12 electric energy to illuminate the street lights located in and
13 owned by said City and Lighting District, and to furnish all tools
14 labor, material, lamps, equipment, and electric energy necessary
15 to install, maintain, and operate the street li_ghtinG system
16 which is to be owned by Company, as provided by Company' s Rates,
17 i-n said City and Lighting District, for a period of three (j)

20 terminated as herein provided.
21 All installations shall be made at locations as shown on
22 Map 1do. 1 on file in the office of 'the City Clerk, which said
23 plan was filed on February 4, 1976 , 1976, in proceedings fo~
24 the establishment of said street lighting, pursuant to Resolution
25 of Intention No. 11672 Attached hereto and marked Exhibit ''A"
26 and made a part hereof by this reference is a copy of said Map.
27 Any modification of or in locations as indicated on Exhibit "A"
28 will be set forth on additional maps furnished from time to time

4 the electric energy and service supplied and furnished to each
5 street li ht or street lighting system requested by Customer,
6 and To pay Company bimonthly therefor at the rates and under the
7 terms and conditions set forth in Pate Schedules Nos . LS--1 and
8 LS-2 and at such higher or lower rakes, pursuant to such neti,; or
9 amended tariff' schedules, applicable to Customer, as may fron
10 time to time be ordered or allowed to become effective wn accord-
11 ancc with la•,a by the Commissicn, regardless of h or by whom
12 proceedings resultin4 in such change may have been initiated,
13 including proceedings initiated by Company, and in accordance
14 with Company' s Rules on file from time to time with said Com-
15 mission. Copies of said Rate Schedules are attached hereto

17 Customer agrees to commence using the street lighting in
18 a bona fide matLner within ninety (90) days after the date of
19 completion of an installation of a street light or street 11I'-ht-
20 ing system requested by Customer.
21 It is understood and agreed that where electrcliers are to
22 be served by means of Company-owned underground system, Customer
23 will advance to Company Company' s estimated diflfcrence in installed
24 cost of the h nderground systw---i and a standard overhead system.
25 And, Customer will advance to Company Company' s estimated cost of
26 trenching, backfilling, and restoring pavement to the satisfactio
27 of the applicable public agency having jurisdiction, or will furn
28 ish same including therein Company' s requirements , Further, when

1 Customer elects to have Company-owned ornamental electrrlicrs
2 installed in a Cempar_y-owned system, Customer shall pay to

6 Z'L is understood and agreed that all poles, wlres, fixtures,
7 lamps, and other appliances, supplied and used by Company in
8 furnishing the service herein provided for, shall at all times,
9 be and remain the property of Company.
10 It is further understood and agreed Lhat the follc,,ring
11 conditions are to govern: All poles, wires; lights, and electri-
12 cal apparatus installed by Company in furnishing service under
13 this agreement, shall be so placed as to work the least possible
14 public and pri•;ate inconvenience, and Customer may at any time
15 order the location of any part of the system changed by Comp=y
16 at the expense of Customer to conform to the abv,e requirements.
17 Customer reserZTes the right to abrogate this contract when-
18 ever current is offered at two-thirds the price fixed in this
19 Contract.
20 This agreement may be terminated by either party hereto
21 at the end of the initial three (3) year term or at the end of
22 any succeeding annual period by written notice given not less
23 than sixty (60) days prior toL the and of said 'three (3) year
24 term or of any succeeding annual period. Such termination shall
25 not affect the obligations nor liabilities of either of the
26 parties hereto, or either of them, accruing at such date of
try termination. And Company shall .have the right to remove or
28 abandon Company-owned street lighting facilities, wholly or in
1 part, upon expiration of this contract or of any renewal thereof.
2 Customer may request termination of service to a street

4 initial continuous three (3) year service period required by
5 this contract. In such event, Company will discontinue energy
6 thereto and billing therefor in accordance with its filed Tariffs,
7 and Company may, but is not obligated to, remove all or any
8 portion of said terminated street lighting facilities and to
9 bill Customer for installation and removal charges for facilities
10 not fulfilling said continuous three-year period requirement.
11 It is understood and agreed that should Customer .request
12 within the initial three (3) year period 1) an increase or
13 decrease in lamp size or 2) a change in mounting height of a
14 luminaire, such changes shall be at Customer expense and on
15 completion of modification a new initial three (3) year period
16 shall commence. Further, relocation of an ornamental electrolier
17 upon request of Customer shall be at expense of Customer.
1s The time of service for any worl=an employed to do any part
19 of The work contemplated by this contract is limited and xestricte
20 to eight hours during any one calendar day and forty hours during
21 any one calendar week, except as permitted by the provisions of
22 Section 1815 of the Labor Code; it is further agreed that in the
23 case of any violation in this regard of the provisions of Section
24 18lo-1815, inclusive, of said Labor Code, Company shall forfeit
25 to Customer the sum of $25 for each workman .employed in execution
26 of this contract for each calendar day during which such worlman
27 is required or permitted to work more than eight hours during any
28 one calendar day and forty hours during any one calendar week,
b except as provided in Section 1815 aforesaid.
2 This contract shall, at all times, be suboect to such

4 may, from time to time, direct in the exercise of its juris-
5 diction.
6 If Company shall be prevented by strikes, by order of
7 court, by public authority, by order of the Commission, or other
8 causes beyond the control of the parties hereto, or either of
9 them, from furnishing 'the service herein provided for,, it shall
10 .not be liable in damages to Customer for such failure but a
11 proportionate reduction in the amounts payable to Company by
12 Customer for street lighting service hereunder, based on the
13 period of suspension of such service, shall be made in case of
14 such failure.
15 In addition to, and under limits of liability set forth in
16 the preceding paragraph, Company may, in the absence of an order
17 frcm the Commission, apportion the supply of electric energy in
18 a manner that appears to Company most equitable, including
19 brownouts, blackouTs, or energy curtailment programs, under
20 conditions there prevailing.

SPECIAL CONDITIONS
1. Standard Equipment Furnished: Bracket or mast arm construction will be furnished. Where feasible
with existing facilities, center suspension construction may be furnished. Enclosed luminaires will be furnished for
lamps of 2500 lumens, or larger, and open reflector lighting units will be furnished for lamps of 1000 lumens. Such
standard lighting equipment will be attached to wood poles.
2. Other Than Standard Equipment: Where the customer requests the installation of other than the standard
equipment furnished by the utility and such requested equipment is acceptable to the utility, the utility will install the
requested equipment provided the customer agrees to advance the estimated difference in cost installed between such
equipment and standard equipment. Advances made for this purpose will not be refunded. Facilities installed in
connection with such agreements become and remain the sole property of the utility.
3. Hours of Service: Under the utility's standard all night operating schedule approximately 4,140 hours of
service per year will be furnished.

4. Removal or Modification of Equipment: Where street lighting service and facilities were ordered
removed or modified by a customer and such service and facilities, or their equivalent, are ordered reinstalled within 36
months from the date of the order to remove or to modify, the customer shall pay to the utility in advance of reinstalla-
tion a nonrefundable amount equal to the cost of removal or modification of the prior facilities and the estimated cost
of such reinstallation. Facilities removed or installed remain the sole property of the utility.
S. Fuel Cost Adjustment: The rates above for all night service are subject to adjustment as provided for in
Part G of the Preliminary Statement. The applicable fuel cost adjustment billing factor set forth therein will be applied
to 29 kwhr per month per 1,000 lumens for incandescent lamps, to 10 kwhr per month per 1,000 lumens for mercury
vapor lamps, and to 4 kwhr per month per 1,000 lumens for high pressure sodium vapor lamps.
• 6. Energy Curtailment Service:
a. Where the customer requests the installation and/or removal of equipment in order to obtain Energy
Curtailment Service, and such request is acceptable to the utility, the utility will comply with such request
provided the customer first agrees to pay to utility the estimated cost installed of any additional equipment
required and/or the removal cost of any equipment currently installed. Such payments will not be refunded
slid shall be paid in advance of in installments acceptable to utility over a period of not to exceed three years.
Facilities installed in connection with such requests become and remain the sole property of the utility.
b. Under the utility's midnight (PST) or equivalent service operating schedule, approximately 2,090 hours of
service per year will be furnished.
c. Facilities charges shall be applicable under this schedule only when the utility has been requested to discon-
tinue the existing service by the customer and the customer has stipulated that the facilities are to be left
in place for future use.
d. The rates above for midnight or equivalent service are subject to adjustment as provided for in Part G
of the Preliminary Statement. The applicable fuel cost adjustment bitting factor set forth therein will be
applied to 15 kwhr per month per 1,000 lumens for incandescent lamps, to 5 kwhr per month per 1,000
lumens for mercury vapor lamps, and to 2 kwhr per month per 1,000 lrtmens for high pressure sodium
vapor lamps.

SPECIAL CONDITIONS
1. Ownership of Facilities:
a. For multiple systems the utility will deliver service at 120, 120/240 volts, or, at the option of the utility,
at 240/480 volts, three wire, single phase. For series systems the utility will furnish and maintain constant
current regulating transformers and deliver service at the secondary side of such transformers.
b. The customer will furnish and maintain all utilization equipment beyond the point of delivery except for
maintenance service provided by the utility in accordance with Special Condition 3.
c. Meter locations for multiple systems shall be at points mutually agreed upon. Meter locations for series
systems shall be on the primary supply circuit to the constant current regulating transformer at a point
acceptable to the utility.

Total lamp load shall be determined to the nearest 1/10 kw.
3. Maintenance Service: Maintenance service furnished by the utility under Rate C for the lamps specified
shall include the following:
a. Renewal of lamps after the original installation by the customer.
b. Regular inspection.
c. Periodic cleaning of globes.
d. Labor of replacing lamps and globes.
Incandescent lamps furnished under this provision will be extended service lamps only. Mercury vapor lamps and
high pressure sodium vapor lamps furnished tinder this provision will be as specified by the utility. Globes for renewal
shall be furnished by the customer. Maintenance service will be furnished only where, in the opinion of the utility,
no undue hazard or expense will result because of location, mounting height, or other reasons.
4. Switching Facilities: For all night or midnight (Pacific Standard Time) service under the utility's standard
operating schedules, the utility will furnish,maintain, and operate the necessary switching facilities. For other operating
schedules, the customer shall furnish, maintain, and operate switching facilities as specified by the utility and take
metered service under Rate B.
S. Hours of Service: Under the utility's standard all night operating schedule approximately 4,140 hours of
service per year will be furnished, and under the utility's standard midnight (Pacific Standard Time) operating schedule
approximately 2,090 hours of service per year will be furnished.
