SUBJECT: REQUEST BY THE CITY OF PALM SPRINGS TO AMEND PALM
SPRINGS ZONING CODE SECTION 92.03.01(C), SECTION 92.04.01(D)
AND SECTION 92.05.01(D) TO REVISE THE STANDARDS FOR HOTEL
RESTAURANTS IN THE R-2, R-3 AND R-4 ZONE DISTRICTS (CASE
5.1420 ZTA).

SUMMARY
This is a request for consideration of a proposed Zoning Code amendment to eliminate
the minimum number of hotel guest rooms required to allow hotel restaurant facilities in
the multifamily (R-2, R-3, and R-4) zone districts. The Zoning Code currently requires a
minimum of 20 hotel guest rooms (R-3 zone district) or 30 hotel guest rooms (R-2, R-4
zone districts) to allow the restaurant use subject to the approval of a Conditional Use
Permit (CUP). Hotels with less than the requisite number of guest rooms are prohibited
from having restaurant facilities. It is proposed that the guest-room threshold be
eliminated, and that restaurant facilities in multifamily zone districts be evaluated on a
case-by-case basis via the CUP process.
RECOMMENDATION:
1) Waive the reading of the ordinance text in its entirety and read by title only; and
2) Introduce on first reading Ordinance No. , "AN ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ADOPTING AN
AMENDMENT TO SECTIONS 92.03.01(C), 92.04.01(D), AND 92.05.01(D) OF THE

BACKGROUND INFORMATION:
Related Relevant City Actions
The City Council approved a Zone Text Amendment (Case 5.1334
05/07/14 ZTA)to allow restaurant facilities at hotels with 20 or more guest rooms
in the R-3 zone subject to a CUP. The previous ordinance only allowed
restaurants at hotels with 30 or more rooms.
The Planning Commission directed staff to prepare a Zone Text
Amendment pursuant to PSZC Section 94.07.01(A)(1) to revise the
04/26/17 threshold requirement for hotel restaurants in the R-3 zone district,
following the discussion of a restaurant at the La Serena Villas hotel
Case 5.1413 .
The Planning Commission reviewed an initial draft of the proposed
05/10/17 ordinance offering to different options for regulating hotel restaurants,
and rovided direction to staff.
The Planning Commission voted 6 to 0 to recommend approval of the
06/14/17 proposed ordinance to the City Council, with the elimination of the
threshold requirements in the R-2 and R-4 zone districts in addition to
the R-3 district.
STAFF ANALYSIS:
The Zoning Code currently allows restaurants at hotels with 20 or more guest rooms in
the R-3 zone (30 or more guest rooms in the R-2 and R-4 zones) upon approval of a CUP.
The guest room threshold requirement for hotel restaurants in the R-3 zone was reduced
from 30 rooms to 20 rooms in 2014 upon approval of Ordinance#1852; no changes were
made at that time to the guest room threshold requirements for the R-2 and R-4 zone
districts. No CUP is required for restaurants at resort hotels in multifamily zoning districts,
which are defined as hotels with 100 or more guest rooms; the guest room threshold
requirement only applies to hotels with less an 100 rooms.
The threshold number of guest rooms for the hotel restaurant use in multifamily zoning
districts is not tied to any other specific zoning requirement or development standard. In
determining whether or not a restaurant is an appropriate accessory use, consideration
must be given as to whether non-hotel patrons are necessary to make the restaurant
operations a viable use, and any associated impacts such as the availability of parking
spaces, traffic generation, noise, proximity to single-family residential districts, and similar
concerns.
Based upon discussion and direction given by the Planning Commission, it is proposed
that the guest room threshold requirements be eliminated, and that requests for hotel

restaurants in multifamily zoning districts be reviewed on a case-by-case basis through
the Conditional Use Permit (CUP) process. Under the CUP process, the application
would be reviewed for adequacy of parking, traffic generation, compatibility with
surrounding uses, noise impacts, and operational issues. The Planning Commission
would be able to impose conditions of approval to address any potential impacts, such as
limiting use by non-hotel patrons, limiting the days or hours of operation, prohibiting
outside advertising, and other similar measures which could address issues associated
with the accessory restaurant use. As the CUP process is a discretionary process, each
application would be evaluated on its own merits and specific site conditions, and
approval would be based on an assessment of the impacts and compatibility of the
restaurant use.
CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) DETERMINATION:
Pursuant to the California Environmental Quality Act (CEQA) Guidelines, the proposed
Zone Text Amendment has been deemed a "project." Staff has determined that the
proposed Zone Text Amendment (Case 5.1420) may be deemed Categorically Exempt
from the provisions of CEQA pursuant to Section 15061(b)(3) (General Rule) of the CEQA
Guidelines, because "it can be seen with certainty that there is no possibility that the
activity in question may have a significant effect on the environment." Approval of the
proposed Zone Text Amendment does not approve any development project. Future
development under the proposed changes would be subject to CEQA at that time, as
those actions would be classified as "projects" under CEQA.

ADOPTING AN AMENDMENT TO SECTIONS
92.03.01(C), 92.04.01(D), AND 92.05.01(D) OF THE
PALM SPRINGS ZONING CODE (PSZC) RELATING
TO THE REQUIREMENTS FOR HOTEL
RESTAURANT FACILITIES IN THE R-2, R-3 AND R-
4 ZONE DISTRICTS
City Attorney Summary
The proposed ordinance will remove the guest room threshold
requirement for accessory hotel restaurants in multifamily zoning
districts, and will allow the use in multifamily districts subject to the
discretionary approval of a Conditional Use Permit.
THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS:
A. Pursuant to Section 94.07.01 of the Palm Springs zoning Code
(PSZC), the Planning Commission is authorized to initiate proceedings and
recommend amendments to the Zoning Code.
B. On April 26, 2017, the Planning Commission directed staff to prepare
a Zone Text Amendment to modify the requirements for hotel restaurants in
multifamily zoning districts.
C. Notice of a public hearing of the Planning Commission of the City of
Palm Springs to consider Case 5.1420 was given in accordance with applicable
law.
D. On June 14, 2017, a public hearing on the proposed Zone Text
Amendment was held by the Planning Commission in accordance with applicable
law, and after taking public testimony and reviewing all evidence presented in
connection with the hearing, the Planning commission voted 6 to 0 to recommend
approval of the proposed ordinance to City Council.
E. Notice of public hearing of the City Council of the City of Palm
Springs to consider case 5.1420 ZTA was given in accordance with applicable law.
F. The proposed Zone Text Amendment (Case 5.1420 ZTA) is
considered Categorically Exempt from the provisions of the California
Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) (General Rule)
of the CEQA Guidelines, because "it can be seen with certainty that there is no
possibility that the activity in question may have a significant effect on the
environment." Approval of the proposed Zone Text Amendment does not approve
any development project. Future development under the proposed changes would
be subject to CEQA at that time, as those actions would be classified as "projects"

under CEQA. There, the proposed action qualifies for exemption and no further
environmental review is necessary.
G. On September 6, 2017, a public hearing on the proposed Zone Text
Amendment was held by the City Council in accordance with applicable law, and
the City Council has carefully reviewed and considered all of the evidence
presented in connection with the hearing on the Zone Text Amendment, including,
but not limited to, the staff report, and all written and oral testimony presented.
H. The City Council hereby finds that the proposed Zone Text
Amendment would:
1. Assist in retaining small hotel uses as part of the unique character of
Palm Springs in accordance with Policy LU7.6 of the General Plan;
2. Remove a regulatory barrier to the provision of quality services at
small hotel facilities in accordance with Policy LU7.7 of the General
Plan;
3. Maintain the discretionary ability of the City of Palm Springs to
approve restaurant facilities at hotel properties and implement
mitigation requirements as may be necessary.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. That the findings and determinations reflected above are true
and correct, and are incorporated by this reference herein as the cause and
foundation for the action taken by and through this Ordinance.
SECTION 2. Palm Springs Zoning Code (PSZC) Section 92.03.01(C)(13)
is hereby amended and restated to read as follows:
13. Restaurants, incidental or accessory to a hotel use, operated
primarily for the convenience of guests, and occupying not more than twenty
(20) percent of the gross floor area of the hotel buildings.
SECTION 3. That PSZC Section 92.04.01(D)(9) is hereby amended and
restated to read as follows:
9. Incidental or accessory commercial uses, including restaurant uses,
located within hotels containing less than one hundred (100) guest rooms
and operated primarily for the convenience of the hotel guests; providing
such total commercial uses shall occupy not more than twenty (20) percent
of the gross floor area of the hotel buildings.

SECTION 4. That PSZC Section 92.04.01(D)(16) is hereby deleted in its
entirety and the following subsection are renumbered accordingly.
SECTION 5. That PSZC Section 92.05.01(D)(5) is hereby amended and
restated to read as follows:
5. Restaurants, incidental or accessory to a hotel use, located within
hotels containing less than one hundred (100) guest rooms, and occupying
not more than twenty (20) percent of the gross floor area of the hotel
buildings.

Planning Commission took the following action:

Planning Director Fagg provided an overview on the two options proposed to
revise the standards for hotel restaurants as outlined in the staff report.
Chair Calerdine and Vice Chair Weremiuk spoke in preference of the second
option that requires a Conditional Use Permit on a case-by-case basis and to
eliminate the threshold requirement.
ACTION: Direct staff to prepare the zone text amendment and schedule a public
hearing.
Motion: Chair Calerdine, seconded by Vice Chair Weremiuk, and unanimously
carried 4-0-3 on a roll call vote.
