EAST PALM CANYON AT ARABY DRIVE/ESCOBA DRIVE TRAFFIC SIGNAL
MODIFICATION
RECOMMENDATION:
It is recommended that the City Council approve and adopt the plans, specifications and
working details, and authorize advertisement for construction bids forthe East Palm Canyon
Drive at Araby Drive/Escoba Drive Traffic Signal Modification, City Project 02-24.
SUMMARY:
Section 7.03.040 of the Procurement and Contracting Code requires that Council approve
and adopt plans, specifications and working details, and authorize the bid request for all
public projects in excess of $100,000. Approval of these two projects will allow staff to
proceed with these public projects, with a total estimated cost of$120,000.
BACKGROUND:
The Engineering Department has been working on a City-wide project to upgrade, modify
and improve traffic signals at various locations. Plans and specifications for these various
traffic signal improvements will be submitted to the Council for approval at a future meeting.
The traffic signal at East Palm Canyon Drive and Araby Drive/Escoba Drive required
advancement as a separate project to allow for the coordination of this traffic signal
modification with two separate development projects that have recently been issued
construction permits: Creative Communities (Tentative Tract Map 30568) on the southwest
corner, and the Villa Del Sol Apartment project (Friend Development) on the southeast
corner.
Staff worked diligently to advance preparation of plans and specifications for the required
traffic signal modification related to the widening and improvements to this intersection as a
result of the two development projects. The lump sum Bid Schedule includes all the
necessary traffic signal pole and equipment removal and replacement to the ultimate
locations, consistent with and coordinated with the street improvements to be constructed by
the two development projects. The total estimate for the project is approximately$120,000.
The funding sources for this project will be account numbers 134-4498-50205 and 134-
4498-50206,

This action is being brought before Council to be in compliance with the Procurement and
Contracting Code. Upon Council's approval with this action, staff will schedule bid
advertisements, with a bid opening date of February 25, 2003.

ADDENDUM NO. 1
To all prospective bidders under Specifications for the East Palm Canyon Drive at Araby
Drive/Escoba Drive Traffic Signal Modification; City Project No. 02-24, which are to be
received by the City of Palm Springs at the office of the Procurement Manager at 3200 E.
Tahquitz Canyon Way, Palm Springs, CA 92262, until 3:00 p.m. on Tuesday, February 25,
2003:
I. The following change shall be made in Part II - Special Provisions:
A. The second paragraph of Section 7-1 .08, Permits and Fees, is hereby deleted. This
project is not within State Highway right-of-way, and not subject to Caltrans
encroachment permitting or inspection, No Caltrans encroachment permit will be
required for this project.
B. The last sentence of the first paragraph of Section 10-5.12, Testing, shall be
revised to read: The City shall pay for the initial testing of the controller, to be
tested at the designated testing laboratory. The Contractor shall be responsible for
any costs of re-testing the controller, if the controller supplied by the Contractor
fails the initial testing performed by the designated testing laboratory, and payment
therefore shall be considered as included in the lump sum bid item for the location
of the work in which the controller is to be installed.
II. The Special Provisions as originally issued shall be used in submitting bids, and an
acknowledgment of receipt of this Addendum No. 1 shall be entered on Page 2 of the
Bid forms. Failure to provide such acknowledgment shall render the bid as non-
responsive and subject to rejection.

NOTICE INVITING BIDS
For constructing the:
East Palm Canyon Drive at Araby Drive/Escoba Drive
Traffic Signal Modification
City Project 02-24
N-1 NOTICE IS HEREBY GIVEN that sealed bids for the East Palm Canyon
Drive at Araby Drive/Escoba Drive Traffic Signal Modification, City
Project 02-24, will be received at the office of the Director of
Procurement and Contracting of the City of Palm Springs, California,
until 3 : 00 P.M. on February 25, 2003, at which time they will be
opened and read aloud.
N-2 DESCRIPTION OF THE WORK: The Work comprises the removal of
existing traffic signal poles and equipment, and installation of new
traffic signal poles, electrical system, controller equipment, and
associated improvements; traffic striping and signage; and all
appurtenant work.
N-3 AWARD OF CONTRACT:
(a) The City reserves the right after opening bids to reject any
or all bids, to waive any informality (non-responsiveness) in a bid,
or to make award to the lowest responsive, responsible bidder and
reject all other bids, as it may best serve the interest of the City.
(b) As a condition of award, the successful bidder will be
required to submit payment and performance bonds and insurance.
N-4 BID SECURITY: each bid shall be accompanied by a certified or
cashier' s check or Bid Bond in the amount of 10 percent of the total
bid price, payable to the City of Palm Springs.
N-5 BIDS TO REMAIN OPEN: The Bidder shall guarantee the Total Bid
Price for a period of 60 calendar days from the date of bid opening.
N-6 CONTRACTOR' S LICENSE CLASSIFICATION: The Contractor shall
possess a valid Class A or C-10 Contractor license at the time of
submitting bids.
N-7 CALIFORNIA WAGE RATE REQUIREMENTS: The Contractor shall pay the
general prevailing rate of per diem wages as determined by the
Director of the Department of Industrial Relations of the State of
California for the locality where the work is to be performed. A copy
of said wage rates is on file at the office of the City Engineer.
The Contractor and any subcontractors shall pay not less than said
specified rates and shall post a copy of said wage rates at the
project site.

N-8 RETAINAGE FROM PAYMENTS: The Contractor may elect to receive 100
percent of payments due under the Contract Documents from time to
time, without retention of any portion of the payment by the City, by
depositing securities of equivalent value with the City in accordance
with the provisions of Section 22300 of the Public Contract Code.
N-9 OBTAINING OR INSPECTING CONTRACT DOCUMENTS:
(a) Contract Documents may be inspected without charge at the
office of the City Engineer, 3200 East Tahquitz Canyon Way, Palm
Springs, CA 92262 .
(b) Complete sets of said Contract Documents may be purchased at
$30 . 00 per set and are obtainable from the office of the City
Engineer, 3200 East Tahquitz Canyon Way, Palm Springs, CA 92262 . No
refund will be made of any charges for sets of Contract Documents.
(c) An additional fee of $20 . 00 will be charged for sets of
documents sent by mail .
N-10 ADDRESS AND MARKING OF BIDS: The envelope enclosing the Bid
shall be sealed and addressed to the City of Palm Springs, and shall
be delivered or mailed to the Director of Procurement and Contracting
at 3200 East Tahquitz Canyon Way, Palm Springs, CA 92262. The
envelope shall be plainly marked in the upper left hand corner with
the name and address of the Bidder and shall bear the words "Bid
For. . " followed by the title of the Project and the date and hour of
opening Bids. The certified or cashier' s check or Bid Bond shall be
enclosed in the same envelope with the Bid.
