Ready, City Manager Initiated by: Engineering Services Department SUMMARY Formal City Council acceptance of the Mizell Senior Center Shade Canopy, City Project No. 15-12, is required to document the completion of the public works improvement, and to allow the City's filing of a Notice of Completion with the Riverside County Recorder in accordance with Section 9200 of the California Civil Code. RECOMMENDATION: 1) Accept the public works improvement identified as the Mizell Senior Center Shade Canopy, City Project No. 15-12, as completed in accordance with the plans and specifications; and 2) Authorize the City Engineer to execute and file for recordation with the Riverside County Recorder a Notice of Completion for the Mizell Senior Center Shade Canopy, City Project No. 15-12. STAFF ANALYSIS: On July 6, 2016, the City Council awarded a construction contract to NR Development, Inc., in the amount of $39,500 for the Mizell Senior Center Shade Canopy, City Project No. 15-12, (Project). The scope of the Project comprised fabricating and installing a fabric shade canopy, footings, powder coating structure posts and railings, modifying existing landscape and irrigation, reconstructing existing PCC pavement and retaining curb, removal and resetting existing decorative pavers, relocating existing bicycle rack, installing new concrete bench, and all appurtenant work. REMNO..�..�� City Council Staff Report September 26, 2017—Page 2 Acceptance of City Project No. 15-12 `I CIO -" MEN .r It Location Map Throughout construction of the Project two contract change orders were approved as follows: • Construction Contract Change Order 1 (CCO1) in the amount of $10,194.00 was approved by the City Manager on January 24, 2017, to include additional concrete flatwork to relocate the existing bike rack and placement of a seating bench under the shade canopy. In addition, modifying the strength of steel used for the shade canopy to comply with current building code requirements. • Construction Contract Change Order 2 (CCO2) in the amount of $1,774.00 was approved by the City Manager on March 27, 2017, to include extra concrete flatwork for a larger bike rack pad and `step out' pad adjacent to parking area. The final cost of the Project was increased by $11,968.00 from the original awarded contract amount of $39,500 for a final contract amount of $51,468; a copy of CCO1 and CCO2 is included as Attachment 1. As determined by City staff, the Contractor satisfactorily completed the Project on September 13, 2017. Staff recommends that the City Council accept the Project as required by Section 9200 of the California Civil Code, and authorize the City Engineer to file and record a Notice of Completion within 15 days of the City Council's action. A copy of the Notice of Completion to be submitted to the County is included as Attachment 2. 02 City Council Staff Report September 26, 2017—Page 2 Acceptance of City Project No. 15-12 ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15303 "New Construction or Conversion of Small Structures," Class 3 projects consist of construction and location of limited numbers of new, small facilities or structures such as electrical, and other utility extensions, as well as, accessory (appurtenant) structures, therefore, the Mizell Senior Center Shade Canopy, City Project. No. 15-12, is considered categorically exempt from CEQA, and a Notice of Exemption has been prepared and filed with the Riverside County Clerk. FISCAL IMPACT: As part of the 2013/2014 fiscal year budget, the City Council appropriated a budget of $25,000 from the Measure J Capital Project Fund for a new shade structure at the Mizell Senior Center. On July 6, 2016, the City Council appropriated an additional $25,000 from the Measure J Capital Fund (Fund 260) contingency reserve to award a construction contract to NR Development, Inc. In March 2017, an additional appropriation of $10,194 was funded through Capital Projects Fund (Fund 261). A total of$60,194 has been appropriated for the Project to date. Table 1 below is a summary of the total costs incurred for the Project. The Finance Department will add the cost of this project to the City's fixed asset system to include the creation of these assets in compliance with Governmental Accounting Standard Board (GASB) 34 Standards for Financial Reporting of Infrastructure Assets. New Items: A. Placement of additional concrete flatwork and removal/replacement of curbs $3,941.00 B. "Extra Strong" Sunbird 1 shade structure, structural calculations and footing mods. $6,253.00 Total Change Order Amount $10,194.00 Reason for Changes In Contract: A. To accommodate the installation of the shade structure, adjustments to existing concrete improvements are necessary. These include the removal and reconstruction of approximately 40 lineal feet of concrete barrier curb and the placement of approximately 80 square feet of 4" thick concrete flatwork. The flatwork will accommodate the relocation of the existing bike rack and the placement of a seating bench under the structure. The curb replacements will allow the adjacent parking space to be narrowed so that the structure does not overhang into the vehicle travel area. This miscellaneous concrete construction will be completed at the Lump Sum/Agreed Price of $3,941.00 and includes all appurtenant work such as excavation, grading, demolition, disposal, irrigation relocation, site clean-up, etc. to construct these improvements at the direction of the Engineer. B. The Sunbird 1 structure that was originally specified did not accommodate current building codes for maximum wind speeds. For this reason, the design is being changed to the Sunbird 1 "Extra Strong" model. This change requires modifications to the structural footings as well as additional costs for providing revised structural calculations. The Lump Sum/Agreed Price indicated above represents the difference in cost of the two structures, modifications to the footings and compensates the Contractor for the cost of additional design calculations.
