SUMMARY
This is a request for the City Council to review an amendment to an existing Sign
District for the addition of one (1) 33-square foot sign attached to the front fagade of the
Mercedes-Benz Auto Dealership; and the addition of five (5) new signs to the proposed
Porsche Dealership. The City Council approved a Special Sign District per Section
93.20.05(C)(8) of the Palm Springs Zoning Code (PSZC) in 2012 to facilitate proposed
signage for multiple auto dealerships located at 3737, 3919, 4057, and 4095 East Palm
Canyon Drive.
RECOMMENDATION:
1) Adopt Resolution No. , "A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING AN AMENDED
SIGN DISTRICT TO INLCUDE ONE (1) 33-SQUARE FOOT SIGN ATTACHED
TO THE FRONT FAgADE OF THE MERCEDES-BENZ AUTO DEALERSHIP;
AND THE ADDITION OF FIVE (5) NEW SIGNS TO THE NEW PORSCHE

ANALYSIS:
There are four (4) existing and one (1) proposed automobile dealerships located east of
Cherokee Way along the south side of East Palm Canyon Drive. From east to west, the
dealerships include Mercedes Benz of Palm Springs, Palm Springs Infinity, Palm
Springs Hyundai, BMW of Palm Springs, and the new Porsche dealership. The City
Council approved a consolidated Special Sign District in 2012 for all auto dealerships in
an effort to allow consistency and flexibility in existing and future signage in this area.
A Special Sign District is similar to that of a Sign Program, in that it allows all
dealerships to identify the number, size, and design of signs with the aim of
complementing the architecture of the complex. Section 93.20.08(J) of the Zoning
Code states the following regarding Special Sign Districts:
The City Council, in its sole discretion, may adopt Special Sign Districts,
and provide appropriate implementing sign programs as part of a specific
plan, Planned Development District, development agreement, or other
process subject to public review when special sign provisions are
necessary or appropriate to implement General Plan provisions and goals.

An analysis of the requested signage is provided below.
Mercedes Benz:
The dealership has two street frontages which allow a main sign and accessory signage
on both frontages under Section 93.20.05 and 93.20.08(L) of the Zoning Code. The
table below provides an analysis of signage permitted:

The existing signs on the building have a total of 70.5 square feet, meeting the
requirement of the PSZC. The addition of the "AMG" logo will add 33-square feet to the
overall signage and will not conform without the approval of the Special Sign District
amendment. The sign will be a metal cabinet painted black with white push-thru letters.
The cabinet will be two (2') feet wide by 16' feet long and will be affixed to existing metal
pillars of the front fagade. The existing "Mercedes-Benz of Palm Springs" sign is slightly
larger at 2'-F and is a different font; however the new "AMG" logo sign will match in
color and mounting method.
Porsche:
The sign package for Porsche includes one (1) main sign with the "Porsche" dealership
name attached to the front fagade facing East Palm Canyon Drive. The red individual
illuminated letters will have a height of 2'-5" with a length of 36'-7" for a total of 91.5-
square feet. The placement of the main "Porsche" sign will be on the lower portion of
the building between the horizontal scoring of the metal bands which make up the skin
of the fagade. One (1) double-sided monument sign will be placed at the driveway
entrance at 7'-4" tall and a smaller service monument at 3' tall on the opposite side of
the entry. One (1) additional "Parts and Service" freestanding sign at 4' tall will be
located at the end of the service street at the second driveway. A small accessory
"Porsche" sign and logo will be laced at the building entry.

The new Porsche dealership has a street frontage of 320 feet which allows for a sign
calculation for the main sign and accessory signage according to Section 93.20.05 and
93.20.08(L) of the Zoning Code.

The sign package as proposed is asking for an additional eighty (80) square feet over
what the PSZC would allow without the approval of the amendment to the Special Sign
District. Staff believes that the signs as proposed will be complimentary to the
minimalist building design. The placement of one larger sign located on the bottom half
of the building and one main monument sign is appropriate in scale and massing.
ARCHITECTURAL ADVISORY COMMITTEE:
The Architectural Advisory Committee reviewed the proposed amendment to the Sign
District at the April 2, 2018 meeting and made two (2) recommendations to the City
Council.
The discussion relative to the Mercedes-Benz sign focused on the relationship of the
existing and proposed signs to the front fagade canopy columns. The new sign will be
slightly smaller in size as compared to the existing Mercedes-Benz sign. The size
difference is due to the proportions of the "AMG" corporate logo and the AAC
questioned increasing the sign box for consistency. The final vote was 5-2 to
recommend approval of the sign as proposed.

The AAC previously reviewed the Major Architectural Application for the new Porsche
dealership building and was familiar with overall design. The AAC felt that the addition
of five (5) new signs with one large "Porsche" brand sign affixed to the front fagade
would be compatible and not out of scale relative to the building design. Members
commented that the proposal was sophisticated and would be an integral part of the
building architecture. The AAC voted 7-0 to recommend approval as presented.
REQUIRED FINDINGS:
SIGN DISTRICT:
The Palm Springs Zoning Code (PSZC) Sections 93.20.08(H) & (1) requires an
evaluation of the proposed deviations from the specific requirements of the Sign
Ordinance. The following findings can be made:
1. Due to the physical characteristics of the property and the orientation and design
of the structures on the property, the strict application of the regulations of the
Sign Ordinance will not give adequate visibility to the signage.
The Special Sign District is unique within the City and is the only one which
encompasses a large concentration of auto dealerships. The proposed amendment to
the Mercedes-Benz signage with the addition of a 33-square foot logo sign will provide a
visual display of a new high-end performance brand which is not currently present on
the building. The additional sign attached to the front fagade canopy columns will
provide greater visibility and be consistent and harmonious with existing signs on the
building relative to style, color, and mounting method.
The construction of the new building for a Porsche dealership requires the addition of
five (5) signs to the Sign District which would not normally be permitted if the strict
application of the Sign Ordinance would be administered. The proposed overall sign
square footage exceeds the limitations of the Code. The new building with its
orientation set back from the Major Thoroughfare of East Palm Canyon Drive limits the
visibility of the signs, requiring relief of the strict application of the sign code resulting in
the amendment to the approved Sign District.
The requested deviations when viewed against the overall cohesiveness of the Special
Sign District can be considered justified. Each auto dealership has its own unique style
and design that identifies each brand while not being excessive with sign clutter.
2. The approved Sign District will be compatible with the design of the property and
will represent the least departure from the standards of the Sign Ordinance
necessary for the effectiveness of the program.
The proposed signs will be placed in logical locations to easily convey to the consumer

the individual auto brands. The placement of the new signs will be consistent and
compatible with other dealerships within the Special Sign District. Therefore, there is a
consistency of composition and treatment within the Special Sign District.
3. The approved Sign District is compatible with the surrounding property and not
contrary to the purpose of the Sign Ordinance.
The proposed signs will complement the existing building architecture by being
proportional in size with appropriate placement on the buildings. In addition, the new
signs will not result in visual clutter and detract from the building design. The signs will
be consistent with other signs on the buildings and within the Sign District.
CEQA:
The proposed project is considered a "project" pursuant to the terms of the California
Environmental Quality Act ("CEQA"), and has been determined to be Categorically
Exempt as a Class 11 exemption (Accessory Structures) pursuant to Section 15311(a)
of the CEQA Guidelines. The project will result in the construction of signs that are
accessory to commercial structures, which are exempt pursuant to the aforementioned
Section.
BUSINESS PRINCIPAL DISCLOSURE:
Please see Attachment #4 for the disclosure of ownership.
CONCLUSION:
The City Council, in its sole discretion, may adopt an amendment to an existing Sign
Districts when special sign provisions are deemed necessary or appropriate. The Sign
District as proposed with one (1) new sign at the Mercedes-Benz dealership and five (5)
new signs for the new Porsche building will be compatible and consistent with existing
signs present within the Sign District. Staff believes that the Sign District amendment is
an appropriate approach to allow for the visual display of the a new product offered by
Mercedes-Benz and the construction of a new Porsche dealership. Based upon the
findings listed within this report, Staff recommends approval with conditions.

PORSCHE DEALERSHIP LOCATED AT 3737 & 4095
EAST PALM CANYON DRIVE.
THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS:
A. VIP Motorcars, ("Applicant") has filed an application with the City pursuant to
Chapter 93.20 (Sign Ordinance) of the Palm Springs Zoning Code for an amendment to
an existing Sign District (Case 18-001) for the addition of one (1) 33-square foot sign
attached to the front fagade at the Mercedes-Benz dealership located at 4095 East
Palm Canyon Drive, Zone C-2.
B. Indigo Auto Group, ("Applicant') has filed an application with the City pursuant to
Chapter 93.20 (Sign Ordinance) of the Palm Springs Zoning Code for an amendment to
an existing Sign District (Case 18-002) to add five (5) new signs for a new auto
dealership building located at 3737 East Palm Canyon Drive, Zone C-2.
C. The Applicant has requested an amendment to an existing Sign District per
Chapter 93.20.08(J) of the Sign Ordinance, as described in the City Council Staff
Report, dated May 16, 2018.

April 2 2018 the Architectural Advisory Committee reviewed the proposed

amendment to the existing Sign District and conducted two separate votes as follows:
• Mercedes-Benz by a vote of 5-2 to recommend approval of the project to the City
Council.
• Porsche by a vote of 7-0 to recommend approval of the project to the City
Council.
E. A notice of public meeting of the City Council of the City of Palm Springs
California to consider Case SD 18-001 & 002 was given in accordance with applicable
law, and on May 10, 2018, the City Council carefully reviewed and considered all of the
evidence presented in connection with the hearing on the Project, including but not
limited to the staff report, and all written and oral testimony presented.
F. Pursuant to Section 93.20.08(L) of the Palm Springs Zoning Code, the City
Council has examined the amendment to the Sign District, and evaluated it against the
required findings for approval as follows:

THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES AS FOLLOWS:
SECTION 1. CEQA.
The proposed project is considered a "project" pursuant to the terms of the California
Environmental Quality Act ("CEQA"), and has been determined to be Categorically
Exempt as a Class 11 exemption (Accessory Structures) pursuant to Section 15311(a)
of the CEQA Guidelines. The project will result in the construction of signs that are
accessory to commercial structures, which are exempt pursuant to the aforementioned
Section.
SECTION 2. Sign District.
That the findings and determinations reflected above are true and correct, and are
incorporated by this reference herein as the cause and foundation for the action taken
by and through this Resolution. The City Council approves this amendment to the Sign
District application (Case SP 18-001 & 002) with conditions as outlined in attached
Exhibit "A."

CONDITIONS OF APPROVAL
Before final acceptance of the project, all conditions listed below shall be completed to
the satisfaction of the City Engineer, the Director of Planning Services, the Chief of
Police, the Fire Chief or their designee, depending on which department recommended
the condition.
Any agreements, easements or covenants required to be entered into shall be in a form
approved by the City Attorney.
ADMINISTRATIVE CONDITIONS
ADM 1. The proposed development of the premises shall conform to all applicable
regulations of the Palm Springs Zoning Ordinance, Municipal Code, or any
other City Codes, ordinances and resolutions which supplement the zoning
district regulations.
ADM 2. The owner shall defend, indemnify, and hold harmless the City of Palm Springs,
its agents, officers, and employees from any claim, action, or proceeding
against the City of Palm Springs or its agents, officers or employees to attach,
set aside, void or annul, an approval of the City of Palm Springs, its legislative
body, advisory agencies, or administrative officers concerning Cases SP 18-
001 & 18-002. The City of Palm Springs will promptly notify the applicant of
any such claim, action, or proceeding against the City of Palm Springs and the
applicant will either undertake defense of the matter and pay the City's
associated legal costs or will advance funds to pay for defense of the matter by
the City Attorney. If the City of Palm Springs fails to promptly notify the
applicant of any such claim, action or proceeding or fails to cooperate fully in
the defense, the applicant shall not, thereafter, be responsible to defend,
indemnify, or hold harmless the City of Palm Springs. Notwithstanding the
foregoing, the City retains the right to settle or abandon the matter without the
applicant's consent but should it do so, the City shall waive the indemnification
herein, except, the City's decision to settle or abandon a matter following an
adverse judgment or failure to appeal, shall not cause a waiver of the
indemnification rights herein.

PLANNING DEPARTMENT CONDITIONS

Any deviations will require review by the Planning Services Department.

At the Architectural Advisory Committee meeting of the City of Palm Springs, held April
2, 2018 the Architectural Advisory Committee took the following two (2) actions:
VIP MOTORCARS REQUESTING AN AMENDMENT TO AN EXISTING SIGN
DISTRICT TO ADD ONE 33-SQUARE FOOT SIGN AT THE MERCEDES-BENZ
DEALERSHIP LOCATED AT 4095 EAST PALM CANYON DRIVE, ZONE C-2 (CASE
18-001 SD); AND
Associate Planner Mlaker presented the proposed sign district amendment for
Mercedes-Benz and Porsche dealership as outlined in the staff memorandum.
Member Jakway verified the existing square footage on the signage.
Member Rotman clarified the existing signage.
Vice Chair Cassady questioned if there are other sign districts and if there are
exceptions from the sign ordinance.
JERRY JOHNSON, VIP Motor Cars LTD, (applicant), provided background information
and requested consideration of the proposed sign.
Member Rotman questioned the proportions of the AMG logo and design.
Member Jakway commented that the building looks cluttered and suggested the scale
be increased to match the size of the "Mercedes' sign.
Chair Song questioned the size and dimensions of the "Mercedes" sign.
Vice Chair Cassady commented on the relationship of the signs to the columns on
which they are attached.
Member Rotman verified the difference in height of the two (2) signs (AMG & Mercedes
Benz sign). He questioned if the sign box could be increase so that the two signs are
the same height.

CHRIS HECTOR, Indigo Auto Group, representing Porsche Dealership, provided details
and was available for questions from the Committee.
Member Rotman questioned the details of the "service" sign; and asked if the conditions
of approval imposed by the Planning Commission would impact the location of signs.
(pedestrian sidewalk)
Member Jakway clarified the sign mounted on the building.
Member Rotman questioned details of the sign mounted building.
Member McCoy verified the LED illumination (internal), service sign is not illuminated.
Member Jakway thinks it's a very sophisticated sign program and likes it. He
questioned the placement of the sign and alignment with the vertical panels.
Member Doczi concurred with Member Jakway and thinks the wall sign is an integral
part of the architecture.
