HomeMy WebLinkAbout24536 RESOLUTION NO. 24536 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING AGREEMENTS WITH CERTAIN TOW COMPANIES FOR AS-NEEDED VEHICLE TOWING AND STORAGE SERVICES FOR THE PALM SPRINGS POLICE DEPARTMENT. A7237, A7238, A7239. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS HEREBY FINDS AND DETERMINES AS FOLLOWS: A. The City of Palm Springs, California, (the "City"), requires the services of one or more privately-owned tow companies for the purposes of effectively enforcing parking and traffic laws; promptly towing vehicles that are inoperative or involved in a collision; and expeditiously removing and safely storing vehicles that the City's Police Department impounds or holds for investigation, examination or evidence. B. The City Council previously adopted Chapter 11.82, "Police Tow Services Standards," of the Palm Springs Municipal Code, establishing a selection process and contractual system for vehicle towing and storage services that are initiated by the Palm Springs Police Department. C. In accordance with Chapter 11.82, on July 18, 2018, the City Council did adopt Resolution No. 24471, entitled "A Resolution of the City Council of the City of Palm Springs, California, Approving the Request for Proposals/Qualifications for the Rotational Tow Program, Authorizing Staff to Advertise and Solicit Responses, and Approving Maximum Rates that Tow Service Providers Can Charge, and an Associated Vehicle Towing Administrative Cost Recovery Fee for the Palm Springs Police Department." D. Incorporated as part of Resolution No. 24471, the City Council adopted the Vehicle Towing Administrative Cost Recovery Fee (the "VTACR Fee") of $147,126.13 as an annual fee establishing the actual and reasonable costs of the City's administration of the rotational tow program. E. On September 6, 2018, the City's Office of Procurement and Contracting issued its Statement of Qualifications (SOQ 07-19) for Towing and Storage of Vehicles as Requested by the Palm Springs Police Department, (the "SOQ"), and subsequently issued four Addenda in response to certain questions related to the SOQ. F. On October 8, 2018, the City received Statements of Qualifications in response to the SOQ from the three following firms: A & A Towing Recovery, Inc.; Dave's Towing Service; and Mohica Towing, Inc. G. An Evaluation Panel consisting of representatives from the City's Police, Finance, and Legal Services Departments evaluated the Statements of Qualifications received in Resolution No. 24536 Page 2 response to the SOO, and has determined that all three firms were fully responsive to the SOO, and are qualified to provide the rotation tow program services to the City. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS HEREBY RESOLVES AS FOLLOWS: SECTION 1. That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. SECTION 2. In accordance with Section 11.82.060 of the Palm Springs Municipal Code, the City Council hereby approves an Official Police Tow Service Agreement with the following firms: A & A Towing and Recovery, Inc. Dave's Towing Service Mohica Towing, Inc. SECTION 3. The City Manager is hereby authorized to take all actions necessary to execute the agreements. ADOPTED THIS 19th DAY OF DECEMBER 2018. David H.
