HomeMy WebLinkAbout24721 RESOLUTION NO. 24721 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, APPROVING A MINOR ARCHITECTURAL APPLICATION (MAA) BY MIKE STORINO ON BEHALF OF IKANIK-CANNUS, INC. FOR THE RENOVATION OF AN EXISTING 3,191-SQUARE FOOT INDUSTRIAL BUILDING FOR A CANNABIS LOUNGE AND DISPENSARY FACILITY LOCATED AT 508 INDUSTRIAL WAY, ZONE CM, SECTION 23 (CASE 3.1112- MAA). THE PALM SPRINGS CITY COUNCIL FINDS AND DETERMINES AS FOLLOWS: A. Mike Storino, on behalf of the Ikanik-Cannus, Inc., has filed a Minor Architectural Application (MAA) request pursuant to Sections 93.23.15(F)(3) of the Palm Springs Zoning Code seeking a minor architectural approval for an existing 3,191 square feet industrialk building to be used as a cannabis lounge and dispensary facility at 508 Industrial Place, Zone CM. B. The PSZC Section 93.23.15(F)(3) requires an architectural review by the City Council of all cannabis lounge facilities and adult cannabis dispensaries upon a recommendation by the Architectural Advisory Committee (AAC) subject to the criteria of Section 94.04.00(D) of PSZC. C. The proposed project is considered a "project" pursuant to the terms of the California Environmental Quality Act ("CEQA"), and has been determined to be categorically exempt pursuant to Section 15301(a) of the CEQA Guidelines (Class 1, Existing Structures). D. PSZC Section 94.04.00(D) requires an evaluation of the proposed project to determine if it will provide a desirable environment for its occupants, be compatible with the character of adjacent and surrounding developments, and. whether it is of good composition, materials, textures and colors. Conformance are to be evaluated based on the following criteria: 1. Site layout, orientation, location of structures and relationship to one another and to open spaces and topography. Definition of pedestrian and vehicular areas; i.e., sidewalks as distinct from parking lot areas. The site is fully developed with an existing building. There are no existing sidewalks but there is a parking lot area. The renovation project will include changes to the building exterior,-installation of new landscaping, new exterior lighting and restriping of the parking lot. All roof mounted equipment will be properly screened on all sides. Resolution No. 24721 Page 2 2. Harmonious relationship with existing and proposed adjoining developments and in the context of the immediate neighborhood/community, avoiding both excessive variety and monotonous repetition, but allowing similarity of style, if warranted. The new building facades will include a mix of desert colors in both light and dark hues. A variety of textures and materials are proposed, such as wood siding paneling and stucco walls. 3. Maximum height, area, setbacks and overall mass, as well as parts of any structure (buildings, walls, screens, towers or signs) and effective concealment of all mechanical equipment; The proposed improvements are on an existing building, the height, mass and setbacks will not be impacted by the renovations. 4. Building design, materials and colors to be sympathetic with desert surroundings; The proposed materials and color scheme fits the desert environment but with a modern commercial/industrial appearance. The proposed colors are sympathetic with desert surroundings. 5. Harmony of materials, colors and composition of those elements of a structure, including overhangs, roofs, and substructures which are visible simultaneously; The proposed upgrade will have a harmonious theme along the street frontage however, overall, the proposed materials and colors will be a much improved appearance compared to the existing building condition. 6. Consistency of composition and treatment; The proposed materials and other components of the renovations are all well suited for the building; considering that the existing building is dilapidated and in need of extensive improvements. 7. Location and type of planting, with regard for desert climate conditions. Preservation of specimen and landmark trees upon a site, with proper irrigation to insure maintenance of all plant materials The proposed conceptual landscape plans and plant materials are appropriate for the desert climate. Landscaped areas are limited to three smaller spaces along the frontage of the building. Proposed plant palette, sizes and inert groundcovers are consistent with the materials recommended by the Coachella Valley Water District and are appropriate for Palm Springs climate and landscape. Resolution No. 24721 Page 3 THE CITY COUNCIL OF THE CITY OF PALM SPRINGS RESOLVES AS FOLLOWS: That the evaluations reflected above are true and correct and are incorporated by this reference herein as the cause and foundation for the action taken by and through this Resolution. Based upon the foregoing, the City Council hereby approves Case 3.1112- MAA; a minor architectural approval for Ikanik-Cannus, Inc., which will be located at 508 Industrial Place, subject to the conditions attached as Exhibit A. " , City Clerk Resolution No. 24721 Page 4 EXHIBIT A Case 3.1112 MAA Ikanic-Cannus, Inc. — 508 Industrial Place February 13, 2020 CONDITIONS OF APPROVAL Before final acceptance of the project, all conditions listed below shall be completed to the satisfaction of the Director of Planning Services, the Director of Building and Safety, or the Director of Community and Economic Development, depending on which department recommended the condition. Any agreements, easements or covenants required to be entered into shall be in a form approved by the City Attorney. ADMINISTRATIVE CONDITIONS ADM 1. Project Description. This approval is for the project described per Case 3.1112- MAA, except as modified by the conditions below. ADM 2. Reference Documents. The site shall be developed and maintained in accordance with the approved plans, date stamped January 16, 2020 on file in the Planning Division, except as modified by the conditions below. ADM 3. Conform to all Codes and Regulations. The project shall conform to the conditions contained herein, all applicable regulations of the Palm Springs Zoning Ordinance, Municipal Code, and any other City County, State and Federal Codes, ordinances, resolutions and laws that may apply. ADM 4. Minor Deviations. The Director of Planning or designee may approve minor deviations to the project description and approved plans in accordance with the provisions of the Palm Springs Zoning Code. ADM 5. Indemnification. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its agents, officers, and employees from any claim, action, or proceeding against the City of Palm Springs or its agents, officers or employees to attach, set aside, void or annul, an approval of the City of Palm Springs, its legislative body, advisory agencies, or administrative officers concerning Case 3.1112-MAA. The City of Palm Springs will promptly notify the applicant of any such claim, action, or proceeding against the City of Palm Springs and the -applicant will either undertake defense of the matter and pay the City's associated legal costs or will advance funds to pay for defense of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the applicant of-any such claim, action or proceeding or fails to cooperate fully in the defense-, the applicant shall not, thereafter, be responsible to defend, indemnify, or hold harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the right to settle or abandon the matter without the Resolution No. 24721 Page 5 applicant's consent but should it do so, the City shall waive the indemnification herein, except, the City's decision to settle or abandon a matter following an adverse judgment or failure to appeal, shall not cause a waiver of the indemnification rights herein. ADM 6. Grounds for Revocation. Non-compliance with any of the conditions of this approval or with City codes and ordinances may result in proceedings to revoke the approval. In addition, violations of the City Codes and Ordinances will result in enforcement actions which may include citations, arrest, temporary.business closure, or revocation of this permit in accordance with law. PLANNING DEPARTMENT CONDITIONS PLN 1. The final landscape plan and parking lot restriping shall be brought back to the AAC for a final review and approval. PLN 2. The applicant shall remove all the wheel stops from the parking spaces. PLN 3. The applicant shall submit a well defined roof plan showing equipment screening. PLN 4. The applicant shall reconsider the height and interior design of proposed skylight. PLN 5. The applicant shall reconsider the size of the proposed skylight as it appears to be disproportionate and could create glare into the sky. PLN 6. The applicant to reconsider the proposed materials as some of the materials will not react well in the desert environment. PLN 7. The applicant shall install a door for access into the lounge from the dispensary area. END OF CONDITIONS
