CITY OF PALM SPRINGS
AND
CALIFORNIA DEPARTMENT OF FORESTRY
This memorandum of understanding is made and entered into by and between
The Riverside Ranger Unit of the California Department of Forestry, here-
inafter referred to as "STATE", and the City of Palm Springs, a municipality
of Riverside County, California, hereinafter referred to as "CITY" for the
purpose of assistance between agencies on vegetation fires. This Memorandum
of Understanding is a supplement to the State of California Master Mutual
Aid Agreement.
1. Upon notification of or threat of a vegetation fire in the CITY
responsibility areas (checkerboard area on attached map) , the STATE
shall immediately dispatch a minimum of one fire engine and one chief
officer and up to the amount of these or other resources requested by
the CITY or deemed reasonable depending on weather conditions and
consistent with policies and availability.
2. Upon notification of or threat of a vegetation fire upon STATE
responsibility areas (slashline area on attached map), the CITY
shall immediately dispatch a minimum of one engine and one chief
officer and up to the amount of resources additionally requested
by the STATE, consistent with policy and availability.
3. Upon determination of the responsible agency at the location of the
fire, the responsible agency will direct operations and support
activities and request additional assistance as needed.
In case of a vegetation fire (or imminent threat) on the boundaries
of the CITY and STATE, there shall be no delay in the attempted
suppression of such fire pending further determination of responsibility.
4. In case of a fire or fires involving joint responsibility (*) , the
ranking fire officers of each agency shall mutually agree on the
strategy as soon as possible, as well as the respective responsibility
and financial obligation. If requested by the ranking CITY fire officer,
and where there is no immediate threat to STATE lands, in the judgement
of the ranking STATE officer, use of STATE firefighting aircraft or
hand crews by the CITY shall be on a reimbursement basis.
(*) Joint responsibility is defined as follows:
Where a fire is burning partly on the land of one agency' s
primary protection responsibility and partly on the land of
another agency's primary protection responsibility at the same
time.
5. Each agency shall advise the other without delay of actions taken
pursuant to articles 1 and 2 herein.
6. The automatic aid zone (identified on attached map) shall be altered
only by the Fire Chief or acting Chief of the CITY, and the Ranger-in
charge or Executive Officer of the STATE (Riverside Ranger Unit).
7. Neither the CITY nor the STATE shall be required to pay any compensation
to the other party for such automatic aid or mutual aid rendered here-

under, except as provided in article 4. The extent of any assistance
provided shall be determined solely by the furnishing agency, and it
is understood that the aid so furnished may be recalled at the sole
discretion of the furnishing agency.
8. The agency providing mutual assistance shall normally be the first
released from the incident.
9. It is mutually understood and agreed to that this agreement does not
relieve either party from the necessity and obligation of providing
adequate fire protection within each party's jurisdiction.
10. Each agency shall provide, at its sole expense, the Worker's Compen-
sation insurance coverage necessary for its own employees. It is
recognized that at such times as one agency provides aid to the other
pursuant to the terms of this agreement, the employees of one may be
contended to have become special employees of the other temporarily;
and should this result in any Worker's Compensation claims being assert-
ed, it is hereby agreed that each such claim shall be the responsibility
and liability of the general employer to process defend and pay, if
necessary; and each agency agrees to assume such responsibility as to
its own general employees and to hold the other agency harmless as to
such claims where said other agency is only a special employer.
11. This Memorandum of Understanding shall remain in effect unless terminated
by either party, by giving written notification to the other party.
