Fuller, Assistant City Manager SUMMARY The Downtown Palm Springs Specific Plan includes a 1,515 space parking facility that incorporates subterranean, surface, and above grade parking spaces throughout the Specific Plan area. Approximately 515 spaces are located on private property and reserved for the exclusive use of future tenants in the project (i.e. apartment residents, professional offices, hotel and restaurant valet parking). The remaining 1,000 parking spaces are located on City property and are available as free public parking, which requires the City Council to establish parking regulations for these new public parking areas. This action will allow the Council to consider a Parking Management Program for the Specific Plan area that includes the following elements: 1. Four (4) hour maximum parking time limit for the public parking areas; 2. Designated employee parking spaces with twelve (12) hour maximum parking time limit; 3. Designating that the public parking areas are closed from 3:00 AM to 6:00 AM for cleaning and security purposes; 4. Authorizing the designation of certain on-street parking spaces as loading areas for commercial deliveries, as well as for drop-off and pick-up of users of Transportation Network Companies (Uber/Lyft), in locations and with appropriate signage as recommended by the City Engineer; 5. Providing for implementation of the Parking Management Program for 12 months, subject to automatic renewal unless otherwise modified by the City. This action will allow the City Council to consider approval of Amendment No. 1 to the current agreement with Ace Parking Management, Inc., to expand its services to cover the new public parking areas, to initiate enforcement of the City's electric vehicle charging stations, and to incorporate the use of a Mobile License Plate Recognition Enforcement System to improve its efficiency in providing parking enforcement services versus the use of chalking. rrEM NO. Finally, this action will also allow the City Council to consider increasing the existing 2- hour parking limitations for all on-street parking spaces throughout the City to 3-hours. RECOMMENDATION: 1. Adopt Resolution No. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ESTABLISHING A PARKING MANAGEMENT PROGRAM FOR THE DOWNTOWN PALM SPRINGS SPECIFIC PLAN, INCLUDING A MAXIMUM 4-HOUR PARKING TIME LIMIT FOR PUBLIC PARKING SPACES, DESIGNATING CERTAIN AREAS AS EMPLOYEE PARKING SPACES WITH A MAXIMUM 12-HOUR PARKING TIME LIMIT, AND AUTHORIZING CLOSURE OF THE PARKING FACILITIES FROM 3:00 AM TO 6:00 AM;" 2. Approve the First Amendment to Contract Services Agreement (A6497) with Ace Parking Management, Inc., a California corporation, in the amount of $68,654 annually for a total contract amount of $205,732 annually, and extending the term thereof by two years through March 18, 2023; 3. Approve the Street Level Parking and Parking Garage Way-finding Master Sign Plan for "Downtown Palm Springs," dated October 5, 2017, prepared by Best Signs, Inc.; 4. Authorize the City Manager to designate on-street parking spaces for time-limited parking (3 hour or 20 minute loading); 5. Authorize the City Manager to re-designate all 2-hour time-limited on-street parking spaces within the City to a 3-hour time limit; and 6. Authorize the City Manager or designee to take all actions needed to execute these actions. BUSINESS PRINCIPAL DISCLOSURE: Ace Parking, Inc. A search of records available through the Secretary of State of California shows that as of July 1, 2003, Ace Parking Management, Inc., is a California corporation with its corporate officer listed as John Baumgardner as CEO/Secretary/CFO, and Scott Jones as its Director, and owns 100% of Ace Parking Management, Inc. 02 City Council Staff Report February 7, 2018-- Page 3 Downtown Palm Springs Specific Plan Parking Management Plan BACKGROUND: The City and Palm Springs Promenade, LLC, a California limited liability company, (hereafter the "Developer"), entered into a Project Financing Agreement (hereafter the "PFA") on September 29, 2011, wherein, Developer conveyed fee title of the parking facilities for the Project (Parking Facility) to the City. In the Grant Deed conveying the Parking Facilities to the City, the City agreed to "operate, maintain, and use the Parking Facilities as and for free parking in a safe, sound, attractive, operational and top quality condition, in perpetuity, for the benefit of the public, including without limitation Grantor, its authorized agents, employees, guests, invitees and customers, and Grantor's authorized tenants and subtenants, and their authorized agents, employees guests, invitees and customers..." The Project is generally located south and east of Museum Drive (and its extension to Belardo Road), west of Palm Canyon Drive, and north of Tahquitz Canyon Way, and includes 1,515 total parking spaces consisting of 615 above ground parking spaces and 900 underground parking spaces, with 515 spaces located on private property and reserved for private use, as shown in Figures 1 through 3 on the next pages. Actual number of parking spaces is subject to change based on revisions to parking striping, modification of ADA spaces, etc. Staff engaged the services of Walker Parking Consultants, a nationally renown parking consulting firm with more than 50 years experience providing parking consulting services. Parking Time Limits Turnover of parking spaces is necessary to ensure parking is regularly available for customers. With a robust enforcement program it is recommended that the City establish a 4-hour parking limit. A robust enforcement program includes an enforcement policy, consistent patrolling, set hours of enforcement, utilizing mobile License Plate Reading (LPR) system and a trained enforcement staff to ensure customers are following parking regulations. Palm Springs Municipal Code, Section 5.38.040 provides that the City Council may, by resolution, "specify the regulations pertaining to each vehicle parking facility including parking rates or fees, allowable maximum and/or minimum parking time limits, special validation programs, incentive parking programs, preferential employee parking, valet parking and long-term rental parking." In consultation with the City Council Ad-Hoc Subcommittee (Mills/Roberts) and Developer at a meeting held in October 2017, staff is recommending that the Council confirm the 4-hour limit for public parking spaces that has been established. Nightly Parking Closure Protocols The Grant Deed conveying the Parking Facility to the City requires the Parking Facility to remain open 24 hours per day, seven days a week, but was amended through an amendment to the Project Financing Agreement such that the City Council may close the Parking Facility between the hours of 3:00 A.M. to 6:00 A.M. Staff is recommending the City Council authorize closure of the Parking Facility during these hours to address issues related to vagrancy and unwanted uses in the Parking Facility late at night. In cases where drivers are unable to drive and leave their vehicles overnight, staff recommends that the Council allow the City Manager to establish administrative regulations allowing for extended parking as a means of preventing drunk driving. 07 City Council Staff Report February 7, 2018 -- Page 8 Downtown Palm Springs Specific Plan Parking Management Plan Employee Parking When employees park in free Public Spaces, particularly in the spaces that are closest to their place of work, they occupy prime spaces for extended periods of time. Furthermore, as the majority of employee shifts are longer than four hours, those employees would have to move their cars every four hours to comply with the time limits. Therefore, it is recommended that designated areas of the Parking Facility be provided for employee parking. Staff recommends two locations for Employee Spaces: (1) the underground tunnel between the north and south underground garages, adjacent to Museum Dr. extending into the underground level of the north parking structure; and (2) the upper level of the north parking structure across from the Palm Springs Art Museum (see Figure 4). Employee Spaces will be striped with a different color than the Public Spaces and signs identifying the spaces for employees parking will also be posted. A total of approximately 220 spaces would be designated for employee parking. Initially, staff recommends that joint use of Employee Spaces by the general public be allowed, with additional signage, but subject to the 4-hour parking time limit. Employee Spaces will be made available to employees through a Parking Permit Program to be established by the City Manager. As a first phase for employees of the Palm Springs Art Museum and the Rowan Hotel, in consultation with the City Council Ad-Hoc Subcommittee (Mills/Roberts) and Developer at a meeting held in October 2017, staff is recommending that the Council confirm designation of the lower and upper levels of the north garage as employee parking areas. Subsequently, as employee parking demands increase, staff recommends using the underground tunnel extending between the north and south garages located below the parcels adjacent to Museum Drive identified as Block H-1 and Block H-2. Main Street Coordination At the January 30, 2018, Main Street Board Meeting, staff presented the proposed Parking Management Program, identifying the 4-hour time-limit and employee designated parking areas. At that time, the Main Street Board was receptive to the proposed Parking Management Program, with the following observations: • Revise the signage at the Hyatt entrance ramp to the north underground parking garage; • Provide for overnight parking for those vehicles where the driver is intoxicated and cannot drive; • Consider additional time for on-street parking elsewhere within the City. Staff has requested the Hyatt entrance ramp signage to be revised to indicate "North Public Parking" in larger text to improve its visibility. Staff will also be installing three additional "Free Public Parking" signs along Palm Canyon Drive from Amado Road to the Hyatt entrance ramp to provide improved directional signage into the underground parking garage. Staff is also recommending that the Council consider increasing the 2-hour parking time limit to 3-hours for the existing on-street parking spaces throughout the City. With the additional 1,000 public parking spaces available, it is anticipated that an additional hour of on-street parking can be accommodated without affecting availability of parking. An additional hour of on-street parking also addresses prior concerns from the merchants of lack of sufficient time for customers to shop, dine and fully enjoy the retail area. C9 City Council Staff Report February 7, 2018 -- Page 10 Downtown Palm Springs Specific Plan Parking Management Plan Enforcement Program Staff anticipates that the initial form of parking enforcement will be performed by tracking the times when customers and employees arrive and by monitoring how long they leave their vehicles parked. The City's current parking enforcement vendor (Ace Parking) will be required to patrol the Parking Facility. It should be noted that Ace Parking is currently under contract to provide the City with parking enforcement services at the Airport, streets, and existing downtown parking facilities (Downtown Parking Structure located at the northwest corner of West Baristo Road and South Indian Canyon Drive). However, an amendment to this contract will be required to establish parking enforcement services at the Parking Facility located at the Downtown Palm Springs Revitalization Project. Staff has negotiated an amendment to the Ace Parking contract, to include the cost of expanding their services to the Parking Facility, inclusive of the use of a Mobile License Plate Recognition (LPR) system, discussed in more detail on the next page. Staff also recommends using this opportunity in amending the Ace Parking contract, to include enforcement of the City's Electric Vehicle Charging Stations (EVCS's). The City previously installed 34 EVCS's throughout the City, noted with signage as limited to a 2- hour use. As more electric vehicles are being driven, there is more demand for use of the City's EVCS's, and enforcement of the 2-hour limit for charging at the City's EVCS's is necessary. The Sustainability Commission will also be considering a recommendation to implement a fee for use of the City's EVCS's. The Ace Parking amendment will include patrols of the 34 EVCS's and citations for vehicles exceeding the 2-hour time limit. In anticipation of the new enforcement, on January 1, 2018, staff provided advance notice at each EVCS's of the City's intent to begin enforcement of the 2-hour time limit. Mobile License Plate Recognition (LPR) System It is recommended that the City utilize a Mobile License Plate Recognition System. License plate recognition involves capturing photographic video or images of license plates, which can be processed by a series of algorithms to provide an alpha numeric conversion of the captured license plate images into data. This system would allow parking enforcement staff to efficiently drive through the Parking Facility, scan license plates, and know immediately if cars are parked in areas they should not be parked in (such as employees) or have overstayed their time limit (such as customers). Ace Parking has proposed to add the LPR system to its vehicles at a cost of $36,000 amortized over 3 years. The proposed amendment to the contract with Ace Parking will extend the term of their contract by 2 years to accommodate amortizing the cost of the LPR system; a copy of the contract amendment is included as Attachment 1 . 10 City Council Staff Report February 7, 2018 -- Page 11 Downtown Palm Springs Specific Plan Parking Management Plan Parking Management Agreement Pursuant to the terms of the Project Financing Agreement, it is necessary for the City to coordinate with the Developer on the terms and conditions of parking restrictions, and in otherwise managing parking of vehicles within the City's Parking Facility. As the Developer owns private parking facilities that are accessed through the City's Parking Facility pursuant to an Easement Agreement previously approved by the Council as part of the Project Financing Agreement, it is necessary to coordinate with the Developer on the administrative regulations associated with the Parking Management Program. Accordingly, the City Manager will establish a Parking Management Agreement with the Developer identifying the administrative regulations related to parking time limits, designated employee parking areas, closure of the Parking Facility, and related issues, recommended as a term of 12-months, subject to automatic renewal, unless otherwise terminated with 60 days' notice. Street Level Parking/Parking Garage Wayfinding Master Sign Plan In preparation for the opening of the Downtown Project in December 2017, the Developer commissioned the preparation of a Master Sign Plan by Best Signs for the Parking Facilities, including on-street surface parking and wayfinding signage. A Master Sign Plan dated October 5, 2017, was prepared by Best Signs and reviewed by the City Council Ad-Hoc Subcommittee (Mills/Roberts) and Developer at a meeting held in October 2017. At that time, the Ad-Hoc Subcommittee approved implementation of signage for the Parking Facilities to allow for opening by December 2017. The signage that has been installed consists of the "north" and "south" designations, section designations (by number and symbol), 4-hour parking time restriction, parking closed 3AM-6AM signage, and directional signage as was considered necessary to the opening of the Parking Facilities. It should be noted the Master Sign Plan dated October 5, 2017, identified a 3-hour parking time restriction and a closure time of 2AM-6AM; however, based on direction given by the Ad-Hoc Subcommittee, and in consultation with the Developer, a 4-hour parking time restriction and closure time of 3AM-6AM was approved. A copy Master Sign Plan by Best Signs for the Parking Facilities dated October 5, 2017, is included as Attachment 2. Staff recommends the Council to confirm and approve the Master Sign Plan as it has been implemented at the direction of the City Council Ad-Hoc Subcommittee (Mills/Roberts) in October 2017, inclusive of the following elements: • Establishing valet only and drop/off signage for designated on-street spaces approved by the City Manager. These spaces will be designated by signage shown as Detail P-3 of the Master Sign Plan, included here. The signage will comply with the City's current sign ordinance with regard to shape and size. The DEIR was released for review on October 22, 2008. Notices of the reports were sent to all applicable agencies and published in accordance with CEQA. Comments were received by the City and responses to comments were provided in the Final Environmental Impact Report (FEIR). The FEIR determined that the project would result in post-mitigation significant effects on aesthetics/visual resources, regional air quality, and cultural resources. However, the City Council concluded that the benefits of the Specific Plan implementation would outweigh the potential adverse effects. 15 City Council Staff Report February 7, 2018-- Page 16 Downtown Palm Springs Specific Plan Parking Management Plan On November 18, 2009, the City Council adopted Resolution No. 22625, which was re- adopted on December 2, 2009, certifying the FEIR including Findings and a Statement of Overriding Considerations associated with the Specific Plan approval. In 2012, the City prepared Addendum #1 to the FEIR for the Specific Plan. Addendum #1 was prepared to evaluate the revised Downtown Revitalization Plan ("Downtown Palm Springs"), as well as the approval of a parcel map to realign property boundaries, the dedication of public streets and abandonment of certain rights-of-way, and acceptance of public easements. Addendum #1 evaluated the potential visual and aesthetic impacts that could result from the proposed changes and found that the overall effects would be no more significant than those associated with the implementation of the adopted Specific Plan. No other environmental impacts were expected to result that were not analyzed and mitigated in the previously certified FEIR, Statement of Overriding Considerations, and Mitigation Monitoring and Reporting Program. Addendum #1 was adopted by City Council on October 17, 2012. In 2015, the City prepared Addendum #2 to the FEIR to evaluate the potential environmental impacts of the changes to the Specific Plan identified in the Amendment, which included various revisions and updates to the Specific Plan, the development of Block E as the Downtown Palm Springs Park, and a Major Architectural Application for the development of a hotel use of up to 75 feet located on Block B-1 (Case No. 3.3908 MAJ). The environmental analysis concluded that the potential environmental impacts associated with the revised Specific Plan identified in the Amendment were substantially consistent with the impacts previously analyzed in the certified FEIR and in Addendum #1 approved in 2012, No changes were proposed that would require major revisions to the previously certified FEIR, and it was determined that the revised Specific Plan identified in the Amendment will ultimately reduce the overall intensity and density previously allowed within the originally adopted Specific Plan. It was also determined that the potential environmental impacts associated with the revised Specific Plan identified in the Amendment will result in the same or reduced environmental impacts when compared to those analyzed in either the previously certified FEIR or Addendum #1 approved in 2012. The City determined that none of the components of the revised Specific Plan identified in the Amendment will result in a significant effect not previously identified in the certified FEIR or Addendum #1 approved in 2012. The Findings and Statement of Overriding Considerations adopted by the City in 2009 are consistent with the environmental analysis provided in Addendum #2. RECITALS A. City has determined that there is a need for parking enforcement services at various City owned public parking facilities and along public streets (hereinafter "parking enforcement"), and on February 19, 2014, the City Council approved a Contract Services Agreement (A6497) with Consultant to provide parking enforcement. B. The Downtown Palm Springs Specific Plan includes a 1,515 space parking facility that incorporates subterranean, surface, and above grade parking spaces throughout the Specific Plan area, with approximately 1,000 parking spaces located on City property and will be made available as free public parking, (the "New Public Parking Facility"). C. At the time the City approved Contract Services Agreement (A6497) with Consultant to provide parking enforcement, the scope of work did not include parking enforcement of the New Public Parking Facility, as refurbishment of the New Public Parking Facility was not completed. D. Refurbishment of the New Public Parking Facility is nearing completion, with opening to public use planned for the immediate future, and for which the City Council has establish parking regulations to allow for parking enforcement of it. E. The City also operates thirty-four (34) electric vehicle charging stations at various locations throughout the City, and has established a two (2) hour maximum time limit for use of these electric vehicle charging stations. F. It is necessary to expand the scope of services for Contract Services Agreement (A6497) with Consultant to provide parking enforcement of the New Public Parking Facility and at the City's various electric vehicle charging stations. G. Consultant has submitted to City a proposal to provide parking enforcement of the New Public Parking Facility and at the City's various electric vehicle charging stations, including the use of a Mobile License Plate Recognition Enforcement System for all parking enforcement services City-wide, at an increased cost of$43,654 annually. H. City wishes to amend Contract Services Agreement (A6497) to add the additional parking enforcement services and extend the term to incorporate the first of the two (2) two (2) year optional renewals, and to incorporate an annual budget of $25,000 for additional "on-call" parking enforcement services, all as identified in this Amendment No. 1. It is important to note that the services do NOT include the Parking Citation Processing and Collecting services, as the City shall contract separately for those services. Please note that sub-contracting is NOT permitted under this contract. Contractor's Responsibilities: Enforce the City's downtown, on-street and parking lot parking program. Please note that this program may be modified at the discretion of the City Manager or the City Manager's designee at any time. Contractor shall provide three (3) qualified, trained personnel who will collectively work approximately 100 hours per week: one (1) full-time Onsite Supervisor/Parking Control Officer (PCO) who will work 9 a.m. until 6 p.m.(40 hours); two (2) part-time PCO to work assigned shifts as necessary to provide parking enforcement services of the various City parking facilities. These hours and schedule may increase or decrease based on the City's needs. Each eight (8) hour shift will be given a meal break of one (1) hour. Health requirements must be substantiated by providing a health certificate that includes a medical exam and an eye exam provided by a Licensed Medical Doctor in the State of California. Parking Enforcement Regular Duty: Contractor shall enforce all parking related ordinances, statutes, and codes as required and where required by the City Manager or the City Manager's designee. Patrol Routes: Contractor's PCOs shall patrol areas in accordance with the patrol plan developed and approved by the City's Contract Administrator. On occasion the City is requested to have a PCO patrol privately owned shopping center parking lots for recurring violations on an as-needed basis. These requests will require modification to the daily patrol plan and will be determined by the Contract Administrator. The patrol plan/route and list of private parking lots is included herein for reference (see below). Patrol times will be logged in a Daily Activity Report (DAR) and turned in at the end of each work day to the Contract Administrator (sample included herein, see below). The City reserves the right to require modification of the patrol plan from time to time as appropriate. Onsite Supervisor: Contractor shall provide an Onsite Supervisor for day-to-day operations and who will also act as a PCO. Supervisor will provide reports as needed, respond to complaints, training needs, will track working hours, and supervise the contract personnel. Any disciplinary action will be the responsibility of Onsite Supervisor and Contractor. Complaints to the City regarding contract employees: Contractor's assigned Onsite Supervisor shall investigate and report any complaints regarding their employees received from the public or the City within 24 hours of the report. The City shall reserve the right to contact the reporting party and Contractor employee as needed to resolve the complaint to the City's satisfaction, with the understanding that unprofessional or discourteous treatment of the public will not be tolerated. City's Rights: City reserves the right to establish, modify, add or delete enforcement areas, routes, and hours of enforcement. City further reserves the right to approve or deny Contractor's personnel. The City retains the right to review and direct modification of any Contract employee training program. The City's rights under this provision may be exercised by the City Manager or the City Manager's designee. PARKING ENFORCEMENT EQUIPMENT, SERVICES AND SUPPLIES TO BE PROVIDED BY CONTRACTOR: Parking Enforcement Uniforms: • All personnel shall wear uniforms while on duty. • Contractor shall be responsible for providing personnel with proper, complete, and acceptable uniforms. • Uniform shall include a name badge or tag. Uniforms and identifying badges shall be distinct enough from those used by Peace Officers or other sworn personnel so that the general public will not mistake parking enforcement personnel for Peace Officers. Contractor shall not issue any uniform or identifying badge without the prior written approval by the City. • Contract employees will not be allowed to work unless attired in complete approved uniform. • Contractor shall provide uniforms for each contract employee at no expense to the employee, except in cases of negligence or abuse of the uniform by the contract employee. • Uniforms should include shirts, pants, shorts,jacket, raincoat, and baseball-style hat. Equipment and Supplies: Contractor must provide all necessary equipment and supplies for the purpose of parking enforcement services, including safety equipment (reflective vests), chalk, chalking sticks, tape- measures, flashlights and batteries. Vehicles: Contractor shall provide a minimum of two (2) of the Smart Cars with air conditioning that will be white in color, with markings identifying them as "City of Palm Springs, Parking Enforcement" with flashing light bar and reflective stickers indicating a "slow moving" vehicle. Vehicles are to be used exclusively for parking enforcement services only as required by this contract and are not to be used for any other purpose, including the personal business by any employee, supervisor or principal, or for any other business activity of the Contractor. Vehicles must be maintained by the Contractor, and kept in good, safe operating condition and in a professional appearance by the Contractor. All parking enforcement vehicles shall be equipped with a mobile License Plate Recognition (LPR) system, using state of the art technology capable of cloud connectivity and processing performance. The LPR system shall utilize multiple cameras affixed to the vehicle to enable the PCO to capture vehicle license plates while in motion, a controller to processing and storage of PCR images, and a cloud portal for vehicle monitoring and reporting, including a mobile enforcement application for use by the PCO with a tablet mounted in the vehicle providing real- time maps and alerts, with audio alerts for noted parking violations. The City reserves the right to review and approve the LPR system to be utilized by Contractor. Contractor shall bear all expenses associated with vehicle repair, maintenance and insurance. Vehicles that are damaged or disabled while in service for the City of Palm Springs shall be replaced with an operable vehicle within four (4) hours. Replacement or repair of damages will be the responsibility of the Contractor. Contractor shall be responsible for parking and securing all patrol vehicles at the City Yard Facility, located at 425 South Civic Drive in Palm Springs, when not in use. The Contractor shall be financially responsible for damaged, lost or stolen equipment provided by the City (including radio equipment, emergency equipment, etc.). The Contractor shall prepare and maintain a complete, detailed, accurate, and current inventory of all equipment and supplies provided by the City for use by the Contractor. PERFORMANCE STANDARDS FOR PARKING ENFORCEMENT SERVICES: Contractor will be responsible for adhering to the City's Parking Enforcement Standards listed below: Operations Methodology: The City strongly believes in customer service, and expects Contractor and Contractor's personnel to treat the public in a polite, helpful, and professional manner at all times. Enforcement action is to be carried out in a uniform and fair manner. Contractor shall not directly or indirectly give any preferential treatment to any person or entity in the performance of their enforcement duties. Patrol City Streets: Contractor shall effectively patrol City streets and take appropriate action (i.e., cite vehicles in violation of parking regulations, report potential abandoned vehicles or vehicles creating unsafe conditions, record date and time of the patrol, etc.). Exhibit"A"—Scope of Work Page 4 of 10 27 Voided Parking Citations: Any citation deemed inappropriate during or immediately following issuance can be voided by the Parking Control Officer (PCO) who issued the parking citation, provided the PCO issues a corrected citation. If the PCO determines that the parking citation should be voided due to an error on the PCO's part and a corrected citation will not be issued, the PCO shall document and record this action. Voided parking citations will be recorded and monitored via the citation database. Citation Processing Services are NOT part of the scope of work for this contract, as the City shall contract for those services separately. Acceptable Time Gaps between Parking Citations: All PCOs are expected to patrol and issue appropriate citations as necessary during their shifts. (Log time) Exhibit"A"—Scope of Work Page 7 of 10 30 Turning right into the "South" parking structure located just west of Belardo Road, BEGIN ENFORCEMENT of and Patrol the "South" and "North" interconnected parking structures (underground, surface, and above ground) within the Downtown Palm Springs Specific Plan (generally located between Museum Drive on the north and Tahquitz Canyon Way on the south, and between Museum Drive on the west and Palm Canyon Drive on the east), exiting from the "North" parking structure at Museum Drive. Turn right onto Museum Drive heading north and east to Belardo Road, turn left onto Belardo Road. Continue north on Belardo Road past Amado Road intersection and past the Amado Center, then turn right into the City of Palm Springs Free Unlimited Parking behind the "Azul" and "Blue Coyote" restaurants and Patrol the parking lots and exit the way you came in. Turn right onto Belardo Road and continue to Alejo Road. Turn right on Alejo Road to Indian Canyon Drive and turn left. Go north on Indian Canyon Drive to Tachevah Drive, then turn right on Mel Avenue. (Log time) BEGIN ENFORCEMENT on the both sides of Mel Avenue (N & S). (Log time) Proceed to Via Miraleste, southbound, and continue enforcement on Via Miraleste (W) to Tachevah Drive. (Log time) Proceed to Palm Canyon Drive, turn left onto Palm Canyon Drive heading south to Andreas Road, turn right onto Andreas Road. BEGIN ENFORCEMENT on both sides of Andreas Road (N & S) to Belardo Road, turn left onto Belardo Road, continue enforcement on both sides of Belardo Road (W & E) to Tahquitz Canyon Way, turn right onto Tahquitz Canyon Way to Museum Drive, heading north to Museum Way, continue enforcement on both sides of Museum Way (N & S) to Palm Canyon Drive. This concludes your DOWNTOWN route. The PCO will at this point look at his or her watch to determine if three (3) hours have passed. If not, the PCO may review the route for other parking violations such as color zones or handicapped violations, etc. If three hours have passed since starting the first enforcement rotation, then the PCO returns to the beginning of the patrol route and observes if any of the vehicles parked are in violation as noted by the LPR system, and issues citations accordingly. Once completing all citations for the route, the PCO then goes back to the beginning of the route and starts the enforcement patrol again. This cycle is typically repeated three times per day. The route may be adjusted as reasonably necessary to improve the Contractor's efficiency, and to include additional parking enforcement areas as directed by the City. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ESTABLISHING A PARKING MANAGEMENT PROGRAM FOR THE DOWNTOWN PALM SPRINGS SPECIFIC PLAN, INCLUDING A MAXIMUM 4-HOUR PARKING TIME LIMIT FOR PUBLIC PARKING SPACES, DESIGNATING CERTAIN AREAS AS EMPLOYEE PARKING SPACES WITH A MAXIMUM 12-HOUR PARKING TIME LIMIT, AND AUTHORIZING CLOSURE OF THE PARKING FACILITIES FROM 3:00 AM TO 6:00 AM WHEREAS, the City of Palm Springs entered into a Project Financing Agreement on September 29, 2011, with Palm Springs Promenade, LLC, a California limited liability company, ("PSP"); and WHEREAS, the Project Financing Agreement was amended on April 18, 2012, December 18, 2012, January 24, 2013, and October 30, 2014, for various changes related to escrow instructions, project design and use, and other project-related issues; and WHEREAS, on June 27, 2012, PSP conveyed by Grant Deed to the City of Palm Springs certain real property, including subterranean, surface, and above grade parking spaces throughout the Downtown Palm Springs Specific Plan area, (hereinafter referred to as the "Parking Facilities"), and wherein the Grant Deed requires the City to "...operate, maintain, and use the Parking Facilities as and for free parking in a safe, sound, attractive, operational and top quality condition, in perpetuity, for the benefit of the public..."; and WHEREAS, the Project Financing Agreement, as amended, does not specify parking time limits, or designated employee parking areas, and allows for the City Council to close only that portion of the Parking Facilities located under Block A of the Downtown Palm Springs Specific Plan from 3:00 AM to 6:00 AM; and WHEREAS, the Parking Management Program for the Downtown Palm Springs Specific Plan is recommended for a period of twelve (12) months, subject to automatic renewal, unless it is terminated with sixty (60) days prior written notice; and WHEREAS, the City Manager may enter into an agreement consistent with the terms of this Parking Management Program for the Downtown Palm Springs Specific Plan, in a form subject to the review and approval by the City Attorney, which sets forth the administrative regulations for implementation of the Parking Management Program; and WHEREAS, Palm Springs Municipal Code, Section 5.38.040 Establishment of vehicle parking facilities and regulations provides that "The city council by resolution may designate vehicle parking areas and facilities including metered lots, streets and other facilities pertaining thereto which will be metered. The resolution(s) may specify the 75 Resolution No. Page 2 regulations pertaining to each vehicle parking facility including parking rates or fees, allowable maximum and/or minimum parking time limits, special validation programs, incentive parking programs, preferential employee parking, valet parking and long-term rental parking. The resolution(s) may be amended from time-to-time to reflect then current conditions"; and WHEREAS, with the increasing use of ride sharing via Transportation Network Companies (or "TNCs"), it is necessary to identify certain on-street parking spaces for drop-off and pick-up of riders using the services of TNCs; and WHEREAS, certain major events occurring at the Palm Springs Art Museum and other venues within the Downtown Palm Springs area generate traffic related to the events, requiring the use of valet parking programs; and WHEREAS, the Parking Facilities acquired by the City are necessary for the successful operation of the commercial, retail, office, hotel, residential, and other uses constructed, under construction, or planned for construction within the Downtown Palm Springs Specific Plan described in the Project Financing Agreement, as amended. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE AS FOLLOWS: Section 1. The foregoing Recitals are true, correct, and incorporated by this reference herein as material terms relied upon by the City Council in adopting this Resolution. Section 2. Pursuant to Palm Springs Municipal Code 5.38.040, the City Council hereby establishes a maximum parking time limit of four (4) hours for public parking spaces within the Parking Facilities located at the Downtown Palm Springs Specific Plan as described in the Project Financing Agreement, as amended, (with the public parking spaces identified on Exhibits 1 and 2, attached hereto this Resolution). Section 3. Pursuant to Palm Springs Municipal Code 5.38.040, the City Council hereby designates Employee Parking within the Parking Facilities located at the Downtown Palm Springs Specific Plan as described in the Project Financing Agreement, as amended, (with the employee parking spaces identified on Exhibit 3, attached hereto this Resolution). The City Manager shall be authorized, upon consultation with and approval of, the City Council Project Sub-Committee and PSP, to adjust the limits and locations of the Employee Parking as deemed necessary by the City and/or PSP. Section 4. Pursuant to Palm Springs Municipal Code 5.38.040, the City Council hereby allows a maximum parking time limit of up to twelve (12) hours for spaces designated as Employee Parking within the Parking Facilities located at the Downtown Palm Springs Specific Plan as described in the Project Financing Agreement, as amended. 76 Resolution No. Page 3 Section 5. The City Manager is hereby authorized to close the entire Parking Facility between the hours of 3:00 AM and 6:00 AM for cleaning and security purposes. Access through the Parking Facility shall be maintained for PSP as to private parking facilities used by PSP and its tenants. Section 6. The City Manager is hereby authorized to designate certain on-street parking spaces within the Downtown Palm Springs Specific Plan as reserved for use as loading areas, and as drop-off and pick-up locations for users of Transportation Network Companies. The City Manager shall be authorized, upon consultation with and approval of the City Council Project Sub-Committee and PSP, to adjust the locations of the loading areas as deemed necessary by the City and/or PSP. All such loading areas shall be identified with appropriate signage. Section 7. The City Manager is hereby authorized to approve Valet Parking License Agreements, or such other similar agreements in a form acceptable to the City Attorney, to designate portions of the Parking Facilities for parking by special events scheduled at the Palm Springs Art Museum or for special events organized by non-profit agencies within the Downtown Palm Springs area that generate traffic requiring traffic coordination and planning efforts. Section 8. The City Manager is hereby authorized to enter into a Parking Management Agreement with PSP in a form acceptable to the City Attorney consistent with the terms of the Parking Management Program adopted pursuant to this Resolution, for a term of twelve (12) months subject to automatic renewal, unless otherwise terminated with sixty (60) days prior notice.
