THE STAR CANYON VILLAS PLANNED DEVELOPMENT DISTRICT 260 AND TENTATIVE TRACT
MAP, AN APPLICATION TO SUBDIVIDE 11.41 ACRES INTO 9 LOTS FOR A RESORT
DEVELOPMENT, LOCATED WEST OF SOUTH PALM CANYON DRIVE, BETWEEN SUNNY DUNES
ROAD TO THE NORTH, MESQUITE AVENUE TO THE SOUTH,AND SOUTH BELARDO ROAD TO
THE WEST, W-C-1 AND W-R-3 ZONES, SECTIONS 22 AND 23.
RECOMMENDATION
The Planning Commission recommends that the City Council approve a time extension from May 17,
2003 to January 30, 2005, for the Star Canyon Palm Springs Resort, Planned Development District 260
(PD 260)and Tentative Tract Map 29691 (TTM 29691),subject to the original conditions of approval.The
subject property is located west of South Palm Canyon Drive between Sunny Dunes Road to the north,
Mesquite Avenue to the south, and South Belardo Road to the west,W-C-1 and W-R-3 Zones, Sections
22 and 23.
SUMMARY
At their meeting on January 22, 2003, the Planning Commission voted to recommend that the City
Council approve a time extension until January 30, 2005,
The applicant is requesting a second, one year time extension of Case No. 5.0830 - Planned
Development District 260 and Tentative Tract Map 29691. The requested time extension is due to the
time share due diligence review and concerns by the applicant that additional time may be required to
prepare final plans. The applicant is currently in negotiations with a large timeshare company regarding
financing and has also entered into a Disposition and Development Agreement with the City and
Redevelopment Agency.
BACKGROUND
The Planning Commission, at its April 26, 2000 meeting, recommended that the City Council adopt a
Mitigated Negative Declaration and approve Case No. 5.0830 - Planned Development District 260 and
Tentative Tract Map 29691. The City Council subsequently approved the project at its May 17, 2000
meeting. On April 24,2002,the Planning Commission voted to recommend a first time extension.On May
15, 2002, the City Council voted to approve the request.
On July 17, 2002, the City Council voted to approve an amendment to the Planned Development District,
to change the land uses from hotel and time share to all timeshare. The amendments to Planned
Development District No. 260 also included:
• Elimination of the ballroom and large kitchen;
• Relocation of recreation facilities, meeting rooms and spa to former ballroom location;
• The addition of nine timeshare units in the former spa location; and
• Conversion of 198 hotel rooms into 70 timeshare units.
The existing 176 timeshare units would remain unchanged. A total of 255 timeshare units would be
developed. The original proposal included 198 hotel rooms and 176 timeshare units, for a total of 374
rooms. Therefore, the amendment resulted in a net reduction in the intensity of use on the site.
The Planned Development District consists of a proposed mixed-use facility which includes a restaurant
and lounge facilities, pool, spa and other associated recreational amenities on a 11.41 acre site. The
Tentative Tract Map includes the subdivision of an existing 11.41 acre parcel into nine lots ranging in size
from 0.35 acres to 3.23 acres for timeshare condominium purposes and to facilitate the development of
the facility.
At this time, the applicant indicates that the extension is required to continue active negotiations with a
large company relating to the financing and construction of both the project.
DISPOSITION AND DEVELOPMENT AGREEMENT
In December 2002, the City Council and Redevelopment Agency approved a revised Disposition and
Development Agreement (DDA). The DDA requires the applicant to begin construction within two years
of the close of escrow, tentatively scheduled for January 30, 2002. Under the DDA, the applicant has an
additional five years in which to finalize construction. In order to meet the time frame outlined in the DDA,
the applicant would need to apply for approval of Final Development Plans early this summer.To provide
the potential financiers of the project with a higher level of confidence, there may be a benefit in
synchronizing the time extension of the Planned Development District and the Tentative Map, with the
life of the DDA. If the City Council were so inclined to synchronize the life of these entitlements, the
project could be extended until January 30, 2005. Staff recommends approval of a time extension to
January 30, 2005.
ENVIRONMENTAL ANALYSIS AND NOTIFICATION
Requests for time extensions are categorically exempt from an environmental assessment per
Section 15301 of the California Environmental Quality Act ("CEQA") and local guidelines for
implementation of CEQA.^^

WHEREAS, Palm Springs New Millennium (Star Canyon Villas), (the"Applicant') request approval

WHEREAS,the Applicant has requested additional time to May 17, 2004, to continue negotiations
with interested parties regarding financing and construction of the project; and
WHEREAS, on April 24,2002,the Planning Commission voted to recommend that the City Council
approve the time extension request; and
WHEREAS, on May 15, 2002, the City Council voted to recommend that the City Council approve
the time extension request; and
WHEREAS, on July 10, 2002,the Planning Commission voted to recommend that the City Council
approve an amendment to the Planned Development District, to change the land uses from hotel
and time share to all timeshare; and
WHEREAS, on July 17, 2002, the City Council voted to approve an amendment to the Planned
Development District, to change the land uses from hotel and time share to all timeshare; and
WHEREAS, on January 22, 2003, the Planning Commission voted to recommend that the City
Council grant a time extension on from May 17, 2003 to December 31, 2004; and
WHEREAS, on January 29, 2003, a public meeting on the request for a time extension from May
17, 2003 to December 31, 2004 for PD-260 and TTM 29691 was held by the City Council in
accordance with applicable law; and
WHEREAS, the City Council carefully reviewed and considered all of the evidence presented in
connection with the hearing on the project, including but not limited to the staff report, all written
and oral testimony presented.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Palm Springs,
California, after considering the evidence provided at the meeting, does hereby approve a time
extension from May 17, 2003 to January 30, 2005, for Case No. 5.0830-PD-260 and TTM 29691.
