Ready, City Manager By: Maintenance and Facilities Department SUMMARY This action will authorize the purchase of a new M30 diesel powered cylindrical Scrubber-Sweeper for the maintenance of the new Downtown Parking Structure. RECOMMENDATION: 1. Authorize the cooperative purchase of 1 new Tennant M30 Diesel Cylindrical Floor Scrubber-Sweeper from Aviate Enterprises Incorporated in an amount not to exceed $71 ,852.41 inclusive of shipping and applicable sales tax; and 2. Authorize the City Manager to execute all necessary documents. BUSINESS PRINCIPAL DISCLOSURE: A search of records available through the Secretary of State of California shows that Aviate Enterprises, Inc. is a California S Corporation with all 100% shares held by the owner and CEO, Timothy P. Devine. BACKGROUND: In December 2017, City assume operation and maintenance costs associated with the northerly portion of the Parking Garage, the addition of the southerly portion of the Parking Garage will take effect this May, for the new Downtown Parking Structure located at Belardo Road and Museum Drive. It has been determined that to effectively clean the large square footage of the parking structure the purchase of a new combination scrubber/sweeper will be necessary. ITEM NO. City Council Staff Report May 2, 2018— Page 2 Authorization to Purchase M30 Scrubber The Tennant M30 has duel cylindrical brushes combined with a 95-gallon capacity recovery tank with a water reclamation system. The 7 cubic foot hopper allows for sweeping and floor scrubbing of the parking structure surface more efficiently than current power washing options. The low profile of the M30 will allow for access to the underground sections that have low overhead clearance. M30 Large Integrated Rider Sweeper-Scrubber cleaning technology features: • Effectively clean in just one pass — wet or dry — with FloorSmart® integrated cleaning system technology. • Achieve consistent cleaning results with MaxPro2Tm hydraulic technology. • Clean up to three times longer on a single tank of water using Tennant's innovative ec-H2OTM technology that uses up to 70% less water. • Increase visibility with cab-forward design, open sightlines, and steering-wheel- mounted controls. • Provide an easy operator and maintenance experience with intuitive controls and easy-to-identify yellow touch points. 4. w `w r fiy - +W M. 02 City Council Staff Report May 2, 2018— Page 3 Authorization to Purchase M30 Scrubber Pursuant to the provisions of the Procurement Ordinance, 7.09.010, the City Council may authorize the acquisition of this piece of equipment through a joint powers or other cooperative purchasing program. The City's Procurement and Contracting Manager worked closely with the Facilities Maintenance staff to secure four cooperative purchase options ranging from $71,852.41 to $88,495.34 for the desired equipment, as identified below. Aviate Enterprises $71,852.41 Tennant Company $77,711.71 Staples, Inc. $81,868.60 Grainger, Inc. $88,495.34 As such, staff recommends the lowest cooperative contract price from Aviate Enterprises via the CMAS contract 4-17-0045A in the amount of $71,852.41, inclusive of shipping and applicable sales tax, as leveraging the purchasing power of the cooperative contract would likely be less than what we could obtain independently. ENVIRONMENTAL IMPACT: The requested City Council action is not a "Project" as defined by the California Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a "Project" means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. According to Section 15378(b), a Project does not include: (5) Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment. FISCAL IMPACT: Completion of the Downtown Palm Springs Specific Plan has delivered to the City new public streets and associated landscaping, and the 1,000 parking spaces extending throughout the new Parking Facility. The City has now assumed operation and maintenance costs associated with these new public improvements, which include costs to provide 24-hour security patrols, parking enforcement, as well as the contract costs for street and sidewalk cleaning and landscape maintenance, and utility costs. These costs have been consistently identified in the Measure J Fund budget as "Downtown Property Maintenance & Other Expenses," with the understanding that the new Downtown Project would require additional budget to appropriately maintain the new public improvements. The current 2017/2018 fiscal year budget appropriated $430,000 into an account established to pay for the new operation and maintenance costs resulting from the Downtown Project. This warranty does not apply to damage or failure caused by accident,freight damage,misuse,negligence, abuse,improper repair,or maintenance of the machines. Contractor acknowledges that no officer or employee of the City has or shall have any direct or indirect financial interest in this Agreement nor shall Contractor enter into any agreement of any kind with any such officer or employee during the term of this Agreement and for one year thereafter. Contractor warrants that Contractor has not paid or given, and will not pay or give, any third party any money or other consideration in exchange for obtaining this Agreement. Covenant Against Discrimination.
