AGREEMENT #591 (Original)

The City of Palm Springs , a body politic
and a municipal corporation of the State of California ,
hereinafter referred to as "CITY", and the State of California,
Department of Public Works , Division of Highways , hereinafter
-referred to as "STATE", do enter into the following agreement:
WHEREAS, State and City contemplate installation of
traffic control signal systems and highway lighting at the
intersections of Alejo Road , midblock between Alejo Road and
Amado Road , Amado Road, Andreas Road, Arenas Road, Barristo
Road, and Ramon Road and modification of traffic signal control
systems at the intersections of Tamarisk Road and Tahquitz-
McCallum Drive with State Highway Route 111 (Palm Canyon Drive) ,
all within the City of Palm Springs , and desire to specify the
proportionate share of the costs that are to be borne by City
and State and to arrange herein for maintenance;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
SECTION I
For and in consideration of the covenants and con-
ditions to be kept and performed by State as set forth herein,
City agrees :
(a) To furnish traffic control signal systems and
highway lighting hereinbefore mentioned, through construction
by City forces , or by contracts with construction contractors
licensed by the State of California , said contracts to be
carried out in accordance with the laws governing City with
reference to the character of the work to be done thereunder,
and to be completed in conformity with plans and specifications
of City or State, and to the satisfaction of and subject to
I-,ie approval of State.
(b) - To bear the entire experse of preparation of
plans and specifications , except where prepared by State, and
City ' s share expense of the constructi®n engineering costs
and construction costs required to complete the traffic control
signal system and highway lighting referred to herein, such
share to be a sum bearing the same proportion to the total cost
of installation of the traffic control signal system and highway
lighting as the number of legs of highways under jurisdiction
of City at the intersections involved bears to` the total number
of legs of highways at such intersections , except that- the share
for the traffic control signal system and highway lighting at the
midblock crossing between Alejo Road and Amado Road shall be
one-half (1/2) of the construction engineering costs and con-
struction costs .
(c) To reimburse State for City' s proportionate
share of the cost of general maintenance and operation of said
traffic control signal systems and highway lighting in the manner
provided in that Agreement for Maintenance of State highways in
the City which is in effect at the time said costs arise.
SECTION II
For and in consideration of the covenants and con-
ditions to be kept and performed by City as set forth in this
Agreement, State agrees :
(a) To pay to City, promptly upon rendition of
statement therefore , State' s share of expense of the construc-
tion engineering costs and construction costs required to com-
plete the traffic control signal system and highway lighting
referred to herein, such share to be a sum bearing the same
proportion to the total cost of installation of traffic control
signal system and highway lighting .as the number of legs of high-
ways under jurisdiction of State at the intersections involved
bears to the total number of legs of highways at such intersections ,
except that the share for the traffic control signal system and
highway lighting at the midblock crossing between Alejo Road and
Amado Road shall be one-half (1/2) of the construction engineering
costs and construction costs .

It is estimated that State ' s share of the
installation .is $65 , 000. 00. The actual amount of State ' s share
will be determined after the traffic control signal installations
are completed, but in no event shall State ' s share exceed
$65 ,000, 00 unless otherwise provided in a subsequent agreement
between City and State,
(b) To maintain and operate the entire traffic
control signal systems and highway lighting as constructed,
SECTION III
IT IS UNDERSTOOD AND AGREED that neither State nor
any officer or employee thereof shall be responsible for any
damage or liability occurring by reason .of anything done or
omitted to be done by City under or in connection with any
work, authority or jurisdiction delegated to City under this
Agreement. It is also understood and agreed that, pursuant to
Government Code Section 895,4, City shall fully indemnify and
hold State harmless from any liability imposed for injury (as
defined by Government Code Section 810, 8) occurring by reason
of anything done or omitted to be done by City under or in
connection with any work, authority or jurisdiction delegated
to City under this Agreement ,
IT IS UNDERSTOOD AND AGREED that neither City nor

SECTION IV
IT IS UNDERSTOOD AND AGREED that should the City
finance any portion of the project with gas tax funds
apportioned to the City, all applicable procedures and
policies relating to the use of such funds shall apply not-
withstanding other provisions of this Agreement,

caused this Agreement to be executed by their respective

RESOLUTION NO. 9264
OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS, CALIFORNIA
APPROVING AGREEMENT WITH THE STATE OF CALIFORNIA, DEPARTMENT
OF PUBLIC WORKS, DIVISION OF HIGHWAYS FOR INSTALLATION OF
TRAFFIC. SIGNALS ON STATE HIGHWAY Ill AT VARIOUS LOCATIONS
WHEREAS, the City Council has budgeted for installation of traffic
signals at the following locations on Palm Canyon Drive (Highway 111) :
Mid-block Pedestrian Crossing between Alejo Road and Amado Road,
Alejo Road,
Amado Road,
Andreas Road,
Arenas Road,
Baristo Road,
Ramon Road,
and modification of existing signals at Tamarisk Road and Tahquitz-
McCallum Way in the 1967-68 Fiscal Budget; and
WHEREAS, the State has investigated and found sufficient warrant
to participate with the City in the installation; and
WHEREAS, the State has prepared an agreement providing for the
participation of the City and State in the installation; and
WHEREAS, the agreement is within the limits of the budget author-
ization for the installation;
NOW THEREFORE BE IT RESOLVED that Agreement No. 591 by and between
the City of Palm Springs and the State of California, Department of
Public Works, Division of Highways is hereby approved and the Mayor
is authorized to execute the agreement in behalf of the City.
