HomeMy WebLinkAbout24555 RESOLUTION NO. 24555 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, DETERMINING THAT THE PUBLIC CONVENIENCE WOULD BE SERVED BY THE ISSUANCE OF AN ON-SALE BEER LICENSE (TYPE 40) AT THE GOLF COURSE PROPERTY LOCATED AT 2700 EAST MESQUITE AVENUE, WITHIN CENSUS TRACT NO. 9407. THE CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Robert Oliver Frost ("Applicant") has applied for a California Department of Alcoholic Beverage Control (ABC) for a Type 40 (On-Sale Beer) alcohol license for the sale of beer as an accessory to the Mesquite Golf Course located at 2700 East Mesquite Avenue, Census Tract No. 9407, Zone PD-153, Case 5.0173 PCN. B. The California Department of Alcoholic Beverages and Control (ABC) has determined that there are three (3) on-sale liquor licenses issued within Census Tract No. 9407 while only two (2) such licenses would be allowed based on the population in the County in which the Applicant's premise is located. C. The California Department of Alcoholic Beverages and Control (ABC) have determined that there is an "undue concentration" of alcohol-related licenses in the Census Tract No. 9407. D. Pursuant to Section 23958.4(b)(2) of the State of California Business and Professions Code, the City Council may determine the public convenience or necessity would be served by the issuance of the requested license. E. On February 6, 2019, the City Council carefully reviewed and considered all of the evidence presented in connection with the meeting on the project, including, but not limited to, the staff report, and all written and oral testimony presented. F. As a commercial enterprise, the existing golf course provides an outdoor recreational amenity to residents and visitors alike. The addition of a retail beer selection will further enhance the ancillary sale of retail items offered by the golf course operator. In addition, other golf course properties in Palm Springs offer the sale of beer as a part of the normal operation. Considering these elements, the Council finds that issuance of the requested liquor license is suitable for the region. THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES: SECTION 1. That the findings and determinations reflected above are true and correct, and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. That the public convenience would be served by the issuance of a Type 40 (On-Sale Beer) liquor license located at 2700 East Mesquite Avenue, within Census Tract No. 9407.
