Subject: AUTHORIZE THE PURCHASE OF ONE NEW TENNANT M30 DIESEL
CYLINDRICAL SCRUBBER-SWEEPER TO MAINTAIN THE NEW
DOWNTOWN PARKING STRUCTURE

SUMMARY
This action will authorize the purchase of a new M30 diesel powered cylindrical
Scrubber-Sweeper for the maintenance of the new Downtown Parking Structure.
RECOMMENDATION:
1. Authorize the cooperative purchase of 1 new Tennant M30 Diesel Cylindrical Floor
Scrubber-Sweeper from Aviate Enterprises Incorporated in an amount not to exceed
$71 ,852.41 inclusive of shipping and applicable sales tax; and
2. Authorize the City Manager to execute all necessary documents.
BUSINESS PRINCIPAL DISCLOSURE:
A search of records available through the Secretary of State of California shows that
Aviate Enterprises, Inc. is a California S Corporation with all 100% shares held by the
owner and CEO, Timothy P. Devine.
BACKGROUND:
In December 2017, City assume operation and maintenance costs associated with the
northerly portion of the Parking Garage, the addition of the southerly portion of the
Parking Garage will take effect this May, for the new Downtown Parking Structure
located at Belardo Road and Museum Drive. It has been determined that to effectively
clean the large square footage of the parking structure the purchase of a new
combination scrubber/sweeper will be necessary.

Authorization to Purchase M30 Scrubber
The Tennant M30 has duel cylindrical brushes combined with a 95-gallon capacity
recovery tank with a water reclamation system. The 7 cubic foot hopper allows for
sweeping and floor scrubbing of the parking structure surface more efficiently than
current power washing options. The low profile of the M30 will allow for access to the
underground sections that have low overhead clearance.

Authorization to Purchase M30 Scrubber
Pursuant to the provisions of the Procurement Ordinance, 7.09.010, the City Council
may authorize the acquisition of this piece of equipment through a joint powers or other
cooperative purchasing program. The City's Procurement and Contracting Manager
worked closely with the Facilities Maintenance staff to secure four cooperative purchase
options ranging from $71,852.41 to $88,495.34 for the desired equipment, as identified
below.
Aviate Enterprises $71,852.41
Tennant Company $77,711.71
Staples, Inc. $81,868.60
Grainger, Inc. $88,495.34
As such, staff recommends the lowest cooperative contract price from Aviate
Enterprises via the CMAS contract 4-17-0045A in the amount of $71,852.41, inclusive
of shipping and applicable sales tax, as leveraging the purchasing power of the
cooperative contract would likely be less than what we could obtain independently.
ENVIRONMENTAL IMPACT:
The requested City Council action is not a "Project" as defined by the California
Environmental Quality Act (CEQA). Pursuant to Section 15378(a), a "Project" means the
whole of an action, which has a potential for resulting in either a direct physical change in
the environment, or a reasonably foreseeable indirect physical change in the
environment. According to Section 15378(b), a Project does not include: (5)
Organizational or administrative activities of governments that will not result in direct or
indirect physical changes in the environment.
FISCAL IMPACT:
Completion of the Downtown Palm Springs Specific Plan has delivered to the City new
public streets and associated landscaping, and the 1,000 parking spaces extending
throughout the new Parking Facility. The City has now assumed operation and
maintenance costs associated with these new public improvements, which include costs
to provide 24-hour security patrols, parking enforcement, as well as the contract costs
for street and sidewalk cleaning and landscape maintenance, and utility costs. These
costs have been consistently identified in the Measure J Fund budget as "Downtown
Property Maintenance & Other Expenses," with the understanding that the new
Downtown Project would require additional budget to appropriately maintain the new
public improvements.
The current 2017/2018 fiscal year budget appropriated $430,000 into an account
established to pay for the new operation and maintenance costs resulting from the
Downtown Project. Sufficient funds are budgeted and available in the Measure J Capital
Fund, Account 260-1369-42301, to approve purchase of Tennant M30 Diesel Cylindrical
Floor Scrubber-Sweeper.

NEW MACHINE WARRANTY
Tennant Company warrants to the original purchaser, for the above-stated periods (whichever occurs first), that machines will be free from defects in
workmanship and material,provided that machines are installed,operated,and maintained in accordance with Tennant written manuals or other instructions.
This warranty does not apply to damage or failure caused by accident,freight damage,misuse,negligence, abuse,improper repair,or maintenance of the
machines. Please refer to the Operator Manual for proper machine operation and maintenance instructions.
The warranty period begins on the installation date at the end-user site.A Machine Installation/Warranty Report form included with the Operator Manual must
be completed and returned immediately at the time of purchase. If propf of purchase is unavailable,the warranty begins ninety(90)days after original sale
to an Authorized Tennant dealer.
Demonstrator machines purchased from Tennant carry the same warranty as a new machine.
LABOR AND TRAVEL WARRANTY
Tennant will,at its option,provide labor and travel or pay for outside repair for the above-stated periods.
PARTS WARRANTY
Parts replaced or repaired under this warranty are guaranteed for the remainder of the warranty period. The parts warranty on batteries is pro-rated from
the Tennant Company shipping date. Consumable parts,expected to wear from normal use,are not covered under the parts warranty. These consumable
parts include,but are not limited to: belts,drive chains, brushes, pad drivers,filters,squeegees,tires[pro-rated for one It)year on rider machines],skirts,
hand grips,battery cables,power cords,cord restraints,external hoses,vacuum bags,fuses and carbon brushes. Battery chargers and accessories are
warranted for one(1)year.
REPAIR PARTS WARRANTY
After the warranty period expires, repair parts supplied by Tennant are warranted against defects for the period of ninety(90)days,with the exception of
batteries. Lithium-Ion and Lead acid batteries are pro-rated for twelve(12)months. All AGM and Gel batteries are pro-rated for ninety(90)days. The repair
parts warranty only covers parts,not labor or travel(see service labor section for terms).
SERVICE LABOR WARRANTY
Labor and travel performed by a Tennant service representative are warranted for thirty(30)days from the date the repairs are completed. This policy does
not cover work performed by any service company other than Tennant,and is restricted to the specific repair operation or component for which a claim is
made.

CONFLICT OF INTEREST AND NON-DISCRIMINATION
CERTIFICATION
Conflict of Interest. Contractor acknowledges that no officer or employee of the City has or
shall have any direct or indirect financial interest in this Agreement nor shall Contractor enter
into any agreement of any kind with any such officer or employee during the term of this
Agreement and for one year thereafter. Contractor warrants that Contractor has not paid or
given, and will not pay or give, any third party any money or other consideration in exchange for
obtaining this Agreement.
Covenant Against Discrimination. In connection with its performance under this Agreement,
Contractor shall not discriminate against any employee or applicant for employment because of
actual or perceived race, religion, color, sex, age, marital status, ancestry, national origin ( i.e.,
place of origin, immigration status, cultural or linguistic characteristics, or ethnicity), sexual
orientation, gender identity, gender expression, physical or mental disability, or medical
condition (each a "prohibited basis"). Contractor shall ensure that applicants arc employed, and
that employees are treated during their employment,without regard to any prohibited basis. As a
condition precedent to City's lawful capacity to enter this Agreement, and in executing this
Agreement, Contractor certifies that its actions and omissions hereunder shall not incorporate
any discrimination arising from or related to any prohibited basis in any Contractor activity,
including but not limited to the following: employment, upgrading, demotion or transfer;
recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of
compensation; and selection for training, including apprenticeship; and further, that Contractor is
in full compliance with the provisions of Palm Springs Municipal Code Section 7.09.040,
including without limitation the provision of benefits, relating to non-discrimination in city
contracting.
