Ready, City Manager Initiated by: Department of Aviation SUMMARY This action allows the City Council to formally accept as complete the Taxiway J Pavement Reconstruction Project, IFB No. 17-06, and allows the City's filing of a Notice of Completion with the Riverside County Recorder in accordance with Section 9200 of the California Civil Code. RECOMMENDATION: 1) Accept the public works improvement identified as the Taxiway J Rehabilitation Project, IFB No. 17-06, as completed in accordance with the plans and specifications; and 2) Approve Change Order #2 in the amount of $2,323.20 and Change Order #3 in the amount of $7,465.79, for a total contract amount of $291,982.99 with All American Asphalt, a California corporation (A6999); 3) Authorize the Director, Department of Aviation, to execute and file for recordation with the Riverside County Recorder a Notice of Completion for the Taxiway J Pavement Reconstruction Project, IFB No. 17-06; and 4) Authorize the City Manager to execute all documents. BUSINESS PRINCIPAL DISCLOSURE: A search of records available through the Secretary of State of California shows that as of February 28, 2013, All American Asphalt was a California corporation with the following corporate officers: Mark Luer (CEO) and Michael Farkas (Secretary/CFO), with the following additionally listed Director: Thomas Toscas. ITEM NO.� �_ City Council Staff Report December 13, 2017— Page 2 Acceptance of City Project No. 17-06 STAFF ANALYSIS: On September 6, 2017, the City Council ratified the award of a construction contract for the Taxiway J Pavement Reconstruction Project, IFB No. 17-06, at Palm Springs International Airport, (Project), to the successful low bidder All American Asphalt, a California corporation, (Contractor), in the amount of $258,265. The scope of the Project consisted of removing and replacing the full depth of old existing asphalt on Taxiway J and applying the necessary required surface markings to meet Federal Aviation Administration standards. An aerial map of the site is identified here: '4LL Location Map On July 19, 2017, the City Council authorized the City Manager to approve and execute construction contract change orders up to a cumulative amount of 10% of the contract amount of $258,265 with all change orders reported to the City Council. During construction of the Project three contract change orders were required as follows: • On November 1, 2017, the City Manager approved Construction Contract Change Order 1 (CC01), in the amount of $23,929, to add aggregate rock as base material to provide the required structural foundation underneath the new asphalt pavement. Upon removal of the old asphalt pavement, it was then revealed the lack of sufficient aggregate rock base necessary to stabilize the surface asphalt of the taxiway. Unit pricing from the specification was used to calculate the cost. • Contract Change Order 2 (CCO2) in the amount of $2,323.20 is recommended for approval to compensate the Contractor for additional paint material required to paint 5" wide chevron markings versus 3" wide chevrons as required by the FAA. 4 . 02 City Council Staff Report December 13, 2017—Page 3 Acceptance of City Project No. 17-06 • Contract Change Order #3 (CCO3) in the amount of $7,465.79 is recommended to accommodate payment of final constructed quantities required to complete the Project in accordance with the bid items and quantities listed in the contract documents, as shown in Table 1. However, the Airport will deduct a fee of$500 required in cleanup of the project area performed by the Airport. The final increase for the three Contract Change Orders is 13.06% of the original base contract amount. A copy of each of the Change Orders is included as Attachment 1. As determined by contracted Construction Manager from URS, the Project was substantially completed and the Contractor satisfactorily finished the Project in accordance with the specifications on October 30, 2017. Staff recommends that the City Council accept the Project as required by Section 9200 of the California Civil Code, and authorize the Director of Aviation to file and record a Notice of Completion within 15 days of the City Council's action. A copy of the Notice of Completion to be submitted to the County is included as Attachment 2. ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Master Plan Update for the Palm Springs International Airport ("Master Plan") is considered a "Project", and in accordance with the CEQA Guidelines, the City acting as "Lead Agency' pursuant to CEQA, previously completed an environmental analysis of the potential impacts resulting from implementation of the Master Plan. A Notice of r,rle►,t to 03 City Council Staff Report December 13, 2017- Page 4 Acceptance of City Project No. 17-06 Adopt a Mitigated Negative Declaration ("MND") was previously filed, and on October 21, 2015, the City Council held a public hearing, and independently reviewed and considered the information contained in the MND prior to its review and approval of the Master Plan, and adopted Resolution No. 23908, adopting and ordering the filing of a Mitigated Negative Declaration for the Master Plan. The Taxiway J Pavement Reconstruction Project, IFB No. 17-06, further implements the Master Plan, and no further environmental analysis pursuant to CEQA is necessary. FISCAL IMPACT: On July 19, 2017, the City Council authorized the City Manager to accept FAA Airport Improvement Grant AIP 3-06-0181-055-2017 for partial funding of three airport capital projects, to include the Taxiway J Pavement Reconstruction Project, IFB No. 17-06. The AIP Grant will cover 90.66% of the total project cost. The remaining percentage is considered a local match and will be paid from the City's Airport Fund. Sufficient funds are budgeted and available in the Airport Capital Improvement Fund, Accounts 416-6401-56186 and 416-6601-56186. Table 2 below is a summary of the total costs incurred for the Project. The aggregate was sampled from the Thousand Palms pit stockpile on April 19,2017. Per your request the following tests were performed utilizing the current test procedures listed: 1) LA Abrasion (ASTM C-131/Cal-211) 2) Sand Equivalent(ASTM D-2419/Cal-217) 3) Durability Index Coarse(ASTM D-3744/Cal-229) 4) Maximum Density/Optimal Moisture(ASTM D-1557) 5) Resistance R-Value(ASTM D-2844/Cal-301) Limitations The results summarized in this report represents only the sample tested. We have striven to provide these results In accordance with generally accepted material testing practices in this community at the time our services are performed. No warranty or guarantee,either express or implied is made. All test results should be reviewed and accepted by the project engineer and contractor for conformance to the project specifications. Test results or observations reported may not be the same or comparable at other times or other samples. Our scope of work was to present our client with the results of testing. Our test results presented are not insurance, nor do they guarantee construction of any type. In all cases, the contractor shall retain sole responsibility for the deficiencies or omissions, regardless of when they are found.
