Ready, City Manager BY: Department of Planning Services SUMMARY This is a request for consideration of a proposed Zoning Code amendment to allow a five- foot high perimeter wall on the property line in a front yard area when the wall serves as a swimming pool safety enclosure. Section 93.20.00 of the Palm Springs Zoning Code (PSZC) currently allows a 4.5-foot high wall at the front property line; the amendment is intend to align with the 2016 California Residential Building Code, which now requires a five-foot high enclosure for swimming pools. RECOMMENDATION: 1) Waive the reading of the ordinance text in its entirety and read by title only; and 2) Introduce on first reading Ordinance No. , "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADOPTING AN AMENDMENT TO SECTION 93.02.00(B) OF THE PALM SPRINGS ZONING CODE (PSZC) RELATING TO WALL HEIGHT FOR RESIDENTIAL SWIMMING POOL SAFETY ENCLOSURES. However, this requirement was recently changed with the adoption of the 2016 Code, and a five-foot barrier is now required. Because many residential swimming pools in Palm Springs are located in front yard areas, this modified height requirement creates difficulties where the front perimeter wall also serves as the swimming pool safety enclosure. In order to comply with the additional height requirement, property owners would be required to file a Variance application to allow the additional wall height, or move the location of the perimeter wall. As a means to correct this issue, it is proposed that PSZC Section 93.02.00 be amended to include an exception to the wall height requirements for swimming pool safety enclosures. Wall height at the property line in the front yard setback area could be increased from 4.5 feet to five feet where necessary as a safety enclosure for swimming pools, and would be approved administratively by staff as part of the building permit review process. This proposed exception would only be applicable where required in front yard areas for swimming pool safety enclosures; in all other situations, perimeter walls would be required to conform to the standard height limits as are currently in place. The amendment to allow the exception for swimming pool safety enclosures is proposed as follows: Section 93.02.00— Walls, fences and landscaping. B. Security Fencing. Security fencing includinq swimming pool safety enclosure fencing, as required by any governmental agency of jurisdiction shall be permitted, notwithstanding any other provision of this Zoning Code. CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) DETERMINATION: The proposed Ordinance is not subject to the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) pursuant to Section 15060(c)(2) of the State Guidelines, because the Ordinance is directly related to ministerial actions, will not result in a direct or reasonably foreseeable indirect physical change in the environment, and is not a "project' as that term is defined in Section 15378 of the State Guidelines. �1 111 �nF�a ag_a AIC A L. City Attorney Summary The proposed ordinance allows an exception to the City's wall height limitations for swimming pool safety enclosures, as required by the California Building Code. THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Pursuant to Section 94.07.01 of the Palm Springs Zoning Code (PSZC), the Director of Planning Services is authorized to initiate proceedings and recommend amendments to the Zoning Code. B. The 2016 California Building Code establishes requirements for swimming pool safety enclosure fencing that is in conflict with PSZC Section 93.02.00, necessitating a change to the City's zoning requirements for perimeter walls. C. Notice of a public hearing of the Planning Commission of the City of Palm Springs to consider Case 5.1421 ZTA ("Zone Text Amendment") was given in accordance with applicable law. D. On June 14, 2017, a public hearing on the proposed Zone Text Amendment was held by the Planning Commission in accordance with applicable law, and after taking public testimony and reviewing all evidence presented in connection with the hearing, the Planning Commission voted 6 to 0 to recommend approval of the proposed ordinance to the City Council. E. Notice of public hearing of the City Council of the City of Palm Springs to consider Case 5.1421 ZTA was given in accordance with applicable law. F. H. The City Council hereby finds that the proposed Zone Text Amendment would: 1. Align the City's zoning requirements with the 2016 California Building Code; 2. Provide a ministerial process for property owners to comply with the updated Building Code requirements; and 3. Maintain the City's aesthetic standards for perimeter walls. A proposed increase in height allowed to 5 feet is not sufficient for those residents that have swimming pools located their front yards. A five foot fence may provide a deterrent for preventing children from accessing the pool area but it is not sufficient to provide privacy and security for the homeowner. Might I suggest allowing a 6 foot barrier for residences that have swimming pools located in the front yard. Given the increased problems with transients and property theft in the City of Palm Springs an increase in allowable height seems to be reasonable.
