HUTTONI PA&RAMON DEVELOPMENT COMPANY - Underground Utilities and - Television Sezvice. iOriA.inal) A G R E E M E N T N 0, 363 AGREEMENT 4363 Res #8469, 8-16-65 FOR PLACEMENT OF UNDERGROUND UTILITIES ANJDI TELEVISSION SERVICE THIS AGREEMENT, made and entered into this day ofd by and between PALM-RAMON DEVELOPMENT COMPANY, a California corporation, hereinafter referred to as "First Party", and the CITY OF PALM SPRINGS, CALIFORNIA, a municipal corporation, hereinafter referred to as "Second Party", W I T N E S S E T H: That in consideration of the hereinafter set forth covenants and pro- mises by the parties hereto, IT IS MUTUALLY AGREED THAT: WHEREAS Second Party has adopted an ordinance providing additions to Division 9 of the Palm Springs Ordinance Code whereby land developers are required to place utility and television service underground; and WHEREAS First Party has made application to Second Party for temporary relief from the requirements so that First Party can be served by overhead utility and television service, NOW THEREFORE Second Party will permit the following type of utility service: 1. In accordance with Resolution No. 8469 of Second Party, First Party may serve First Party's building, said building being located at the southwest corner of Palm Canyon Drive and Ramon Road, with overhead utilities, including electri- city, telephone and television. 2. First Party agrees that Second Party may order the utility or television company to cease service if First Party does not comply with demand for underground utility and television service after one year. 3. First Party specifically agrees and does hold harmless the Second Party and any utility or television company from any and all claims by First Party, or its successor in interest, occasioned by cessation of the utility or television service upon demand of Second Party. 4. First Party agrees to provide Second Party with a bond guaranteeing the installation of underground utility service, at the above loca- tion, within one year from the date hereof; said bond in amount of � 2„50Q..00_yr Dated at Palm Springs, California, the day and year first above written. ALESHIRE City Manager of the City of Palm Springs "SECOND PARTY" Posed c. ttzh _L�,o tid iN 13a Nd J- rk V47- (,�'eU # 2.34 n s RESOLUTION NO. 8822 OF THE CITY COUNCIL OF THE CITY OF PALM SPRINGS CALIFORNL?, APPROVING TIE APPEAL OF THE PALM RAMON DEVELOPMENT COMPANY, FOR AN EXTENSION OF TIME, FOR RELIEF FROM UNDERGROUND UTILITIES REQUIREMENTS AND EXTENDING AGREEMENT NO. 3630 WHEREAS the City of Palm Springs Ordinance Code, Section 8049.14 requires all utilities to be installed underground; and WHEREAS the Palm Ramon. Development Company has requested relief from said provision, and extension of agreement dated 8-16-66, for one (1) year from Dec. 8, 1966; and WHEREAS the Board of Appeals, on December. 8, 1966, did grant the appeal of the Palm Ramon Development Company, to continue with overhead utility service as requested; NOW THEREFORE BE IT RESOLVED THAT. THE City Council does hereby approve the action of the Board of Appeals to allow the Palm Ramon Development Company permission to continue with overhead utilities for the E. F. Hutton Building, sucject to the following conditions: 1. Agreement No. 363 to be extended for one (1) year ending December 7, 1967. 2. CASH BONDS BE RETAINED FOR PARILING LOT REQUIREMENTS AND ELECTRICAL SERVICE FOR TWELVE (12) MONTHS.
