Subject: WAIVER OF FEES FOR A CONDITIONAL USE PERMIT APPLICATION,
CASE 5.1419 CUP

SUMMARY
This action will allow the City Council to consider waiving the application fee of
$5,288.40 plus mailing fees for public notification associated with a Conditional Use
Permit, Case 5.1419 CUP, filed by Well in the Desert.
RECOMMENDATION:
Approve the waiver of application fees associated with a Conditional Use Permit, Case
5.1419 CUP, filed by Well in the Desert.
STAFF ANALYSIS:
An application for a Conditional Use Permit has been filed with the Planning Services
Department by Well in the Desert, a social service provider (Charitable Institution), to
operate a cooling center, and offer other general social services and employment
services for homeless individuals at an existing commercial office building located at
441 S. Calle Encilia. The application has been identified as Case 5.1419 CUP.
The City Council has the authority to consider waiving various application fees for good
cause. In this case, a Charitable Institution is proposing to offer social services within an
existing commercial building, but for which the City requires an application for a
Condition Use Permit. The current application fee is $5,288.40 plus mailing fees for
public notification, for a total fee of approximately $5,300. The City Council may
consider that the intended purpose of the social services provided by this Charitable
Institution is good cause to waive the required application fees.

ENVIRONMENTAL IMPACT:
This actions is not a "project' for purposes of the California Environmental Quality Act
(CEQA), as that term is defined by CEQA guidelines (Guidelines) section 15378. This
action is an organizational or administrative activity by the City of Palm Springs in
furtherance of its governmental authorities, and will not result in a direct or indirect
physical change in the environment, per section 15378(b)(5) of the Guidelines.
FISCAL IMPACT:
Waiver of the application fees associated with Case 5.1419 CUP defers payment of
approximately $5,300.

Subject: Proposed homeless facility
Dear Ms. Hart,
We would like to add our voices in opposition to the proposed location for a homeless facility on
South Calle Encilia and request that you circulate this e-mail to the appropriate decision makers.
Though the proposed property is vacant and zoned commercial, the east side of the street from
Ramon north is entirely residential consisting of apartment buildings and condominiums. The
neighborhood has witnessed considerable investment in new and renovated housing in the past few
years and the residential community along South Calle Encilia is home for a diverse group of
residents ranging from young children to senior citizens. Though we are sympathetic to the homeless
problem faced by every city, there must be a healthier location for such a facility than creating a
magnet for the homeless in the heart of a residential neighborhood one block from a playground. I
am in my 60s and currently feel safe as I enjoy my walks unencumbered by, petty crime, drug and
alcohol problems and I worry for my future safety and the safety of my neighbors.

Dear City Clerk,
I would like to clarify my position on the Well in the Desert site proposed for Calle Encilia in Palm
Springs. After some
research it is my firm opinion that local residents across the street, mostly at the Biarritz, will be
impacted negatively
with noise and crime. I therefore cannot support the proposal at the current location. Has the city considered
locating
the facility at the empty lot on the corner of Baristo & Farrell? That's right in back of the Palm Springs Police
station
where monitoring the activity will be easiest.

proposed location of the facility will be directly across from my bedroom at the Biarritz complex. We do
support assistance for vulnerable citizens, however, we would like assurance from the organization and the city
that the surrounding area will remain a safe and viable neighborhood. Put another way, after the cooling center
closes at 6:OOpm, where are the occupants expected to go? It would be helpful if the city and "Well" presented
a plan that will meet the needs of the homeless AND abutting neighbors.

Subject: Conditional Use Permit At 441 S Calle Encilia
As an employee and customer of Wangs In the Desert, I strongly oppose the issuance of a conditional use permit to Well in the Desert
for the building located at 441 S Calle Encilia
There have been a significant number of problems related to homeless people trespassing on the Wangs property; including harrassing
customers,breaking into cars in the parking lot,and sleeping on the property during bussines hours.
Also,there recently was a shooting/murder at the restaurant property nex door to Wangs.
This Cooling Center would serve as a magnet to bring in more homeless people and there problems.
It is for these reasons and more that i strongly oppose the issuance of a conditional use permit to Well in the Desert by the Planning
Commission.
