HomeMy WebLinkAbout24501RESOLUTION NO.24501 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, RATIFYING TENTATIVE TRACT MAP 36691 AS CONFORMING TO ITS APPROVAL BY CITY COUNCIL RESOLUTION 24085, AND APPROVING A TWELVE MONTH EXTENSION FOR TTM 36691 — A SUBDIVISION OF 156.18 GROSS ACRES INTO 386 RESIDENTIAL LOTS, PUBLIC AND PRIVATE STREETS, A PARK, PRESERVED OPEN SPACE, AND PRIVATE OPEN SPACE, GENERALLY LOCATED NORTH OF VERONA ROAD, EAST OF SUNRISE WAY, AND SOUTHWEST OF WHITEWATER RIVER WASH TTM 36691. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS FINDS AND DETERMINES: A. Palm Springs Country Club, LLC ("Applicant') filed an application with the City, pursuant to Section 9.63.110 of the Municipal Code, for an extension of time to TTM 36691, to develop and subdivide 126-acres of land previously operated as a golf course with (386) residential dwelling units, open space and streets located within Sections 1 and 36, currently identified as APNs: 501-190-002, 501-190-011, 669-480-027, 669-590- 066 (the "Project' also known as Serena Park). B. On September 7, 2016, the City Council held a public hearing, certified an Environmental Impact Report, and adopted Resolutions 24082, 24083, 24084, 24085 and Ordinance 1898, approving the Project subject to conditions. At the time of this approval hearing, a revised Tentative Tract Map had not been finalized in accordance with the site plan revisions recommended by the Planning Commission and ultimately approved by the City Council. It was also noted that any revision from the 429-unit proposal would require the resubmittal of the TTM to ensure the revised project is consistent with the approved land subdivision. The applicant has submitted the revised TTM, dated January 9, 2018, for ratification as conforming to City Council Resolution 24085. C. On September 26, 2018, the Planning Commission voted to recommend approval of the extension of time request to the City Council, finding that the applicant had demonstrated good cause for the extension. D. On October 17, 2018, a consideration of the application for the extension of time was held by the City Council in accordance with applicable law. E. The proposed project is considered a "project' pursuant to the terms of the California Environmental Quality Act ("CEQA"). An EIR certified by the City Council on September 7, 2016, is the controlling environmental document for the Project. Pursuant to Section 15162 of the CEQA Guidelines, the preparation of further environmental documentation is not necessary because the changed circumstances of the project will not result in any new significant environmental effects or a substantial increase in the Resolution No. 24501 Page 2 severity of previously identified significant effects. The extension of time request would not result in any new environmental impacts beyond those already assessed in the certified EIR. F. The City Council has carefully reviewed and considered all of the evidence presented in connection with the hearing on the project, including but not limited to the staff report, and all written and oral testimony presented. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS DOES HEREBY RESOLVE: SECTION 1: That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. SECTION 2: The City Council hereby ratifies the revised Tentative Tract Map, dated January 9, 2018, as conforming to City Council Resolution 24085. SECTION 3: Pursuant to Section 9.63.110 of the City of Palm Springs Municipal Code, the City Council hereby approves a twelve month extension of time for Tentative Tract Map 36691, from September 8, 2018 to September 7, 2019, subject to the conditions of approval imposed in City Council Resolution 24085, as amended in the attached Exhibit A.
