RECOMMENDATION
The Planning Commission recommends that the City Council approve Case No. 5.0866-PD for
a revised Preliminary Planned Development District (No. 267), and a revised Tentative Tract
Map (TTM 30054)for a 227 lot gated subdivision,with residential lot sizes ranging in size from
5,000 to 7,000 squarefeet,located northeast of the intersection of Sunrise Way and San Rafael
Drive,subject to the conditions outlined in the attached Resolution.The applicant is the Burnett
Companies, the principals are Lynn Burnett, President and Thomas LeBeau, Chief Financial
Officer.
SUMMARY
Approval of the project will result in the subdivision of 61.9 acres into 227 lots for future
development as a single family subdivision.
BACKGROUND
On January 8, 2003, the Planning Commission held a public hearing on this project. At that
meeting the Planning Commission decided by a 5- 1 (Klatchko) -0 vote, on the third motion,
to approve the project subject to the deletion of the gates.
The first motion to approve the project, subject to insertion of a condition which would allow the
project to be gated only if developed as an age-restricted senior community, failed on a 3-3-0
vote.
A second motion to approve the project subject to the deletion of the gates, failed on a 3-3-0
vote. The Planning Commission then engaged in a discussion on the issues of vehicular
circulation, location of amenities, inclusion of the adjacent golf course and related clubhouse
facilities into the project and gates. The Planning Commission also asked the applicant to state
their priorities. The applicant indicated that, they would prefer to have an approval
recommendation at that meeting, subject to elimination of the gates, rather than have the
matter continued to the next meeting of the Planning Commission.

The applicant noted that they would contact the buyer and relay the Planning Commission's
recommendation on the issue of gates. The applicant noted that, based upon the direction
provide by the buyer, they may ask the City Council to approve a gated residential community.

BACKGROUND
On January 8, 2003, the Planning Commission held a public hearing on this project. As of the
writing of this staff report, that meeting had not occurred. A supplemental staff report will be
prepared following that meeting.
On January 16, 2002, the City Council approved an application by the Burnett Companies for
a Preliminary Planned Development District to develop a private, single family residential
community with common open space and recreation amenities. The project approved by the
City Council also included a Tentative Tract Map application to subdivide a 61.9 acre parcel into
238 residential lots.The map also included lettered lots for use as common area improvements
and amenities such as open space, a swimming pool, spa area with accompanying restrooms,
pool building, project roadways,sidewalks, an on-site retention area, utility easements and well
sites.
Subsequent to the original approval, the applicant has submitted an application for a revised
Preliminary Planned Development District and Tentative Tract Map. The revised project
features a reduction in the number of lots, from the original 238 lots to 227 lots. The applicant
has also redesigned the project to eliminate one street, for incorporation of the area into a
consolidated amenities package. The previous project included 6.7 acres of open space
amenities in three areas. The proposed project includes 6.47 acres of open space and
recreation amenities.

In accordance with Section 9403.00(C) of the Zoning Code, the City Council is authorized to
establish a full range of development standards appropriate to the orderly development of a site
for which a PD is approved. Therefore, the City Council may determine that the benefits of the
proposed development plan warrant the granting of the development standards proposed.

As part of the Preliminary Planned Development District application,the applicant is proposing
variations to certain development standards. These include deviations with respect to lot area,
building height, front and side yards and setbacks, rear yards backing onto a Major
Thoroughfare, building separation, lot coverage and lot width as noted above. The project
complies with R-1-C zone standards for minimum lot depth.
A number of facts exist in support of this application for a PPD, including the irregular crescent
shape of the parcel in question, the provisions for common area improvements with 6.6 acres
of devoted to open space and amenities,the private streets proposed as part of this project,and
the proposed traffic calming.The City Council approved all of these modifications in its previous
approval of the project.
The applicant is requesting to be allowed to provide a detailed amenity package as part of the
Final Planned Development District. The amenities package would include an upgraded
multipurpose recreation center approximately 13,000 square feet in area. This building will be
subject to architectural approval. The area would include a large recreation building, capable
of hosting large functions such as ballroom dancing, bingo and other formal functions. In
addition the building may include a spa,fitness center, library, business center, arts and crafts
room and a cad and game room.Additional outdoor recreation amenities would include a pool
and spa, paddle tennis courts, a bocce ball court, a shuffle board court, horse shoes, croquet,
basketball/badminton court and a formal garden.

CITY COUNCIL
Case No. 5,0866, a revised Preliminary Planned Development District (PD No. 267) and revised
Tentative Tract Map 30054, for the subdivision of a 61.9 acres into 227 single family
residences, with minimum lot sizes of 5,000 and 6,000 square feet, and a limited number (56)
of 24' feet tall, two story residences within a gated community, located to the northeast of the
intersection of Sunrise Way and San Raphael Drive, Zone R-1-C and 0-5, Section 36.
Applicant: The Burnett Companies.
NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will hold
a public hearing at its meeting of January 15, 2003. The City Council meeting begins at 7:00 p.m.
in the City Council Chamber at City Hall, 3200 E. Tahquitz Canyon Way, Palm Springs, California.
The purpose of the hearing is to consider an application for a revised preliminary planned
development district, and a revised tentative tract map. The project includes the subdivision of a
61.9 acres into 227 single family residences, with minimum lot sizes of 5,000 and 6,000 square
feet, and a limited number(56) of 24'feet tall, two story residences within a gated community. The
revision to the project would reduce the number of lots from 238 to 227 and include a 6.47 acre
area for common area and recreation amenities.
An Environmental Assessment / Initial Study was prepared for the project. Pursuant to Section
21092.6 of the Public Resources Code, the California Environmental Quality Act (CEQA), and
Section 15063 of the California Environmental Quality Act Guidelines, a Mitigated Negative
Declaration was previously adopted by the City Council on January 16, 2002.The proposed revised
project is consistent with the Initial Study/Environmental Assessment (IS/EA) prepared for the
project. Mitigation measures are included in the draft conditions of approval.
The proposed map, architectural plans, Initial Study and related documents are available for public
review daily, between 8 am and 5 pm at the City of Palm Springs in the Planning and Zoning
Department, located at 3200 Tahquitz Canyon Way East.
If any individual or group challenges the action in court, issues raised may be limited to only those
issues raised at the public hearings described in this notice or in written correspondence at or prior
to the Commission meeting.
Notice of Public Hearing is being sent to all property owners within four hundred (400) feet of the
subject property.An opportunity will be given at said hearings for all interested persons to be heard.

The project site is currently vacant.The site is generally level(1-2%slope)and contains sparse
vegetation primarily consisting of scattered shrubs, palms and other trees.An existing concrete
lined Whitewater River storm channel runs 2,959 feetjust east of the eastern project boundary.
The Planned Development District Ordinance,Section 94.03.00 of the Zoning Ordinance,notes
that Planned Development District is intended to provide various types of land use which can
be combined in compatible relationship with each other as part of a totally planned
development.The intent of this district is to ensure compliance with the General Plan and good
zoning practice, while allowing certain desirable departures from the strict provisions of the
specific zone classifications.
The R-1-C Zone, Section 92.01.01.D.10 of the Zoning Ordinance, notes that in order to
encourage a more creative approach in the development of land and to allow for more usable
open space areas, large scale residential developments may be permitted on site of not less
than four and one half acres of land. The land is required to developed as an integrated unit,
conforming to density and all other property development standards except that lot area, lot
dimensions, and yards may be modified to allow "cluster" and "row" housing: provided the
overall development equals the general quality of development in this zone.
The 227 lot project features residential lots ranging in size from 5,000 to 7,000 square feet,with
the largest lot 18,141 square feet,with most lots between 5,000 and 8,000 square feet in area.
The minimum proposed lot widths are 50'and 60'.The minimum proposed lot depths are 100'.
The applicant is proposing 5' front yard setbacks, 3' side yard setbacks and 15' rear yard
setbacks. The applicant's research indicates that there is a market for smaller lot sizes with
common recreation and open space amenities.
PROJECT DESIGN
As part of the Planned Unit Development, the applicant has submitted architectural plans.
These plans are for illustrative purposes only,to depict potential relationships between a range
of models on the various lot configurations proposed as part of this project. It is proposed that
future merchant builders will submit architectural plans at a later date. The proposed models
feature 2 to 4 bedroom units, ranging in size from 1,650 square feet to 2,769 square feet in
detached one and two-story structures. All proposed single family residences will feature 2
parking spaces in a garage and an additional two spaces in front of the garage, in accordance
with established parking standards. The applicant is requesting that a maximum of 25%of the
units be allowed with a second story.
The project is designed around the existing Palm Spring Country Club golf course and features
a primary road with 13 cul-de-sacs.The previous design featured 12 cul-de-sacs. The project
is proposed to be a gated community with private streets. The applicant proposes to integrate
traffic calming measures into the project including the narrowing of street pavement within
portions of the right of way inside the project. Sixty seven lots are located adjacent to the golf
course.The Planning Commission had previously considered the issue of gates and determined
after some discussion on the merits of gated communities, that the issue of gates would be
determined by the applicant.
One recreation areas is proposed as part of this project. This recreation area would feature a
swimming pool, spa, sun decking, shade arbors and restroom building and drinking fountain.

The project also features pedestrian pathways and active and passive recreation areas. The
recreation area will be owned and maintained by the homeowners association.
This Planned Development District application proposes to provide specific development
standards for the project as well as a preliminary development plan as provided for by Zoning
Code Section 9403.00. Approval by the Planning Commission and City Council of the
preliminary development will constitute approval of the Preliminary Planned Development
District.

ANALYSIS:
The General Plan indicates that within the L-4 (Low Density Residential) designation a
maximum density of 4 dwelling units per acre is permitted (General Plan 3.5.a). Therefore, a
maximum of 247 units could be permitted on the site. However 227 units, or a density of 3.66
dwelling units per acre is proposed. The General Plan also notes that a limited number of units
may contain a second story (Policy 3.5.2) with a maximum height of 25' as long as: a) the
windows of the second story are oriented away from the living space, interior and exterior, of
adjoining areas; and b)the two-story elements shall be placed toward the south portion of the
lots; and c)the two story units shall be located so that they are not visible at the boundaries of
the planned development.
Staff is recommending a 200' setback to existing single story development from proposed 2-
story units. The project will minimally affect views from lower level residences of the adjacent
single family residential properties.Project layout,design and landscaping will reduce the visual
impact of the project.

BUILDING HEIGHT AND SETBACKS
The project elevations and cross sections indicate that the proposed project includes a
maximum building height of 24', which is six(6) feet above that allowed in the R-1-C zone, in
non-hillside conditions. The proposed project includes two story residential units within 100' of
R-1 zoned property developed with one story residences.Staff would recommend a prohibition
of two-story units both within 200 feet of adjacent R-1 zone boundary to the south and in
locations visible from the exterior of the project. Staff favors the 200'distance, because this is
the standard unit of measurement required between 2 story building in higher density zones,
such as the R-2 zone and one story residences located in the R-1-C zone.
GOLF COURSE AND AMENITIES
With respect to site design, the 227-unit project design features the grouping of residential
structures around an existing golf course, the Palm Spring Country Club. However, the
applicant has not demonstrated that the proposed residential units will have direct access to the
course. Currently, the course utilizes a hedge dense row of Tamarisk trees as a windbreak.
The applicant has stated their intent to thin the windbreak on their property, however the
windbreak is dense and approximately 10'ofwindbreakwould remain along the edge of the golf
course. Under existing conditions, these residences would not be considered golf course
frontage homes. Were this situation to be resolved, staff would consider the golf course,
expansive sight lines and related open space as a quality enhancing amenity.
A number of amenities are currently proposed as part of the project including,two common pool
and spa facilities have been located on the project site, and retention basins at the northwest
part of the site. It should be noted that the proposed lot sizes and proposed structures may
preclude the construction of individual pools on some lots.
CIRCULATION

A Traffic Impact Study was prepared for the project by Wildan (August 6, 2001). The traffic
study indicates that the future development of this subdivision will create approximately 2,300
daily trip ends.The report further notes that the project is expected to generate approximately
240 trip ends during the peak hours. Proposed mitigation of traffic impacts included the
construction of a traffic signal at the intersection of Sunrise Way and San Raphael Drive.
The General Plan requires resolution of potential traffic and driveway conflicts. The applicant
has proposed improvements to Sunrise Way,in orderto meet this objective.The improvements
include constructing Sunrise Way to its ultimate right of way, a landscaped median in Sunrise
Way,and project entryway improvements.The objective of these improvements is to channelize
traffic flows, provide traffic calming in the immediate vicinity of the project area, and create an

upgraded project entryway The improvements are also intended to improve the Sunrise Way
streetscape.
From the northern project entry at Sunrise Way, a 36'wide road provides vehicular circulation
through the site. The gated project entry will feature a key card entry and a guest lane with
phone and address board for guests to call their hosts and announce their arrival.A landscaped
median will provide a buffer between traffic flows.The median will have a breakto allow for mis-
directed vehicles to turn around.
In response to staff concerns, the applicant has proposed the use of traffic-calming, narrow
street sections, in order to slow the rate of travel on site. In these street sections,the applicant
will utilize a reduced pavement width of 24' (Section'E'-'E' and'F'-"F" on the tentative map).
The normal street cross-section features a 36' wide street (Section 'B' - 'B' on the tentative
map). Street right of way remains a constant 50'throughout the project, with the exception of
the primary entry, which features an 80' street right of way (Section 'C' - 'C' on the tentative
map). The traffic calming street section would vary from 50'to 100' in length, and be utilized in
four locations. The traffic calming street sections would be constructed with a colored or
decorative Portland concrete cement.The proposed narrowed 24'wide roadway complies with
Fire Department requirements. Staff supports use of these traffic calming special street
sections.
The secondary project entry features an offset intersection design. An alternative secondary
entry design features Golden Sands Road, which is aligned with San Rafael Road and is the
preferred design of the City Engineer and applicant. All parcels required by the alternative entry
design are now controlled by the applicant.
ENVIRONMENTAL ANALYSIS:
An.Initial Study/Environmental Assessment (IS/EA) dated November 20, 2001 was prepared
by staff for the Planned Development and Tentative Tract Map. A Mitigated Negative
Declaration was adopted by the City Council on January 16, 2002. The proposed mitigation
measures are included in the conditions of approval.All environmental issues were previously
assessed in the 2001 Initial Study/Environmental assessment.The revised project would result
in a further reduction in the level of environmental impacts associated with this project.
NOTIFICATION/COMMUNITY INVOLVEMENT
All property owners within a 400-foot radius of the parcel considered for subdivision were
notified.A legal notice was published in the Desert Sun. The City has not received any written
correspondence from area residents.

Ms. Jackie Morgan stated that she is available to answer questions.
Ms. Josette McNary, Assistant City Librarian, stated that the City owns the land; however this
particular branch was built from funds from a special library tax and that proceeds of the sale will
go to library funding. She confirmed that the Library Board does not anticipate that this building
will ever be needed for library use again.

PUBLIC HEARINGS:
Case 5.0866 -Application by Burnett Companies for a preliminary Planned Development District
(PD 267)related architectural approvals and Tentative Tract Map 30054 for the subdivision of 61.9
acres into 238 single family residences with minimum lot sizes of 5,000 and 6,000 square feet
within a gated community located to the northeast of the intersection of Sunrise Way and San
Rafael Drive, R-1-C and 0-5, section 36
Commissioner Shoenberger abstained due to conflict of interest.
Alex Meyerhoff, Principal Planner, reported that the project is designed around the existing Palm
Springs Country Club golf course and features a primary road with 12 cul-de-sacs. He stated that
the site is currently vacant but does have an existing concrete-lined storm channel running adjacent
to the easterly perimeter of the site. He reported that the applicant plans to work with the
Engineering staff to integrate street narrowing as a traffic calming measure. He reported that the
238-lot project features residential lots (ranging from 5,000 to 8,000 square feet). He stated that
the applicant is proposing 5'front yard setbacks, 5'side yard setbacks, and 15' rear yard setbacks
in order to provide common recreation and open space amenities. He stated that two recreational
areas are proposed which include swimming pools,spas,sun decks,shade arbors, restrooms,and
drinking fountains and will be located adjacent to the north fairway of the existing course. He
reviewed conceptual architectural plans and stated that actual plans will come before the Planning
Commission at a later date. He reported that the applicant is requesting that a maximum of 35%
of the units be allowed to be two-storywhich will also come to the Planning Commission for review.
Director reported that the Planning Commission has reviewed proposed elevations at a recent
Study Session at which time Commissioners expressed concern regarding the overall design. He
clarified that today's application is not for Architectural Approval and the elevations are only
conceptual at this point. He reviewed the revised Conditions of Approval with the Commission and
stated that staff would like to work with the applicant to establish a time frame for complete
landscaping of side and rear yards (using CC&R's) and clarified that the developer will be
responsible for the landscaping of front yards. He reiterated that the Planning Commission retains

authority of approval for architecture and that the developer's intent is to sell sets of lots to
merchant builders. He stated that the two-phase project consists of subdivision improvements such
as street, curbs, gutters, and other infrastructure elements (Phase One) and residential
development (Phase Two).
Chairman Klatchko opened Public Hearing.
Mr. Jason Lee, Burnett Companies, addressed the Planning Commission to thank staff for
assistance and stated that he will be available for questions.
There being no further appearances, the Public Hearing was closed.
Commissioner Matthews called the applicant to the podium.
To Commissioner's questions, Mr. Lee reported that, typically his company builds a first phase of
20 houses and a main recreation center to begin development. He stated that the community is
gated in order to build a neighborhood feel for the development as it is surrounded by a golf course
and a mobile home park as well as to give a sense of pride in ownership, not necessarily as a
security issue. He stated that his company is anticipating working with no more than four merchant
builders after the project is entitled. He stated that there are two recreation centers, barbeque, and
play areas and that approximately 85% of the lots are available for private pools.
Commissioner Jurasky stated that he believes security gates can lead to the demise of traditional
neighborhoods; however, in the subject case, the gate seems to be acceptable. He asked that
it not be overly formal in order to integrate better with the surrounding neighborhood. He also
stated that the value of neighborhoods is to encourage families to interact and that the architecture
of the neighborhood should also encourage interaction. He stated that he felt the project could be
spectacular and that he would like it to have open pedestrian gates if possible. He stated that, in
other Coachella Valley cities, walled developments demonstrate the loss of interaction within and
between neighborhoods and encouraged the applicant to keep in mind the unique design qualities
of Palm Springs.
Commissioner Caffery stated that, at the Study Session when this project initially reviewed, it was
not gated and he suggested that it be gated as it is at the end of a major thoroughfare.
Commissioner Raya concurred.
Director reported that instead of standard Southern California Edison overhead lighting, the
applicant plans to install decorative street lights on Sunrise Way, entry gates, and at driveways.
Commissioner Raya asked that the applicant assure that the lighting is of a pedestrian scale at the
entries and for the landscape lighting. Director stated that high-pressure sodium lighting will be
used.
Dave Barakian, City Engineer reported that staff is pleased with the proposed street narrowing as
a means to mitigate traffic impacts. He stated that the applicant plans to incorporate a decorative
paving surface at intervals which will also cause traffic to slow down. He stated that the originally

proposed median islands are not an effective mitigation tool.
Directorstated that,as the streets are private,the Homeowners Association may choose to modify
traffic calming to a more severe level; but that will not include City review. He stated that the
applicant may choose to allow pedestrian traffic through the entries but restrict vehicles with the
gate.
Commissioner Matthews stated that having gates or not is a marketing issue — that the
developer/builders must sell the units and that they and the Homeowner's Association are the
appropriate entities to determine the existence and type(s) of gates.
Chairman Klatchko thanked City Engineer for reporting about the traffic calming measures
proposed and encouraged Planning Commission members to do a site visit to see examples of the
discussed narrowing and decorative paving. He confirmed with the Director that Planning
Commission consideration of small lot sizes is dependent upon a more creative architectural
approach, and that the final architectural development plans will need to be of high quality to meet
the intent of the Zoning Ordinance. Director confirmed that staff would include that direction in its
report to City Council.
MIS/C(Caffery/Matthews 5-0,1 abstention)to approve subject to amended Conditions of Approval
and:
A. Planning Condition No.4 to be corrected to require High Pressure Sodium Lighting;
and
B. Rear and side yard setbacks to be landscaped according to CC&R requirements;
and
C. Planning Condition Nos. 26 and 27 shall be amended to require decorative
landscape lighting and that decorative street lighting will be pedestrian-scale at
entries.
Case 5.0891 and 5.0893 - General Plan Amendment so as to redesignate property from M-15:
Medium Density Residential to Resort Commercial, and a Zoning Map Amendment to rezone
property from WR2: Watercourse and Limited Multiple-Family Residential Zone to WC1:
Watercourse and Retail Business Zone. The property is located at 4601 Matthew Drive, Section
30.
Planning Manager reported that the subject property is 1.13.acres of vacant, significantly sloped
land with a hillside portion. She stated that detailed development plans have not been submitted
but will be consistent with the Resort Commercial General Plan designation and W-C-1 zoning
requirements. She stated that the redesignation of this property would serve to extend the Resort
Commercial area and is appropriate for the physical condition of the land.

15. CASE 5.0866, PD267, TTM30054— BURNETT COMPANIES
Recommendation: That the Council approve a Planned Development District 267
and Tentative Tract Map 30054 for a 238 lot gated subdivision with residential lot
sizes ranging in size from 5,000 to 7,000 square feet located northeast of the
intersection of Sunrise Way and San Rafael Drive, subject to conditions, Zone R-
1-C and 0-5, Section 35.
Director of Planning & Building reviewed the staff report and visual display located
in the Chamber.
Mayor stated that the developer may or may not build out the entire project.
Director of Planning & Building stated that Phase I is the subdivision
improvements; that Phase II would be the residential portion; and that plans were
needed for the housing and recreational portion.
Councilmember Mills stated that the item before the Council is only for the
subdivision improvements such as streets, landscaping and walls; questioned if
the exterior wall is 8 foot as in the plan, or 6 foot as indicated on the map; and
questioned if the developer would include the golf course plans.
Director of Planning and Building stated that the golf course questions needs to
be deferred to the developer; that the walls on the northern property line are 7 feet
with Sunrise Way being 6 feet and all would be to grade.
Councilmember Mills questioned the landscaping plan offered for the windbreak.
Director of Planning & Building stated that the landscaping is addressed in the
mitigation measures along the north and northwest boundaries and some in the
recreational facilities.
Mayor declared the hearing open.
Jason Burnett, applicant, stated presence for any questions and added that a
boundary wall for the project is being put in place to help address wind issues.

Rod Gunnerson, 1750 Joyce Drive, stated that access does need to be from the
southern road; that two-story units should not be allowed that overlook existing
residences and that the project as a whole is outstanding and needed in the north
end area.

Councilmember Oden questioned the two-year period for the project.
Director of Planning & Building stated that the developer would have two years to
start the project or to request time extensions; that the completion date for the
entire project has not been set; that Phasing of a project allows for the completion
of each Phase; that there is no official relationship between the developer of the
project and the developer of the golf course; that the golf course is in close
proximity to the project; that the separation of property lines is by tamarisk trees;
that consideration of the project by the Council does not include architectural
approval; that as a matter of information the applicant was requested to submit
layout of the homes for Council to observe; and that the final development plans
will be formally reviewed by the Planning Commission.
Councilmember Mills stated that there have been other large projects of this type
built in similar areas; that there is a concern for wind and the its mitigation; that
the mitigation with the trees and walls will be somewhat effective, but that there
should be a formal program for a windbreak addressed by the developer.
Director of Planning & Building stated that the condition could be added to
Condition 6; and that the language could read that substantial windbreak along
back yards, included in the tree and shrub program, should be added in addition
to a seven foot wall.
Councilmember Mills questioned if the ten foot area along the golf course where
the tamarisk trees are located would be mutually maintained and if the developer
of the residential homes will address the immediate need of clean up of the area.
Director of Planning & Building stated that the matter had been discussed with the
developer to have a presentable edge to the homeowners of the area.
Councilmember Mills questioned if the developer had agreed to all conditions.
Director of Planning & Building stated that all conditions were agreed to.
Councilmember Mills questioned parking for the pool area and the mid-park area.
Director of Planning & Building stated that parking would be permissible on the
street for both locations.
Mayor questioned the width of the streets and if there were concerns by
emergency personnel.

Director of Planning & Building stated that the street widths vary but are in
approximate 24 feet width to slow traffic concerns; that the typical width of 36 feet
allows for parking on the streets; that the Fire and Police Departments did
address the project; that the concerns, if any, would already have been
addressed.
Councilmember Oden left at 7:55 p.m.
Mayor questioned if the parking stalls were 8 foot in width.
Mayor questioned if all the lots are substandard in size; whether setback
requirements are met and added that it seems that the lot size coverage is at
46%.
Councilmember Oden entered at 8:00 p.m.
Director of Planning & Building stated that a Planned Development District
typically allows for the creation of smaller lots; that this project, if developed 15
years ago, would be more like a condominium project; that at this time, the single
family residences are developed in the same type of manner; that it is usually the
developer style to prefer a smaller lot; that it does allow for community open
space amenities; that the Planning Commission did indicate some concern with
the lot size, but did determine that it is the housing product type; that there is a
market for this type of home and that the type of project does market well.
Mayor questioned if there would be a homeowners association and whether there
are median strips.
Director of Planning & Building stated that there will be a homeowners
association and that there will be median strips to maintain through the
association.
Mayor stated that there are specific plans for the planned development district;
that what is not clear is the relationship of the project and the adjacent golf
course; that the pond at the front will probably have problems with maintenance;
that this project is not the typical project offered in the City; and requested that the
hearing be reopened to address the developer.
Mayor declared the hearing open.
Lynn Burnett, Burnett Companies, stated that the south entry is preferable closer
to San Raphael; that there is one remaining parcel to be acquired to achieve the
preferred entryway; that the Golf Course does have a long term lease with
American Golf who is subletting to Sunterra Golf; that there is a mutual desire to
work together to make both projects a success; that the wind mitigation issue is
being addressed through the wall, landscaping plan and hopefully upwind
development in the future; that an additional 25 acres to the north is in negotiation
for acquisition; that the gates for the project are desirable; that it is hoped that the
gates can be added; that the water feature at the entry way may need to be
redesigned with the wind in mind; that there are three lots on the Westside that
are called flag lots; that flag lots are many times the most desirable lots of a
development due to the seclusion; that that there are common

areas for the project and that those areas will be maintained through the
homeowners association.

Councilmembers reported on various civic and community organizational

meeting, and announced upcoming events of community interest.

17. MUNICIPAL CODE AMENDMENT- COUNCIL MEETING TIMES
On December 21, 2001 Council directed preparation of documents to establish
the hour for meeting in Study Session at 1:30 p.m., Closed Sessions at 4:00 p.m.
and Regular City Council meetings at 6:00 p.m., all held on the first and third
Wednesdays of each month.
City Manager stated that the proposed change in time is with the idea of starting
earlier so that the meetings will not continue well into the night; that there are
many times the residents must wait into the late night to speak on a particular
item; that in addition, for a City the size of Palm Springs two meetings per month
should be sufficient; and requested approval of the recommendation.
Councilmember Oden stated that for those employed the new meeting times
create a special challenge; that it is not that the times could not be changed, but
that the change of Study Sessions to 1:30 in the afternoon may impede citizens
from attending; that the time change does not seem to be in the best interest of

Dear Doug:
As you may know,K. Hovnanian acquired the above referenced property from the Burnett Companies on
December 31"as part of an assembly of three parcels which will comprise K. Hovnanian's Four Seasons
at Palm Springs, a master planned active adult community. The community will be highly amenitized
with residents being able to take advantage of a private 10,000 square foot recreation center, an array of
outdoor activities such as tennis, paddle tennis, bocce ball, etc.., an interconnected system of walking
trails,and an enhanced streetscape becoming of its desert environment.
The development of these lifestyle communities for active adults includes an element of privacy and
exclusivity that depends upon controlled access to the homeowners private amenities. It has come to our
attention that the Planning Commission (the "Commission") approved our revised layout for the
community but deadlocked over the issue of gating the community. We understand the Commission's
concern over egress from the community but believe that the impacts of the revisions are negligible and
when viewed in context with the City's approval of Tentative Tract Map No.30058,which includes gated
access to the western portion of the community, the condition that this portion of the community not be
gated would create a severe detriment to the overall master plan.
As a leader in the development of age restricted communities throughout the northeast, Texas and
California, we have come to recognize the particular needs and desires of this buyer demographic and
gated access is vital to creating a lifestyle community. Further, gated access is part of the community
theme and therefore, we would not gate a portion of the community without gating the entire community.
Accordingly,we respectfully request that the Planning Department support gated access to the community
and recommend to the City Council that the Council approve the revised Tentative Tract Map No. 30054
with a condition that allows this portion of the community to be gated.

I, the undersigned City Clerk of the City of Palm Springs, California,
do hereby certify that a copy of the Notice of Public Hearing before
the City Council of the City of Palm Springs, in conjunction with The
Burnett Companies, Case No. 5.0866, revised PD 267 and TTM
30064, for the subdivision of a 61.9 acres into 227 single family
residences, located northeast of the intersection of Sunrise Way and
San Raphael Drive, Zone R-1-C and 0-5, Section 36, was mailed to
each and every person set forth on the attached list on the 23rd day
of December, 2002. A copy of said Notice is attached hereto. Said
mailing was completed by placing a copy of said Notice in a sealed
envelope, with postage prepaid, and depositing same in the U.S.

NOTICE OF PUBLIC HEARING
CITY COUNCIL
Case No. 5.0866, a revised Preliminary Planned Development District (PD No. 267) and revised
Tentative Tract Map 30054, for the subdivision of a 61.9 acres into 227 single family
residences, with minimum lot sizes of 5,000 and 6,000 square feet, and a limited number (56)
of 24' feet tall, two story residences within a gated community, located to the northeast of the
intersection of Sunrise Way and San Raphael Drive, Zone R-1-C and 0-5, Section 36.
Applicant: The Burnett Companies.
NOTICE IS HEREBY GIVEN that the City Council of the City of Palm Springs, California, will hold
a public hearing at its meeting of January 15, 2003. The City Council meeting begins at 7:00 p.m.
in the City Council Chamber at City Hall, 3200 E. Tahquitz Canyon Way, Palm Springs, California.
The purpose of the hearing is to consider an application for a revised preliminary planned
development district, and a revised tentative tract map. The project includes the subdivision of a
61.9 acres into 227 single family residences, with minimum lot sizes of 5,000 and 6,000 square
feet, and a limited number(56) of 24'feet tall, two story residences within a gated community. The
revision to the project would reduce the number of lots from 238 to 227 and include a 6.47 acre
area for common area and recreation amenities.
An Environmental Assessment / Initial Study was prepared for the project. Pursuant to Section
21092.6 of the Public Resources Code, the California Environmental Quality Act (CEQA), and
Section 15063 of the California Environmental Quality Act Guidelines, a Mitigated Negative
Declaration was previously adopted by the City Council on January 16,2002.The proposed revised
project is consistent with the Initial Study/Environmental Assessment (IS/EA) prepared for the
project. Mitigation measures are included in the draft conditions of approval.
The proposed map, architectural plans, Initial Study and related documents are available for public
review daily, between 8 am and 5 pm at the City of Palm Springs in the Planning and Zoning
Department, located at 3200 Tahquitz Canyon Way East.
If any individual or group challenges the action in court, issues raised may be limited to only those
issues raised at the public hearings described in this notice or in written correspondence at or prior
to the Commission meeting.
Notice of Public Hearing is being sent to all property owners within four hundred (400) feet of the
subject property.An opportunity will be given at said hearings for all interested persons to be heard.

PLANNING COMMISSION
Case No. 5.0866, a Preliminary Planned Development District (PD No. 267), related
Architectural Approvals and Tentative Tract Map 30054, for the subdivision of a 61.9 acres into
227 single family residences, with minimum lot sizes of 5,000 and 6,000 square feet, and a
limited number (56) of 24' feet tall, two story residences within a gated community, located to
the northeast of the intersection of Sunrise Way and San Raphael Drive, Zone R-1-C and 0-5,
Section 36.
Applicant: The Burnett Companies.
NOTICE IS HEREBY GIVEN that the Planning Commission of the City of Palm Springs, California,
will hold a public hearing at its meeting of January 8, 2003. The Planning Commission meeting
begins at 1:30 p.m. (Public Hearings begin at 2:00 p.m.) in the City Council Chamber at City Hall,
3200 E. Tahquitz Canyon Way, Palm Springs, California.
The purpose of the hearing is to consider an application for a revised preliminary planned
development district, and a revised tentative tract map.
An Environmental Assessment / Initial Study was prepared for the project. Pursuant to Section
21092.6 of the Public Resources Code, the California Environmental Quality Act (CEQA), and
Section 15063 of the California Environmental Quality Act Guidelines, a Mitigated Negative
Declaration was adopted by the City Council on January 16, 2002. The proposed revised project
is consistent with the Initial Study/Environmental Assessment (IS/EA) prepared for the project
Mitigation measures are included in the draft conditions of approval.
The proposed map, architectural plans, Initial Study and related documents are available for public
review daily, between 8 am and 5 pm at the City of Palm Springs in the Planning and Building
Department, located at 3200 Tahquitz Canyon Way East.
If any individual or group challenges the action in court, issues raised may be limited to only those
issues raised at the public hearings described in this notice or in written correspondence at or prior
to the Commission meeting.
Notice of Public Hearing is being sent to all property owners within four hundred (400) feet of the
subject property.An opportunitywill be given at said hearings for all interested persons to be heard.

RESIDENTIAL DEVELOPMENT LOCATED NORTHEAST OF
THE INTERSECTION OF SUNRISE WAY AND SAN RAFAEL
DRIVE, ZONE R-1-C AND 0-5, SECTION 35.
WHEREAS, The Burnett Companies ("Applicants") filed an application with the City pursuant
to Sections 9403.00 and 9402.00 of the Zoning Ordinance for a Preliminary Planned
Development District and Preliminary Development Plan for a 238-unit single family residential
project for the property located northeast of the intersection of Sunrise Way and San Rafael
Drive, Zone R-1-C, Section 35; and
WHEREAS, an the applicant has filed an application with the City pursuant to Section 9.62.00
et. seq. of the Municipal Code for Tentative Tract Map 30054(TTM 30054)for the subdivision
of a 61.9 acre parcel into a 277 numbered lots and 17 lettered lots; and
WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs
to consider an application for a Tentative Tract Map, and a Preliminary Planned Development
District 5.0866-PD-267 (PD 267)was issued in accordance with applicable law; and
WHEREAS, said Preliminary Planned Development District, and Tentative Tract Map were
submitted to appropriate agencies as required by the subdivision requirements of the Palm
Springs Municipal Code, with the request for their review, comments and requirements; and
WHEREAS, on December 12, 2001, a public hearing on the application for TTM 30054 and
PD 267 was held by the Planning Commission in accordance with applicable law; and
WHEREAS, the Planning Commission carefully reviewed and considered all of the evidence
presented in connection with the hearing on the project, including but not limited to the staff
report, all written and oral testimony presented and then voted to recommend that the City
Council approve said project; and
WHEREAS,on January 16, 2002, a public hearing on the application for a TTM 30054 and PD
267 was held by the City Council in accordance with applicable law; and
WHEREAS, the City Council carefully reviewed and considered all of the evidence presented
in connection with the hearing on the project, including but not limited to the staff report, all
written and oral testimony presented and then voted to approve said project;
WHEREAS, the City Council voted to approve said project; and

WHEREAS, the applicant subsequently redesigned the proposed project and reduced the
number of lots from 238 to 227, in order to provide a location for enhanced amenities, and
subsequently request approval of the revised project; and
WHEREAS, notice of a public hearing of the Planning Commission of the City of Palm Springs
to consider an application for a revised Tentative Tract Map,and a revised Preliminary Planned
Development District 5.0866-PD-267(PD 267)was issued in accordance with applicable law;
and
WHEREAS, on January 8, 2003, a public hearing on the application for TTM 30054 and PD
267 was held by the Planning Commission in accordance with applicable law; and
WHEREAS, the Planning Commission carefully reviewed and considered all of the evidence
presented in connection with the hearing on the project, including but not limited to the staff
report, all written and oral testimony presented and then voted to recommend that the City
Council approve said project; and
WHEREAS,the Planning Commission voted to recommend that the City Council approve said
project; and
WHEREAS, on January 15, 2003, a public hearing on the application for TTM 30054 and PD
267 was held by the City Council in accordance with applicable law; and
WHEREAS, the City Council carefully reviewed and considered all of the evidence presented
in connection with the hearing on the project, including but not limited to the staff report, all
written and oral testimony presented and then voted to recommend that the City Council
approve said project.
THE CITY COUNCIL HEREBY FINDS AS FOLLOWS:
Section 1: Pursuant to CEQA, the City Council finds that, an Initial Study/Environmental
Assessment (IS/EA) dated November 20, 2001 was prepared by staff for the
Planned Development and Tentative Tract Map. A Mitigated Negative
Declaration was adopted by the City Council on January 16, 2002. The
proposed mitigation measures are included in the conditions of approval. All
environmental issues were previously assessed in the Initial
Study/Environmental assessment.The revised project would result in a further
reduction in the level of environmental impacts associated with this project.
Section 2: Pursuant to Zoning Ordinance Section 9402.00, the City Council finds that:
a. The use applied for at the location set forth in the application is properly one for which
a Planned Development District is authorized by the City's zoning ordinance.
Pursuant to the Zoning Ordinance, cluster residential development (single family
residences) is a permitted use within the R-1-C and 0-5 zones.
b. The said use is necessary or desirable for the development of the community, and is
in harmony with the various elements or objectives of the General Plan, and is not
detrimental to the existing or future uses specifically permitted in the zone in which the
proposed use is to be located.
The proposed project consists the subdivision of 61.9 acres into 238 lots and the
development of a 238 unit,one and two story,detached singlefamily residential project.
The use is consistent with the objectives of the General Plan, and numerous
improvements, including two recreation areas have been proposed in conjunction with
the subject application(s). These recreation areas would feature free-form resort style
swimming pools, pas, sun decking, shade arbors and restroom buildings and drinking
fountains. The project also features pedestrian pathways and active and passive
recreation areas. The project will therefore not be detrimental to the existing or future
uses permitted in the zone in which the use is located.
C. The site for the intended use is adequate in size and shape to accommodate said use,
including yards, setbacks, walls or fences, landscaping and other features required in
order to adjust said use to those existing or permitted future uses of land in the
neighborhood.
This Planned Development District application proposes to provide specific
development standards for the project as well as a preliminary development plan as
provided for by Zoning Code Section 9403.00.Approval by the Planning Commission
and City Council of the preliminary development will constitute approval of the
Preliminary Planned Development District.
Pursuant to the R-1-C zone,Section 92.01.01.D.10 of the Zoning Ordinance, in order
to encourage a more creative approach in the development of land and to allow for
more usable open space areas, large scale residential developments may be
permitted on site of not less than four and one half acres of land.The land is required
to developed as an integrated unit, conforming to density and all other property
development standards except that lot area, lot dimensions, and yards may be
modified to allow"cluster"and"row"housing:provided the overall development equals
the general quality of development in this zone. A number of facts exist in support of
this application for PD-267, including the irregular crescent shape of the parcel in
question, the provisions for common area improvements with 6.6 acres of devoted to
open space and amenities,the private streets proposed as part of this project, and the
proposed traffic calming.
The proposed 20'parkway along Sunrise Way combine with the 15'minimum rearyard
setbacks will produce a building setback of 35'along Sunrise Way,which is consistent
with development in the area, most notably the Coyote Run Apartments.
A prohibition of two-story units both within 200 feet of the adjacent R-1 zone boundary
to the south and in locations visible from the exterior of the project,in consistent with the
provisions of the General Plan and the Zoning Ordinance. The 200' setback distance
is the standard unit of measurement required between 2 story buildings in higher
density zones, such as the R-2 zone and existing single story residences located in the
R-1-C zone. Therefore, the site is adequate in size and shape to accommodate the
proposed uses,and the proposed project is within allowable density of the R-1-C zone.
d. The site for the proposed use relates to streets and highways properly designed and
improved to carry the type and quantity of traffic to be generated by the proposed use.
The proposed project will contribute to improvement of the existing street system that
will serve the site, and with said improvements, the public street system will be
adequate to carry the type and quantity of traffic to be generated by the proposed use.
e. The conditions to be imposed are deemed necessary to protect the public health,safety
and general welfare, of the existing neighborhood in which this project is situated.
The conditions imposed are necessary to bring the project into compliance with
applicable zoning, building, and other regulations to protect the public health, safety,
and general welfare of the existing neighborhood in which this project is located.
Section 3: Pursuant to 9.62.010 of the Palm Springs Municipal Code and Section 92.01.00
et. sec. of the Zoning Ordinance, the City Council finds that:
a. The proposed Tentative Tract Map is consistent with all applicable general and specific
plans.
The proposed Tentative Tract Map is consistent with the goals and objectives of the L-4
Low Density Residential,General Plan designation which governs the subject property
as well as all property adjacent to the subject site.
b. The design and improvements of the proposed Tentative Tract Map are consistent with
the R-1-C zone in which the property is located.
The proposed project is consistent with existing development in the immediate vicinity
of the proposed project, particularly the existing single story residences and mobile
home park located to the south and the existing two-story multi family residential
development located directly to the west of the property.
C. The site is physically suited for this type of development.
The project site is level and each lot contains adequate developable building area.
There are no bodies of water,ravines,or significant topographic features on the subject
property.
d. The site is physically suited for the proposed density of development.
City zoning criteria for the R-1-C and 0-5 zone encourage and allow for a more creative
approach in the development of land,which allows for more usable open space areas.
Pursuant to Section 92.01.00 of the Zoning Ordinance, large scale residential
developments may be permitted on sites of not less than four and one half acres of
land.The land is required to developed as an integrated unit,conforming to density and
all other property development standards except that lot area,lot dimensions,and yards
may be modified to allow"cluster"and"row"housing: provided the overall development
equals the general quality of development in this zone.

The proposed project will allow for a housing opportunity which provides common open
space amenities, private street and smaller lot sizes.This type of housing product does
not currently exist in the community and will provide needed housing product within the
community.
The General Plan Designation of L-4 permits establishes a threshold density of 3
dwelling units per acre and a maximum of 4 dwelling units per acre. The proposed
density of 3.66 dwelling units per acre is within the allowable range of density.Thus,the
site is physically suited for the proposed number of lots, and the density of the
subdivision is consistent with the General Plan. The proposed project which
incorporates a more creative approach in the development of land and allows for more
usable open space areas is consistent with the provisions of the zoning ordinance.
e. The design of the subdivision is not likely to cause environmental damage or
substantially and avoidably injure fish, wildlife, or their habitats.
The Mitigated Negative Declaration prepared for the project determined that the project
is adjacent to existing developments to the west and south. Through the
implementation of the proposed mitigation measures any environmental impacts
regarding animal or plant life will be reduced to a level of less than significant. There
are no bodies of water on the subject property and therefore no fish will be disturbed.
f. The design of the subdivision or type of improvements will not conflictwith easements,
acquired by the public at large, for access through or use of the property within the
proposed subdivision.
The design of the subdivision will not conflict with easements for access through or use
of the property. A number of easements,transect the property;however,the proposed
subdivision will not interfere with these easements.
NOW, THEREFORE, BE IT RESOLVED that, based upon the foregoing, the City Council
hereby order the filing of a Negative Declaration and approves Case No. 5.0866-PD-267; and
Tentative Tract Map 30054,subject to those conditions set forth in the attached Exhibit A,which
are to be satisfied prior to the issuance of building permits unless otherwise specified.

Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer, the Director of Planning, the Chief of Police, the Fire Chief or
their designee, depending on which department recommended the condition.
Any agreements, easements or covenants required to be entered into shall be in a form
approved by the City Attorney.
PLANNING DEPARTMENT:
1. The proposed development of the premises shall conform to all applicable regulations
of the Palm Springs Zoning Ordinance, Municipal Code, or any other City Codes,
ordinances and resolutions which supplement the zoning district regulations.
1a. The owner shall defend, indemnify, and hold harmless the City of Palm Springs, its
agents, officers, and employees from any claim, action, or proceeding against the City
of Palm Springs or its agents, officers or employees to attach, set aside, void or annul,
an approval of the City of Palm Springs, its legislative body, advisory agencies, or
administrative officers concerning Case 5.0866-PD 267 and TTM 30054. The City of
Palm Springs will promptly notify the applicant of any such claim, action, or proceeding
against the City of Palm Springs and the applicant will either undertake defense of the
matter and pay the City's associated legal costs or will advance funds to pay for defense
of the matter by the City Attorney. If the City of Palm Springs fails to promptly notify the
applicant of any such claim, action or proceeding or fails to cooperate fully in the
defense,the applicant shall not,thereafter, be responsible to defend, indemnify, or hold
harmless the City of Palm Springs. Notwithstanding the foregoing, the City retains the
right to settle or abandon the matter without the applicant's consent but should it do so,
the City shall waive further indemnification hereunder, except, the City's decision to
settle or abandon a matter following an adverse judgment or failure to appeal, shall not
cause a waiver of the indemnification rights herein.
2. If, within two (2) years after the date of approval by the City Council of the preliminary
development plan, the final development plan, as indicated in Section 94.03.00(I), has
not been approved by the planning commission,the procedures and actions which have
taken place up to that time shall be null and void and the planned development district
shall expire. Extensions of time may be allowed for good cause.
3. The final development plans shall be submitted in accordance with Section 9403.00 of
the Zoning Ordinance. Final construction plans shall include site plans, building
elevations, floor plans, roof plans, fence plans, entry plans, landscape plans, irrigation
plans, exterior lighting plans, sign program, site cross sections, property development
standards, street improvement plans and other such documents as required by the
Planning Commission. Final construction plans shall be submitted within two years of
the Planning Commission approval.
4. The applicant prior to issuance of building permits shall submit a draft declaration of
covenants, conditions and restrictions ("CC&R's") to the Director of Planning and
Building for approval in a form to be approved by the City Attorney, to be recorded prior
to issuance of occupancy permits. The CC&R's shall be enforceable by the City, shall
not be amended without City approval, shall require maintenance of all property in a
good condition and in accordance with all ordinances.The applicant shall submit to the
City of Palm Springs, a deposit in the amount of$5,000 for the review of the CC&R's
by the City Attorney.
5. The project shall be developed in two phases.
A. Phase 1 shall include completion of the specific requirements of the subdivision
including all street improvements, and all off-site improvements. These
improvement shall include improvements of Sunrise Way.
B. Phase 2 shall include the residences and on site amenities, including tot lots,
pools spas and other passive and active recreation areas. Phasing of amenities
shall be concurrent with construction of adjacent residential units. Phase 2
includes site plans, roof plans, floor plans, exterior building elevations,
landscape plans (front yards only), irrigation plans exterior lighting plans, etc.,
for all single family residences.
6. Final landscaping, irrigation, exterior lighting, and fencing plans for each phase shall be
submitted for approval by the Department of Planning and Building prior to issuance of
a building permit/construction permits. Landscape plans shall be approved by the
Riverside County Agricultural Commissioner's Office prior to submittal. A substantial
windbreak shall be provided in the rear yards along the northern and eastern project
perimeters, using trees and shrubs. The windbreak shall be installed as residential
phases are developed.
7. The project is subject to the City of Palm Springs Water Efficient Landscape
Ordinance. The applicant shall submit an application for Final Landscape Document
Package to the Director of Planning and Building for review and approval prior to the
issuance of a building permit. Refer to Chapter 8.60 of the Municipal Code for specific
requirements.
8. All proposed trees within the public right-of-way and within 10 feet of the public sidewalk
and/or curb shall have City approved deep root barriers installed per City of Palm
Springs Engineering specifications.
9. All roof mounted mechanical equipment shall be screened from all possible vantage
points both existing and future per Section 9303.00 of the Zoning Ordinance. The
screening shall be considered as an element of the overall design and must blend with
the architectural design of the building(s). The exterior elevations and roof plans of the
buildings shall indicate any fixtures or equipment to be located on the roof of the
building, the equipment heights, and type of screening. Parapets shall be at least 6"
above the equipment for the purpose of screening

10. No exterior down spouts shall be permitted on any facade on the proposed building(s)
which are visible from adjacent streets or residential and commercial areas.
11. The design, height,texture and color of building(s),fences and walls shall be submitted
for review and approval prior to issuance of building permits.
12. The street address numbering/lettering shall not exceed eight inches in height.
13. An exterior lighting plan in accordance with Zoning Ordinance Section 93.21.00,
Outdoor Lighting Standards, shall be submitted for review and approval by the Director
of Planning & Building prior to the issuance of building permits. Manufacturer's cut
sheets of all exterior lighting shall be submitted to and approved by the Director of
Planning and Building prior to issuance of a building permit. If lights are proposed to
be mounted on buildings, down-lights shall be utilized.
14. The detention basins shall be fully landscaped and designed to provide passive
recreation opportunities, to the extent possible.
15. Plans meeting City standards for approval on the proposed trash and recyclable
materials enclosure shall be submitted prior to issuance of a building permit. For single
family residences, cans must be located with 50' of the street. For the common areas,
trash enclosures shall be required in each recreation area.
16. Details of pool fencing (materials and color)and equipment area shall be submitted with
final landscape plan.
17. Handicapped accessibility shall be indicated on the site plan to include the location of
handicapped parking spaces,the main entrance to the proposed pool structure and the
path of travel to the main entrance. Consideration shall be given to potential difficulties
with the handicapped accessibility to the building due to the future grading plans for the
property.
18. Common areas pool use shall be prohibited between the hours of 10 pm to 7 am.
19. The maximum building height shall be 24'.A maximum of 25%of the units(70) may be
two-story.
20. The windows of the second story units shall be oriented away from the living space of
adjoining areas.
21. Two-story units shall be located a minimum of 200' from the existing adjacent R-1-C
residences to the south. All two-story units shall be located so that they are not located
on the southern or western perimeter of the planned development and are prohibited
adjacent to Sunrise Way (lots #47-73), and adjacent to existing development to the
south (lots#78-83, or with alternative entry plan lots#72-75 and 78).
22, The entry plan for both project entries shall be refined to provide adequate
improvements and provide additional details as part of the Final Planned Development
plans.
23. Front yards shall be fully landscaped prior to issuance of a certificate of occupancy.The
developer shall be responsible for completed front yard landscape, irrigation and
exterior lighting plans. In addition, rear and side yards shall be landscaped within 90
days of occupancy per the CC&R's. The HOA will be responsible for enforcement of
this requirement.
24. The project shall incorporate decorative safety lighting at all Sunrise Way entries.
25. Entry gate areas shall have decorative safety lighting.
26. Project setbacks shall be as follows:
Front yard setback- 5' for side entry garages and residence;
20' for front loaded garages;
Side yard setback - 5'; and
Rear yard setback- 15'.
27. The minimum house size shall be 1,650 square feet, with a mix of housing sizes up to
2,700 square feet. Larger residences may be permitted as long as the building footprint
is consistent with setback and lot coverage requirements.
28. All proposed single family residences shall be submitted for Planning Commission
approval, subject to Condition #3. A fee to $225 per typical model shall be paid upon
submission of final development plans.
29. The maximum lot coverage shall be 45% of the net lot area.
30. Final wall plans shall be required as part of the Final Development Plans.All walls shall
be decorative. Perimeter walls along Sunrise Way may be constructed on a berm a
maximum of one foot(1') high and shall be six feet (6) in height. Walls along the north
and east perimeter of the site with a maximum height of seven feet (T) shall be
permitted.
31. The gates shall be deleted from the project.
MITIGATION MEASURES
1 Cut and fill quantities will be balanced onsite.
2 Any construction equipment using direct internal combustion engines shall use a diesel
fuel with a maximum of 0.05 percent sulfur and a four-degree retard.
3 Construction operations affecting offsite roadways shall be scheduled by implementing
traffic hours and shall minimize obstruction of through-traffic lanes.
4 The use of energy efficient street lighting and parking lot lighting (high pressure sodium
vapor lights)shall be considered onsite to reduce emissions at the power plant serving
the site.
5 Remove sand and repair any damages to surrounding properties caused by sand and
wind erosion.
6 Project grading shall be phased consistent with the development phases for the project.
This grading requirement shall be verified by the City Building Official prior to the
issuance of grading permits.
7 The project applicant shall pay its fair share financial contribution to implement a traffic
signal at the intersection of San Rafael Drive and Sunrise Way. The fair share
contribution shall be determined by the City Engineer. Payment of the required fees
shall be made prior to issuance of grading permits, and shall be verified by the Director
of Planning and Building.
8 The street improvement plans for the proposed project shall include appropriate
markings in the east-west direction through the intersection of San Rafael Drive and
Sunrise Way to provide additional guidance to drivers. Incorporation of these traffic
mitigation features shall be verified by the City Engineer prior to approval of street
improvement plans.
10 All construction vehicles or equipment, fixed or mobile, operated within 1,000 feet of a
dwelling shall be equipped with properly operating and maintained mufflers. This
requirement shall be shall be included on the contractor specifications and shall be
verified by the Building Official.
11 Stockpiling and/or vehicle staging areas shall be located onsite and as far as practical
from sensitive noise receptors, i.e., residential areas. This requirement shall be shall
be included on the contractor specifications and shall be verified by the Building Official.
12. The proposed project includes the implementation of a landscape plan as conceptually
depicted on Exhibit 5. The landscape concept includes drought-tolerant plants for
landscaping and turf areas would be limited to areas to be used for active recreation.
The final landscape plan shall be reviewed and approved by the Director of Planning
and Building.
BUILDING
1. Prior to any construction on-site, all appropriate permits must be secured.
ENGINEERING
The Engineering Division recommends that if this application is approved, such approval is
subject to the following conditions being completed in compliance with City standards
and ordinances:
Before final acceptance of the project, all conditions listed below shall be completed to the
satisfaction of the City Engineer.
STREETS
1. Any improvements within the street right-of-way require a City of Palm Springs
Encroachment Permit. Work shall be allowed according to Resolution 17950 -
Restricting Street Work on Major and Secondary Thoroughfares.

2. Submit street improvement plans prepared by a Registered Civil Engineer to the
Engineering Department. The plan(s) shall be approved by the City Engineer prior to
issuance of any grading or building permits.
Minimum submittal shall include the following, IF applicable:
A. Copy of signed Conditions of Approval from Planning Department.
B. All agreements and improvement plans approved by City Engineer, IF
applicable.
C. Proof of processing dedications of right-of-way, easements, encroachment
agreements/licenses, covenants, reimbursement agreements, etc. required by
these conditions.
NORTH SUNRISE WAY
3. Dedicate an additional right-of-way of 10 feet to provide the ultimate half-street width of
50 feet from the southerly line of APN 669-480-007 to 669-470-013 along the entire
frontage.
4. Dedicate an additional right-of-way of 50 feet to provide the ultimate half-street width of
50 feet adjacent to APN 669-470-012 along the entire frontage.
5. Dedicate a 20 feet wide easement for sidewalk and bikepath purposes along the entire
project frontage.
6. Developer shall apply for the vacation of North Sunrise Way (80 feet wide) for that
portion of North Sunrise Way right-of-way within the project. Developer shall be
responsible for final resolution of all utilities, demolition of all existing improvements,
reconstruction of affected intersecting streets and coordination of improvements with
adjacent property owners, if applicable, for the street vacation. All agreements and
improvement plans relative to the above mentioned items shall be approved by the City
Engineer prior to the submittal of the street improvement plans.
7. The main entrance to the project shall match with the proposed entrance to Tentative
Tract Map 30058 on the west side of North Sunrise Way.
8. Remove the existing curb and gutter, curb returns, spandrels, and cross-gutters along
the entire project frontage.
9. Construct an 8 inch curb and gutter,43 feet east of centerline along the entire frontage,
with 35 feet radius curb returns and spandrels on both sides of the Golden Sands Entry
and "H" Street Main Entry in accordance with City of Palm Springs Standard Drawing
No. 200 and 206.
10. Construct an 8 feet wide cross-gutter at the intersection of North Sunrise Way and the
Golden Sands Entry and "H" Street Main Entry with a flow line parallel with and 43 feet
east of the centerline of North Sunrise Way in accordance with City of Palm Springs
Standard Drawing No. 200.
11. Construct a 10 feet wide meandering combination sidewalk and bicycle path along the
entire project frontage. The construction shall be with colored Portland Cement
concrete. The admixture shall be Palm Springs Tan, Desert Sand, or approved equal
color by the Engineering Division. The concrete shall receive a broom finish.
12. Construct a Type A curb ramp meeting current California State Accessibility standards
on both sides of the Golden Sands Entry and "H" Street Main Entry in accordance with
City of Palm Springs Standard Drawing No. 212.
13. Construct a 14-feet wide landscaped, raised median island as specified by the City
Engineer along the entire project frontage. Provide left turn pockets, as required, at all
intersections. The length of the turn pockets shall be determined in accordance with
Caltrans Highway Design Manual and be approved by the City Engineer.
14. Construct a minimum pavement section of 5 inch asphalt concrete pavement over 4
inch aggregate base with a minimum subgrade of 24 inches at 95% relative
compaction, or equal,from edge of proposed gutter to clean sawcut edge of pavement
along the entire frontage in accordance with City of Palm Springs Standard Drawing No.
110 and 340. The pavement section shall be designed, using'R"values, by a licensed
Soils Engineer and submitted to the City Engineer for approval.
15. Construct a temporary cul-de-sac or turn-around acceptable to the City Engineer and
Fire Chief north of the Main Entry.
ON-SITE (PRIVATE) STREETS
16. Dedicate an easement of varying width, (50, 56, or 80 feet wide)and extending to back
of curb or sidewalk adjacent to and within street"knuckles' and cul-de-sacs, for sewer
and public utility purposes with right of ingress and egress over the private streets to the
City of Palm Springs.
17. The following requirements for a gated entry shall be met to provide adequate setbacks
and turning movements for vehicles entering the project:
A. Provide a minimum 50 foot setback measured from the face of curb to the gate
access control mechanism.
B. Provide a turnaround after the mechanism for vehicles unable to enter the
project
C. The main gated entry, as shown in Section"D"-"D" on the Tentative Map, and
the two gated entries off of Golden Sands shall be revised to provide a 20 feet
wide entrance and separate exit. The entry security gate shall provide a
minimum of 20 feet clear width for emergency vehicle access.
18. Construct all cul-de-sacs with a minimum curb radius of 43 feet throughout the cul-de-
sac bulb.
19. Construct all street "knuckles" in accordance with City of Palm Springs Standard
Drawing No. 104.
20. The following traffic calming devices shall be incorporated into the on-site streets:
Narrowed pavement "chokers' shall be provided on "C" Street between "D" and "E"
Streets,on"I"Street between"J"and"K"Streets, and on"M"Street between"P"and"Q"
Streets, as approved by the City Engineer. Chokers shall be designed with a transition
using 25 feet radius reverse curves and a 50 to 100 feet long, 24 feet wide (12 feet
each side of centerline) narrowed travel way. The narrowed travel way shall be
constructed with a colored or decorative Portland cement concrete section 6 inches
thick as approved by the City Engineer.
A traffic circle shall be provided at the intersection of"C", "H" and "I" Streets, and the
intersection of"I", "K" and "M" Streets. The traffic circle shall be designed using a 27
feet radius island and a 20 feet wide travel way around the traffic circle. The travel way
throughout the traffic circle shall be constructed with a colored or decorative Portland
cement concrete section 6 inches thick as approved by the City Engineer.
"H" STREET
21. Construct a 6 inch curb and gutter 30 feet either side of centerline with a 20 feet wide
raised landscaped median, from North Sunrise Way to the gated entry, together with
a raised circular landscaped island, in accordance with City of Palm Springs Standard
Drawing No. 200.
22. Construct a minimum pavement section of 3 inch asphalt concrete pavement over 6
inch aggregate base with a minimum subgrade of 24 inches at 95% relative
compaction, or equal,within all paved areas. The pavement section shall be designed,
using "R" values, by a licensed Soils Engineer and submitted to the City Engineer for
approval.
GOLDEN SANDS ENTRY
23. The property owner (developer) shall prepare a reciprocal access agreement with the
owner(s), master lessor/lessee and all sub-leases that may existing within the Golden
Sands Mobile Home Park in a form acceptable to the City Attorney. A private access
easement shall be prepared in a form acceptable to the City Attorney for access from
North Sunrise Way through the development for all residents within the Golden Sands
Mobile Home Park. The access agreement and easement shall be submitted prior to
issuance of a grading permit. The easement shall be shown on the Final Map or
recorded as a separate document prior to approval of the Final Map.
24. The alternate entry configuration for Golden Sands shall be required, such that the
Golden Sands Entry more directly accesses the North Sunrise Way/San Rafael Drive
intersection, as recommended by the traffic study for this development prepared by
Wildan, dated August 2001.
25. Construct 6 inch curb and gutter, 18 feet either side of centerline along the entire
frontage, with turn-out area and raised islands at the gated entries as shown on the
tentative map, in accordance with City of Palm Springs Standard Drawing No. 200.
26. The gated entries shall be revised to provide a minimum 20 feet wide clearance for
emergency vehicle access.
27. Construct a 5 feet wide sidewalk behind the curb along both sides of the entire frontage
in accordance with City of Palm Springs Standard Drawing No. 210.
28, Construct a minimum pavement section of 2-1/2 inch asphalt concrete pavement over
4 inch aggregate base with a minimum subgrade of 24 inches at 95% relative
compaction, or equal, within all paved areas in accordance with City of Palm Springs
Standard Drawing No. 110 and 300.The pavement section shall be designed, using"R"
values, by a licensed Soils Engineer and submitted to the City Engineer for approval.
ALL OTHER ON-SITE (PRIVATE) STREETS
29. Construct 6 inch curb and gutter, 18 feet both sides of centerline along all on-site street
frontages, with 25 feet radius curb returns and spandrels (where required) at
intersecting on-site streets in accordance with City of Palm Springs Standard Drawing
No. 200 and 206.
30. Construct 6 feet wide cross-gutters at all intersections (where required)with a flow line
parallel with and 18 feet from the centerline of the intersecting street, in accordance with
City of Palm Springs Standard Drawing No. 200 and 206.
31. Construct minimum 10 feet wide driveway approaches in accordance with City of Palm
Springs Standard Drawing No. 201.
32. Construct a 5 feet wide sidewalk behind the curb along both sides of the entire on-site
street frontages in accordance with City of Palm Springs Standard Drawing No. 210.
The typical 50 feet wide interior street section, as shown in Sections "B" - "B" and "E" -
"E" on the Tentative Map shall be revised to indicate construction of a 5 feet wide
sidewalk along both sides of interior street sections.
33. Construct Type A curb ramps meeting current California State Accessibility standards
at all intersections of the subject property in accordance with City of Palm Springs
Standard Drawing No. 212.
34. Construct Type B curb ramps meeting current California State Accessibility standards
across from all cul-de-sac intersections in accordance with City of Palm Springs
Standard Drawing No. 213. Alternatively, driveway approaches may be located
opposite cul-de-sac intersections.
35. Construct a minimum pavement section of 2-1/2 inch asphalt concrete pavement over
4 inch aggregate base with a minimum subgrade of 24 inches at 95% relative
compaction, or equal, within all paved areas in accordance with City of Palm Springs
Standard Drawing No. 110 and 300. The pavement section shall be designed, using
"R" values, by a licensed Soils Engineer and submitted to the City Engineer for
approval.
SANITARY SEWER
36. Dedicate an easement 30 feet wide to the City of Palm Springs for sewer purposes
across Lot N.
37. Obtain an easement 30 feet wide to the City of Palm Springs for sewer purposes across
those portions of off-site property identified by APN 501-241-022 (Lot 111 of Desert
Park Estates No. 12) and APN 501-190-011 and 669-490-001 (Palm Springs Country
Club golf course).
38. Construct 8 inch sewer mains within all on-site streets and connect to the existing sewer
main located in North Sunrise Way.
39. Construct an 8 inch sewer main across off-site property identified by APN 501-241-022
(Lot 111 of Desert Park Estates No. 12)and APN 501-190-011 and 669-490-001 (Palm
Springs Country Club golf course) to connect to the existing sewer main located in
Farrell Drive.
40. All sewer mains constructed by the developer and to become part of the City sewer
system shall be televised by the developer prior to acceptance of said lines.
41. Submit sewer improvement plans prepared by a Registered Civil Engineer to the
Engineering Division. The plan(s) shall be approved by the City Engineer prior to
issuance of any grading or building permits.
Minimum submittal shall include the following:
A. Copy of signed Conditions of Approval from Planning Department.
B. Proof of processing dedications of right-of-way, easements, encroachment
agreements/licenses, covenants, reimbursement agreements, etc, required by
these conditions.
GRADING
42. A copy of a Title Report prepared/updated within the past 3 months and copies of
record documents shall be submitted to the City Engineer with the first submittal of the
Grading Plan.
43. Submit a Grading Plan prepared by a Registered Civil Engineer to the Engineering
Department for review and approval. The Grading plan shall be submitted to the
Planning Department for approval to submit for plan check prior to submittal to the
Engineering Department. A PM 10 (dust control) Plan shall be submitted to and
approved by the Building Division prior to approval of the grading plan. The Grading
Plan shall be approved by the City Engineer prior to issuance of any grading or building
permits.
Minimum submittal includes the following:
A. Planning Department approval to submit for plan check.
B. Copy of signed Conditions of Approval from Planning Department.
C. Copy of Tentative Map stamped approved and signed by the Planning
Department.
D. Copy of Title Report prepared/updated within past 3 months.
E. Copy of Soils Report.
F. Copy of Hydrology Study/Report.
G. Copy of the General Construction Activity Storm Water Permit from the State
Water Resources Control Board (Phone No. 760-346-7491) to the City
Engineer prior to issuance of the grading permit.
44. Obtain a General Construction Activity Storm Water Permit from the State Water
Resources Control Board(Phone No.760-346-7491)and provide a copy of same,when
executed, to the City Engineer prior to issuance of the grading permit.
45. Drainage swales shall be provided adjacent to all curbs and sidewalks- 3'wide and 6"
deep to keep nuisance water from entering the public streets, roadways, or gutters.
46. In accordance with City of Palm Springs Municipal Code,Section 8.50.00,the developer
shall post with the City a cash bond of two thousand dollars ($2,000.00) per acre for
mitigation measures of erosion/blowsand relating to his property and development.
47. A soils report prepared by a licensed Geotechnical Engineer shall be required for and
incorporated as an integral part of the grading plan for the proposed site. A copy of the
soils report shall be submitted to the Building Department and to the Engineering
Department along with plans, calculations and other information subject to approval by
the City Engineer prior to the issuance of the grading permit.
48. Contact the Building Department to get information regarding the preparation of the
PM10 (dust control) Plan requirements.
49. In cooperation with the Riverside County Agricultural Commissioner and the California
Department of Food and Agriculture Red Imported Fire Ant Project, applicants for
grading permits involving a grading plan and involving the export of soil will be required
to present a clearance document from a Department of Food and Agriculture
representative in the form of an approved "Notification of Intent To Move Soil From or
Within Quarantined Areas of Orange, Riverside, and Los Angeles Counties" (RIFA
Form CA-1)or a verbal release from that office prior to the issuance of the City grading
permit. The California Department of Food and Agriculture office is located at 73-710
Fred Waring Drive, Palm Desert. (Phone: 760-776-8208).
DRAINAGE
50. Accept all stormwater runoff passing through and falling onto the site and conduct this
runoff to approved drainage structures as described in the Hydrology Analysis for
Tentative Tract Map No. 30054, prepared by Hunsaker&Associates, dated March 12,
2001. The Hydrology Analysis shall be amended to reflect revisions to the original
tentative tract map, and shall include catch basin sizing, storm drain pipe sizing, and
retention/detention basin sizing calculations and other specifications for construction of
required on-site storm drainage improvements.
51. Submit storm drain improvement plans to be reviewed and approved by the City
Engineer.
52. Submit storm drain improvement plans,forthat portion of the proposed system to outlet
into the Whitewater River Channel, to the Riverside County Flood Control and Water
Conservation District (RCFC) for their review and approval. The developer shall be
responsible for obtaining all required RCFC permits for construction of storm drain
improvements within RCFC jurisdiction.
53. The developershall be responsible for construction of drainage improvements,including
but not limited to retention/detention basins, catch basins, storm drain lines, and outlet
structures, as required by the Hydrology Analysis (to be revised) and as approved by
the City Engineer.

54. The project is subject to flood control and drainage implementation fees. The acreage
drainage fee at the present time is $6,511.00 per acre in accordance with Resolution
No. 15189. Fees shall be paid prior to issuance of a building permit.
GENERAL
55. Any utility cuts in the existing off-site pavement made by this development shall receive
trench replacement pavement to match existing pavement plus one additional inch in
accordance with City of Palm Springs Standard Drawing No. 115. Pavement shall be
restored to a smooth rideable surface.
56. All existing utility lines that are less than 35 kV on or adjacent to this project shall be
relocated underground. The location and size of the existing overhead facilities shall
be provided to the Engineering Department along with written confirmation from the
involved utility company(s) that the required deposit to underground the facility(s) has
been paid, prior to issuance of a grading permit. All undergrounding of utilities shall be
completed prior to issuance of a certificate of occupancy.
57. All proposed utility lines shall be installed underground.
58. All existing utilities shall be shown on the grading/street plans. The existing and
proposed service laterals shall be shown from the main line to the property line.
59. The original grading, street,storm drainage, and other improvement plans approved by
the City Engineer shall be documented with record drawing "as-built' information and
returned to the Engineering Department prior to issuance of the certificate of
occupancy. Any modifications or changes to approved improvement plans shall be
submitted to the City Engineer for approval prior to construction.
60. Nothing shall be constructed or planted in the corner cut-off area of any driveway which
does or will exceed the height required to maintain an appropriate sight distance per
City of Palm Springs Zoning Code 93.02.00 D.
61. All proposed trees within the public right-of-way and within 10 feet of the public sidewalk
and/or curb shall have City approved deep root barriers installed per City of Palm
Springs Engineering specifications.
MAP
62. The Title Report prepared for subdivision guarantee of the subject property,the traverse
closures for the existing parcels and all lots created therefrom, and copies of record
documents shall be submitted with the first draft of the Final Map to the Engineering
Department for review and approval.
63. A Final Map shall be prepared by a licensed Land Surveyor or qualified Civil Engineer
and submitted to the Engineering Department for review and approval. The Final Map
shall be approved by the City Council prior to issuance of building permits.
TRAFFIC
64. The developer shall provide a minimum of 48 inches of sidewalk clearance around all
street furniture for handicap accessibility. The developer shall provide same through
dedication of additional right-of-way and widening of the sidewalk orshall be responsible
for the relocation of all existing traffic signal/safety light poles, conduit, pull boxes and
all appurtenances located on the North Sunrise Way and on-site street frontages of the
subject property.
65. Install street name signs at each intersection in accordance with City of Palm Springs
Standard Drawing No. 620-625.
66. A 30 inch "STOP" sign and standard "STOP BAR" and "STOP LEGEND" shall be
installed in accordance with City of Palm Springs Standard Drawing No. 620-625 at the
following locations:
"H" Street at North Sunrise Way exit
"D", "E", "F", and "G" Streets for vehicles entering "C" Street
"C", "H", and "I" Streets (3-way stop)
"J" and "K" Streets for vehicles entering "I" Street
"L", "N", "O", "P", "Q", "R", "S" and "T" Streets for vehicles entering V' Street
67. Install a traffic signal at the North Sunrise Way and San Rafael Road intersection. East-
west approaches shall be split-phased. A traffic signal plan prepared by a registered
civil or traffic engineer shall be submitted to the Engineering Department for review and
approval. The traffic signal shall be installed and operational prior to release of the 50th
certificate of occupancy for this project. The developer may enter into a reimbursement
agreement with the City of Palm Springs for reimbursement of a maximum of 40% of
the cost of the traffic signal construction, and shall receive reimbursement as the
owner(s) of Tentative Tract Map 30058 develop and post payment for their fair share
contribution towards its installation. The fair share contribution of 60% associated with
this development is determined by the Traffic Study prepared by Wildan, dated August
2001.
68. The developer shall replace all damaged or destroyed traffic control devices and provide
any new traffic control devices required by the City Engineer on North Sunrise Way
adjacent to this project.
69. Golden Sands Street shall be striped to provide one combination left-through lane and
a separate right turn lane (westbound) with "cat tracking" through the Sunrise Way
intersection.
70. The developer shall install a 9,500 lumen high pressure sodium vapor safety street light
with glare shield on a marbelite pole on the northeast corner of North Sunrise Way and
"H" Street (Main Entry) with the mast arm over North Sunrise Way. The pole and
luminaire shall be furnished by the developer.
71. Construction signing, lighting and barricading shall be provided for on all projects as
required by City Standards or as directed by the City Engineer. As a minimum, all
construction signing, lighting and barricading shall be in accordance with State of
California, Department of Transportation, "Manual of Traffic Controls for Construction
and Maintenance Work Zones," dated 1996, or subsequent additions in force at the
time of construction.
72. This property is subject to the Transportation Uniform Mitigation Fee based on the
Residential Single Family Detached and Mulit-family ITE Code B land use.

FIRE
1. Construction Requirements: All Construction shall be in accordance with the 1998
California Fire Code,the 1997 Uniform Building Code,City of Palm Springs Engineering
requirements, City of Palm Springs Fire Protection Plan, Vol II, City of Palm Springs
Ordinance 1570, Desert Water Agency specifications, NFPA Standards plus UL and
CSFM listings.
2. Streets and Fire Lanes: Street construction, widths, turning radius' and cul-de-sacs
shall be constructed in accordance with the 1998 California Fire Code, Article 9, City of
Palm Springs engineering standards, 1997 California Building Code, and Palm Springs
Ordinance 1570,
3. Fire Department Access: Minimum Fire Lane width shall be 20' unobstructed per the
1998 California Fire Code, Article 9. Vertical clearance shall not be less than 146".
4. Emergency access Gate Width: Minimum gate width shall be 14' unobstructed.
5. Second Fire Apparatus Access Gate: Provide Fire Department access gate at East
end of project.
6. Construction Site Fencing Required: Construction site fencing required for new
construction over 5,000 SF. Fencing shall remain intact until buildings are stuccoed or
covered and secured with lockable doors and windows or until the Fire Marshall deems
necessary. Provide 14'wide access gates equipped with changeable chains and locks.
7. Construction Site Guard: Construction site guard required for new construction over
5,000 SF per City of Palm Springs Ordinance 1570. Guard to remain on duty 24 hours
a day, 7 days per week, as determined by the fire marshal.
8. Turning Radius: The outside turning radius of fire apparatus roads and Cul-de-sac
streets shall be at least 43' from centerline, inside turning radius required is 30' from
centerline per the 1998 California Fire Code, Article 9 and City of Palm Springs
Ordinance 1570.
9. Complex Gate Locking Devices: Complex gate(s)) shall be equipped with a KNOX
locking device per the 1998 California Fire Code. Contact this office for a KNOX
application form as soon as possible.
10. Fire Hydrants, Water Systems and Standpipes: Fire hydrants shall be installed per
NFPA standards, plus 1998 California Fire Code and DWA standards. Where
underground water mains are to be provided, they shall be installed, completed and in
service with fire hydrants and standpipes or combinations thereof located as directed
by this office, but not later than the time when combustible materials are delivered to the
construction site.
11. Water Agency Construction Specifications: All water mains, fire hydrants and devices
shall be installed in accordance with Desert Water Agency specifications and
standards.
12, Mandatory Fire Sprinklers: Automatic Fire Sprinkler System with 24 hours monitoring
is required per City of Palm Springs Fire Protection Master Plan Vol. II and City of Palm
Springs Ordinance 1570.

13. Fire Sprinkler Installation: Fire sprinklers shall be designed and installed per NFPA 13
and 13D (Modified) by a state licensed C-16 Fire Sprinkler Contractor.
