside County portion of the Salton Sea Air Basin are in attainment for the federal and State standards for lead. Discussion of Impacts a) No Impact. The project site is located in the Salton Sea Air Basin (SSAB) and will be subject to SCAQMD's 2016 Air Quality Management Plan (2016 AQMP) and the 2003 Coachella Valley PM10 State Implementation Plan (2003 CV PM10 SIP). The AQMP is a comprehensive plan that establishes control strategies and guidance on regional emission reductions for air pollutants. It was based, in part, on the land use plans of the jurisdictions in the region. The proposed project area is designated as a roadway and will continue to function as such. Therefore, the proposed project is consistent with the intent of the AQMP and will not conflict with or obstruct implementation of the applicable air quality plan. No impacts associated with compliance with applicable management plans are expected. b-d) Less than Significant Impact. Development of the proposed project will result in the release of criteria air pollutants. The Road Construction Emissions Mode, Version 7.1.5.1 was used to determine air quality emissions that will be generated by construction and operation of the proposed project. Construction Emissions The construction period includes site preparation, grading, building construction, paving, and architectural coating associated with the proposed project. For analysis purposes, it is assumed that construction will occur over an 18 month period. As shown in Table 2, emissions generated by construction activities will not exceed SCAQMD thresholds of significance for criteria air pollutants. The data reflect average daily emissions over the 18 month construction period. It should be noted that the table shows projected unmitigated emissions. Implementation of minimization measures during construction will further reduce emission levels. Applicable minimization measures include, but are not limited to, the implementation of dust control practices in conformance with SCAAMD Rule 403, and proper maintenance and limited idling of heavy equipment. Construction related criteria pollutant emissions are therefore expected to have a less than significant impact on air quality. Operational emissions include area source emissions, emissions from energy (electric and natural gas) demand, and mobile source (vehicle) emissions. The emission of air pollutants from operation of the subject bridge replacement project are limited to existing and forecast moving source emissions from vehicles. The project will not result in additional vehicle trips directly. Instead, the proposed project will alleviate traffic through a currently constrained segment of South Palm Canyon Drive. A project-specific traffic impact analysis evaluated the potential traffic and circulation impacts associated with the project opening year of 2020 and the horizon year of 2040. The subject segment will be required to accommodate 21,200 vehicles per day in 2020 and up to 25,700 vehicles per day in 2040. The project's primary objective is to enhance safety and traffic capacity along the proposed segment of South Palm Canyon Drive by replacing the bridge, road widening, and other improvements. These improvements will improve current traffic flow that may produce greater levels of air pollutants without the project. Therefore, operational conditions are expected to improve air quality. e) Less than Significant Impacts. To determine that a project has potential to generate significant adverse localized air quality impacts, the 2-acre mass rate Localized Significance Thresholds (LST) Look-Up Table for SRA 30 (Coachella Valley) was utilized. Under existing conditions in 2016, the nearest sensitive receptors are single- and multi-family residence located more than 250 meters southeast of the project site boundary. However, there is a proposed multi-family development for the vacant lot located immediately southeast of the project site boundary. The construction of the development will likely occur before initiation of the South Palm Canyon Drive Bridge replacement. Given this fact, the LSTs will be analyzed for sensitive receptors located approximately 50 meters from the emission source. Best management practices and required dust control plan will further reduce project-related impacts to less than significant levels. As depicted in Table 3 below, LST thresholds will not be exceeded during construction of the project. The proposed project is not expected to produce significant odors during any of the construction phases or at project buildout. Asphalt paving and other construction activities have the potential to produce short-term odors. Even so, construction-related odors will be dispersed below detectable thresholds as distance from the construction areas increases. For this reason, impacts associated with objectionable odors are expected to be less than significant. City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 16 3a - INITIAL STUDY/MITIGATED NEGATIVE DECLARATION Minimization Measures While project air emissions are projected to have a less than significant impact on air quality, the following measures will further reduce emission of potentially harmful pollutants and should be included in project grading and dust control plans, as well as in construction and construction traffic staging: 1. SCAQMD Rule 403 (403.1 specific to the Coachella Valley): A dust control plan shall be prepared and implemented during all construction activities, include ground disturbance, grubbing, grading, and soil export.This plan shall include but not be limited to the following best management practices: • Chemically treat soil where activity will cease for at least four consecutive days; • All construction grading operations and earth moving operations shall cease when winds exceed 25 miles per hour; • Water site and equipment morning and evening and during all earth-moving operations; • Operate street-sweepers on paved roads adjacent to site; • Establish and strictly enforce limits of grading for each phase of development; and/or • Stabilize and re-vegetate areas of temporary disturbance needed accomplish each phase of development. • Wash off trucks as they leave the project site as necessary to control fugitive dust emissions. • Cover all transported loads of soils, wet materials prior to transport, provide adequate freeboard (space from the top of the material to the top of the truck) to reduce PMio and deposition of particulate matter during transportation. • Use track-out reduction measures such gravel pads at project access points to minimize dust and mud deposits on roads affected by construction traffic. 2. SCAQMD Rule 402:The project shall adhere to nuisance odor requirement. 3. CalTrans Standard Specifications for Air Quality: The project shall adhere to all requirements set forth in CalTrans Sections 14 and 18. 4. To reduce particulate matter and NOx emissions construction equipment should utilize aqueous diesel fuels, diesel particulate filters and diesel oxidation catalyst during all construction activities. 5. All construction equipment should be properly serviced and maintained in optimal operating condition. 6. Construction equipment should not be left idling for more than five minutes. 7. As feasible, construction waste should be recycling to reroute waste from landfills and minimize the project's contribution to the landfill. 8. The contractor shall notify the City of the start and end of grading and construction activities in conformance and within the time frames established in the 2003 PMio State Implementation Plan. 9. Construction staging and management plans shall be reviewed and conditioned to require the application of all reasonably available methods and technologies to assure the minimal emissions of pollutants from the development.The City Engineer shall review grading plan applications to ensure compliance with the mitigation measures set forth in this document and as otherwise conditioned by the City. Setting Coachella Valley Multiple Species Habitat Conservation Plan The City of Palm Springs participate in the Coachella Valley Multiple Species Habitat Conservation Plan (CV MSHCP), which is a comprehensive regional plan encompassing a planning area of approximately 1.1 million acres and conserving approximately 240,000 acres of open space. The Plan is intended to address the conservation needs of a variety of plant and animal species and natural vegetation communities that occur in the Coachella Valley region. The Plan was finalized in October 2008. It City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 18 32 INITIAL STUDY/MITIGATED NEGATIVE DECLARATION establishes a system of preserves outside of urbanized areas in the valley in order to protect lands with high conservation value. It streamlines the permitting processes by implementing state and federal endangered species acts while providing for land development within its planning area. The proposed improvements would occur within the CV MSHCP planning area and the subject road and bridge- replacement project is a "Covered Activity" as defined by the CV MSHCP. The Plan provides mitigation for impacts associated with the bridge replacement project. Federally Protected Waters Tahquitz Creek flows from west to east through the study area within a concrete-lined channel. It traverses through the middle portion of the study area and flows for 640 feet before exiting near the middle of the eastern boundary. The Tahquitz Creek is an intermittent stream that typically flows for more than 3 months per year. For this reason, the United States Army Corps of Engineers (USACE) will possibly classify Tahquitz Creek as a Relatively Permanent Waterway (RPW). Tahquitz Creek has a surface water connection to the Salton Sea, which is classified as a Traditional Navigable Waterway (TNW). The USACE can consider it to have a "significant nexus" with a TNW and be considered a jurisdictional Waters of the US. Discussion of Impact a) Less Than Significant Impact. Amec Foster Wheeler prepared a general biological resources assessment for the proposed project area. Results of the assessment indicate that quality of the native habitat on the subject site is fairly low due to previous site alteration and degradation produced by a variety of human activities. Based on personal knowledge and literature review of the project area indicate that as many as 34 sensitive biological species have the potential to occur in the general vicinity of the project site. Nonetheless, no sensitive species were observed or detected on site during the biological surveys and impacts will be less than significant. It should be noted that impacts associated with non-listed species would require mitigation. The expansion seam that was observed beneath the South Palm Canyon Drive Bridge may provide day roosting habitat for bat species and there is a potential for bats to forage onsite. It will be required that a Bat Habitat Assessment be performed prior to initiation of construction activities to ensure impacts to bat species are avoided or reduced to less than significant impacts. The Migratory Bird Treaty Act (MBTA) protects all native birds while nesting. Trees and shrubs on the project site provide suitable habitat for nesting birds. In order to assure that impacts to nesting birds are less than significant, the biologist recommended that prior to any vegetation removal and/or work on the proposed project site a nesting bird survey is completed if such removal or ground disturbing activities occurs during the nesting bird season, which is between February 1 through August 31. This measure will minimize potential impacts to less than significant levels. The City of Palm Springs is a permittee of the CVMSHCP and is required to pay the land development fee to mitigate impacts covered under the MSHCP. Payment of such fee will ensure impacts associated with CVMSHCP will be reduced to less than significant levels. b) No Impact. The project study area occurs in area that has experienced significant development/disturbance during the past several decades. The project site is dominated by non-native vegetation, including African fountain grass and redstem stork's bill, Mediterranean tamarisk, and rabbit foot grass. The proposed portion of the Tahquitz Creek Channel is a grouted, rip-rap, manmade channel with no riparian vegetation present. Therefore, the project will have no impacts on riparian habitats. City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 19 33 INITIAL STUDY/MITIGATED NEGATIVE DECLARATION c) Less Than Significant Impact with Mitigation. Amec Foster Wheeler prepared a project-specific jurisdictional delineation report in September 2015 to determine the projects impacts to federally protected wetlands. Results of the report indicate that the project will have a temporary impact of 0.82 acres during construction, and no permanent impact (0 acres) at project buildout. Because the proposed project requires temporary impacts to a jurisdictional drainage, authorizations from the U.S. Army Corps of Engineers (USACE), Riverside Water Quality Control Board (RWQCB), and California Department of Fish and Wildlife (CDFW) will be required. Necessary authorizations include completion of the 401 (RWQCB), 404 (USACE), and 1602 (CDFW) permits. Completion and approval of these permits will ensure impacts associated with federally protected waters are less than significant. d) No Impact. A wildlife corridor is a link of wildlife habitat, generally containing native vegetation, which joins two or more larger areas of similar wildlife habitat. According to the biological assessment report prepared for the project, the survey area does not contain any CVMSHCP designated wildlife movement corridors or linkages. Therefore, there will be no impact to wildlife corridors. e,f) No Impact. The project will not conflict with any local policy, ordinance or adopted habitat conservation plan. The project is considered a "covered activity" under the CVMSHCP. Measure "A" tax funds will be used to mitigate the direct, indirect, and cumulative effects of transportation projects on the Covered Species and the conserved natural communities in the CVMSHCP. In addition, CVAG or Caltrans contribute to the Endowment fund as part of the mitigation for the covered roadway projects. Therefore, there will be no impacts. Mitigation Measures: 1. Any ground disturbing activity proposed for the period from February 1 to August 31 shall be preceded by a nesting bird survey performed by a qualified biologist. The biologist shall perform the survey within 30 days of the initiation of activities, and provide mitigation measures should nesting birds be identified. A report of findings shall be provided to the City prior to the initiation of ground disturbing activities. 2. Obtain a permit issued by USACE under Section 404 of the CWA to authorize the discharge of dredged or fill material into WUS. 3. The project proponent will need to obtain a 401 Water Quality Certification. In addition to the formal application materials and fee (based on area of impact) a copy of the appropriate CEQA documentation must be included in the application. 4. A 1602 Streambed Alteration Agreement is required for all activities that alter streams and lakes and their associated riparian habitat. For this reason, the project proponent will need to obtain a Streambed Alteration Agreement from the California Department of Fish and Wildlife. A copy of the appropriate CEQA documentation must be included with the formal application materials and fee (based of cost of the project). 5. Prior to any ground disturbing activities, a Bat Habitat Assessment, Level 1 and Level 2 surveys (if applicable) is required to determine 1) if bats are utilizing the expansion seam beneath the bridge and/or general area to forage in, and 2) how many and what species are present. A report of findings shall be provided to the City prior to the initiation of ground disturbing activities. Setting The City of Palm Springs is situated in the northwestern portion of the Coachella Valley, a northwest- southeast trending desert valley that constitutes the westernmost portion of the Colorado Desert. Dictated by this geographic setting, the climate and environment of the Palm Springs area is typical of southern California's desert country, marked by extremes in temperature and aridity. Temperatures in the region reach over 120 degrees in summer, and dip to near freezing in winter. Average annual precipitation is less than five inches. The area of potential effect (APE) extends approximately a third of a mile along South Palm Canyon Drive, in a transitional area between the urban core of Palm Springs and outlying vacant land, and about a half-mile east of the base of the San Jacinto Mountains. Most of the APE is occupied by the public rights-of-way for South Palm Canyon Drive, East Sunny Dunes Road, and Riverside Drive, and by vacant lands on the west side of South Palm Canyon Drive. Undeveloped land in the APE is concentrated mainly within the Tahquitz Creek Channel. Discussion of Impacts a-c) Less than Significant Impact with Mitigation: According to the Archaeological Survey Report for the proposed project, no archaeological features or artifact deposits, either prehistoric or historic in origin, were encountered during the survey. The general location of the undertaking is considered to be highly sensitive for prehistoric cultural remains, but the specific degree of sensitivity of each portion of the APE varies greatly based on its relative location to the known archaeological findings and the extent of past ground disturbances. In addition, the project area is primarily occupied by the public rights-of-way for South Palm Canyon Drive, East Sunny Dunes Road, and Riverside Drive, and by vacant lands on the west side of South Palm Canyon Drive. The portion of the APE where the ground surface remains relatively undisturbed, including the proposed staging area, appears to be sensitive for buried cultural deposits of prehistoric origin. However, the project does not require subsurface disturbance at the staging areas, and such deposits, if present, would be outside the vertical extent of the APE. The rest of the APE has been City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 21 35 INITIAL STUDY/MITIGATED NEGATIVE DECLARATION extensively disturbed by past construction activities as well as natural erosion, especially where excavations are required by the project design, and is unlikely to contain any intact, potentially significant archaeological remains.Therefore, the subsurface sediments within the vertical extent of the APE appear to be generally low in archaeological sensitivity. Nonetheless, a Native American monitor shall be present during all ground disturbing activities per consultation with the Agua Caliente Band of Cahuilla Indians to ensure impacts to culturally significant resources are avoided. Therefore, impacts are expected to be less than significant. d) Less than Significant Impact with Mitigation: No cemeteries or human remains are known to occur onsite. In the event human remains are uncovered, California law requires that all development activity be suspended, and that the procedures established in Public Resources Code 5097.94 be followed to determine the disposition of the remains. Compliance with the law will reduce potential adverse impacts to less Than significant levels. Mitigation Measures: 1. Source: Palm Springs General Plan, 2007. Setting The San Andreas Fault zone is the major fault in the Coachella Valley, which exposes the City to high amounts of seismic activity. The project and its vicinity are not within or adjacent to any Alquist Priolo Fault Zones. The City's soils are generally composed of alluvial sediments ranging from sand and silty sand to large boulders. The area of the project site, and its surroundings, consist of developed sites with compacted fill. Discussion of Impacts a) i) No Impact. The Alquist-Priolo Earthquake Fault Zoning Act prohibits the location of structures for human occupancy across the surface trace of an active fault. The site is City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahgaitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 23 37 , INITIAL STUDY/NEGATIVE DECLARATION not located within an Alquist-Priolo Fault zone. There are also no active faults located on- site. The nearest Alquist-Priolo Fault Zone is located approximately 8 miles north of the project site. The proposed bridge project will not result in the development of structures for human occupancy and therefore there will be no impact. ii) Less than Significant Impact. There are several active faults in the City of Palm Springs. No active faults are known to underline or project toward the site. which makes the probability of fault rupture low (Figure 6-1, Palm Springs General Plan). The nearest known active fault is the San Andreas (San Gorgonio Pass-Garnet Hill) fault zone, located 5.2 miles northeast of the project site. All structures in the area risk being damaged if not properly designed. The proposed project is limited to a bridge replacement and minor roadway improvements, and will not substantially alter the exposure of people to risks of seismic ground shaking. All construction on the site will be required to abide by the Caltrans Design Specifications thereby reducing impacts related to strong ground shaking to less than significant levels. iii) Less than Significant Impact. Figure 6-1 of the Palm Springs General Plan indicates the project site is located in an area of low liquefaction susceptibility. This area is characterized by fine-grained granular sediments that are normally susceptible to liquefaction with groundwater depths greater than 50 feet. Since the project site is located in an area that is susceptible to high levels of ground shaking, it is possible that the area could result in impacts related in liquefaction around saturated foundations or load-carrying structures. The proposed project is limited to a bridge replacement a roadway improvements and will not substantially alter the exposure of people to risks associated with liquefaction. The bridge will be constructed in accordance with Caltrans design specifications that will reduce impacts associated with such hazards. Impacts are expected to be less than significant. iv) Less than Significant Impact. Landslides can worsen depending on the conditions of the surrounding area. They occur more frequently if paired with saturated ground conditions. Southern Palm Springs is most vulnerable to landslides and rock falls, especially areas near the base of the San Jacinto Mountains. Figure 6-2 of the Palm Springs General Plan indicates that areas immediately east of the South Palm Canyon Drive Bridge have a moderate susceptibility of being impacted by rock falls and seismically induced land- sliding. However, the South Palm Canyon Drive Bridge is located approximately 0.5 miles west of the nearest rock slope and potential impacts to passing motorists would be less than significant. In addition, the Tahquitz Creek Channel would act as a catch basin for boulders and debris that may approach the South Palm Canyon Drive Bridge in the event of a major landslide. b) Less than Significant Impact. According to the General Plan, erosion is the removal of earth material via water, wind or ice and is considered a significant geologic hazard in the City of Palm Springs due to the topographic and weather conditions. The wash that lies under the South Palm Canyon Drive Bridge periodically fills with water from the San Jacinto Mountains and the passing water can lead to soil erosion if proper measures are not taken to prevent this. Channel improvements immediately upstream and downstream of the proposed bridge will consist of fully lined (sides and bottom) concrete riprap to protect the bridge foundations from scour and erosion. The project contractor would also be required to implement dust control mitigation measures that will ensure potential wind erosion is controlled during the construction phase. After the construction phase is completed, the project will be paved, landscaped and include other stable surfaces, which will limit erosion. c,d) Less than Significant Impact. According to Figure 6-3 of the Palm Springs General Plan, the site contains older alluvial gravel and sand (Qoa), and stream channel gravel and sand (Qg). Post- City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 24 8 8- INITIAL STUDY/NEGATIVE DECLARATION construction settlement and soil expansion at both bridge abutments is expected to be minimal. Settlement of fill material is expected to be essentially complete after fill loads are applied due to the granular nature of the alluvium. Impacts associated with unstable or expansive soils are considered less than significant. e) No Impact. No septic tanks or alternative wastewater disposal systems would be constructed as part of the proposed project. Therefore, no impact would occur. Minimization Measures A. Bridge construction will be required to abide by Caltrans Design Specifications, including applicable seismic performance standards. Mitigation: 1. Any final foundation investigations should be performed by a certified Engineer to determine the subsurface conditions and final foundation type and depth. The geotechnical engineer should review project plans and specifications prior to bidding and construction to check that the intent of the recommendations in geotechnical report has been incorporated. Observations and tests should be performed during construction. If the conditions encountered during construction differ from those anticipated based on the subsurface exploration program, the presence of the geotechnical engineer during construction will enable an evaluation of the exposed conditions and modifications of the recommendations in the geotechnical report or development of additional recommendations in a timely manner. Setting: Air pollution is a chemical, physical or biological process that modifies the chemistry and other characteristics of the atmosphere. The primary contributor to air pollution is the burning of fossil fuels used in transportation, power and heat generation, and industrial processes. The byproducts from the combustion of fossil fuels can contain a number air polluting substances.These emissions are responsible for the poor air quality that is evident in industrial centers worldwide. California was the first state to establish regulations that require the reduction of emissions of GHGs from motor vehicles. On September 24, 2004, the California Air Resources Board adopted a bill that requires all motor vehicles of 2009 vintage or later to reduce their greenhouse gas emissions by about 30% by the year 2016. On June 1, 2005 Governor Arnold Schwarzenegger issued executive order S-3-05, which calls for reduction in GHG emission to 1990 levels by 2020 and for an 80 percent reduction below 1990 levels by 2050. The California Global Warming Solutions Act (AB 32) was adopted by the state legislature in 2006. It sets forth a program to achieve 1990 emission levels by 2020 and requires CARB to proclaim 1990 GHG emissions and develop a Scalping Plan, which sets forth GHG reduction methods. CARB has reported that 1990 GHG emissions totaled 427 million metric tons (MMT) for the state of California; CARB adopted a GHG Scoping plan on December 11, 2008. The Scalping Plan includes a cap and trade program, green building strategies, recycling and waste reduction, and Voluntary Early Actions and Reductions. More recently, Executive Order B-30-15 was issued by Governor Brown on April 29, 2015 establishing a new California goal to reduce greenhouse gas emissions to 40 percent below 1990 levels by 2030 ensuring the state will continue its efforts to reduce carbon pollution. California SB 375 was signed by the Governor in September 2008 and is intended to at least in part implement greenhouse gas reduction targets set forth in AB 32. The bill encourages regional land use planning to reduce vehicle miles traveled and requires jurisdictions to adopt a sustainable communities strategy. a-b) Less Than Significant Impact. The Roadway Construction Emissions Model was used to quantify air quality emission projections, including greenhouse gas emissions. Construction related greenhouse gas emissions will be temporary and will end once the project is completed. As previously discussed, operation of the proposed project will not generate additional emissions, including greenhouse gas emissions. Therefore, GHG emissions are limited to construction of the project. The following table provides projected GHG generation associated with construction of the South Palm Canyon Drive Bridge Replacement. There are currently no adopted thresholds of significance for GHG emissions for construction or replacement of a bridge. It is recognized that GHG impacts are intrinsically cumulative. As such, project construction will be conducted in a manner that is consistent with applicable rules and regulation pertaining to the release and generation of GHG's. Statewide programs and standards will further reduce GHG emissions generated by the project, including new fuel- efficient standards for cars, and newly adopted Building Code Title 24 standards. The City has adopted a Climate Action Plan designed specifically to meet the requirements of state law relating to the reduction of greenhouse gas emissions. Specifically, this shows that the City has already implemented a number of GHG reducing emissions to 1990 levels by 2020. In order to reach the City's goal of reducing emissions by 7% below 1990 levels by 2020, the City will need to reduce emissions by 7.9% over business as usual rates. The project will not result in direct operational emissions of GHGs. Therefore, the proposed project will have a less than significant impact on the environment from the emission of GHG's and will not conflict with any applicable GHG plans, policies or regulations. Mitigation: None required. Monitoring: None required. City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 28 42 INITIAL STUDY/NEGATIVE DECLARATION Setting The site is located in proximity to several commercial land uses. A KFC restaurant is currently located northwest of the bridge. Northeast of the project site is a used car dealership. South of the project site are vacant lots. Discussion of Impacts a,b,d) Less than Significant Impact. A Phase I Initial Site Assessment was conducted to identify any potentially hazardous substances onsite or in the project area. Currently, South Palm Canyon Drive Bridge connects Palm Springs with its southern adjacent neighbor, Cathedral City. Due to this connectivity, South Palm Canyon is considered a major roadway into the City and may occasionally be used to transport hazardous materials. Though the bridge may periodically contain automobiles transporting hazardous materials, the proposed project is designed to improve traffic flow and safety and will therefore have a less than significant impact on the transportation of hazardous materials. Construction to replace the bridge would require the use of heavy, oil-using equipment, which could lead to fuel and oil spills if not properly managed. The Contractor will be required follow proper protocol to assure that potential impacts are minimized. A Phase I Initial Site Assessment was conducted to identify any potentially hazardous substances onsite or in the project vicinity that could impact or be impacted by the proposed project. Records review of the project area identified 28 locations/businesses within 1-mile of the project site that have, or have had the potential to release hazardous materials into the subsurface soil and/or groundwater. Eleven of these properties are located within the site, immediately adjacent to the site, or up-gradient (north) of the site. The closest listed property, Meader's Cleaners at 711 South Palm Canyon Drive (currently a KFC restaurant), is located immediately northwest of the onsite bridge. This property released dry cleaning solvents into the underlying soil and groundwater and the impacted water has migrated beneath the subject site. In addition, underground gasoline storage tanks are currently located within the onsite 76 fuel station and underground gasoline tanks were formerly located within the pawn shop property and the adjoining Jack in the Box property. Regulatory-requested actions have been implemented at four of the onsite or adjoining properties known to contain hazardous materials. Cleanup actions have been requested at the 76 fuel station, Jack in the Box, Rocky's Pawn Shop, and at the KFC (previously Meader's Cleaners). With the exception of the KFC, these cleanup actions have been completed to the satisfaction of the regulatory agencies (no further actions, cases closed). The cleanup of spilled solvents remains underway at the KFC. Lead was detected in the paint on the bridge and roadway surfaces, however these surfaces do not contain elevated levels of lead that would require special removal, handling, and/or disposal. Asbestos-containing materials were suspected within the South Palm Canyon Drive Bridge due to the structures age. As such, an asbestos study was performed for this bridge in order to assess the possible presence of asbestos. Asbestos was not detected in any of the materials collected from the bridge. Due to the absence of detectable asbestos in the samples collected, additional asbestos studies and/or remedial measures are not recommended. City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 29 43 INITIAL STUDY/NEGATIVE DECLARATION Additional environmental studies are not required or recommended for the project site. With the exception of the KFC property, there are no known onsite conditions that would warrant regulatory involvement, including actions leading to environmental soil sampling, soil remediation, groundwater sampling, and/or groundwater remediation. Further soil and groundwater sampling and/or remediation will likely be required at the KFC property due to the extensive solvent release. These actions are currently being conducted by the responsible party, and are not required as part of the proposed project. Based on the above analysis, impacts related to hazardous materials, in this sense, are considered less than significant. c) No Impact. The South Palm Canyon Drive Bridge is not located within '/A mile of an existing school. The nearest school is the Cahuilla Elementary School located approximately 0.37 miles east of the bridge. The proposed project will not generate hazardous materials, nor will these products be used in the project area. There will be no impact on existing or proposed schools. e-f) No Impact. The project area is located approximately 2.5 miles away from the Palm Springs International Airport. The purpose of the project is to improve roadway capacity and safety and will not create adverse impacts to those working or residing in the area. There are no private airstrips in Palm Springs.Therefore, there will be no impacts related to airports. g) Less than Significant Impact. The proposed project area would require temporary lane closures and detour areas during construction. The proposed roadway-widening project may require temporary lane closures, detours and re-routing. However, a Construction Traffic Control Plan will be prepared for the project and emergency access will be preserved during all construction activities. At build out, improved roadway and bridge capacity will enhance access for emergency vehicles. Therefore, there will be a less than significant impact to the adopted emergency response plan or evacuation plan. h) No Impact. The project is located within an urbanized area of Palm Springs, and immediately adjacent to the San Jacinto Mountains. The site is not located in a wildlands fire hazard area, and will not expose people or structures to a significant risk of loss, injury or death. Minimization Measures 1. It is recommend that any soil excavations conducted onsite be monitored (by the construction contractor) for visible soil staining, odor, and the possible presence of unknown hazardous- material sources, such as buried 55-gallon drums and underground tanks (although not anticipated). If hazardous material contamination or sources are suspected or identified, an environmental professional should evaluate the course of action required. This course of action should include following the Unknown Hazards Procedures found in Chapter 7 of the California Department of Transportation's Construction Manual. Construction at the site would be subject to National Pollutant Discharge Elimination System (NPDES) stormwater regulations for construction activities. The proposed project will be required to comply with all rules, regulations and procedures of the NPDES permit for municipal, construction and industrial activities as promulgated by the California State Water Resources Control Board or any of its Regional Water Quality Control Boards (Colorado River Basin-Regional VII). A Drainage Area Management Plan must usually be prepared to determine and describe the Best Management Practices (BMPs), which will be implemented during project construction. The project would be required to meet all applicable water quality standards or waste discharge requirements thereby avoiding violation of such standards or requirements. Therefore, compliance with all standards would ensure that potentially significant impacts would be reduced to less than significant. b) Less than Significant Impact. The proposed project is limited to bridge replacement, roadway widening and improvements and does not include the development of habitable structures requiring water service. The water for the area is supplied through the natural groundwater recharge and imported supplies of the Colorado River. Water used during construction will be minimal and temporary. Therefore, the proposed project will have a less than significant impact on groundwater supplies and recharge. c,d) Less than Significant impact. The project will not substantially alter the existing drainage pattern of the site or area or substantially increase the rate or amount of surface runoff in a manner that could result in flooding on or off site. Neither would the project create or contribute runoff that could exceed the capacity of existing or planned stormwater drainage systems or provide substantial additional sources of polluted runoff. The project is designed to maintain existing roadway drainage patterns and improve existing stormwater drainage capacity. The project will replace the existing bridge footings with new, structurally improved footings. The project will not alter the existing course of the Tahquitz Creek Channel, or any other stream or river. Therefore, impacts to drainage and run-off are expected to be less than significant. e,f) Less than Significant Impact. The project will not make a significant contribution to storm water runoff or have a significant adverse effect on local or regional flood control capabilities. The project will not have a significant adverse effect on local or regional ground water quality or quantity. With the implementation of required Best Management Practices (BMPs), no significant long-term impact to water quality would result. Therefore, impacts associated with water quality will be less than significant. g-h) No Impact. The proposed project is located in an area defined as being between limits of the 100-year flood and 500-year flood; or certain areas subject to 100-year flooding with average depths less than one foot (General Plan Figure 6-5). However, the proposed project will not result in the development of housing and will therefore not place housing within a 100-year flood zone. No impact is expected. 1) No Impact. The subject property is located approximately 0.5 miles south of the southeast edge of the Dam Failure Inundation Pathway of the Tachevah Creek Detention Reservoir (General Plan Figure 6-5).Therefore, the project site will not be impacted by potential levee/dam failure. j) No Impact. The proposed project site is not located in the vicinity of a body of water that can produce seiche, tsunami, or mudflow. There will be no impact. The proposed project will result in in the replacement of the existing South Palm Canyon Drive Bridge. It will not divide an established community and no impact is expected. b) No Impact. The proposed project does not conflict with any policies, goals, and programs of the General Plan. It does not violate provisions or regulations of the City's Zoning Ordinance and is consistent with surrounding existing and planned land uses. Therefore, impacts to land use are not expected. c) No Impact. The proposed project is not located in a Conservation Area, as delineated by the Coachella Valley Multiple Species Habitat Conservation Plan (MSHCP). In addition, mitigation for the project's potential impacts on sensitive plants, wildlife and habitat in the form of a land development fee is incorporated in the MSHCP. No impact to the MSHCP will result from build out of the proposed project. A once popular mining area, minerals such as asbestos, beryllium, gold, limestone, tungsten, copper, garnet and tourmaline have almost all been extracted from mines in the nations Monument. Despite limestone deposits, these mineral deposits are either limited, not precisely known or have not been extensively mined. The majority of the City, including the project site, is located in Mineral Resource Zone 3 (MRZ-3). MRZ-3 is an area containing mineral deposits the significance of which cannot be evaluated from available date. Discussion of Impacts a-b) Less than Significant Impact. The project site is located in Mineral Zone MRZ 3, which indicates the significance of mineral deposits cannot be determined from available data. There is no significant need for new sand and gravel resources and the impacts to mineral resources will be less than significant. Noise levels from temporary construction activities will be limited to the least noise sensitive times of day. The Municipal Code exempts construction activities from short-term, short-duration noise standards when they are conducted during permitted time frames. The City will require that construction activity comply with Section 8.04.220 of the Municipal Code, which limits construction activity to between 7 a.m. to 7 p.m. on weekdays and 8 a.m. to S p.m. on Saturdays. No activity is permitted on Sundays and holidays. These requirements will reduce noise impacts to less sensitive daytime hours and assure that short-term construction noise impacts will be less than significant. Short-term impacts could temporarily exceed acceptable noise thresholds. The project will not result in a new operational noise source. However, these impacts will be short-lived and temporary. Project related noise impacts from noise would be less than significant b) Less than Significant Impact. Construction of the proposed project could produce ground-borne vibration and/or ground-borne noise that may be felt by adjacent land uses. The primary source of ground-borne disturbances will be operation of heavy equipment, such as bulldozers. Any ground-borne impacts will be temporary and will end once construction is complete. Long-term operation of the project is not expected to generate ground-borne vibrations or noise, and impacts will be less than significant. As discussed in the Transportation/Traffic section below, the project will not generate additional daily trips as it is non-traffic generating, and will not significantly increase noise levels associated with traffic noise. Therefore, increase in permanent ambient noise levels is expected to be less than significant. d) Less than Significant Impact. There would be some short-term increases in noise levels during construction of the proposed project. However, the City's Municipal Code limits the time period that construction activities may occur, as specified by the Palm Springs Noise Ordinance. Construction is expected to occur only during the less sensitive daylight hours, when ambient levels of noise are higher, and therefore construction noise is less perceptible. Impacts associated with construction noise are expected to be less than significant. e-f) No Impact. The proposed project will not expose people residing or working in the project area to excessive aircraft-related noise. The Palm Springs International Airport is approximately 2.3 miles northeast of the subject property, and the property is outside of airport noise contours. The project will not extend City streets or infrastructure; however, the project will replace the existing bridge and enhance traffic flow by correcting an existing bottleneck. This will not indirectly impact the population. Therefore, there will be no impacts. b-c) No Impact. No housing currently exists within the project boundary (roadway), and the proposed action will not displace existing housing, affordable housing, or people. Fire Protection: There are five fire stations location within the City of Palm Springs, all of which provide for fire, paramedic and emergency services. The nearest fire station in relation to the project site is the Palm Springs Fire Station 441 on North Indian Canyon Drive, approximately 1 mile north. Fire State 444 on La Verne Way is the second nearest fire station to the project site, approximately 2 miles south. Fire personnel will be able to reach the site within the target five- minute response time in the event such services are required during construction. The project will not result in habitable structures or increase populations; therefore, the project will not result in the need for expanded fire services within the City. Emergency roadway access will be affected during the construction phase of the project. Traffic control measures (i.e. Construction Traffic Control Plan) implemented during construction of the project will assure that impacts to mobility and accessibility in the area will be less than significant. Police Protection: The Palm Springs Police Department offers response service, criminal investigation, traffic enforcement and preventive patrol for the City. There are 88 sworn and 59 non-sworn personnel. The police department is located at South Civic Drive, approximately 3 miles northeast of the project site. The project will not result in habitable structures or increase populations; therefore, the project will not result in the need for expanded police services within the City. As previously mentioned, emergency roadway access will be affected during the construction phase of the project. Traffic control measures (i.e. Construction Traffic Control Plan) implemented during construction of the project will assure that impacts to mobility and accessibility in the area will be less than significant. Schools: The nearest school the project site is the Cahuilla Elementary School located less than a mile southeast of the project area. The proposed project will result in a bridge replacement and does not include new residential units or habitable structures that would require new schools City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 38 52 - INITIAL STUDY/NEGATIVE DECLARATION and would not increase demand for such services. Therefore, there are no adverse impacts associated with schools as a result of the project. Parks: There are currently 10 parks in the City of Palm Springs that encompass more than 156 acres, including local parks, neighborhood parks, and specialty parks The project does not include new residential units or habitable structures that would require new parks or other public services, and would not increase demand for such services. Therefore, there are no adverse impacts associated with public services as a result of the project. Minimization A. Prepare and implement a Construction Traffic Control Plan to reduce traffic delay impacts and ensure proper emergency access throughout all phases of the construction period. An existing hiking/equestrian trail is located along the Tahquitz Creek Channel, just east of the Tahquitz Canyon Trail Head, and extends east underneath the existing South Palm Canyon Drive bridge. Discussion of Impacts a-b) Less than Significant Impact, No Impact. As previously described, the proposed project will result in the replacement of the existing South Palm Canyon Drive Bridge over the Tahquitz Creek Channel, in addition to various safety and roadway infrastructure improvements. The project will not increase population, and therefore will not increase demand on City recreational facilities. Pedestrian facilities (sidewalks) will be temporarily impacted, however still accessible, during construction and will be improved upon at project completion. The existing hiking/equestrian trail will be temporarily impacted during construction; however will be fully accessible after the bridge has been replaced. The new bridge is designed to provide sufficient clearance for the hiking/equestrian trail. Minimization Measures Mitigation: None required. Monitoring: None required. The project is located in the City of Palm Springs on South Palm Canyon Drive south of the intersection of East Sunny Dunes Road. South Palm Canyon Drive used to be a part of State Highway 111, serves as a major traffic corridor through the City; linking the commercial community of Palm Springs with its neighboring cities. A Traffic Analysis' was prepared by KOA Corporation to analyze traffic impacts associated with the replacement of the South Palm Canyon Drive bridge. Discussion of Impacts a,b) Potentially Significant Unless Mitigation Incorporated. The South Palm Canyon Drive Bridge is classified as a 4-lane divided Major Thoroughfare yet it is approximately 62 feet wide making it smaller than a secondary thoroughfare. The purpose of this project is to enhance traffic flow, increase roadway safety, and replace a structurally deficient bridge. The project, in and of itself, is not traffic inducing and will not result in an increase in traffic volumes, but will result in increased traffic flow and reduced delays by correcting an existing bottleneck condition at the proposed bridge. "Traffic Analysis for the South Palm Canyon Drive Bridge Replacement at Tahquitz Creek Channel in the City of Palm Springs," prepared by KOA Corporation.April 9,2015. City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 41 55 INITIAL STUDY/NEGATIVE DECLARATION Two construction plan alternatives were analyzed for the project, including a full bridge closure and a partial bridge closure. Ultimately, the Full Bridge Closure alternative will not be pursued per recommendations of the Palm Springs Fire Department2. With the closure of Fire Station 4 on Lo Verne for a period 2-3 years, a full bridge closure would adversely effect response times from Fire Station 1 into the area south of the Tahquitz Creek Channel and east of Sunrise Way. Therefore, the project will be constructed via partial bridge closure. Partial Bridge Closure The bridge will be built half-by half. Each phase will close half of the existing roadway section (2 lanes) and leave the other half open for two-way traffic, virtually reducing the capacity from a four-lane roadway to a two-lane roadway. The limits of traffic control are south of East Camino Parocela to north of East Mesquite Avenue. Keeping two (2) lanes open at all time during construction provides necessary emergency access along South Palm Canyon Drive. In addition, a sidewalk will be maintained at all times to allow for pedestrian and bike access. However, the required traffic control lane merges and closures might have minor impacts to some driveway access along South Palm Canyon Drive just north of Sunny Dunes Road. This can be mitigated with the removal of the existing raised medians at this intersection. The same treatment will be required south of the bridge as well, as noted earlier that Cameron project would construct raised center medians, which will need to be removed in order to properly align traffic using lane mergers and shifts down to two lanes on the open portion crossing the bridge. The Cameron project driveways on South Palm Canyon Drive will be restricted to right turn in/out only access, prohibiting left turns in/out. Operation The traffic report prepared for this project indicates that future average daily traffic volumes will increase regardless of "with project" or "without project' conditions due to valley-wide population growth. For opening year 2020, without the improvement, the bridge would operate at LOS D and with the bridge improvement, the bridge section will operate at an acceptable LOS A. A Traffic Control Plan shall be prepared to reduce delays and safety hazards during the construction period. Therefore, the project will have a less than significant impact on increased traffic c) No Impact. The Palm Springs International Airport is located approximately 2.3 miles northeast of the project site. The project is a roadway improvement and bridge replacement project, and will not increase air traffic or result in the change of air traffic patterns. The project will not change the location of airport facilities or result in an airport related safety hazard.Therefore, the proposed project will have no impact on air traffic patterns. d) No Impact The proposed project is designed to improve the traffic flow and safety along South Palm Canyon Drive over the Tahquitz Creek Channel. Modifications include curb and gutter improvements, and installation of a median, sidewalks, and bike paths. In addition, traffic signal modifications will be provided at East Sunny Dunes Road and South Palm Canyon Drive to provide improved visibility, an upgraded detection system, and new ADA compliant pedestrian access ramps at all four corners of the intersection. Therefore the proposed project will not result in increased safety hazards. e) Less than Significant Impact. Currently, emergency access is subject to minor interruptions due to the bottleneck (narrow bridge approach) that occurs across the subject segment of South Palm Canyon Drive. A Traffic Control Plan will be prepared to ensure through traffic flow during construction and that emergency service access is not interrupted during project construction. Post-construction, the widening of lanes in each direction will enhance accessibility for emergency service providers. Overall, impacts to emergency services are expected to be beneficial. f) No Impact. The proposed roadway widening project will have no impact to available parking since it neither removes nor creates parking areas.There will be no impacts to parking. g) Less than Significant Impact. Public transportation in the City of Palm Springs is provided by SunLine Transit Agency. The proposed segment of South Palm Canyon Drive is currently serviced by SunLine Route 111, with stops located near Sunny Dunes Road and at Mesquite Avenue, both north and southbound. SunLine services will be temporarily impacted/rerouted during project construction, however these impacts will be temporary and services will continue as scheduled at project buildout. The project will reconstruct curbs, ramps, and sidewalks along the proposed segment of South Palm Canyon Drive per current American Disabilities Act (ADA) standards. Overall, the proposed project will help improve transit infrastructure and accessibility. The proposed project will not interfere with applicable city programs or the CVAG Non-Motorized Transportation Plan. Therefore, there will be no conflict with applicable transit plans or policies. Mitigation Measures A. Prepare and implement a Construction Traffic Control Plan to reduce traffic delay impacts and ensure proper emergency access throughout all phases of the construction period. This includes detailed re-routing and additional signalization plans for potential detour routes to ensure impacts to traffic during construction are reduced to less than significant levels. Mitigation will require removal of current and future constructed raised medians along South Palm Canyon Drive in order to adequately facilitate traffic control. Setting The area of potential effect (APE) extends approximately a third of a mile along South Palm Canyon Drive, in a transitional area between the urban core of Palm Springs and outlying vacant land, and about a half-mile east of the base of the San Jacinto Mountains. Most of the APE is occupied by the public rights-of-way for South Palm Canyon Drive, East Sunny Dunes Road, and Riverside Drive, and by vacant lands on the west side of South Palm Canyon Drive. Undeveloped land in the APE is concentrated mainly within the Tahquitz Creek Channel. The project APE does not encroach into tribal lands, however there are tribal lands immediately west of the APE boundaries. Discussion of Impacts a, b) Less than Significant Impact: Native American consultation was conducted in 2015 to evaluate the potential presence of tribal cultural resources within the project area. Correspondence with the State of California's Native American Heritage Commission (NAHC) resulted in the recommendation to further consult with the Aguo Caliente Band of Cahuilla Indians (ACBCI) and the Morongo Band of Mission Indian. Representatives of the Morongo Band indicated that the tribe has no comments regarding this undertaking and recommends further contact with "the appropriate tribes who have cultural affiliation to the project area." Agua Caliente Band of Cahuilla Indians identified the APE as part of the tribe's traditional use area, and requests Native American monitoring during the undertaking as well as formal, government-to-government consultation under Section 106 guidelines. These requests have been addressed via mitigation measures provided in Cultural Resources section of this document. Therefore, impacts to tribal cultural resources are expected to be less than significant. City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 44 58 INITIAL STUDY/NEGATIVE DECLARATION XVIII. Source: Palm Springs General Plan Wastewater: The City is working in partnership with Veolia Water North America to operate a comprehensive wastewater treatment program that will recycle wastewater, which will be used to irrigate public facilities, such as the nearby golf courses. The treatment facility would include a 10.9 million gallon per day (mgd) trickling filter wastewater treatment plant: five pump stations, 225 miles of sewer collection pipelines, six percolation ponds and a biosolids disposal program. Domestic Water: The Coachella Valley Water District (CVWD), the Desert Water Agency (DWA) and Mission Springs Water District (MSWD) provide water to the City of Palm Springs. There are three ground water subbasins, Whitewater River, Mission Creek, and Indio, all of which serve the Coachella Valley. Whitewater River basin is the largest of the three basins and contains 28 million acre-feet of water. The basin is recharged every season by rainfalls, snowmelt and surface water from several creeks, however, due to the unreliability of the seasonal inflow, the Coachella Valley water agencies rely on the Colorado River and the State Water Project as its two main sources of imported water. Solid Waste: Palm Springs Disposal Services provides solid waste disposal to the City of Palm Springs. The waste is transported from Palm Springs to Edam Hill Transfer Station in Cathedral City where it is hauled to Lamb Canyon Sanitary Landfill in Beaumont. City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tohquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 45 59 INITIAL STUDY/NEGATIVE DECLARATION Drainage: The Palm Springs Master Drainage Plan covers approximately 26.5 square miles, and consists of flay valley terrain. Gas: There is a 4" gas line owned by Southern California Gas Company currently going through the existing bridge under the easterly sidewalk and will be reincorporated into the new bridge. Telecommunications: Six underground telephone conduits by Frontier (formerly Verizon) currently run along the west side of South Palm Canyon Drive under the sidewalk through the existing bridge. Discussion of Impacts a,b) No Impact, Less than Significant. The proposed project will not result in the need for additional public services, including utilities, because the project will not result in the development or expansion of habitable structures or otherwise create a new demand for such services. The project will neither exceed wastewater treatment requirements nor require or generate the need for new wastewater treatment facilities.There will be no impacts to wastewater. A 10" domestic water line is currently located under the easterly sidewalk of the bridge. It is anticipated that a new domestic water line would be installed and activated in the new half of the bridge before the existing waterline is abandoned and removed with the demolition of east half of the bridge. A 12" domestic water line by Desert Water Agency (DWA) ends near the southerly Abutment. This waterline does not cross the channel in the bridge, however a portion will require to be vertically realigned due to the changing of the roadway elevation. Impacts to water infrastructure will be less than significant. c) Less than Significant Impact. The NPDES implements the federal Clean Water Act and was adopted in 1990. It requires the development, adoption, and implementation of plans and programs for storm water management, which must, among other things, effectively prohibit non storm water discharge into the storm drain and require controls to reduce the discharge of pollutants from stormwater systems to waters of the United States. Currently, Riverside County municipalities and agencies, including the City of Palm Springs, Riverside Flood Control and Water Conservation District, and CVWD/DWA, joined together to develop and implement the 2001-2006 Stormwater Management Plan, as part of NPDES permitting requirements. This Plan was designed to manage and control stormwater runoff to the maximum extent practical. The project will result in the construction of enhancements to existing drainage facilities, such as gutters, within the proposed segment of South Palm Canyon Drive. The existing drainage pipe/inlet at the northwestern bus bay will also be reconstructed. The construction of these facilities will assure their protection of a large flood event and is not expected to have a significant adverse effect on the environment. d) Less than Significant Impact. At buildout, the proposed project will not require water services, and construction activities will generate only a limited and temporary demand for water. Therefore, the project is not expected to significantly impact water supplies. e) No Impact. The project will not result in the development or expansion of habitable structures or otherwise create a new demand for such services. The project will neither exceed wastewater treatment requirements nor require or generate the need for new wastewater treatment facilities. There will be no impacts to wastewater. f) Less than Significant Impact. The project will accumulate a limited volume of solid waste during time of construction. This waste includes concrete, asphalt and wood framing materials. The project will not be significantly impacted since the amount of waste will be limited and temporary. City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tohquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 46 60 INITIAL STUDY/NEGATIVE DECLARATION g) No Impact. The City is in compliance with federal, state, and local statutes regulating solid waste. Development of the proposed project will not conflict with federal, state, or local statutes regulating the disposal of solid waste.There will be no impacts. Mitigation: None. Monitoring: None. City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 47 - 61 INITIAL STUDY/NEGATIVE DECLARATION XVIIII. MANDATORY FINDINGS OF SIGNIFICANCE NOTE: If there are significant environmental impacts which cannot be mitigated and no feasible project alternatives are available, then complete the mandatory findings of significance and attach to this initial study as an appendix. This is the first step for starting the environmental impact report (EIR) process. Biological Resources The proposed project will be required to pay the land development fee to mitigate potential impacts associated with covered species in the CVMSHCP. A Bat Habitat Assessment, Level 1 and Level 2 (if applicable) will also be required prior to construction to ensure impacts to bat species are avoided or mitigated to less than significant levels.Section VI, Biological Resources Mitigation Measures further explains these requirements. In addition, the project will be required to adhere to rules and regulations of the MBTA. Any ground disturbing activity proposed for the period from February 1 to August 31 shall be preceded by a nesting bird survey performed by a qualified biologist. The biologist shall perform the survey within 30 days of the initiation of activities, and provide mitigation measures should nesting birds be identified. A report of findings shall be provided to the City prior to the initiation of ground disturbing activities. The impact for these species will be less than significant once MBTA protocol is enacted and THCP mitigation measures are addressed. Cultural Resources As described in Section V, Cultural Resources, the subject property has a low probability of containing archaeological resources. In addition, no historical or paleontological City of Palm Springs South Palm Canyon Drive Bridge Replacement over Tahquitz Creek Channel November 2016 Initial Study/Mitigated Negative Declaration 48 62 INITIAL STUDY/NEGATIVE DECLARATION resources were found on the subject site. For this reason, the proposed project will result in a less than significant impact to cultural resources. b) Less than Significant Impact. Replacement of the South Palm Canyon Drive Bridge is consistent with the General Plan, in that it does not change existing land use, and will not have any additional cumulatively considerable impacts beyond buildout of the General Plan. c) Less than Significant Impact. The project's potential environmental effects have been mitigated to a less than significant level by the measures outlined in the Initial Study and development requirements of the City of Palm Springs, and Caltrans. Further, as proposed the project will not cause substantial adverse effects on human beings. This Agency intends to adopt a Mitigated Negative Declaration based upon the supporting documentation herein. Both reports are referenced in Section VIII of the IS/MND (Hazards and Hazardous Materials). Records reviews performed as part of the project Phase 1 identified 28 locations/businesses within 1-mile of the project site that have, or have had the potential to release hazardous materials into the subsurface soil and/or groundwater. Eleven of these properties are located within the site, immediately adjacent to the site, or up-gradient (north) of the site. The closest listed property, Meader's Cleaners at 711 South Palm Canyon Drive (currently a KFC restaurant), is located immediately northwest of the bridge site. This property released dry cleaning solvents into the underlying soil and groundwater and the impacted water has migrated beneath the subject site. In addition, underground gasoline storage tanks are currently located within the onsite 76 gas station, and underground gasoline tanks were formerly located within the pawn shop property and the adjoining Jack in the Box property. Regulatory-requested actions have been implemented at four of the adjoining properties known to contain hazardous materials. Cleanup actions have been requested at the 76 gas station, Jack in the Box, Rocky's Pawn Shop, and at the KFC (previously Meader's Cleaners). With the exception of the KFC, these cleanup actions have been completed to the satisfaction of the regulatory agencies (no further actions, cases closed). The cleanup of spilled solvents remains underway at the KFC, where a vapor recovery system is in operation, No other sources or potential sources of contamination were identified. and additional environmental studies are not required or recommended for the project site. With the exception of the KFC property, there are no 72 known onsite conditions that would warrant regulatory involvement, including actions leading to environmental soil sampling, soil remediation, groundwater sampling, and/or groundwater remediation. Ongoing soil and groundwater sampling and/or remediation may be required at the KFC property due to the historical solvent release. These actions are currently being conducted by the responsible party, are being monitored by the Region 7 offices of the Regional Water Quality Control Board, and are not required as part of the proposed project. Both construction and operation of the proposed project will be required to comply with hazardous materials laws and regulations that relate to the transport, use, and disposal of hazardous materials. Based on the above, impacts related to hazardous materials are considered less than significant. Comment 2: If there are any recognized environmental conditions in the project area, then proper investigation, sampling and remedial actions overseen by the appropriate regulatory agencies should be conducted prior to the new development or any construction. Response: As noted in Response 1 above, additional environmental studies are not required or recommended in the project area because cleanup actions are either completed or are currently underway on existing hazardous sites. These actions are currently being monitored by the Region 7 offices of the Regional Water Quality Control Board, and are not required as part of the proposed project. Further examination or action is not required as part of the proposed project. 73 Comment 4: If the project plans include discharging wastewater to a storm drain, you may be required to obtain an NPDES permit from the overseeing Regional Water Quality Control Board (RWQCB). Response: Comment noted. The project will be required to comply with National Pollutant Discharge Elimination System (NPDES) regulations, which minimize the pollutant load associated with urban runoff (See Section IX. Hydrology and Water Quality). Comment 5: If during construction/demolition of the project, soil and/or groundwater contamination is suspected, construction/demolition in the area should cease and appropriate health and safety procedures should be implemented. If it is determined that contaminated soil and/or groundwater exist, the [IS/M]ND should identify how any required investigation and/or remediation will be conducted, and the appropriate government agency to provide regulatory oversight. As described in Section VIII of the IS/MND, construction of the proposed project will be required to comply with hazardous materials laws and regulations that relate to the transport, use, and disposal of hazardous materials. The Phase 1 ESA analysis indicates that the depth to the contamination plume is approximately 200 feet greater than the maximum depth of grading disturbance associated with the bridge project. In addition, as described in Section IX, the project will be subject to all local and NPDES requirements pertaining to surface and groundwater contamination. These standards, which include best management practices for the protection of surface and groundwater, are designed to assure that impacts to these resources remain less than significant. Comment 1: The MND indicates that vegetation removal may occur within the project site as shown on Exhibit 3 of the MND. Please be advised that the project site appears to include a portion of Tahquitz Creek Channel that the District is currently conducting restoration activities within. The mitigation/restoration site begins approximately 150 feet west of the bridge centerline as shown on the enclosed exhibit. Please contact the District prior to any vegetation removal to ensure that the ongoing restoration activity is not adversely impacted. Response: Comment noted. Improvements to the channel do not extend into the described restoration limits. The vegetation removal referred to in the IS/MND is within the limits of the channel that has a grouted Rip-Rap bottom. Comment 2: Please be advised that any work that involves District rights-of-way, easement, or facilities will require an encroachment permit from the 74 District. As part of the encroachment permit process, the applicant will be required to submit a series of documents including but not limited to: a. CEQA Compliance: As proposed, the project would affect existing facilities within the District's rights-of-way. As such, the District is considered to be a Responsible Agency. The proposed project consists of replacement of the existing South Palm Canyon Drive Bridge, one half at a time, in order to remove the existing bottleneck traffic condition. The bridge is proposed to be widened to support two lanes in each direction, a Class 11 bike lane, sidewalk on both sides, and a center median. Bridge footings in the District's Tahquitz Creek Channel are proposed to be replaced with new structurally improved footings. The District has the following comments/concerns that should be addressed: 1. The MND indicates that vegetation removal may occur within the project site as shown on Exhibit 3 of the MND. Please be advised that the project site appears to include a portion of Tahquitz Creek Channel that the District is currently conducting restoration activities within. The mitigation/restoration site begins approximately 150 feet west of the bridge centerline as shown on the enclosed exhibit. Please contact the District prior to any vegetation removal to ensure that the ongoing restoration activity is not adversely impacted. 2. Please be advised that any work that involves District rights-of-way, easement, or facilities will require an encroachment permit from the District. As part of the encroachment permit process, the applicant will be required to submit a series of documents including but not limited to: a. CEQA Compliance: As proposed, the project would affect existing facilities within the District's rights-of-way. As such, the District is considered to be a Responsible Agency. Upon completion of the final environmental document, please submit a copy of the approved document to the District for consideration. The District will need to verify that the permits cover temporary construction impacts as well as permanent impacts. Regulatory permits may be submitted as part of your submittal for an encroachment permit. Please be sure to include plans and exhibits that indicate the specific location of where temporary and permanent impacts will occur. c. Nesting Bird Plan: Impacts to nesting birds are proposed to be reduced by requiring a nesting bird survey to be conducted by a qualified biologist within 30 days of the initiation of project construction if ground disturbance will occur between February I" and August 31". if a nesting bird survey is conducted, please submit a copy of the results to the District.
