Subject: APPROVAL OF PLANS, SPECIFICATIONS AND ESTIMATE (PS&E)
AND AUTHORIZATION TO BID THE PALM SPRINGS CONVENTION
CENTER PARKING LOT (PHASE 2), CITY PROJECT NO. 17-14

SUMMARY
The construction documents (Plans, Specifications and Estimate) are completed and, in
accordance with Section 7.03.040 of the Procurement and Contracting Code the City
Council is required to approve and adopt plans, specifications and working details, and
authorize the bid request for all public projects in excess of $100,000. Approval of this
project will allow staff to proceed with this public project, with an estimated construction
cost of$400,000.
RECOMMENDATION:
Approve the plans, specifications and estimate, and authorize staff to advertise and
solicit bids for the Palm Springs Convention Center Parking Lot (Phase 2), City Project
No. 17-14.
BACKGROUND:
On March 19, 2014, the City Council authorized staff to proceed with the design of a
new parking lot to support the Convention Center.
On November 4, 2015, the City Council awarded a construction contract to Golden
Valley Construction Inc., in the amount of $1,201,554.40 for the Convention Center
Parking Lot, City Project No. 14-09, (Phase 1 of the "Project'). The Phase 1 Project
scope included the construction of a new surface parking lot with a total of 655 parking
spaces, perimeter landscaping, all on-site lighting and electrical improvements, on-site
retention basins, and traffic striping. An aerial map of the full site is identified below.

On September 21, 2016, City Council accepted Phase 1 of the Project (City Project No.
14-09). The final cost of Phase 1 was decreased by ($8,046.20) from the original
awarded contract amount of $1,201,554.40 for a final contract amount of$1,193,508.20.
Completion of the Convention Center Parking Lot (Phase 2), identified as City Project
No. 17-14, is required now that the Dream Hotel has commenced construction. The
scope of work for Phase 2 includes expanding the surface parking lot to the east of
Phase 1 with an additional 251 parking spaces, perimeter landscaping, on-site lighting
and electrical improvements, on-site retention basins, crosswalk in-pavement flashing
warning lights and traffic striping.
The contract documents prepared by MSA Consulting Inc., have been reviewed and
approved by the City's Engineering Services Department. Staff recommends that the
City Council approve the contract documents and authorize staff to formally solicit
construction bids for the Project.
With City Council approval, staff will advertise the project in the Desert Sun, submit the
Notice Inviting Bids to plan rooms, and provide the bid documents available free of
charge to prospective bidders. A copy of the contract documents are on file with the
Engineering Services Department. The following tentative schedule has been identified
for the bid process:

ENVIRONMENTAL IMPACT:
Section 21084 of the California Public Resources Code requires Guidelines for
Implementation of the California Environmental Quality Act ("CEQA"). In accordance with
the CEQA Guidelines, the City acting as "Lead Agency" pursuant to CEQA, previously
completed an environmental analysis of the potential impacts resulting from construction
of the Project. On May 20, 2015, the City Council adopted Resolution No. 23824,
adopting and ordering the filing of a Mitigated Negative Declaration for the Project; a copy
of Resolution No. 23824 is included as Attachment 2. A Notice of Determination ("NOD")
was subsequently filed with the Riverside County Clerk on May 27, 2015; a copy of the
NOD is included as Attachment 3.
FISCAL IMPACT:
The total cost to complete the Convention Center Parking Lot (Phase 2) is approximately
$500,000 — with the construction cost estimated at $400,000. The Project's overall
budget, and expenditures, are identified in Table 1 below.

On March 6, 2013, the City Council approved a Services Agreement (A6329), recently
amended by City Council on October 18, 2017, with Selene Palm Springs, LLC, a
California limited liability company ("Selene"). Pursuant to the Services Agreement,
Selene has agreed to pay the City the amount of $2,675,000 for the unamortized
parking improvements necessary to replace existing public parking spaces on the
property Selene purchased from the City for construction of the Dream Hotel. This
payment has been considered the "Parking Fee" for the purposes of the Services
Agreement.

Section 3(c) of the amended Services Agreement allowed for deferral of the Parking
Fee following issuance of a building permit, with the condition that...City shall have full
discretion to call for payment of a portion of, or the full amount of, the Parking Fee,
when it so requires.
In light of the City Council's action to approve bidding the completion of the Convention
Center Parking Lot (Phase 2), the City has issued a letter to Selene requesting that
Selene submit payment of a portion of the Parking Fee in the amount of $500,000. The
City has requested that payment be received prior to April 30, 2018, which precedes the
date scheduled for Council award of the contract.
Upon receipt of Selene's payment of $500,000 sufficient budget will be available to
proceed with this project. Funding for this project is not required from the General Fund
or Measure J Capital Fund.

RESOLUTION NO. 23824
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM SPRINGS, CALIFORNIA, ADOPTING AND
ORDERING THE FILING OF A MITIGATED NEGATIVE
DECLARATION FOR THE CONVENTION CENTER
PARKING LOT IMPROVEMENTS (CITY PROJECT
NO. 14-09).
WHEREAS, the City of Palm Springs ("City") proposes to construct a new
surface parking lot with a maximum of 906 parking spaces, including perimeter
landscaping improvements along Avenida Caballeros and Amado Road, and on-site
lighting and electrical improvements, with on-site retention basins, all described as the
Convention Center Parking Lot, City Project No. 14-09, (the "Project"); and
WHEREAS, the Project will provide additional parking lot facilities to support the
City's Convention Center and other tourism based needs; and
WHEREAS, the Project implements the goals and policies of the General Plan;
and
WHEREAS, an Initial Study was prepared pursuant to the provisions of the
California Environmental Quality Act ("CEQA"), Division 13 of the Public Resources
Code of the State of California, beginning with §21000 (hereinafter"Act"); and
WHEREAS, pursuant to Section 21152 of the Act, on February 4, 2015, a Notice
of Intent to Adopt a Mitigated Negative Declaration and Availability of Initial Study, was
published in The Desert Sun; and
WHEREAS, the Initial Study and Mitigated Negative Declaration (IS/MND) was
circulated for public comment from February 3 through February 23, 2015; and
WHEREAS, by the close of the public comment period on February 23, 2015,
there were no requests for a Public Hearing submitted in response to the IS/MND; and
WHEREAS, pursuant to Section 15202 of the CEQA Guidelines, Title 14,
Division 6, Chapter 3, Article 13 "Review and Evaluation of EIRs and Negative
Declarations," of the California Code of Regulations, CEQA does not require formal
hearings at any stage of the environmental review process, and public comments may
be restricted to written communications; and
WHEREAS, the IS/MND prepared for this project has concluded, and following
public review, it has been determined that the Project will not have a significant effect on
the environment with the adoption of avoidance and mitigation measures identified in
the MND; and

WHEREAS, the City Council has carefully reviewed and considered all of the
evidence presented in connection with the Project, including, but not limited to, the staff
report, the IS/MND, and all written and oral testimony presented.
THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY
RESOLVE AS FOLLOWS:
SECTION 1. The above recitals are all true and correct.
SECTION 2, The City Clerk of the City of Palm Springs, is hereby designated the
custodian of the documents and other materials which constitute the record of proceedings
upon which the City Council has based its decision. The custodian of the documents is
located at 3200 E. Tahquitz Canyon Way, Palm Springs, California.
SECTION 3. Pursuant to Section 15063 of the CEQA Guidelines, a Mitigated
Negative Declaration ("MND") of environmental impact was prepared and circulated for
a 20-day public review period ending on February 23, 2015. The Mitigated Negative
Declaration adequately analyzes the general environmental setting of the Project, its
potentially significant environmental impacts, and the alternatives and mitigation
measures related to each potentially significant environmental impact for the Project,
and has determined that there are no potentially significant impacts associated with the
Project.
SECTION 4. The Project implements the following goals and policies of the
General Plan:
Goal LU7. Maintain and enhance the City's status and image as a premier resort
destination and cultural center in the Coachella Valley.
Policy LUTZ Ensure that visitor-serving uses such as hotels, restaurants, and
entertainment uses that generate high levels of activity are developed in close proximity
to the Palm Springs Convention Center,
SECTION 5. The City Council has carefully reviewed and considered all of the
evidence presented in connection with the Project, including, but not limited to, the staff
report, the Initial Study and public comments received, the proposed Mitigated Negative
Declaration, the proposed Environmental Commitment Record (otherwise known as a
"Mitigation Monitoring and Reporting Program"), and all written and oral testimony
presented. The City Council further finds that on the basis of the entire Project record,
there is no substantial evidence that the Project will have a significant effect on the
environment and that the Mitigated Negative Declaration reflects the City's independent
judgment and analysis.
NOW, THEREFORE, BE IT RESOLVED, that based upon the foregoing, and
pursuant to Section 15074 of the CEOA Guidelines, Title 14, Division 6, Chapter 3,
Article 6 "Negative Declaration Process," of the California Code of Regulations, the City

Council adopts and orders the filing of a Mitigated Negative Declaration, and approves
the Environmental Commitment Record (otherwise known as a "Mitigation Monitoring
and Reporting Program"), for the Convention Center Parking Lot, City Project
No. 14-09.
