AND FOR A TIME EXTENSION ON TENTATIVE TRACT MAP 28033, SUBJECT TO
CONDITIONS, CREATING 23 LOTS LOCATED AT THE SOUTHEAST CORNER OF
GENE AUTRY TRAIL AND VISTA CHINO, WM1 P AND 05 ZONES, SECTIONS 7 & 18
RECOMMENDATION:
The Planning Commission recommends that the City Council approve a time extension,
from November 29, 2002 to November 28, 2003, for the Palm Springs Classic, Preliminary
Planned Development District 231 (PD 231) and for Tentative Tract Map 28033 (TTM
28033), subject to the original conditions of approval. The subject property is located at the
southeast corner of Vista Chino and Gene Autry Trail (Highway 111).
SUMMARY:
On November 13, 2002, the Planning Commission voted to recommend that the City
Council approve a time extension for The Classic.
The applicant is requesting a one year extension of Preliminary Planned Development
District 231 and Tentative Tract Map 28033. The Preliminary Planned Development District
has received six time extensions to date and the Tentative Tract Map has received four
extensions to date. The requested time extension is necessary to complete revisions to the
design concept and to secure funding. Pursuant to Section 66452.6 of the Subdivision
Map, a tentative tract map may be extended a maximum of five times.
BACKGROUND:
During its meeting of November 9, 2001 the Palm Springs City Council granted a one year
time extension for the above referenced Planned Development District and Tentative Tract
Map. This was the sixth time extension issued for the Planned Development District and
the fourth time extension granted for the Tentative Tract Map. The City Council's action
was in response to a request for a one year extension. The Planning Commission had
recommended approval of a one year time extension.
The existing Planned Development District consists of up to a 400 -room hotel, up to 500
two-bedroom Vacation Ownership Units (VDU's), research and development facilities,
commercial/retail and light industrial uses, a tennis complex, a 27-hole golf course and golf
clubhouse on approximately 369.5 acres. The applicant is proposing to revise the proposed
Planned Development District to have 5.7 acres allocated to a 400 room hotel, 5 acres
allocated to 150 Vacation Ownership Units, a retail / village component including 3
restaurants and small retail shops, 970 residential units including estate lots, single family
homes, town homes, and multi-family condominiums, and an 18 hole golf course.
Approximately 55 acres is expected to be dedicated for roadways, parks, and open space.

The project was initially recommended for approval at the October 12, 1994, Planning
Commission meeting and was approved at the October 19, 1994, City Council meeting with
a two-year time frame. The City Council approved the five time extensions. Thus, the
applicant is requesting approval of the sixth time extension of PD 231.
The tentative tract map for the site was recommended for approval at the July 26, 1995
Planning Commission meeting. The mapwas then approved atthe September6, 1995 City
Council meeting. The map would have expired on September 6, 1997; however, as a result
of AB771 - Chapter 46 of the 1996 State Statutes, one additional year was provided for the
map. A second time extension of TTM 28033 was approved on November 10, 1999. This
extension was granted for a period of 13 months in order to synchronize the TTM and PD
approvals. During its meeting of October 4, 2000, the City Council granted a third time
extension of six months. A fourth map extension was granted on November 9, 2001.
At this time, the applicant indicates the extension is required to revise the design concept,
finalize land acquisition, and to secure financing for the development. By approving the
requested time extension, the City Council would keep existing permits active. This will be
the final time extension for the Tentative Tract Map.

Dear Mr, Evans:
As you know, this office represents PSIC with respect to the above referenced Project. As you
also know,PSIC has been authorized,pursuant to a letter from the Owner of the Property to you dated Iuly
22,2002, to process entitlements and related matters for the Project.
It is,our understanding that approvals for both PDD 231 and TTM 28033 are scheduled to expire
on October 19, 2002. Additional time is required to complete revisions to the Project to bring it into
conformity with current plans and market conditions. Accordingly,based on the authority set forth above,
PSIC hereby makes applications for extensions, as follows:
(1)PSIC requests a one(1)year extension of PDD 231 based on applicable provisions of
the City Zoning Ordinance.
(2)PSIC requests a one(1)year extension of T I M 28033 based on applicable provisions
of State law. In our view, Government Code Section 66452.6(e) would authorize extensions of TTM
28033 up until September 5, 2003, however, PSIC is requesting only a one(1) year extension and feels
that will provide more than adequate time to complete appropriate Project revisions.

WHEREAS, PS Investment Company, L.L.C., Inc., (the "Applicant') requests approval of
a time extension for Preliminary Planned Development District(PD)231 and Tentative Tract
Map(TTM)28033 for property located at the southeast corner of Gene Autry Trail and Vista
Chino, (the "Project'), W-M-1-P and 0-5 Zones, Sections 7 and 18; and
WHEREAS,Applicant has requested additional time to record the approved subdivision and
have final development plans prepared and approved; and
WHEREAS, the Planning Commission considered the time extension for the project at its
duly noticed meeting held on November 13, 2002; and
WHEREAS, the Planning Commission, has reviewed all evidence provided, including the
staff report dated November 13, 2002 and all other written and oral testimony, and finds the
Project, subject to the original conditions of approval, consistent with the requirements of
the ordinances of the City and with State law; and
WHEREAS, the Planning Commission voted to recommend that the City Council grant the
time extension; and
WHEREAS,the City Council considered the time extension for the project at its duly noticed
meeting held on January 15, 2003; and
WHEREAS, the City Council, has reviewed all evidence provided, including the staff report
dated January 15, 2003 and all other written and oral testimony, and finds the Project,
subject to the original conditions of approval, consistent with the requirements of the
ordinances of the City and with State law; and
NOW THEREFORE BE IT RESOLVED that the City Council of the City of Palm Springs,
California, after considering the evidence provided at the meeting, does hereby approve of
the fifth time extension of for the tentative tract map and seventh time extension of the
planned development, for the property herein above described, to November 29, 2003.
