HomeMy WebLinkAbout01418 - PELTON LAS PALMAS EST SEWER Kelton, Ted - Private Sewer Re- SEWER REIMBURSEMENT AGREEMENT imb Agr - Las Palmas Estates BETWEEN THE CITY OF PALM SPRINGS AGREEMENT IA1418 AND TED PELTON. 7-14-78 THIS AGREEMENT made and entered into this day of 1978, between the CITY OF PALM SPRINGS, CALIFORNIA, a municipal✓ corporation, hereinafter called the CITY and Ted Pelton, hereinafter called the DEVELOPER. WHEREAS the DEVELOPER is, at the time of this agreement, the owner of the following described property: Lots 6, 7 and 8, Block A, Las Palmas Estates as shown upon a map of said subdivision recorded in Map Book 15, pages 15 and 16, records of Riverside County, and the legal holder of Sewer Construction Refund Agreement No. 361 , having an expiration date of August 1 , 1975; and WHEREAS the City Council by Resolution 12590, established a policy relative to sewer reimbursement agreements which have fixed expiration dates; and WHEREAS the DEVELOPER has requested that the CITY and DEVELOPER enter into a new agreement, in accordance with said Resolution 12590, to continue to reimburse the DEVELOPER for assessments remaining unpaid under Agreement No. 361 , or amounts equaling the Street Main Charge, whichever are lesser; and WHEREAS the CITY has determined, and DEVELOPER agrees, that the total remaining assessable frontage of lots which can connect to the sanitary sewer by use of sewer laterals is 304.72 feet; NOW THEREFORE IT IS AGREED that the DEVELOPER shall continue to be entitled to reimbursements of assessments still unpaid under Agreement No. 361 , provided, however that the amount reimbursable shall in no case exceed the amount of the City' s Street Main Charge in effect as of the above date. For these purposes it is agreed that developers , owners, or lessees of lots shown on Exhibt "A" attached hereto in the area served by said sewer shall pay to the CITY the amount shown herein or the Street Main Charge whichever is greater, plus sewer connection charges SEWER REIMBURSEMENT AGREEMENT BETWEEN THE CITY OF PALM SPRINGS AND TED PEL.TON. in effect at such time, prior to a permit being issued for connection to said sewer. Upon receipt of such payment, CITY shall pay to the DEVELOPER the amount prescribed by this Agreement. The assessment for Lots is hereby established: Lots 6, 7, 8, Block A inclusive of Tract No. NIA Las Palmas Estates $ 6.4430 per front foot. LOT NO. ASSESSMENT FRONTAGE COST PER LOT 6 65.94 $ 424.92 7 100.00 644.30 8 138. 77 894.10 Total $ 1 ,963.32 IN WITNESS WHEREOF, the CITY and the DEVELOPER have hereunto caused these presents to be executed the day and year first above mentioned.
