A G R E E M E, N T
1 The City of Palm Springs , a political subdivision of the
2 State of California, hereinafter referred to as "CITY", and
3 the State of California, Department of Public Works, Division
4 ; of Highways, hereinafter referred to as "STATE", do enter into
5 :' the following agreement:
6 WHEREAS, the State and City contemplate installation of a
7 full-traffic-actuated signal system and highway lighting at the
8 (' intersection of Sunrise Way with State Sign Route 111, all
9 within the City of Palm Springs, and to arrange herein for the
10 maintenance functions that are to be performed by the State and
11 ; to specify the proportionate share of the costs that are to be .
12 'iborne by City and State;
13 NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
14 SECTION I
15 For and in consideration of the covenants and conditions
16 to be kept and performed by the City as set forth herein, State
17 !` agrees:
18 (a) To furnish a traffic controlled signal system and
19 highway lighting hereinbefore mentioned, through construction
20 ;Iby contracts with construction contractors licensed by the State
21 of California, said contract to be carried out in accordance
i
22 "with provisions of the State Contract Act, Chapter 3, Part 5,
23 ,Division 3, Title 2 of the Government Code, and to be completed
24 in conformity with plans and specifications of the State of
25 California, Department of Public Works, Division of Highways .
26 (b) To bear entire expense of preparation of plans and
27 �Ispecifications and the State's share of expense of the engineer

28 , ing, inspection and construction costs to complete the traffic
29 control signal system and highway lighting referred to herein,
30 such share to be a sum bearing the same proportion to the total
31 cost of installation of signals as the number of highways under

1 jurisdiction of State, which may enter the intersection involved,
2 bears to the total number of highways entering such intersection.
3 (c) The State will maintain and operate the entire traffic
4 control system and highway lighting as constructed.
5 SECTION II
6 For and in consideration of the covenants and conditions to
7 be kept and performed by State as set forth in this Agreement..
8 City agrees :

9 (a) To reimburse State promptly upon rendition of state-
i
10 ment therefor, City's share of expense of the engineering,
11 inspection and construction costs, to complete the traffic con-
12 trol signal system and highway lighting referred to herein, such
13 share to be a sum bearing the same proportion to the total cost
14 of installation of signals and highway lighting as the number of
15 highways under jurisdiction of City, which may enter the inter-
16 section involved, bears to the total number of highways entering
17 ; such intersection.
18 It is estimated that the cost of .the City' s share is
19 approximately, $4,500.00; however, the actual amount will be deter--
zo , mined after the award and completion of the construction contract. ,
21 (b) To reimburse State for its proportionate share of the
22 cost of general maintenance and operation of said traffic control
23 +,' signal system and highway lighting in the same ratio as the
24 ! number of. highways under jurisdiction of the City, which may
25 enter the intersection involved, bears to the total number of
26 highways entering such intersection.
27 IN WITNESS WHEREOF, the parties hereto have caused this '
28 : Agreement to be executed by their respective officers,, duly
29 authorized by the City, this 12th day of March , i958,
30 and by the State, this day of 1958.
