EHRLICH SEWER AGREEMENT NO. THIS AGREEMENT made and entered into this 14th day of November 1973 , between the CITY OF PALM SPRINGS, CALIFORNIA, a municipal corp- oration, hereinafter called the CITY, and Richard K. Ehrlich hereinafter called the DEVELOPER: WHEREAS, the DEVELOPER is, at the time of this agreement, the owner of certain parcels of land delineated on the plat "Sewer Construction Refund Agreement" attached hereto, marked Exhibit "A" , and hereby made a part of this Agreement; and WHEREAS, the DEVELOPER, in accordance with CITY requirements, has constructed a sanitary sewer located in; Phillips Road South of Tamarisk Road ;and WHEREAS, the CITY has established a policy for sewer refund agreements by City Council Resolution No. 9388, dated January 13, 1969, which by reference is hereby made a part of this agreement ; and WHEREAS, said sanitary sewer has been dedicated to public use by the DEVELOPER, and accepted by the CITY; and WHEREAS, the DEVELOPER has submitted an itemized financial statement of const- ruction and engineering costs for said sewer from B $ B Pipeline, Inc. and Smith Construction Co. , Contractors dated May 15, 1973 and June 13, 1973 KWi. Associates , Consulting Engineer, dated April 9, 1973 , copies of which are attached hereto, marked Exhibit "B", and hereby made a part of this agreement; and WHEREAS, the DEVELOPER, in accordance with Resolution 9388, has requested that the CITY and the DEVELOPER enter into a Sewer Refund Agreement to reimburse the DEVELOPER for the cost of off-site sewer in Phillips Road South of Tamarisk Road and WHEREAS, the CITY has determined that benefit from the construction of the off- site sewer connected to the City Sewer System will accrue to properties connecting to the off-site sewer; and WHEREAS, the CITY has determined, and DEVELOPER agrees, that the total assessable frontage of parcels which can connect to the sanitary sewer by use of sewer laterals is 499.75 feet; NOW THEREFORE, THIS AGREEMENT WITNESSETH that developers, owners or lessees of parcels shown on Exhibit "A" abutting said sewer shall pay to the CITY the amount shown herein, plus sewer connection charges in effect at such time, prior to a permit Page 1 of 3 17 a � � � 1 • Sewer Agroent No. being issued for connection to said sewer. Upon receipt of such payment, the CITY shall pay to the DEVELOPER the amount shown herein. This agreement shall be in effect for fifteen (15) years from the year and date first above mentioned. There- after all fees collected shall be at the CITY''S prevailing front footage rate and shall be retained by CITY. Except for Agreement No. 806 where we are awaiting clarification of the legal owner, and Agreement No. 874 where we have been unable to locate the owner; we have received letters requesting no expiration date, and I have sent letters of confirmation. Dallas thought this procedure would constitute a sufficient "new agreement. " The amounts per linear foot of sewer main required by the agreements is less than the City fee of $16/ft. , except for Agreement No. 869. An asterisk has been placed by the agreement amount in that file, and a note added not to pay more than the City fee in effect at the time a reimbursement may be due. Charles Thomas CT:al ;;. k RESOLUTION NO. 15975 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA, ESTABLISHING A POLICY RELATIVE TO SEWER REIMBURSEMENT AGREEMENTS WHICH CONTAIN FIXED EXPIRATION DATES. WHEREAS, the City's policy regarding sewer reimbursement agreements and City contributions for '„sewer construction was originally established by Resolution No. 5891; and WHEREAS, the policy ,expressed in Resolution No. 5891 was later modified by Resolutions 9388 and 12590; and WHEREAS, Resolution No. 12590 established a policy relative to sewer reimbursement agreements which contained fixed expiration dates; and WHEREAS, Resolution Nos. 9388 and 12590 were rescinded by Resolution No. 13773 on April 15, 1981, with no provision for the extension of sewer reimbursement agreements with expiration dates; and WHEREAS, it is necessary to provide a policy relative to remaining sewer reimbursement agreements with fixed expiration dates. NOW THEREFORE BE IT RESOLVED by the City Council of the City of Palm Springs as follows: Section l : Those owners of remaining Sewer Reimbursement Agreements with fixed expiration dates which have not yet expired shall be mailed notification and given an opportunity for 60 days from mailing of such notification to request a new sewer reimbursement agreement for the unpaid reimbursement assessments. Section 2: For those agreement holders requesting new sewer reimbursement agreements, the reimbursable amount shall be the amount shown in the original sewer reimbursement agreement for that property, or an amount that would be collected by the City as a front footage fee based on current fee schedules at the time a new agreement is entered into, whichever is the lesser amount. Section 3: All new Sewer Reimbursement Agreements shall have no expiration date, unless otherwise ordered by the City Council . Section 4: The City Manager shall be responsible for administration of this policy, through such appropriate staff members as he may direct. Section 5: The City Manager is hereby authorized on behalf of the City of Palm Springs to enter into new sewer reimbursement agreements authorized pursuant to and consistent with this policy of the City Council .
