Ready, City Manager BY: Planning Services Department SUMMARY Leef Industries, LLC is seeking an Administrative Minor Modification (AMM) for relief from the minimum separation distance requirement of six hundred (600') feet from a proposed cannabis dispensary to a public park. Pursuant to Section 93.23.15(C)(4)(c) of the Palm Springs Zoning Code (PSZC) any medical or adult use cannabis dispensary may not be located closer than six hundred (600') feet to a public park; waivers may be approved by the City Council on a case-by-case basis. The proposed dispensary is located in the Sossa Plaza at the corner of East Vista Chino Road and North Gene Autry Trail. The City Park is located diagonally across the street on the southwest corner of the intersection. RECOMMENDATION: 1) Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING AN ADMINISTRATIVE MINOR MODIFICATION GRANTING RELIEF FROM THE SEPERATION DISTANCE REQUIREMENT OF SIX HUNDRED (600) FEET FOR A CANNABIS DISPENSORY TO A PUBLIC PARK LOCATED AT SUITE D, 3700 EAST VISTA CHINO DRIVE." ZONING CODE REQUIREMENTS: The City Council adopted Ordinance 1943 on December 6, 2017 which amended Chapters 91, 92, and 93 of the Palm Springs Zoning Code (PSZC) relative to zoning ITEM I .�— City Council Staff Report Page 2 of 7 April 18, 2018 Case 7.1552 AMM—Leef Industries—3700 East Vista Chino Drive requirements and development standards for commercial medical and adult use cannabis facilities. Section 93.23.15(C)(4)(c) of the Palm Springs Zoning Code (PSZC) states the following: "Notwithstanding any other verbiage in this in this Subsection 93.23.15(C), unless modified by the City Council as described above, a minimum six hundred (600) feet separation distance shall be required between any Medical Cannabis Facility or Adult Use Cannabis Facility and any a. School, b. Public playground, C. Public park, d. Day care%hild care center, or e. Youth center." Section 93.23.15(C) of the PSZC also states the following: "Separation Distances and Concentrations of Use. No Medical Cannabis Facilities or Adult Use Cannabis Facilities shall be established, developed or operated except in accordance with the following principal. All distances shall be measured in a straight line, without regard to intervening structures, from the nearest property line of the property on which the Cannabis facility is, or will be located, and to the nearest property line of those uses described in this Subsection. These principles as not absolute; the City Council will exercise discretion in their application to individual cases, via modifications considered and granted by the Council, on a case-by-case basis, pursuant to Section 94.06.01(B), (the Administrative Minor Modification (AMM) process)." As stated above, the City Council has the discretion to grant relief in the separation distance requirements by determining that findings can be made that warrant the approval of an Administrative Minor Modification (AMM). APPLICATION REQUEST AND LOCATION: The applicant, Leef Industries LLC, has received a Cannabis Related Businesses and Activities Permit from the City of Palm Springs #C-2017-015, issued on January 30, 20181. In addition, the Bureau of Cannabis Control for the State of California has issued an Adult-Use Retailer Temporary License #A10-18-0000227-TEMP valid from 2/6/2018 until 6/6/2018 for the applicant. The proposed dispensary will be located within the Sossa Plaza at the northeast corner of East Vista Chino Road and North Gene Autry Trail. Both streets are designated on 1 Due to a misunderstanding with City staff, the applicant opened to the public prior to receiving the required distance waiver. The distance from the front door of the dispensary to the City Park is approximately three hundred (300') feet. The 1,120-square foot retail dispensary will occupy Unit D which is located in the center of the retail in-line shopping center. Sossa Plaza is a 12,000-squre foot multi-tenant shopping center containing seven (7) suites leased to a variety of retail operators, including a liquor store, convenience market, mattress store, and restaurant. The applicant states in their justification letter that Leef Industries has leased the space since November 2017 and the proposed dispensary will contain a reception room, retail sales display area, office, security and break rooms. Off-street parking will be accommodated within the existing fifty-three (53) space parking lot. Section 93.23.15(C)(4)(c) of the PSZC requires that a dispensary be located no closer than six hundred (600') feet from a public park. Section 93.23.15(C) provides specific guidelines when measuring these distances which shall be measured in a straight line from one property line to another. In applying this measurement method the properties are one hundred seventy (170') feet apart. Sections 93.23.15(C)(4)(c) and Section 93.23.15(C) of the PSZC provide guidelines in measuring distances from a dispensary to a public park which is enumerated in the table below: Measurement Point Distance Deviation from Code Property Line to Property Line 170' feet 430' feet 04 City Council Staff Report Page 5 of 7 April 18, 2018 Case 7.1552 AMM—Leef Industries— 3700 East Vista Chino Drive The PSZC Section 93.23.15(C) allows the City Council to exercise its discretion in the application to individual cases, via modifications considered and granted by the Council, on a case-by-case basis, pursuant to Section 94.06.01(B), (the Administrative Minor Modification (AMM) process). City Park: The City Park located at the southwest corner of North Gene Autry Trail and East Vista Chino Road was constructed in 2012 and has an area of 1.72-acres. The park contains both passive and active components. A large Palm Springs entry sign is located at the street corner. There are two (2) full size Bocce Courts with two (2) shade structures and benches. Other amenities include meandering walking paths, benches, water fountains, and trash receptacles. There is no playground equipment located within the park. The landscaping within the park is mature desert plantings with large trees, shrubs, grasses, and cacti. The park provides a buffer for the neighboring Rancho Vista Estates community from the busy intersection of North Gene Autry Trail and East Vista Chino. Findings of the Administrative Minor Modification The PSZC Section 94.06.01(B)(2)(a-d) provide specific findings that must be met before the City Council can grant the Administrative Minor Modification. The findings are as follows: a. The requested minor modification is consistent with the General Plan, applicable specific plan(s) and overall objectives of the zoning ordinance. There is no General Plan Policy that would be adversely affected by this modification nor are there any specific plans associated with this property. The Palm Springs Zoning Code (PSZC), Section 94.06.01(B)(2)(a-d) specifically allows for the requests and the finding has been met. b. The neighboring properties will not be adversely affected as a result of the approval or conditional approval of the minor modification. The request to reduce the required separation distance of six hundred (600) feet to one hundred seventy (170') feet from a cannabis dispensary to a public park will not adversely affect the surrounding properties. The immediate adjacent parcels are commercial or industrial uses and will not be impacted by the retail dispensary. The Sossa Plaza is an in-line shopping center with a mix of retail uses sharing a common parking lot. The front fagade of the dispensary will not be altered and will be consistent with the other retail stores in the center and the finding has been met. c. The approval or conditional approval of the minor modification will not be detrimental to the health, safety, or general welfare of persons residing or working on the site or in the vicinity; and 5 City Council Staff Report Page 6 of 7 April 18, 2018 Case 7.1552 AMM—Leef Industries—3700 East Vista Chino Drive The park in question does not have play facilities for children, nor is the park directly accessible from the proposed dispensary. Based on the park's location relative to the dispensary and the intended use of the park, it is not anticipated that the dispensary will be detrimental to the general welfare of the public. d. The approval of the minor modification is justified by environmental features, site conditions, location of existing improvements, or historic development patterns of the property or neighborhood. The intersecting Major Thoroughfares comprised of East Vista Chino Road and North Gene Autry Trail provide a barrier which separates the uses of the four corner quadrants. The 1.72-acre public park located in the southwest corner of the intersection which is diagonal from the Sossa Plaza is one hundred seventy (170') feet away as measured from the property line to property line. The distance from the front door of the dispensary to the City Park is approximately three hundred (300') feet. The relief from the distance requirement is justified due to environmental features with the presence of the Major Thoroughfares which separates and contains the uses to each perspective corner. Based upon this determination the finding has been met. ENVIRONMENTAL DETERMINATION: Pursuant to the California Environmental Quality Act (CEQA) Guidelines, the project is a Class I exemption and is categorically exempt per Section 15301(a) (Existing Facilities) because: a. Work to include interior alterations involving such things as interior partitions, plumbing and electoral conveyances. FISCAL IMPACT: No fiscal impact. CONCLUSION: The request to reduce the required separation distance between the proposed cannabis dispensary and the City Park will not adversely impact surrounding residential communities. The intersection of two (2) major arterials provides a significant separation of commercial and residential uses. The area surrounding the intersection is not pedestrian friendly or inviting. The City Park is not intended as a children's play area with no presence of play equipment of other play areas intended for youth. THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Kort Potter, Owner — Leef Industries LLC, has filed an Administrative Minor Modification (AMM) request pursuant to Sections 93.23.15(C)(4)(c), and 93.23.15(C) of the Palm Springs Zoning Code seeking relief from the minimum separation distance requirement of six hundred (600') feet from a cannabis dispensary to a public park located at Suite D, 3700 East Vista Chino Road, Zone M-1-P, Section 6, APN 677-040- 027 (Case 7.1552 AMM). B. The PSZC Section 93.23.15(C) provides specific guidelines regarding separation between two uses as measured in a straight line, without regard to intervening structures, from the nearest property line of the property on which the cannabis facility is located to the nearest property line of a public park. The measured distance from the property with APN # 677-040-027 (3700 East Vista Chino Road) is one hundred (170') feet to the property with APN # 677-250-062 (City Park). C. The PSZC Section 93.23.15(C) allows the City Council to exercise discretion in applying the PSZC relative to separation distances on a case by case basis with modifications considered and granted by the Council if proper findings can be made for an Administrative Minor Modification (AMM). D. The proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act ("CEQA"), and has been determined to be categorically exempt pursuant to Section 15301(a) of the CEQA Guidelines (Class 1, Existing Structures). Based upon the foregoing, the City Council hereby approves Case 7.1552 MAA granting relief from the separation distance requirement to place a 1,200-square foot cannabis dispensary within one hundred seventy (170') feet from a public park subject to the conditions of approval stated below: 1. Dear Members of City Council: As owner of Leef Industries LLC, a newly awarded Cannabis Related Business and Activities Permit for a medical and recreational marijuana dispensary. I received the Permit on January, 30th 2018 Application Case No. C-2017-015. Since then I have applied to the State and have also received my Temp License on February 6th, 2018 License#A10-18-0000227-TEMP. One of the conditions receiving the permit was I had to obtain a certificate of occupancy prior to being open to the public. As I have eagerly anticipated an open date since November, we have hit a small road bump regarding the updated zoning requirement for a public park. In adjacent to building where we lease our retail space there is a residential neighborhood which has an area that is designated as open space and has developed shuffleboard courts and a trail. I have occupied this lease space since November of 2017. 1 have made a significant investment to cosmetically remodel the unit to bring it up to date; creating a modern boutique retail facility that goes along with the style of Palm Springs. I pride my business on it's appearance and presentation and hope our customers and community will feel the same way. Since obtaining the Permit and State License I have hired 4 employees who have already undergone background checks through the Police Department of Palm Springs. Spent numerous hours on staff training which includes, procedures, policies and general operating instruction. The intended hours of operations 9 am to 10pm. Leef Industries will make a positive impact and contribution to the City of Palm Springs. Offering its residents and visitors quality&affordable tested products relevant to the cannabis industry. The dispensary occupies unit D at Sosa's Plaza which is situated on the corner of Gene Autry Trail and E Vista Chino. It is a multi-tenant commercial center that was constructed at this location several decades ago. Making this exception will not trigger new upgrades to the building or landscape and has adequate parking required by code. It also is known for high traffic location and with an established presence in which I don't foresee any negative impacts on the surrounding businesses or community. I respectfully ask the City Council to make an exception to the 600ft rule. With a substantial investment at stake along with the promised jobs of employees; the fate of opening is up to you all.
