Ready, City Manager Initiated by: Engineering Services Department SUMMARY Formal City Council acceptance of the Palm Springs Library Shade Structure, City Project No. 15-27, is required to document the completion of the public works improvement, and to allow the City's filing of a Notice of Completion with the Riverside County Recorder in accordance with Section 9200 of the California Civil Code. RECOMMENDATION: 1) Accept the public works improvement identified as the Palm Springs Library Shade Structure, City Project No. 15-27, as completed in accordance with the plans and specifications; and 2) Authorize the City Engineer to execute and file for recordation with the Riverside County Recorder a Notice of Completion for the Palm Springs Library Shade Structure, City Project No. 15-27. STAFF ANALYSIS: On June 15, 2016, the City Council awarded a construction contract to NR Development, Inc., in the amount of $50,500 for the Palm Springs Library Shade Structure, City Project No. 15-27, (the "Project"). The scope of the Project included the fabrication and installation of a new steel cantilevered shade structure, metal perforated panels, powder coating, and a modification to the existing irrigation and landscaping. Imri � ■L' P�:Jt!� J wF"" 9 ' Location Map Throughout construction of the Project two contract change orders were approved as follows: • Construction Contract Change Order 1 (CC01) in the amount of $2,396.60 was approved by the City Engineer on November 29, 2016, to add an anti-graffiti coating and increase shade structure by 6 inches to fit more closely within the allowable space at the front entrance. • Construction Contract Change Order 2 (CCO2) in the amount of $1,158.00 was approved by the City Engineer on March 2, 2017, to raise the Palm Springs Library Sign letterings as a result of the shade structure partially blocking the letterings. The final cost of the Project was increased by $3,554.60 from the original awarded contract amount of $50,500 for a final contract amount of $54,054.60; copies of CCO1 and CCO2 are included as Attachment 1. As determined by City staff, the Contractor satisfactorily completed the Project on April 6, 2017. Staff recommends that the City Council accept the Project as required by Section 9200 of the California Civil Code, and authorize the City Engineer to file and record a Notice of Completion within 15 days of the City Council's action. A copy of the Notice of Completion to be submitted to the County is included as Attachment 2. 02 City Council Staff Report May 3, 2017—Page 3 Acceptance of City Project No. 15-27 ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15303 "New Construction or Conversion of Small Structures," Class 3 projects consist of construction and location of limited numbers of new, small facilities or structures such as electrical, and other utility extensions, as well as, accessory (appurtenant) structures, therefore, the Palm Springs Library Shade Structure, City Project. No. 15-27, is considered categorically exempt from CEQA, and a Notice of Exemption has been prepared and will be filed with the Riverside County Clerk. FISCAL IMPACT: The Project was funded entirely by the Library Endowment Trust Fund (Fund 151) in Account No. 151-2752-51025. On May 26, 2016, the Library Board approved an additional allocation of $45,000 for the Project. The estimated Project budget and incurred expenditures are identified in Table 1.
