Ready, City Manager Initiated by: Engineering Services Department SUMMARY Formal City Council acceptance of the Palm Springs Swim Center Replaster and Pool Repair Project, City Project No. 16-06, is required to document the completion of the public works improvement, and to allow the City's filing of a Notice of Completion with the Riverside County Recorder in accordance with Section 9200 of the California Civil Code. RECOMMENDATION: 1) Accept the public works improvement identified as the Palm Springs Swim Center Replaster and Pool Repair Project, City Project No. 16-06, as completed in accordance with the plans and specifications; and 2) Authorize the City Engineer to execute and file for recordation with the Riverside County Recorder a Notice of Completion for the Palm Springs Swim Center Replaster and Pool Repair Project, City Project No. 16-06. STAFF ANALYSIS: On September 26, 2017, the City Council awarded a construction contract to Condor, Inc., in the amount of $384,000 for the Palm Springs Swim Center Replaster and Pool Repair Project, City Project No. 16-06, (Project). The scope of the Project comprised draining of the pool, removing existing plaster to the gunite, removing and reinstalling existing bulk-head, replacing existing expansion joints and joint tiles, crack and leak repairs, high-pressure water blasting, hypo washing, surface preparation, plastering, minor tile work (as-needed), curing, clean-up, filing of the pool, and all appurtenant work. ITEM NO. - City Council Staff Report February 21, 2018—Page 2 Acceptance of City Project No. 16-06 Aa- 4 s r _ a t� i a �t Location Map Throughout construction of the Project one contract change order was approved as follows: • Construction Contract Change Order 1 (CCO1) in the amount of $24,312.95 was approved by the City Manager on January 31, 2018, to include additional equipment such as new deck anchors, light rings, bond/replace light fixtures, bulkhead and rail anchors, and hand rails. The final cost of the Project was increased by $24,312.95 from the original awarded contract amount of $384,000 for a final contract amount of $408,312.95; a copy of CCO1 is included as Attachment 1. As determined by City staff, the Contractor satisfactorily completed the Project on January 17, 2018. Staff recommends that the City Council accept the Project as required by Section 9200 of the California Civil Code, and authorize the City Engineer to file and record a Notice of Completion within 15 days of the City Council's action. A copy of the Notice of Completion to be submitted to the County is included as Attachment 2. 02 City Council Staff Report February 21, 2018—Page 3 Acceptance of City Project No. 16-06 ENVIRONMENTAL IMPACT: Section 21084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301 "Existing Facilities," Class 1 projects consist of repair, maintenance, or minor alteration of existing public facilities involving negligible or no expansion; therefore, the Palm Springs Swim Center Replaster and Pool Repair Project, City Project No. 16-06, is considered categorically exempt from CEQA, and a Notice of Exemption has been prepared and filed with the Riverside County Clerk. FISCAL IMPACT: As part of the 2016/2017 fiscal year budget, the City Council appropriated a budget of $250,000 from the Measure J Capital Project Fund (Fund 260) to replaster and perform pool repairs at the swim center. On September 26, 2017, the City Council appropriated an additional $230,193 from the Capital Projects Fund (Fund 261) to award a construction contract to Condor, Inc. A total of $480,193 has been appropriated for the Project to date. Table 1 below is a summary of the total costs incurred for the Project. Deck Anchors At the request of Swim Center staff the contractor was asked to provide pricing for installing equipment anchors in the pool deck. The Contractor will core drill the pool decking and install nine (9) equipment anchors (anchors provided by City), at various locations as directed. This new item of work is inclusive of all labor, materials and equipment necessary to complete the work, including but not necessarily limited to, coring the existing pool deck, setting anchors in place vertically at deck elevation, installation of bonding clamps and wire, installation of cementitious setting materials and any other appurtenant labor or materials as needed to install the anchors. This work will be performed at the Lump Sum/Agreed Price of$3,416.00. B. Provide and Install 30 New Light Rings Existing pool lighting fixtures were installed without mounting rings leaving underwater pool light un-secure. The Contractor will provide and install new light rings that can be used to properly attach the existing underwater light fixtures. This new item of work is inclusive of all labor, materials and equipment necessary to complete the work, including but not necessarily limited to, providing new brass light rings for all existing fixtures, installation of bonding wire, and all other fasteners, inserts, setting materials and any other appurtenant labor, materials or equipment as needed to install and bond the light rings in accordance with all applicable industry standards. This work will be completed at the Lump SumlAgreed Price of$6,617.00. C. Remove and Re-Install (30) Light Fixtures Bonding Fixtures to Deck Pull Boxes Existing pool light fixtures were installed without bonding wires. Bonding is the practice of intentionally electrically connecting exposed metallic items not designed to cant'electricity as a protection from electric shock. The Contractor will bond all existing underwater lighting fixtures by installing bonding wire from the underwater light fixtures to the nearest deck pull box. The Contractor will also replace electrical cables for light cables that are too short to be placed on the pool deck for service. This item also includes the full replacement of five (5) LED light fixtures and light cables that are inoperable. This new item is inclusive of removal of the light fixtures, installation of bonding wires, extension of light cables where necessary, supplying and installing 5 new fixtures, including niche compounds, mechanical lugs, wire pulling, and any other appurtenant labor, 06 Contract Change Order No. 001 DATE: 12/22/17 Page 2 materials or equipment necessary to complete the in accordance with all applicable codes and industry standards. This work will be performed at the Lump Sum/Agreed Price of$8,670.00 D. Remove and Replace Bulkhead and Handrail Anchors Prior to re-installing the existing bulkhead it is necessary for the anchors that hold the bulkhead down to be removed and replaced. The existing anchors are oxidized, bent and in various states of disrepair. Some handrail anchors are in the same condition and require removal and replacement with new escutcheon plates. This new item of work is inclusive of all labor, materials and equipment necessary to complete the work, including but necessarily limited to core drilling to remove the old anchors, replacement utilizing 5/8"x 4 %" Hilti anchors, installation of bronze wedge anchors, installation of any required bonding clamps and bonding wires, installation of stainless steel escutcheon plates, cementitious setting materials and any other appurtenant labor or materials. This work will be performed at the Lump Sum/Agreed Price of$2,070.00. E. New Handrail The handrail at the entry into the shallow end is bent and in poor condition. It will be replaced at the Lump Sum/Agreed Price of$424.00. Note: All items are inclusive of all applicable mark ups and no additional compensation will be made for the completion of the additional work indicated herein.
