HOLD HARMLESS AGREEMENT AGREEMENT 4422 (Original)2-7-66
as required by AA
WHEREAS , on November 17 , 1965, the Planning Commission of -
the City of Palm Springs , California, in its Case No.
AA 2 . 192 , did grant the application of MARTIN A. RUDERMAN,
ANNETTE RUDERMAN, MICHAEL M. SACK and SARA SACK for archi-
tectural approval of a shopping center located on the South-
west corner of Sunny Dunes Road and South Palm Canyon Drive
' in a C-2 Zone , and more fully described in the attached
Exhibit "A" ; and
WHEREAS a portion of the subject property is zoned W-C-2
and the Planning Commission did require the applicants to
file with the City of Palm Springs an agreement holding the
City harmless from any and all claims or liability arising
out of future £food damage over the property described in
Exhibit "A" attached hereto, before a Building Permit be
issued,
NOW THEREFORE, the applicants do hereby agree, in accordance
with Planning Commission action in its Case No. AA 2 . 192,
to hold harmless the City of Palm Springs , California, and
its employees , agents and officers from any and all claims
of liability arising out of future flood damage over property
more fully described in Exhibit 11A" attached hereto.

South, Range Four (4) East, San Bernardino Base and Meridian, in the
City of Palm Springs , County of Riverside, State of California, as per
map of Palm Valley Colony Lands , recorded in Book 14, Page 652 of Maps ,
in the office of the County Recorder of San Diego County, California,
described as follows :
Beginning at the Northwest corner of said lot; thence South 125.01
feet on the West line thereof; thence North 89°40 ' East-, 263. 90 feet
to the Southwest corner of that portion described in deed to the State
of California, recorded February 20, 1956 as Instrument No. 11859 in
Book 1866, Page 58, Official Records of said Riverside County; thence
Northerly on the Westerly line of said portion, being a curve concave
Westerly having a radius of 1,382 . 47 feet, from a tangent bearing North
3051' 05" West, through an angle of 4°02' 55" , a distance of 97 . 69 feet
to a point of compound curve; thence along said compound curve concave
Westerly with a radius of 1, 106 . 28 feet, from a tangent bearing North

Beginning at a point on the West line of said Lot, 125 .01 feet South
of the Northwest corner thereof, being the Northwest corner of that
certain parcel described in deed to Martin A. Ruderman et al, recorded
January 31, 1951 as Instrument No. 4419 in Book 1240, Page 231, official
records of said Riverside County; thence continuing South 38 . 37 feet to
a point on the Northerly line of that portion described in deed to the
Riverside County Flood Control and Water Conservation District recorded
January 12 , 1949 as Instrument No. 1259 in Book 1043, Page 517 , official
records of said Riverside County; thence South 70053 ' East, 285 feet,
more or less and on the Northerly line of said flood control parcel to
a point- on the Westerly line of that certain parcel described in deed
to the State of California, recorded February 20, 1956 as Instrument
No. 11855 in Book 1866, Page 20, official records of said Riverside
County; thence North 1°10' 00" West, 69 .02 feet; thence along a tangent
curve concave Westerly with a radius of 1, 382 . 47 feet, through an angle
of 2°41' 05" , a distance of 64. 78 feet to a point on the Northerly line
of said Ruderman parcel hereinabove referred to; thence South 89°40'
West, 263 .90 feet on said Northerly line to the point of beginning.
