This Agreement is entered into this s1 day of

1967, by and between the CITY OF PALM SPRINGS, hereinafter referred
to as the CITY and H. W. BURNS and GAYLE S. DURN5 , hereinafter
referred to as the DEVELOPERS .
In consideration of the CITY ' 5 approval of Final Subdivision
Tract No. 3631 , a one-lot condominium for an existing nine--unit
apartment development located on the North side of Arenas Road ,
West of the extension of Lugo Road with certain variances from the
legal requirement thereof, the ➢EVELOPERS hereby agree as follows :
1 . DEVELOPERS shall provide designated space for off-street
parking in the common area when the entire North Side of Arenas
Road from Cahuilla Road to Tahquitz Drive is improved as determined
by -the CITY . The off-street parking required herein shall meet the
CITY ' S approval. Sketch attached shows approved parking spaces.
2. DEVELOPERS, within ten ( 10) days after the effective date
of this Agreement, shall make a Three Thousand ➢ollar {'w3 ,OdC1.00)
cash in-lieu payment to the City Treasurer to meet the cast of improv-
ing to CITY standards the North side of Arenas Road where contiguous
to the subject subdivision to include curb , gutter and a six ( 6)
foot sidewalk adjacent to the curb when required by the CITY. Upon
making said in-lieu payment, ➢EVELOPERS relinquish all rights there-
to including interest. This payment is in lieu of any future or
additional obligation for the cost of said improvements.
3 . DEVELOPERS hereby hold the CITY harmless and shall indemnify
the CITY from any cost resulting from damages proximately caused
from the development or design of said property, including but not
limited to , on-street parking and water drainage damages.
4 . The CITY hereby authorizes the continuation of present
use of the five (5 ) foot strip of dedicated area until such time as
it is improved as provided in Paragraph 1 above . The intent here
is to preserve the present use status quo of the dedicated area
unless further uses are authorized by the CITY in writing .
