RESOLUTION AUTHORIZING AGREEMENT BETWEEN CITY OF PALK
SPRINGS, CALIFORNIA AND DESERT WATER AGENCY CONCERNING
PRIOR RIGHTS IN SECTION 14
WHEREAS, it is deemed necessary to determine who

is liable to pay the costs of relocation of water facilities
in public streets in Section 14; and
WHEREAS , the issue of prior rights in Section 14
has not been satisfactorily resolved because of the
Federal Trust status and Indian ownership of lands and
also because of previous dedications and land subdivisions,-
and
WHEREAS, it is the desire of the City and the .
Agency to avoid costly litigation necessary to clarify
the conflicting claims of each party,
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The Agency is deemed to have prior rights
within those rights-of-way shown on "Section 14 Street
Plan" approved for 50 years by Leonard M. Hill, Area
Director on February 17, 1955 and recorded in Book 1705,
page 159 on 3-17-55, Riverside County, subject to the
exceptions and conditions set forth below. The City will
be deemed to have prior rights on other portions of streets
within Section 14 which do not conform to the aforementioned
map.

2. Within those street rights-of-way delineated
on the "Supplemental Plat of Section 14" surveyed by
Francis E. Joy and approved by the Department of Interior
on September 7, 1927 the City and Agency will share the
cost of relocation of water facilities required by street
improvement and other Public Works projects.
. 3. The City will be deemed to have prior rights
on the Section line streets (Indian, Alejo, Sunrise, Ramon)
dedicated to the County of .Riverside in 1937.
4. Delineation of responsibility for the cost
of water facilities relocations in existing streets in
Section 14 are shown on attached map marked Exhibit "A" .
5. The cost of relocation of water -facilities
previously incurred shall be distributed as follows :

6. This resolution shall become effective
only upon the adoption of an identical resolution by the
City of Palm Springs.
I hereby certify that the foregoing is a full,
true and correct copy of a resolution adopted by the Board
of Directors of the Desert Water Agency at a regular
adjourned meeting of said Board held on Tuesday,
1 November 10, 1970 , at which meeting a quorum was at
all times present and acting.
