Sumich: Confirming our recent telephone conversation relative to a refund due us under the referenced Agreements, we are the holder of the Agreements via our July 1983 merger with United Savings, who was the successor in interest to Coachella Valley Savings . We filed Articles of Combination in Riverside Countv on February 24, 1984 , Book 1984 , Page 37847 . In the event a third party should file any claim for reimbursement under these agreements subsequent to your reimbursement to us, we will then restore the reimbursed funds to you, upon presentation to us of adequate evidence to the right to the funds by the claimant. AGREEMENT #1419 4-14-78 THIS AGREEMENT made and entered into this f day - 19jef, between the CITY OF PALM SPRINGS, CALIFORNIA, a municipal corporation, hereinafter called the CITY and COACHELLA VALLEY SAVINGS AND LOAN ASSOCIATION, hereinafter called the DEVELOPER. WHEREAS the DEVELOPER is, at the time of this agreement, the legal holder of Sewer Construction Refund Agreement No. 413, having an expiration date of February 24 , 1976; relating to the following described property: Portion of Government Lot 15, Section 22, T4S, R4E, SBB&M, Parcel 1 of Record of Survey 30/71 and Lot 9, Block 29 of P. S. Townsite. and WHEREAS the City Council by Resolution 12590, established a policy relative to sewer reimbursement agreements which have fixed expiration dates; and WHEREAS the DEVELOPER has requested that the CITY and DEVELOPER enter into a new agreement, in accordance with said Resolution 12590, to continue to reimburse the DEVELOPER for assessments remaining unpaid under Agreement No. 413, or amounts equaling the Street Main Charge, whichever are lesser; and WHEREAS the CITY has determined, and DEVELOPER agrees , that the total remaining assessable frontage of lots which can connect to the sanitary sewer by use of sewer laterals is 643.88 feet; NOW THEREFORE IT IS AGREED that the DEVELOPER shall continue to be entitled to reimbursements of assessments still unpaid under Agreement No. 413, provided, however that the amount reimbursable shall in no case exceed the amount of the City's Street Main Charge in effect as of the Sw GREAT WESTERN SAVINGS A FEDERAL SAVINGS AND LOAN ASSOCIATION I 9301 Corbin Ave.•Suite 380•P.O Box 1010•Northridge,California 91328 l� -7� 1 May 22, 1984 n `� Ms . For these purposes it is agreed that developers, owners, or lessees of lots shown on Exhibit "A" attached hereto in the area served by said sewer shall pay to the CITY the amount shown herein or the Street Main Charge whichever is greater, plus sewer connection charges in effect at such time, prior to a permit being issued for connection to said sewer.
