rH Whereas, it has been determined that there exists within the City's

T1 right-of-way located along North Palm Canyon Drive between Tamarisk Road
and El Alameda the front portion of a building belonging to the undersigned,
it is hereby understood and agreed that the encroachment may exist until such
time as the area within the -right-of-way must be utilized for the improve-
ment of or widening of North Palm Canyon Drive, then that portion of the
building encroaching on said right-of-way will be removed at no expense
to the City of Palm Springs, California.
The area of said right-of-way being more particularly described as
follows:
The Westerly 5.00 feet of Lot 33, the Westerly 5.00 feet of Lot 34,
and the Westerly 5.00 feet of the Northerly 6.5 feet of Lot 35, all
in Block "A" of Palm Springs Estates No. 2 as shown on Map 'filed in
Book 16, Page 45, of Maps, Records of Riverside County, being in the
Southeast Quarter of Section 10, Township 4 South, Range 4 East,
SBB & M.
