FROM : David H. Ready, City Manager BY : Engineering Services Department SUMMARY Formal City Council acceptance of 2017 ADA Curb Ramps & Library Sidewalk, City Project No . 17-11 is required to document the completion of the public works improvements, and to allow the City 's filing of a Notice of Completion with the Riverside County Recorder in accordance with Section 920.0 of the California Civil Code . RECOMMENDATION: 1. Accept the public works improvement identified for 2017 ADA Curb Ramps & Library Sidewalk , City Project No . 17-11 , as completed in accordance with the plans and specifications; and 2. Authorize the City Engineer to execute and file for recordation with the Riverside County Recorder a Notice of Completion for the 2017 ADA Curb Ramps & Library Sidewalk , City Project No . 17-11 . BACKGROUND: In February 2017, the Department of Engineering Services submitted two applications for Community Development Block Grant (CDBG) funds for Program Year 2017/2018 . The first application , "Citywide ADA Curb Ramps ," requested $100 ,000 in ADA curb ramp improvements. The second application requested $34,0 00 for "Sidewalk Improvements at the Palm Springs Public Library." On November 1, 2017 , City .Council approved the plans , specifications and estimates and authorized staff to advertise and solicit bids for 2017 ADA Curb Ramps & Library Sidewalk project. In general accordance with the CDBG Grant, the work was broken down into two separate bid schedules as follows : ITEM NO. .1 . l-\. 2 City Council Staff Report September 5, 2018 --Page 2 Acceptance of CP 17-11 1) Bid Schedule A: Reconstruction of existing curb ramps and upgrade nonconforming curb ramps located on Ramon Road from Calle Encilia to Sunrise Way and on Sunrise Way from Baristo Road to Alejo Road as shown in Figure 1. 2) Bid Schedule B: Construct Sidewalk from Baristo Road to Palm Springs Library entrance as shown in Figure 2. VICINI TY MA l' (NOT TO SCAL I':) CI TY OF PA I.M SPRlKGS, CA !JFORNIA FIGURE 1 FIGURE 2 On November 4, 2017 , the Notice of Inviting Bids was released to the general contracting community and was published in the Desert Sun in accordance with the City 's bidding procedures. The final engineer's estimate for this Project was $118 ,000. On January 24 , 2018 , the contract was awarded to STL Landscape , Inc ., in the amount of $134,104 . Their bid amount was approximately 13 % over the engineer's estimate. STL Landscape , Inc., was not the lowest bidder, but was responsive . On May 21 , 2018 , STL Landscape , Inc. commenced construction of the project , which was completed on July 3, 2018 . The final cost of the work is $124 ,868 and a deductive (credit) change order will be issued to reduce the contract amount by $8 ,6 36. As determined by City staff, the Contractor satisfactorily completed the Project requirements . Staff recommends that the City Council accept the Project as required by Section 9200 of the California Civil Code , and authorize the City Engineer to file and record a Notice of Comp letion within 15 days of the City Council 's act ion . A copy of the Notice of Completion to be submitted to the County is included as Attachment 1. 3 City Council Staff Report September 5, 2018 --Page 3 Acceptance of CP 17-11 ENVIRONMENTAL IMPACT: Section 21 084 of the California Public Resources Code requires Guidelines for Implementation of the California Environmental Quality Act ("CEQA"). The Guidelines are required to include a list of classes of projects which have been determined not to have a significant effect on the environment and which are exempt from the provisions of CEQA. In response to that mandate, the Secretary for Resources identified classes of projects that do not have a significant effect on the environment, and are declared to be categorically exempt from the requirement for the preparation of environmental documents. In accordance with Section 15301(c) "Existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities (this includes road grading for the purpose of public safety)," Class 1 projects consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. Therefore, in accordance with Section 15301 (c), staff determined that the 2017 ADA Curb Ramps and Library Sidewalk, City Project No. 17-11, is considered categorically exempt from CEQA and a Notice of Exemption was prepared and filed with the Riverside County Clerk. FISCAL IMPACT: The Engineering Services Department requested a total of $134,000 for the two applications submitted for the CDBG program. The first application, "Citywide ADA Curb Ramps," requested $100,000 for ADA curb ramp improvements. The second application requested $34,000 for "Sidewalk Improvements at the Palm Springs Public Library." Due to the selection committee's desire to spread funding amongst the many qualified applicants and limited amount of CDBG funds, the City was awarded only $88,983 for the first application and the full award of $34,000 for the sidewalk improvements. The total initial award for both projects was $122,983. As part of the CDBG Program, a total of $89,769 and $34,000 was approved as part of the FY 2017/2018 allocations. Continuing the City's commitment to public safety and accessibility for all pedestrian users, staff identified another source of funding (Gas Tax) to supplement funding for the project.
