Ready, City Manager BY: Planning Services Department SUMMARY La Quinta Brewing Company has initiated an application with the California Department of Alcoholic Beverage Control (ABC) for a Type 42 (On Sale Beer and Wine — Public Premises) alcohol license to allow a cocktail lounge/tap room. The store is located at Suite 100, 301 North Palm Canyon Drive located within Census Tract 446.06, which is identified by the ABC as an area with over concentration of liquor licenses. The applicant is requesting the City Council make a determination of public convenience or necessity for the sale of beer and wine as part of a tap room. RECOMMENDATION: 1) Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT PUBLIC CONVENIENCE WOULD BE SERVED BY THE ISSUANCE OF ALCOHOLIC BEVERAGE CONTROL LICENSE TYPE 42 AT SUITE 100, 301 NORTH PALM CANYON DRIVE WITHIN CENSUS TRACT #446.06." BACKGROUND AND PROJECT DESCRIPTION: The La Quinta Brewing Company has leased Suite 100 within the Cornerstone Building located at the corner of North Palm Canyon Drive and West Amado Road. The new business will be classified as a cocktail lounge/tap room with product brewed off site. The tenant space (Suite 100) will occupy 1,340-square feet on the ground floor and will consist of twenty-six (26) indoor and sixteen (16) outdoor seats located in the area ITEM NO. The proposed tap room will operate from 12:00 PM to 2:00 AM daily seven days a week. The Planning Commission approved a Conditional Use Permit (Case 5.1431 CUP) on February 14, 2018 for the operation of a cocktail lounge/tap room, limiting the number of indoor and outdoor seats and subject to other conditions of approval. The California Department of Alcoholic Beverages Control (ABC) requires a Type 42 license for On-Sale Beer and Wine with no food service. Due to overconcentration of liquor licenses that have been issued within Census Tract #446.06, the approval of a Resolution of Public Convenience and Necessity (PCN) will be required for the operation of the proposed tap room in accordance with Division 9 (Alcoholic Beverages) of the State of California Business and Professions Code. Related Relevant City Actions 02/14/2018 Planning Commission approved a Conditional Use Permit (CUP) for a cocktail lounge/tap lounge/tap room in Suite 100 of the Cornerstone Building. The ABC identifies the Type 42 license as follows: ON SALE BEER AND WINE— PUBLIC PREMISES (Bar, Tavern) 02 City Council Staff Report Page 3 of 4 March 7, 2018 Case 5.1431 PCN —Suite 100, 301 North Palm Canyon Drive Authorizes the sale of beer and wine for consumption on or off the premises where sold. No distilled spirits may be on the premises. Minors are not allowed to enter and remain on the premises. Food service is not required. Pursuant to Section 23958 of the State of California Business and Professions Code, the California Department of Alcoholic Beverage Control (ABC) is required to "...deny an application for a license if issuance of that license would tend to create a law enforcement problem, or if issuance would result in or add to an undue concentration of licenses, except as provided in Section 23958.4." Section 23958.4(a) of the Code defines undue concentration as follows: As to on-sale retail license applications, the ratio of on-sale retail licenses to population in the census tract or census division in which the applicant premises are located exceeds the ratio of on-sale retail licenses to population in the county in which the applicant premises are located. The Section further states that a license may be issued when "...the local governing body of the area in which the applicant premises are located, or its designated subordinate officer or body, determines within 90 days of notification of a completed application that public convenience or necessity would be served by the issuance..." (State of California Business and Professions Code, Section 23958.4(b)(2)). The subject property is located within Census Tract No. 446.06, which is identified as the west side of the north portion of Palm Canyon Drive that includes parts of Uptown and Downtown neighborhoods. According to the ABC, there are three (3) Type 42 license issued within this Census tract while only two (2) such licenses would be allowed. Hence, the applicant is requesting a determination of public convenience or necessity for the liquor license required for the operation of the business. According to the Palm Springs 2007 General Plan Land Use Element, the land use designation of the subject property is Central Business District. The General Plan further states the intended use of the CBD designation allows for a "mix of commercial, residential, and office uses at a higher concentration, density, and intensity than in other areas of the City. The CBD serves as the main activity center and cultural core of the community... and uses such as grocery stores, hardware stores, and convenience or pharmacy stores that provide services to the Downtown residential population is encouraged." Therefore, the operation of a cocktail lounge and tap room selling locally brewed beer products will be consistent with the intent of the General Plan Land Use Element for the site and its vicinity. Palm Canyon Drive is the major commercial corridor in the Census Tract Map No. 446.06 area. The proposed location in Suite 100 equaling 1,340-square feet within the Cornerstone Building is adequate in size and suitable for the proposed tap room. Additionally, the issuance of the requested license will contribute to diversifying products and services the area has to offer. Considering these elements, staff finds that the issuance of the requested liquor license is suitable for the area and will serve the public convenience. FISCAL IMPACT: No fiscal impact. C. The California Department of Alcoholic Beverages and Control (ABC) have determined that there is an "undue concentration" of alcohol-related licenses in the Census Tract No. 446.06. D. Pursuant to Section 23958.4(b)(2) of the State of California Business and Professions Code, the City Council may determine the public convenience or necessity would be served by the issuance of the requested license. E. The business, La Quinta Brewing Company will be located in Census Tract No. 446.06 within the Central Business District land use designation and the CBD (Central Business District) Zone. The cocktail lounge/tap room use will be consistent with the intent of the Palm Springs 2007 General Plan Land Use Element and the Palm Springs Zoning Code, which encourage service-oriented land uses. The proposed use will require a Type 42 license from the California Department of Alcohol Beverage Control ("ABC") before beginning operations. Under existing zoning, "beer gardens" are a permitted use by Conditional Use Permit, which has been submitted and will go before the Planning Commission on February 141m Operations of the La Quinta Brewing Co Taproom would primarily consist of onsite sales of: 1) craft beer produced offsite by LQBC in Palm Desert, 2) other beer supplied by other craft breweries, as well as 3) wine and cider. Sale of bottles and cans for offsite consumption is also permitted under the Type 42 ABC license. The taproom will also offer limited, pre-packaged food snacks for onsite consumption. No brewing would be conducted onsite. Proposed hours are from noon to 2am daily, seven days a week. It is estimated that approximately 3 employees will be working onsite at any one time. LQBC has successfully operated a similar retail taproom in Old Town La Quinta for the last 2 years and has been embraced by the city, local residents and tourists. Studies have shown that beer drinkers are increasingly interested in beer freshness and will specifically seek out locally produced beer. While cities in Southern California like San Diego have exploded on the to craft beer seen,the Coachella Valley has lagged behind in terms of craft beer growth.
