TO RELEASE SUBDIVISION IMPROVEMENT SECURITIES FOR THE
"DESERT PALISADES" DEVELOPMENT, TRACT MAP 35540

SUMMARY
On December 3, 2014, the City Council approved Tract Map 35540 and a subdivision
improvement agreement with Pinnacle View, LLC, a California limited liability company,
(Developer), securing the Developer's completion of certain required public and private
improvements associated with Tract Map 35540. The Developer has completed the
required public improvements, and the City Council may accept these improvements as
completed and complying with the City's approved plans, authorize release of
subdivision improvement securities, and accept a maintenance and warranty security
for the required one-year warranty period.
RECOMMENDATION:
Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF PALM SPRINGS, CALIFORNIA, AUTHORIZING ACCEPTANCE OF THE
SUBDIVISION IMPROVEMENTS ASSOCIATED WITH TRACT MAP 35540 AND

BUSINESS PRINCIPAL DISCLOSURE:
A search of records available through the Secretary of State of California shows that as
of January 26, 2010, Pinnacle View, LLC, a California limited liability corporation, was
managed by Weston Investment Co., an Oregon limited liability company. According to
an annual report filed with the Oregon Secretary of State, Weston Investment Co., LLC,
has one member, listed as Joseph E. Weston. Ed Freeman has also previously been
listed as the principal business member, serving as President of Pinnacle View, LLC.

STAFF ANALYSIS:
At its meeting on October 27, 2010, the Planning Commission recommended approval
of Tentative Tract Map 35540, which was subsequently approved by the City Council,
subject to conditions, on January 5, 2011. Tentative Tract Map 35540 is located at the
westerly terminus of Racquet Club Road as shown in Figure 1 —Vicinity Map.

Acceptance of Tract Map 35540
Desert Palisades Public Improvements
On December 3, 2014, the City Council adopted Resolution No. 23720, approving Tract
Map 35540 and an associated Subdivision Improvement Agreement, (SIA), with the
Developer. Tract Map 35540 created a subdivision of 110 single family residential lots
and infrastructure located at the westerly terminus of Racquet Club Road as shown in
Figure 2.

Acceptance of Tract Map 35540
Desert Palisades Public Improvements
Associated with Tract Map 35540 was a requirement to construct certain public and
private improvements, including:
• On-site private street and storm drainage improvements
• On-site public sewer and domestic water system improvements
• Off-site public street improvements
At the time Tract Map 35540 was approved by the City Council, construction of required
public and private improvements associated with Tract Map 35540 (the "Works of
Improvement") had not been completed. An engineer's estimate of the cost of the
Works of Improvement to be completed was $9,270,058.
In accordance with Section 66462 of the California Government Code, the Developer
requested that the City enter into the SIA securing the cost of the Works of
Improvement not yet completed to the City's satisfaction. Accordingly, pursuant to the
terms of the SIA, the Developer filed the following Security Instruments with the City
Clerk to guarantee construction of the Works of Improvement:
• Faithful Performance Letter of Credit, No. IS0256140U; $9,270,058
• Labor and Materials Letter of Credit, No. IS0256141 U; $4,635,029
• Monumentation Letter of Credit, No. IS0256139U; $30,000
• Maintenance and Warranty Letter of Credit, No. IS000020283U; $1,390,508
The Developer has completed construction of the Works of Improvement, and has
requested that the City Council accept the improvements and release the Security
Instruments in accordance with the terms of the SIA. On behalf of the City Engineer, the
City's Public Works Inspectors have inspected the Works of Improvement and found
them to be in accordance with the City's approved plans and specifications, and
recommends the City Council accept the improvements and release the Security
Instruments in accordance with the SIA. The Security Instrument for the Maintenance
and Warranty of Improvements will be held by the City Clerk, and released following
expiration of the one-year warranty period, and confirmation by the City Engineer that
no claims of defective improvements have been received.
ENVIRONMENTAL IMPACT:
Tentative Tract Map 35540 was considered a "Project" pursuant to the California
Environmental Quality Act ("CEQA") Guidelines. The City, acting as Lead Agency
pursuant to CEQA, prepared an Environmental Impact Report (EIR), identified by State
Clearinghouse #2007121044, for Tentative Tract Map 35540. On January 5, 2011, the
City Council adopted Resolution No. 22846 certifying the EIR and approving Tentative
Tract Map 35540. Acceptance of the public improvements associated with Tract Map
35540 implements the Project as envisioned by Tentative Tract Map 35540, and is
therefore consistent with the EIR previously certified by the City Council, and no further
action with regard to CEQA is required.

Desert Palisades Public Improvements
FISCAL IMPACT:
The Works of Improvement include both publicly maintained and privately maintained
improvements. The public improvements to be accepted and subsequently maintained
by the City include the off-site street improvements constructed along Racquet Club
Road, and the on-site public sewer system improvements. Sufficient funds are budgeted
as part of the City's annual fiscal year budget in the Gas Tax, Measure A, and
Wastewater Enterprise Funds to accommodate maintenance of public street and sewer
improvements.
Private improvements will be maintained by the Homeowners Association pursuant to
the Covenants, Conditions and Restrictions (CC&Rs) recorded against the properties
within Tract Map 35540.

ASSOCIATED WITH TRACT MAP 35540 AND
AUTHORIZING RELEASE OF SECURITIES REQUIRED BY
THE SUBDIVISION IMPROVEMENT AGREEMENT WITH
PINNACLE VIEW, LLC, A CALIFORNIA LIMITED LIABILITY
COMPANY, FOR PROPERTY LOCATED AT WESTERLY
TERMINUS OF RACQUET CLUB ROAD, IN SECTION 4,
TOWNSHIP 4 SOUTH, RANGE 4 EAST.
WHEREAS, the Planning Commission of the City of Palm Springs, at its meeting of
October 27, 2010, recommended approval of Tentative Tract Map 35540, subject to
conditions; and
WHEREAS, the City Council of the City of Palm Springs, (hereinafter the "City"), at its
meeting of January 5, 2011, approved Tentative Tract Map 35540 subject to conditions;
and
WHEREAS, the City Council of the City of Palm Springs, (hereinafter the "City"), at its
meeting of December 3, 2014, adopted Resolution No. 23720, approving Tract Map
35540 and a related Subdivision Improvement Agreement, (Agreement No. 6635), with
Pinnacle View, LLC, a California limited liability company, (hereinafter the "Developer"),
in accordance with Section 66462 of the California Government Code; and
WHEREAS, in accordance with Section 4.1 of the Subdivision Improvement Agreement,
the Developer was required to submit subdivision improvement securities in the amount
of $9,270,058 to guarantee construction of certain public improvements required for and
associated with Tract Map 35540, (the "Works of Improvement'); and
WHEREAS, the Developer has filed with the City Clerk a performance bond in the
amount of $9,270,058, a labor and materials (payment) bond in the amount of
$4,635,029, and a Monumentation (payment) bond in the amount of $30,000 in
accordance with the Subdivision Improvement Agreement; and
WHEREAS, the Developer has completed construction of the Works of Improvement,
and has requested that the City accept the Works of Improvement in accordance with
Section 1.14 of the Subdivision Improvement Agreement; and
WHEREAS, in accordance with Section 4.5 of the Subdivision Improvement Agreement,
the Developer has requested that the City release the subdivision improvement
securities filed with the City Clerk to guarantee construction of the Works of
Improvement; and

WHEREAS, the City Engineer has examined the Works of Improvement, and has found
them to be constructed and completed in accordance with the Subdivision Improvement
Agreement, and the associated plans and specifications; and
WHEREAS, the City Engineer recommends that the City Council accept the Works of
Improvement, and authorize the City Clerk to release the subdivision improvement
securities filed with the City Clerk to guarantee construction of the Works of
Improvement, with the exception of the warranty security required by Section 4(b) of
Subdivision Improvement Agreement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES
HEREBY RESOLVE AS FOLLOWS:
Section 1. The recitals above are found to be true and correct and constitute the
findings of the City Council made in support of this resolution.
Section 2. The City Council hereby finds and determines that the Works of
Improvement have been completed in accordance with the relevant
provisions of the Subdivision Improvement Agreement and the approved
plans and specifications, and the City Council hereby accepts the
completed Works of Improvements.
Section 3. The City Council's acceptance of the Works of Improvement effectuated
by this resolution shall not in any way supersede or relieve Pinnacle View,
LLC, a California limited liability company, or its successors and assigns,
of any other obligations required by the Subdivision Improvement
Agreement or the conditions of approval associated with Tentative Tract
Map 35540.
Section 4. The City Council's acceptance of the Works of Improvement effectuated
by this resolution shall not in any way impose an obligation on the City of
Palm Springs to maintain those improvements that are required to be
privately maintained by a Homeowners Association through Covenants,
Conditions and Restrictions (CC&R's), including the private streets
associated with Tract Map 35540.
Section 4. In accordance with Section 4.5(a) of the Subdivision Improvement
Agreement, the City Clerk is hereby authorized to release the following
Security Instruments previously filed with the City Clerk to guarantee
construction of the Works of Improvement:
• Faithful Performance Letter of Credit, No. IS0256140U; $9,270,058
• Labor and Materials Letter of Credit, No. IS0256141 U; $4,635,029
• Monumentation Letter of Credit, No. IS0256139U; $30,000

Section 5. In accordance with Section 4.5(b) of the Subdivision Improvement
Agreement, the City Clerk is hereby authorized to release the Bond for
Maintenance and Warranty of Improvements, Letter of Credit No.
IS000020283U, in the amount of $1,390,508 upon expiration of the
warranty period following one year of the City Council's acceptance of the
Works of Improvement, and upon receipt of the City Engineer's verification
that no claims regarding defective work associated with the Works of
Improvement have been received.
Section 6. The City Clerk, following adoption of this resolution, shall file with the
Riverside County Recorder, the Acceptance of the Works of Improvement
Certificate attached hereto.

fully satisfied its obligations under the following documents:

The Mitigation Monitoring Program
Our attached letter describes a few areas where we believe the developer has not fulfilled its entire obligation.Releasing the financial
surety before completion of the requirements makes it more difficult to exact improvements from the developer and shifts the financial
burden from the developer to the people of Palm Springs.
We ask that you consider our concerns and enter this letter into the formal public record.

DEVELOPMENT, TRACT MAP 35540
Dear Mayor and City Council Members,
Before approving the release of securities for the Desert Palisades Development we would like
you to ensure that the full breadth of the requirements by the Specific Plan, EIR, and tract map
are satisfied. In our one day review, it appears that not all the conditions and terms have been
satisfied. Below is just a small example:
1. All the required hiking trails have not been installed and/or do not satisfy the paving
requirements
2. The five interpretive plaques do not appear to be in place
3. W. Racquet Club Road has been damaged and not repaired
4. The developer has not removed the tailings from the rock berm they created along the
north side of W. Racquet Club Road
5. Has the $14,610 been paid for a traffic signal at Via Escuela and N. Palm Canyon Drive
as required by TTM #35540 Condition of Approval ENG 75
6. The developer continues to utilize the homes within the Desert Palisades as "event
houses" seemingly without permits: 2025 Celestial- Desert House

Missing Trails
There should be a trail from W. Racquet Club Road that is missing and it should be made of
decomposed granite.

Page 20 of the Specific Plan:
New public hiking trails will be added to the project site and this portion of the Chino Cone
through the implementation of Desert Palisades. The locations of these hiking trails are shown
on the Site Plan in Exhibit 5. All open space corridors and trails between home sites interior to
the project are proposed to be left in a natural state. The trail fronting the south side of Tram
Way(northwest comer of the property) will be wider than those interior to the project(8 feet) and
will be surfaced with Adopted January 5, 2011 - 20- Desert Palisades Specific Plan—ESA-SP
Planning Area #4 City of Palm Springs decomposed granite. Additional discussion on the
appearance and maintenance of the project's trail system is provided in later sections of this
document, as well as Appendix A (Trails Analysis).
Page 67 of the Specific Plan:
The Conceptual Master Plan of Trails for the Chino Cone (displayed in Exhibit 12) was
developed through feedback from neighboring property owners, as well as the City, and is also
incorporated into the EiR prepared for the Desert Palisades. This exhibit outlines the pedestrian
connectivity between the project and the surrounding recreational opportunities within Chino
Canyon.

In addition to the design of individual home sites, there are four proposed design situations
within the Desert Palisades project where low intensity, native landscaping materials will be
incorporated. These include: The main entry to the project from Racquet Club Road, the
northwest portion of the property fronting Tram Way(including the perimeter trail which
provides a connection to Racquet Club Road), ........
Page 99 of the Specific Plan:
Adjacent to the channel will be the trail, which will have a decomposed granite surface and will
accommodate both pedestrians and bicyclists, and will have a linkage to the meandering natural
surface hiking trail proposed throughout the project. This trail will also transition to an additional
trail extending east/west toward the main entry of the project and Racquet Club Road, which will
also be surfaced with decomposed granite.

Hiking Trails—Proposed Surfaces, Entries, Linkages, and Crossings
As previously discussed, three sets of trails are proposed for the project. One of these trails will
meander parallel to Tram Way along the project's northwest frontage, one extends along the
project's northern boundary—creating a pedestrian connection between Tram Way and
Racquet Club Road, and another internal trail system will connect to the perimeter system and
meander throughout the project, crossing streets in several areas.
Exhibits 12, 15, 16, 18, and 19A, B, & C clearly depicts this trail and the decomposed granite
along Tram Way.
Exhibit 23 clearly indicates where the trail should connect to W. Racquet Club Road.
Several visits to the site indicate that this trail is not there.
Interpretive Plaques
The Specific Plan calls for five (5) interpretive plaques that are not in place

Section 92.21.1.05 of the ESA-SP Ordinance requires an "interpretive nature center'or
"specialty park"for all proposed projects in the zone, which will be provided onsite along with
the establishment of the interpretive hiking/biking trail system proposed throughout the
community. There are a number of potential locations for the interpretive center, which will be
accessible by the trail system and will include a small gathering area (utilizing decorative
benches and native rocks with naturally flat surfaces for seating), and a series of plaques
identifying the native flora and fauna and other natural and cultural features of the Chino Cone
area (refer to Exhibit 13). The trail system itself will also contain benches and plaques at
appropriate points along the trails.

Condition of Approval PLN 35 for TTM 35540 requires Interpretive Centers in each planning
area.
Condition of Approval ENG 21 requires the trials to be dedicated to the City of Palm Springs

Exhibit 13 depicts the locations of the 5 interpretive plaques
Appendix A provides the Chino Cone Trails analysis
Damage to Racquet Club Road and other streets
W. Racquet Club Road as well as side streets of Milo and Janis have been damaged and not
repaired. During the construction and installation of Desert Palisades' infrastructure, street
cleaners gouged the streets and heavy trucks broke up parts of the streets. These streets
should be returned to their original state.
Condition of Approval ENG 12
All broken or off grade street improvements shall be repaired or replaced
Condition of Approval ENG 61
.....the pavement conditions of the existing off-street shall be returned to a condition equal or
better than existed prior to construction of the proposed development
Berm north of W. Racquet Club Rd.
The developer dug a massive utility ditch north of W. Racquet Club road within the City R.O.W.
This created a berm two stories high. The utility trench was filled in with off-site fill of sand with
the entire 2-story berm remaining in place and spread across the public R.O.W. and into the
adjacent property. Public testimony at the Planning Commission by the adjacent property owner
stated this would be removed. This fill created an elevation increase reducing the enjoyment of
the adjacent property and will impact the height of any future development proposed for the
land.
Condition of Approval Eng 46 - requires a financial security to ensure areas are re-naturalized
Condition of Approval Eng 61 -Although this condition relates to the roadway it is also related to
the R.O.W. as this is where the public utilities were placed.
Page 19 of the specific Plan:
Findings:As previously discussed, grading will be required to construct the site's
roadways/infrastructure and install utilities. The preliminary grading plan submitted with the
Specific Plan is limited to only these roadways. Once this initial phase of grading is completed,
disturbed areas will be re-naturalized and lots will remain undisturbed until individual owners are
ready to construct homes.
Page 117 of the Specific Plan:
Findings: As proposed, the Desert Palisades project will respect existing topography and natural
features as much as possible. Site disturbance will be limited to the initial grading for street and

Homes within Desert Palisades used as rentals and event houses
Little Tuscany residents have complained about the abundance of activity within the Desert
Palisades Development including homes being used as event houses creating a significant
impacts to the Little Tuscany neighborhood. It seems this activity is continuing unchecked. Palm
Springs Code requires a vacation rental and event house to be registered and for the
registration number to be listed in all advertisements. This is not the case as can be seen in the
following example where the property is being managed by McLean Company Rentals.
